Councilman Davis reporting for the Street Department stated that it was the recommendation of the committee that the request ofF. T. Councilman Davis referred to the matter of the Street Department em- ployees working on Saturday Afternoons. He stated that the Street Committee had considered this for considerable time and it was their recommendation that the Street Depa'rtment employees should work till noon only on Saturdays with the understanding th~t there would be 2 men left on duty in case of emergency. A motion to this effect was made by Davis and seconded by Johnson and carried. Councilman Davis reported that sawdust and garbage trucks were careless about covering their loads and considerable refuse was being left on the Streets The Recorder was instr.ucted to write a letter calling this to their attention and see if the matter could be remedied. Councilman Johnson at this time stated that Mr. Hendrickson of the West Coast Lumbermens Association had called on him in regard to rpiorities for building on City lots and that there had been some requests from individuals asking the City give options on the City lots till priorities could be secured for building. There was considerable discussion on this matter by the Council but no action was taken. ~ I Councilman Davis stated there were already demands for improvement'of the streets in the recently annexed Westmoreland territory. He stated the Street Department only had about $500.00 left in the Maintenence fund and that would not go very far. Councilman Bailey called attention to the growth of black-berry vines in the parking on the East side of University between 18th and 19th and'Councilman Davis stated that the matter would be taken care of at once. ' Fire and Water Committee - no report Dr. Hurley at this time reporting for the Health Department made an explanation regarding the pasteurization of milk and stated that there was now a bill before the legislature in regard to this situation.. He stated it probably was the right thing to do, tequiring all th~ milk to ~e pasteurized 1 :..~ but it was much easier for the Council to pass an ordinance of this kind that I it would be for the milk dealers to live up to and felt that the Council shoul~ work with the dealers instead of t~ying to force them at this time. He'stated as since the bill was befbre the legislature he felt it should be delayed. Dr. Hurley make a motion that the recommendation of Dr. Helterline in his annua~ report to the Guuncil on January 8th should be accepted by the Council. This motion was seconded by Davis. At this time the Recorder read the letter of protest against the pasteurization of all milk and the restriction about keep~ ing cows inside of the City limits from C. Madison Landaker. Councilman Hawn stated'he beleived the request for the pasteurization of all milk was the best thing to do and that he was willin~ to'go down the line with the Health Comm- ittee in enforcement of such ann ordinance. Councilman Crumbaker stated that he felt there were three divisions in the recommendation by Dr. Heiterlinej 1st was the collection of the 'fees which would come under the City Manager, 2nd, the pasteurization of milk and 3rd the keeping of the cows in the City. He stated that he was in favor of doing away with the keeping of cows in the City and felt that since there was a bill before the legislature that the mat- ter should be held up. Councilman Koppe stated that he felt the same way. Both Dr. Hurley and Councilman Davis withdrew their motion for the acceptance of the recommendation of Dr. Helterlines report and the matter was laid over. I ~ The Recorder referred to the Ordinance which had its first reading on December 11th regarding the vacation of streets and alleys outh of 19th and west of Patterson for School District No. 4 and the University of Oregon. Councilman Koppe stated that the Judiciary Committee had been unable to get a meeting with the School Board and recommened further reading of the ordinance be delayed until arrangement would be made regarding the opening of Pearl Street south of 19th. 24!: Councilman. 6rumbaker objected to the delay in the passing of the Ordinance for ~: the vacation of the streets and alleys. Councilman Hawn stated that he had been i.: . and was still in favor of the vacation of the streets and alleys for the school I board as outlined in the ordinance but that he wondered why the delay of the I'; School Board with the Judiciary Committee in' the arranging for the opening of Iii Pearl Street and that he was not willing to go further with the Ordinance until !; the Pearl Street situation had been cleared up. After some discussion a motion I was made by Bailey and seconded by Hawn and carried that the 2nd reading of the i: ordinance be further delayed. Councilman Bailey stated that he beleived he could I' arrange a meeting with the School Board and the Judiciary Committee and see what r could be worked ~ut regarding the Pearl Street situation. '11;'"" ;0lIli.