Findings EugeneCodeSection9.7735requiresthatthefollowingapprovalcriteria(in bolditalics)beappliedto aMetroPlanamendment: CriteriaforApprovalofPlanAmendment.Thefollowingcriteriashallbeappliedbythecitycouncil inapprovingordenyingaMetroPlanamendmentapplication: (1)TheproposedamendmentisconsistentwiththerelevantStatewidePlanningGoals;and Goal1CitizenInvolvement.Todevelopacitizeninvolvementprogramthatinsurestheopportunity forcitizenstobeinvolvedinallphasesoftheplanningprocess. TheCityhasacknowledgedprovisionsforcitizeninvolvementwhichensuretheopportunityfor citizenstobeinvolvedinallphasesoftheplanningprocessandsetoutrequirementsforsuch program.Theprocessfor involvement.Theamendmentdoesnotamendthecitizeninvolvement adoptingthisamendmentcomplieswithGoal1becauseitisconsistentwiththecitizeninvolvement provisions. Thisamendmentanticipatesthefutureadoptionofanewparkandrecreationplan.Thecitizen involvementprocessforthedraftEugeneParksandRecreationSystemPlanhasfarexceededany previousstandardsestablishedforcitizenandcommunityinvolvement.Morethan10,000 interactionswithEugenecommunitymembershaveoccurredthusfarthroughonlinesurveys,phone surveys,smallgroupdiscussions,andmorethanfortypubliceventsinparksandotherpublicspaces designedtogatherinput. ThePlanningCommissionpublichearingontheproposalwasdulynoticedtoallindividualswhohave requestednotice,aswellastotheCityofSpringfieldandLaneCounty.Inaddition,noticeofthe publichearingwasalsopublishedintheRegisterGuard.TheCityCouncilwillholdadulynoticed Exhibit A publichearingtoconsiderapproval,modification,ordenialofthecodeamendments.These processesaffordampleopportunityforcitizeninvolvementconsistentwithGoal1.Therefore,the proposedordinanceisconsistentwithStatewidePlanningGoal1. OAR6600230250(3)provides:LocalgovernmentsarenotrequiredtoapplyGoal5in considerationofaPAPAunlessthePAPAaffectsaGoal5resource.Forpurposesofthissection, aPAPAwouldaffectaGoal5resourceonlyif: (a)ThePAPAcreatesoramendsaresourcelistoraportionofanacknowledgedplanorland useregulationadoptedinordertoprotectasignificantGoal5resourceortoaddress specificrequirementsofGoal5; (b)ThePAPAallowsnewusesthatcouldbeconflictinguseswithaparticularsignificant Goal5resourcesiteonanacknowledgedresourcelist;or (c)ThePAPAamendsanacknowledgedUGBandfactualinformationissubmitted demonstratingthataresourcesite,ortheimpactareasofsuchasite,isincludedinthe amendedUGBarea. Goal8RecreationalNeeds.Tosatisfytherecreationalneedsofthecitizensofthestateandvisitors, andwhereappropriate,toprovideforthesitingofnecessaryrecreationalfacilitiesincluding destinationresorts. Goal8ensurestheprovisionofrecreationalfacilitiestoOregoncitizensandislargelyconcernedwith theprovisionoflargedestinationfacilitiesinnonurbanareas.NeitherGoal8nor5\[/5͸ƭrules requirescitiestoadoptlocalparkplans.Nonetheless,theCityofEugeneisanticipatingthefuture adoptionofalocalparkplan.TheamendmentallowstheCityofEugeneflexibilityintheprocessfor adoptionof9ǒŭĻƓĻ͸ƭparkandrecreationplan.TotheextentStatewidePlanningGoal8isapplicable (ifatall),thisamendmentisconsistentwithStatewidePlanningGoal8. Goal9EconomicDevelopment.Toprovideadequateopportunitiesthroughoutthestateforavariety ofeconomicactivitiesvitaltothehealth,welfare,andprosperityofhƩĻŭƚƓ͸ƭcitizens. Theamendmentdoesnotchangeavailableopportunitiesforeconomicactivities.Therefore, StatewidePlanningGoal9doesnotapply. Goal10Housing.Toprovideforthehousingneedsofcitizensofthestate. Theamendmentdoesnotimpactprovisionofhousing.Therefore,StatewidePlanningGoal10does notapply. Goal11PublicFacilitiesandServices.Toplananddevelopatimely,orderlyandefficientarrangement ofpublicfacilitiesandservicestoserveasaframeworkforurbanandruraldevelopment. Goal15WillametteRiverGreenway.Toprotect,conserve,enhanceandmaintainthenatural,scenic, historical,agricultural,economicandrecreationalqualitiesoflandsalongtheWillametteRiverasthe