~' . The regular meeting of the Common Council of Eugene, held July 8, 1946
~ at 7:30 P.M. The meeting was called to order by his Honor, Mayor Earl McNutt,
. Councilmen present at rollcall were - Koppe, Hawn - 8:50 P.M., Davis, Crumbaker,
Bailey, Hurley, Johnson, Allen.

REPORTS OF COMMITTEES
The Finance Committee submitted the following report on offers to-
purchase City property.
Paul W. Campbell offers $510.00 for a strip of land 56' x 312' approximately
1 North of 24th Avenue if extended East from Alder. Beginning 125 feet East of
Alder Street. 20% down and balance at $70 each 6 months plus interest.
Original Appraisal: $510.00
Committee Recommendation: Sell for $510.00 cash.
Mr. and Mrs. Peters off~r $100.00 for the North"6.4 feet of Lot 4, Block 2, Rugh's
2 Addition. Wants deed and. title insurance. (This is a strip 6.4 feet wide ad-
joining their property.)

A report of the Finance Committee rela tive to proposed sale of City 1
property and other matters was submitted and read as follows:
"Your Committee on Finance to whom was referred various matters, begs to
4 report .as follows: That in the matter of the proposed sale of appro~imately 25
acres of City owned property at 13th Avenue West and Chambers Street for develop-
ment as a medical center, your committee recommends that the proposal be submitted
to the office of Howard Buford, Planning Consultant for a report and recommendation
on the proposed project in relation to park and airport development in the area.
We further recommend that the Finance Committee be authorized to secure
app~aisals and negotiate with the proposed purchasers with instructions to report
I back at the next regular meeting of the Common Council.

: . In the matter of Council Bill No. 86, a proposed ordinance to levey a
I license tax on theatrical, public amusements and other exhibitions, this committee
I recorunends that Council Bill No. 86 be amended in paragraph (b), Section 4 to
I provide for a tax of 3% upon the total of admission charges and that the bill as
amended be given third readi.q.g and finpl passage by the Common. CounciL
In the matter of licensing pin bal~ m~chines, an investigation by the
Committee discloses that 25 towns and cities in the State of Oregon impose a
license fee upon the operation of such devices and that such a license should be
effected within the City of Eugene for regulatory and revenue purp9se~. We,
therefore, recommend that the City Attorney be instructed to prepare an ordinance
which will provide a license fee of $20.00 per month per Inachine operating within
the City."

, Dean Orlando Hollis, representing the University of Oregon, appeared in
opposition to Council Bill No. 86 as it might affect activities of the University,
declaring it to be an unwarranted tax on a State institution, exacting tribute
from students attending the school. _

:! Attorney of Eugene.

!: This resigna tion, termina ting many years of conscientious and outstanding I
i! service to the municipal government, has been accepted with regret. As the \
!' members' of the council judiciary committee will recall, Mr. Calkins submitted his I
resignation a year ago, asking to be relieved of his duties at that time because
, of the press of private practice. At that time he was prevailed upon to serve I
, one more year. I
~ After a very careful consideration of several applications for the I
!., vacated position and following consultation with your judiciary committee, I have I
i: the pleasure of announcing the appointment of Mr. William G. East as City Attorney, !
:j effective immediately.' ,"

:: ,Mr. East attended grade and high schools at Salem, Oregon and graduated I
:: from the University of Oregon Law School in 1932, entering the practice of law inl
I: Eugene the same year as an associate in the offices of Harris, Smith & Bryson, I
h where he continued until 1937 at which time he took over the law office and practic~
~ of the late Charles A. Hardy. In 1941 he joined the law office of Harris, Bryson, ~
I; & East and was a member at the time of entering active military service in July, ,
~ 1942. '

~ !: Mr. East served three and a half years in the army, spending a third of
I Ii this time in tIle European theatre as an infantry officer detailed to Civil Affairs
:" in France and Military Government in Germany and Austria. He spent nine consecu-
, _ !; tive months with combat divisions and was awarded the Combat Infantryman's Badge
:, ,/ ii and Purple Heart. Upon release from service I'Ilr. East re-en.tered the practice of i
I; law in Eugene in February of this year with his associate Mr-. Sidney A. Milligan.