~ .."'~ Councilman Davis stated he wished to call attention to the traffic hazard at 13th and Charnelton and stated there was another accident at this corner this afternoon and that he would like to have the Police Committee make an investigation with the view of making this a stop street. Councilman Hawn explained that the Police Committee had investigated this matter of stop streets for 13th on the west ii side of Willamette and that the Chief of Police had felt that a stop sign at 13th i:I' and charnelton would not be much help. Councilman Hawn stated that what was needed . was a thorough traffic survey for the City of Eugene but that it had been brought ii !; up from time to time and nothing had ever been done about it. After some discuss- ion Councilman Hawn stated that he would make an investigation regarding this interesection as 13th and Charnel ton and report back at the next Council meeting. .*~~, I: Councilman Davis reported regarding the vacation of the alley south of the Eugene Hospital stated that construction had been started on the building north of the alley along the Electric Cleaners Building and that this matter of vacation and changing the width of the alley would have to be dropped. 'I i, I r Ii Ii Ii 1:11 I I I, I: I. f At this time a letter from Hugh L. and overhead wires was read. ,To this was vice-president and General Manager of the follows: "Please be advised that if authority is given the Railway Company to use this class of power in the City of Eugene, if and when we are able to secure sufficient units t~ handle the business now being handled by electric locomotives, it is the intention of the Oregon Electirc to abondon the electric operation, and we would as soon as possible thereafter remove the poles and overhead now used for the transmission of power, from the streets of the City. " Biggs regarding the removal of poles attached a letter signed by T.F. Dixon Oregon Electric Railway which was as An ordinance amending Section. 4 of Ordinance 8514, granting the franchise to the Oregon Electric Railway Co., was brought up at this time. Amotion was made by Bailey and seconded by Hawn and carried that the Ordinance should have its second reading at this time by title. The title of the ordinance was read and the Ord- inance laid over for its 3rd reading. Councilman Allen not being able to be present had left a report with the Recorder and it was read at this time. He stated it was the committees recommend- ation that Mr. Boentgen at 1404 East. 21st be allowed to remove the trees in the parking as requested and that he be allowed to make a refill of Hawthorne trees. This all to be done at the expense of Mr. Boentgen. Councilman Allen also left a report regarding a tree in front, of the Unitarian church at 11th and Ferry. He stated it was the recommendation that this tree should be removed. There was some discussion by the Council regarding the removal of the tree in parking strips, if it should be at the expense of City or whether it should be borne by the abutt- ing property owners. . A motion was made, seconded and carried that the Board of Trustees of the Unitarian Ohurch should be notified that the tree should be re- moved at the expense of the church. Departmental reports of the Police Department andoEugene Public Library for December and the annual report of the Police Department for the year 1944 were ordered placed on file. Curb cut requests for Mrs. C. B. Ellis, 1760 Villard, Charles F. Johnson, 132 West 23rd and Melba M. Jones, 1395 Washington, for 12 foot cut was granted as recommended by City Engineer, W. C. The Recorder stated that he had contacted the Eugene manager of the Oregon Motor Stages and he reported there were 5 buses on the Springfield run, two on the Fairmount, Lopp, one on the University Loop, one each on the River Road, West 11th and College Crest and an afternoon tripper on these routes and an owl bus for the SP shops from 12:20 to 6:00 A.M. This would be a total of 13 busses and the Oregon Motor Stages paymen~ was for 11 buses making a total of $275.00. On motion made, seconded and carrie the Recorder was instructed to return the check to the Oregon Motor Stages and ask for an adjustment of the matter. I At this time the Recorder read a request from