WillametteRiverGreenway. TheamendmentdoesnotcontainanychangesthataffecttheWillametteRiverGreenway regulations,Therefore,StatewidePlanningGoal15doesnotapply. Goal16through19EstuarineResources,CoastalShorelands,BeachesandDunes,andOcean Resources. Therearenocoastal,ocean,estuarine,orbeachandduneresourceswithinthejurisdictionofthe MetroPlan.Therefore,thesegoalsarenotrelevantandtheamendmentswillnotaffectcompliance withStatewidePlanningGoals16through19. (2)TheproposedamendmentdoesnotmaketheMetroPlaninternallyinconsistent. TheMetroPlantextamendmenttoallowEugenetoadoptaparksandrecreationplanthatis aspirationalwillnotcreateaninternalconflictwiththeremainderoftheMetroPlan.Noothertext changesandnodiagramchangesarenecessarytoensureinternalconsistencywiththeproposedtext amendment;adoptionofthisamendmentwillnotmaketheMetroPlaninternallyconsistent. Thefollowingpolicyfromthe MetroPlan(identifiedbelowin italics)ispotentiallyapplicabletothis amendment. Findings4 Exhibit A ParkandRecreationFacilitiesElement Policies H.1Developasystemofregionalmetropolitanrecreationalactivityareasbasedonafacilitiesplan forthemetropolitanareathatincludesacquisition,development,andmanagementprograms.The MetroPlanandsystemshouldincludereservoirandhillparks,theWillametteRiverGreenway,and otherrivercorridors. Theamendmentdoesnotimpactthefacilitiesplanforthemetropolitanarea.Theamendmentdoesnot changetheallowanceforparkandrecreationplanstoincludeacquisition,developmentandmanagement programs,ortoincludereservoirandhillparks,theWillametteGreenwayandotherrivercorridors. Therefore,thispolicydoesnotapplytotheamendment. Thefollowingpoliciesrelatedtoparkandrecreationfacilitiesdonotapplytotheamendmentbutare addressedhereforcontext: H.3Acceleratetheacquisitionofparklandinprojectedgrowthareasbyestablishingguidelines determiningwhereandwhendeveloperswillberequiredtodedicatelandforparkandrecreation facilities,ormoneyinlieuthereof,toservetheirdevelopments. Theamendmentdoesnotaddressguidelinesfordedicationoflandforparkandrecreationfacilitiesor fundsinlieuofdedication.Therefore,thispolicydoesnotapplytotheamendment. H.4Encouragethedevelopmentofprivaterecreationalfacilities. Theamendmentdoesnotaddressdevelopmentofprivaterecreationalfacilities.Therefore,thispolicy doesnotapplytotheamendment. H.5Developmechanismsandprocessesbywhichresidentsofanareatobeservedbya neighborhoodpark,neighborhoodcenter,orplaylotcanparticipateinthedesign,development, andmaintenanceofthefacility. Theamendmentdoesnotaddressprocessesforpublicandcommunityinvolvementindesign, developmentormaintenanceofparkandrecreationfacilities.Therefore,thispolicydoesnotapplytothe amendment. H.6Allmetropolitanareaparksandrecreationprogramsanddistrictsshallcooperatetothe greatestpossibleextentintheacquisitionofpublicandprivatefundstosupporttheiroperations. Theamendmentdoesnotchangetheregionalcoordinationbetweenparkandrecreationagenciesand programsrelatedtoacquiringpublicandprivatefunds.Therefore,thispolicydoesnotapplytothe amendment. TheamendmentdoesnotaddresstheRiverfrontParkoranyotherspecificsites.Therefore,thispolicy doesnotapplytotheamendment. (3)Whenthecityspecificlocalcomprehensiveplanalsoapplies,theproposedamendment isconsistentwiththecityspecificlocalcomprehensiveplan. TheCityofEugenedoesnothaveacityspecificcomprehensiveplan. ApplicableRefinementPlans Theamendmentisalegislativetextamendmentanddoesnotaddressanyspecificsites.Further,it onlyaddressestheadoptionprocessfortheparkandrecreationplanandanalysis,allowingan aspirationalplantobeadopted.Therefore,itdoesnotaffectorconflictwithanypolicywithinthe /źƷǤ͸ƭrefinementplans,noneofwhichaddressthatprocess.
