The Judiciary COmDlittee presented the following report:
We recommend that the duties of Municipal Judge be removed from the
office of Recorder and that a regularly constituted Municipal Court be establi-
shed. We further recommend that Municipal Court sessions be held three times
weekly; the days and hours to be set by the court. We further recommend that
the Council appoint Attorney Stanley R. Darling as municipal judge and that a
fee of $100.00 per month be paid for his services until July 1, 1945 when the
fee will be subject to review depending upon the amount of work and number of
hours necessary for court hearings. We further recommend that the matter in-
volving court records, handling of fines, etc. be referred to the Judge and
City manager. '
It was moved by Bailey and seconded by Hawn that the report of the committee be
adopted. Motion was carried.
The Parks Committee submitted the following report:
{I)-That the following described properties now owned by the City be dedicated
for Park-Playground purposes:
a- property bounded BY Washington & Lawrence streets between 19th and 21st
avenue.
b- property bounded QY Potter and University streets, between 23rd and 24tH
with the exception of lots 8 and 13 now privately owned.
(2)-We further recommend that investigation be made relative to purchase of the
two above mentioned lots in order that the entire block may be secured for
Park purpos~a. ,
(3)-We further recommend that City owned property on first aven~e west of Blai~
Blvd, between D and E street be reserved for Playground pnnposes until sucn
time as further industrial developments may require the sale of this prop-
etty.

REPORT OF OFFICERS:
The Chief of Police submitted the report of the Police Department for
the month of January, 1945. Upon motion report was ordered received and placed
on file. A summary of sewage.charges billed and collected by the City Waterr
Board as of January 31, 1945 was submitted and upon motion was ordered received
and placed on file.

The Board of Appeals has received a request from R. D. Randolph asking for a
-waiver of i'set-back" for a garage on Lot 5 block 30, Fairmount Addition. This
lot is on the east side of Fairmount Boulevard where there is a steep bank. As
there are a number of garages built up to the sidewalk along this side of the
street, t~e Board recommends that this request be granted on condition that he
keep back as far as possible.
A request was also received from Clarence Hines, Ass. Super. of the City Schools
asking for a waiver of the Code requirements for a continuous concrete found-
ation under ten or more portable class rooms which are to releive over-crowded
conditions at the grade schools. These building are to be 20 feet by 30 feet
in size and of a temporary nature. The Board recommends that this request be
granted.
A letter was received from the Twin Oaks Builders Supply Co., through Bert H.
Snook, asking to be allowed to substitute gypsum plaster board in lieu of the
present code requirements of two layers of shiplao as a one-hour fire sepera-
tion between garages and living quarters where both occupancies are .in the same
building, The board recommends that one layer of No. 4 shiplap and one layer
of 3/8 inch shett rock or plaster board be required as the one hour fire sep-
eration between such occupancies.

It was moved by Hawn and seconded pavis that this report be adopted. Motion
carried.
The report of the City Manager was submitted and read to the Council.
A letter from the Oregon Association of City Police Officers requesting
an expression from the Council relative to House Bill #344 providing for a
retirement plan for all State, County & City employees. Motion was made by
Hawn and seconded by Crumbaker that the Common Council go, on record as endors-
ing house bill number 344. Motion was carried.. '

Special Council meeting of February 7, 1945, relative to Federal Housing lease,
be amended by substituting property description tract as follows:
Beginning at the interseotion of the south line of 12th avenue west and the east line of Cham-
bers street in the City of Eugene, Oregon, running thenoe south along said east line of Cham-
bers street to the north line of 13th avenue west, 334.25 feet, thenoe east along the north
line of 13th avenue west, 908.8 feet more or less to the east line of the property oonveyed
by F. G. Vaughn to S. H. Friendly and R. S. Bean by deed recorded in book 24 page 142 Lane Co.
Deed records, thence north 33.465 feet 'to the south line of 12th avenue west thence west 906.5
feet to the point of beginning, in Eugene, Lane County, Oregon and containing 6.966 acres more
or less.

I Application of Gerald E. Butler for Restaurant Licenses was'brought on
, for consideration. It was moved by Hawn and seconded by Hurley that applica-
~X~ toin be undefinitely tabled. Moved by Bailey and seconded by Hawn that appli-
cation be not considered unless all Council members are present ~ the meeting
when the application would be again presented.
Matter of disposition of Rent Control files deferred to this date was
brought on for consideration. It was moved by Crumhaker and seconded by Bai-
ley that the request be granted to remove files to State Archives at Salem.
An ordinance amending Block I', Westmoreland addition and lots 7, 8, 9,
and 10 of block 6 of Chambers Addition, having had the first reading on Feb-
ruary 12th was passed to its second and third readings by unanimous consent
of the Council by title under suspension'of the rules and was placed for final
passage. Councilmen present voting AYE, absent none. The ordinance was
declared passed and numbered 8811.
An ordinance rezoning property north of West 13th and East of Chambers
was read the first time on January 22nd was passed to its second and third
readings by unanimous consent of the Council by title under suspension of the
rules and was placed for final passage. All councilment present voting AYE,
absent none. The ordinance was declared passed and n~bered 8812.
An ordinance rezoning property south of 7th avenue as single family
residence and territory north of 7th as light industrial zone. First reading
January 22nd, was passed to its second and third readings by unanimous consent
of the Council by title under suspension of the rules and was placed for final
passage. All councilmen present voting AYE, absent none. Ordinance was
declared passed and numbered 8815.
Council Bill No. 1 re: Establishment of Sewage rates for 1945 was sub-
mitted. The ordinance was read the first time and passed to its second and
third readings by unaimous consent of the Council by title under suspension of
the rules and was placed for final passage. All Councilmen present .voting AYE
absent none. The ordinance was declared passed and numbered 8814.
Council bill No. 2 relative to adoptiong of 1943 Building Code was sub-
mitted. Motion was made by Crumbaker and seconded by Hawn that ordinance be
given first reading and laid ove.

A petition of Norman,Schneider et all requesting the construction of a
28 sewer eastoand west of block 6, Chambers addition was submitted. The petition
was ordered referred to the sewer committee with power to act.
Councilman Crumbaker reported that he had been contacted by the ,Head
29 of History Department and they requested in case any of the City records were
to be removed. The wished to.examine them for records at the University of
Oregon Library.