P I believe him to be well qualified for the position of city attorney and

"The following report on various phases of the city's business, together
with several recommendations in connection therewith, are submitted for your con-
sideration.
Final plans and specifications for the first unit of the projected
Amazon interceptor sewer line are complete and authorization of the Council is
hereby requested to advertise a bid call for the work starting July 12, with
bids to be publicly opened by the Sewers Co~~ittee Monday afternoon, July 29 at
2 p.m. and thereafter reported to the Council for action at an adjourned meeting
I of the Common Council the evening of Monday, July 29th. Bids will be asked for
the installa tion of a 42" and 32" line on Tyler Street from Sixth Avenue West,
South to 15th Avenue East, thence Easterly to Jefferson Street, together with
other work necessary in connection therewith.
As the initial units in our program of general street repair, as pro-
I vided for in the 1946-1947 fiscal year budget, the authorization of the Council
I is asked to call for bids for the asphalt resurfacing of the following streets:
,I 13th Avenue, Willamette St. to S. P. Railroad
16th Avenue between Olive and Pearl Streets
Olive Street, 5th Avenue to 11th Avenue
High Street, 9th to lOth
! Blair Boulevard, 1st Avenue to 8th Avenue I
. Eighth Avenue, Olive Street to Blair Blvd.
j General PatChing, Various downtown business streets.

i (The above work is estimated to require approximately 1,900 tons
I of asphalt.)
It is recommended that bids be called for public opening by the Streets
Committee at 2 p.m., July 26 for report to the Common Council at the adjourned
meeting of July 29th.
Authorization is likewise requested from the Common qouncil for ,a bid
call on grading, filling and other necessary grounds work in the playground area
bou~ded by Washington, Lawrence, 19th and 21st Avenues West. The necessary
appropriation for this work has been provided in the budget and is necessary for
full developmen t of the grounds for next summer. It is rec ommended that b ids be
called for public opening in the Engineer's Office July 25 for report to the
Common Council July 29.
Acting on the suggestion of several local contractors this office called
for bids July 5 on the Eugene Memorial Swimming Pool. For the second time no bids
were received, interested parties informing us that uncertainties on prices and
; deliveries of short items and question of C.P.A. approval made it impossible to
; submit a reasonable bid figure. One contractor informed us that he had developed
'I a bid figure of $137,000, which he declined to submit for obvious reasons.

I As the council is aware we have reopened the Anchorage Pool, having
'I effected several improvements including a new filter, to safeguard the purity of
I the water, and our recreationg department is endeavoring to make swimming available
l to the youngsters of Eugene as a part of the summer program that has already served
: children this season, providing baseball, softball, handicraft, tennis, badminton
! and other activities as well as swimming.
In connection with the swimming pool and sewage treatment plant projects
we have been observing with interest the experience of other municipalities on I'
bid calls for similar construction. Low bids have exceeded estimates by 80% to
200%, leading to the conclusion that the pUbliC'S financial interests may best be
served by delaying this type of copstruction in favor of street, sewer and grounds .
improvement for the present at least. .

i It has been called to my attention that prior to the war the Common
, Council had interested itself in a serious sewage and surface drainage problem
i existing on West 24th. The engineer's office reported on the need of a storm
I /
sewer but no action was taken because of lack of funds. It is recommended that
this matter be referred to the Sewers Corr~ittee.

il "At a meeting of the Board of Appeals 'held in the office of the City:;::
14t; Engineer Friday, July 5th a request was received from Frank J. Fox aSking for a
~ waiver of set-back for an addition to his house at 1112 - 25th Avenue East. The
Ii proposed addition would set back seventeen feet from 25th Avenue and from Potter
i Street. The Board recommends that the request be granted.
~ A request was received from Brock Dixon aSking to be allowed to build
II an extens ion on the front of his garage at 2685 Colwnbia Street. This construction
;1 was started without a permit. The surveyors checked the street as per accompanying

An Oral request from A. L. Segar for permission to convert the upstairs

The City Engineer reported that he had inspected the premises as of
this date and that he felt that the Board of Appeals would have no objection to
such remodeling provided that the present single entrance to the house was uti-