Gerald E. Butler to open a Cocktail Bar under what the Oregon Liquor Commission calls a Restaurant License. Mr. Butler was present and stated that if permitted to open this place, he would put it in a part of the City that would meet the approval of the Council; that he would run a clean and orderly place and cooperate to the full extent with the City and Federal Authorities. Councilman Hawn explained that there was only one business of this kind in operation in Eugene that he had had several requests for the opening of these places that had not come before the Council. Councilman Bailey stated that he had heard no urgent demand for a business of this kind, that he felt the matter should be delayed until there was more of a demand; Councilman Crumbaker stated he felt this would be a move in the wrong direction. Councilman Koppe stated that he did not favor the granting of any more beer lic- enses or the kind requested by Mr. Butler. Councilman Jurley stated that Mr. Butler had ~ontacted him but that he was unfamiliar with the situation and had given Mr. Butler no encouragement. Councilman Johnson stated that he was oppose~ to a move of this kind. Mr. Butler stated that he would like to have an express- ion of the Council regarding the proposal at this time. A motion was made by Hawn and seconded by Davis that the request of Mr. Butler be granted. On roll call councilmen voting AYE were, Hawn, Davis and Hurley. Voting NO were Koppe, Crumbaker, Bailey and Johnson. Absent Allen. And the motion was declared lostt. A bill from Dr. E. T. Helms in the sum of $19.25 which he paid a plumber for the repair of a sewer and was asking a refund from the Council, was referred to the Sewer Committee. A letter from I. G. Kjosness, regarding the. FPHA War Housing was" read and ordered placed on file. The Lane County Health Boa~d had sent notices to Mrs. Mary B. Cherry, 503 Pearl and the manager of the Northwest Poultry & DairYt 472 Pearl regarding garbage and waste material on their premises. Mr. W. J. Cloyes, Sanitarian was present and the meeting and stated that both of the places had been renovated. Mayor McNutt stated that Mr. Tugman was present and that he would ask him to address the Council regarding the re-routing Highway #99 west and south of town. Mr. Tugman explained the highway commission had already secured the right of way as far as Eleventh Avenue. That he was meeting with the Highway Commission tomorrow and was taking with him letters from Mr. Kinney and the Oregon Properties in which they were offering the right of way through their properties south of town at a nominal figure. Mr. Tugman suggested that it would be nice thing if the City could offer theHrghway Commission the right way through what is known as the old City Airport. He stated the proposed high- way would cut diagonally through what is known asdtheeold airport for about a half mile. He was asked how wide the right of way would be and Mr. Tugman stated he did not know whether the Commission would want. 200 or 240 feet. After some discussion by the Council a motion was mad~ by Davis and seconded by Hawn that the Pfuty offer to the Highway Commission free of charge a right of way 200 feet wide through the old airport with the understanding this would revert beck to the City if construction was not made within five years after the end of the present world war. On vote the motion was carried. I A letter from the Greyhound lines stating reduction of rates and fares so~th of Portland was ordered placed on file. The State Highway Commission had addressed a letter to the Mayor and City Council showing the proposed High Street and Mill race routes for the connection between the proposed Ferry Street Btidge and Sixth Street. . These diagrams were in detail and explained the costs of the two routes. The communication was ordered placed on file for further consideration. A letter from W. C. Martin and Early K. Elmore requesting permission to operate an aircraft electrical and repair shop on the Mahlon Sweet Airfield was read. Councilman Hawn suggested that the Mayor sho~ld appoIDnt a Special Airport Committee, stating that there would prabably be several other requests and ~iff- .erent matters coming up that should be referred to such a committee. The Mayor promised that he would make appointment of a committee of this kind at the next Council meeting and the letter was. ordered place~ on file. M. Gunn, Superintendand of School District No. 4 stated that they had bought the Dr. Norton hanger on the old airport and asking permiss- ion to leave the hanger there for the dura.tion. On motion made, seconded and carried this request was granted. w - -- a.