The regular meeting, of the Common Council of Eugene, held May 13, 1946
at 7:30 P.M. The meeting was called to order by his Honor, Mayor Earl McNutt.
Councilmen present at rollcall were - Koppe, Hawn, Davis, Crumbaker, Bailey,
Johnson and Allen.

The City Manager reported to the Council that this' was the date set for
the opening of bids for the construction of a new municipal swimming pool and for
certain street. impr:,ovements, to-wit.:.
Improvement of Alder Street between 25th and 27th Avenues East including
alleys; the alley between 7th and 8th from Charnel ton to Olive and improvement of
Taylor Street between 8th..and. :j3roadway.
1 In the matter of bids on the swimming pool, the manager reported receipt
of No_ bids.
It was- moved by Crumbaker, s.econded, by Hawn that the City Manager b.e authorized to
consult with the City Attorney on legality of City using available swimming pool
funds t.o pur.chase nec,e.s.sary. ,ma terials. for pool, construction. Motion carried.
In the matter of the improvement of Alder Street from 25th to 27th
2 Avenues East, includ.ing. alleys, the Manager reported the receipt of three (3) bids.

A report of the City Manager relative to the bus strike and the question
of bus fare -increas,e_ was submitted and read a s follows:
"According to r.eports received Saturday from Portland, it is ind'icated
that the strike which has tied up bus seTvicein the cities o,fEugene and Salem
maybe settled th.is week pr.ovided- that the International offices of the Motor
Coach employees Union agree to a separate settlement of the strike issues in the
two cities and the strike. of drivers of the Oregon Motor Stages, In~er-City lines.
However, the settlement of the City linets dispute at Salem and Eugene
will automatically hinge on a req~st for fare increase from 7~ tG 8~ or 4 tokens
for 30~. According to the Office, of the State Public Utilities Commissioner, such
a fare increase rests entirely with the c.ity Council of Eugene and Salem, with the
State office hav-ing no jurisdiction as had prev:iously been be-lieved to be the case.
I believe it timely that the Council, if possible, indicate its position
in the matter of the proposed fare increase in event that the ~trike settlement
occur within the next few days. While it would be necessary to call a special
meeting of the Council to. f.ormally act on the fare increase, your expression of
opinion at this t,ime, if favorable might allow an earlier resumption of bus ser-'
v ice than would other.wise be, po.ssi,ble.

tion of service to the public in event that favorable action is taken by the
parties concerned in the" strike controversy."

I Report of the City Manager relative to the matter of allowing popcorn
I or novelty stands on the streets, was su-bmi tted and read.
I "In the matter of esta blishment of popcorn or novelty food wagons on
10 I the streets of the City of Eugene, the exemine tion of ord.inances reveals that we
I have no specific legislation, prohibiting these ins talla.t ions,. Ordinance' No. 4464
I which was referred to in our previous discussion of this matter covers the house-
1 to-house peddler or salesman, but makes no reference to any permanent or semi-
I permanent ins_talla tions on ,th.e City stree,ts.

I find, however, tha tit has been. a long establi,shed policy not to allow
su,ch ins.talla tions. While an ordinance could be drawn specifically prohibi ting
popcorn wagons and ,similar.. installations on the City streets,- it would be im-
practical for an operator to attempt such operation unless the same were approved
and licensed by the City. During the past year, I have been contacted by several
different local merchants protesting that our license fees for the itinerant ped-
dler or salesman are not adequate.
. 'If the, Council sees fit to enact further legislation governing the
operat1.on of the a.bove mentioned wagons or installations I would suggest that
the proper committee or council consider such provisions'in connection with a
re-vamping and re-writing of Ordinance No. 4464."
It was moved by Crumbaker, seconded by Hawn that the report be received and that
the matter be referred to the Judiciary Committee for investigation and report.
Motion carried.
Report from the City Engineer re: Filmore Street, was submitted and
read as follows:
11 "On, December 10, 1.945 petitions were received for the opening of Filmore
Street from Broadway to a point 239 feet North of 11th Avenue West ,and West Broadway
(from ~lmaden Street to Chambers Street. No action has yet been taken by the City
: Coune 1.1.
The present wid,th of. F,ilmore Street, North of 11th Avenue is 26.67 feet.
The owner's of t he property through which 'the street would be opened are

convert a residence at 1394 Lawrence Street into four apartments. The Board
recommends that this request be granted.
A request has been r,eceived from Ralph H. Fulbright for. the Timber
Structures, Inc. to be allowed to erect a. pre-fabricated plywood house on the
South side of 25th Avenue between Agate and Columbia Streets. This is not a War
constructed building, but is built. up of plywood panels glued onto a structural
fr.ame, fabric.ated at. their. plant on North. Garfield Street. The Board is recom-
mending that this type of construction be permitted in the City provided they are
placed on a continuous concrete foundation and that the roof panels are covered
w.i th Shingles or compos,i,tion rOOfing.