-J A letter had been addressed to the City Engineer from Corvallis regarding a 2 weeks school on Sewage Disposal problems. Engineer Clubb stated that this would be of considerable value to the City if someone would attend and a motion was mad.e by Davis and seconded by Hawn that the. City Engineer be granted permiss- ::~.; ion to attend this school. On vote the motion was carried. :;;::~~.- A report By Percy W. Br~wn regarding the audit for the months of October, November and December was read at this time. He called attention in this report to fire hazards of the Treasurer and Recorders office records. Also the large number of traffic ticketswhic,h are never collected in the Police Department, and the record of equipment of the City as carried on the general ledger. He explained that they had made a survey of the equipment but that it needed corr- ection in order to show the proper valua of present equipment. There were several typewri tten pages of the inventory a'ttached to the report. On motion made, second~d and carried this matter w~s referred to the City Manager. The Planning Commission by its secretary, S. M. Calkins, reported on the proposed zoning which the Council has passed the resolutions on January 8th. The following ~es&lliution was adopted: RESOLUTION BE IT RESOLVED by th~ Common Council of the City of Eugene that there is hereby transmitted to the Planning Commission of the City of Eugene, a pro- posal to reclassify Block 1, Westmoreland Addition and Lots 1, 2, 3, 13, 14, 15, 16, 17, and 18, and Block 7, Chambers A~di t,ion into a business district. . And directing the Planning Commission to adopt a Tentative Report, .an~ to hold a hearing thereon in the Council Chambers in the City Hall in the City of Eugene, on ~uesday the 30th day of January" 1945, at 7:30 o'clock p.m., after giving due notice by publication once in the Eugene Register Guard an.d t.hey shall thereafter make a final report and transmit the same to the Common Counpil with their recommendation. An Ordinance amending #8413, establishing all of the territory recently annexed to the City of Eugene which lies s~uth of 7th Avenue west, as a single family residence zone; and establishing ~ll of the area north of 7th Avenue west in. the annexed territory as light industrial zone, had its first reading and was laid over. . RESOLUTION WHEREAS, heretofore the Common Council has submitted to the Planning Commission the establishment of zones in the territory recently annexed to_ th~ City of Eugene, as a single family residence zone south of 7th avenue West and as a light industrial zone north of 7th avenue west, and the Planninc Commission has held a heiring, adopted a tentative report, and converted the same into a permanent and final report and resubmitted ,it to the Common Council with ~he re- commendation that the same be enacted into an ordinance, and the Council has ~re- pared and given its first reading of an ordinance enacting said permanent report. Now, Therefore, the City Recorder be and he is hereby directed to prepare and cause to be published not less than three times in the Eugene Register Guard in Eugene, Oregon, a notice of a hearing to be held in th~ regular Council meet- ing on Monday, February 26, 1945 at 7:30 o'clock P.M. said notice to be published within the week commencing February 19, 1945. On motion made, seconded and carried this request was granted and the Mayor and Re~order were authorized to execute this Consent. At this time Mayor McNutt stated he wished to appoint the following members as a Special Armory Committee; Dr. Waller, Harry Powell and William Porter and stated that Dr. Waller had promised they would make detailed reports regarding the activiti'es of the Armory to the Council. On motion made, seconded and carried this committee was confirmed by the Council. Ranck. Additional names for the pay roll for the Fire Department were as follows: Charles Wl Brites and Lloyd Ranck @ $152.00 per month. -: At this time the Finance Committee asked for a few minutes recess to consider the property offer of R. W. Prescott for lots 22, 23, 24, Sunset Terrace which had been held up at the first of the meeting. After consultation, Council man Johnson reporting for the Finance Committee stated that it was the recommend- ation of the Finance Committee that the offer of $2000.00 made by Mr. Prescott for lots stated about should be accepted. With the exception that the interest rate should be 6% instead of 4%. On motion made, seconded and carried the recom- mendation of the Finance Committee was adopted. On motion the Council Adjourned.
