The regular meeting of the Common Council of Eugene held July 14, 1947 at ~
7:30 P.M. The meeting was called to order by his Honor, Mayor Earl McNutt.
Councilmen present at rollcall were - Hawn, Davis, Crumbaker, Bailey, Johnson,
Pennington and Wells. Allen pre~ent at 8:10 P.M.
Upon motion the minutes of the last regular meeting held June 9, 1947 were
.1 considered read and approved.
. ~i Monthly estimates and approval for progress payments were submitted by the
City Engineer as follows:
Third and Final payment - Franklin Blvd. Interceptor Sewer $27,903.59
First Payment - Interceptor Sewer on 15th Avenue between Jefferson
and Charnelton 15,585.26
First and Final payment - sidewalk -Van Buren from 12th to 13th 792.29
Second and final payment - sidewalk - 13th Avenue from Adams to
Almaden 1,382.32
First and final payment - sidewalk - Kincaid from 25th to 26th 885.25
First payment - Paving of Monroe Street from 19th to 22nd 2,218.00
It was moved by Davis, seconded by Crumbaker that the estimates as approved be
received and placed on file and that the proper city officers be authorized to
make payment in accordance with the approved estimates. Motion carried. Rollcall-
All Councilmen present voting AYE. Allen absent.
REPORTS OF CO~wrrTTEES
,I 2 A report of the Finance Committee was submitted and read as follows:
"Your Committee on Finance to whom was referred various matters, begs to
report as follows:
That we recommend acceptance of the offer of Harold W. Biggerstaff of $100.00
for Lot 6, Block 28, Chula Vista Park Second Addition. This acceptance to be con-
ditioned on the agreement of the purchaser to install approximately 100 feet of
30" drain tile across the lot to connect with present city storm line at this
location and the purchaser to pay the cost of title insurance.
Your Committee has stUdied the matter of the legality of certain types of
merchandise vending boards and license and control of the same and recommends that
the City Attorney's office prepare an ordinance to submit to the Common Council
setting up a schedule of licenses and regulatory control of these devices."

It was moved by Davis, seconded by Hawn that the report of the cormnittee be re-
ceived and placed on file and that the report be adopted. Motion carried.
3 A report of the Judiciary Committee was submitted and read as follows:
"Your Committee on Judiciary to whom was referred various matters bigs to re-
port as follows:

. With reference to the revision of the City's Peddlers Ordinance, the Committee
recommends that this problem be held in the committee and that the City Manager be
directed to consult with the Hetail Trades Group for further determination on policy
and fees for the itinerant peddler and/or solicitor within the City and that this
information be reported back to the Judiciary Committee."
It was moved by Pennington seconded by Bailey that the report of the Committee be
received and placed on file and that the recommendation be adopted. Motion carried.
1 4 A report of the Public Works Committee was submitted and read as follows:
"Your Committee on Public Works ( present Harold Wells and Calvin Crumbaker),
met with the Central Lane Planning Commission to consider the matter of naming
and numbering streets and roads in the Eugene-Springfield metropolitan area.
Postmaster Newman and an assistant in charge of rural deliveries pointed out
that serious and unnecessary difficulties in finding addresses in the City of Eugene
and outlying territory exist. The postmaster of Springfield said similar problems
exist in Springfield and surrounding territory.

Representatives of the Eugene Water Board reported that the Board finds ~

similar problems and difficulties. It was asserted by business men who conduct ':

deliveries in the Eugene-Sprin,gfie'ld area, that great difficulty and expense are i:

incurred in locating addresses for deliveries. i ~

It.was stated that co~rection of certain errors in naming or numbering, "

removal of duplicatio~s, and the system9tic numbering of homes on roads and high- r

ways would eliminate the difficulties. . J

As far a~ Eugene is concerned it was agreed that the matter was relatively i'
minor and fairly easily corrected and adjusted. While much has been said about " f
.' .
renaming streets, it was agreed that the major problem was not naming but the .1
f;
)'
establishment of a uniform system of numbering which would apply to Eugene, i!
Spr ingfi eld, and the entire outlying area. The really big!problem lies in this --
numbering of the outlying territory, and the most interested persons in this [:
numbering are Eugene and Springfield business interests, the Eugene Water Board, "

the Mountain States Power Company, and the United States postoffices. It was not i'
offered as a proposition that required concessions by Eugene and Springfield,
but a matter which called for intelligent planning and for cooperation.
In the discussions it was a commonly expressed opinion that the development
of a single base and meridian for the numbering of all streets, roads, and highways
of the entire metropolitan area would be feasible and desirable at this time. "

This might ,require some adjustments in both Springfield and Eugene. At a later r:

time when the territory was more completely built, changes to conform to this plan I.

would be more difficult if not impossible. i

It is ,the recommendation of the Co~ittee on Public Works that-the City.
Manager's office be requested to compile the evidence of the need for changes
in naming or numbering within the City of Eugene, and of the :need for some type ,:
of uniform numbering in the metropolitan area, and that the committee on Public "
works be insttucted to continue its study of the problem."

It was moved by Crumbaker, seconded by Baile~_ that the report of the Committee be
received and placed on file and that the report be adopted. Motion carried.
REPORTS OF OFFICERS I

A report ;of the City .Manager re: appointment of ~ Municipal Judge pro tem
5 was submitted and read as follows:

. "I should like to ask your favorable consideration of the appointment of a
municipal court judge pro tem to act during the absence occasi~ned by il~ness and/
or vacation of the regularly appointed municipal judge.
The postponement, of. the regular court sessions during these periods works a
definite hardship on the Police Dept. on apprehended persons and on the court
itself. It would, therefore, like to request that the Common Council take action
to make the necessary pro tem appointment and would suggest that the City Attorney J:

placed on file and that the Council direct the City Recorder ~o act as municipal '.
judge pro. tem in the absence or inability of the regularly appointed municipal
judge to serve and that the City Attorney be instructed to prepare an ordinance
making provision for this pro tem appointment if in his opinion such ordinance is I,
necessary. Motion carried. \.

6 A report of the City 1~nager re: annexation of City Outlook and Inavale areas,~
was submitted and read as follows: , I

riAt a recent meeting of the Council your body has received petitions for and \;
against the proposed annexation in the City Outlook and Inavale areas. At the June:
meeting I was instructed to make a.n analysis of these petitions and submit the "

I find that there is a duplication of names on both petitions, 5 persons having(
. signed both petitions while 2 property owners have declared themselves on the !,
petition as being neutral. A re-cap of the petition in favor of an annexation i: I
election shows that this petition represents 27 residence properties and 4 vacant ~
properties, with a total of 54 names. Deducting the names of the 7 persons referredt
to 9bove, would leave a net figure, so to speak of 47 in favor of the annexation. ~ . -);:
The peti tion opposing annexation contains the signatures of persons representing ::
. '-20- residences and 6 vacant properties .wi th a total of 46 names. Again deducting I'

these same 7 names, we find a ne,t figure on the petition "against" of 39. From my l!

investigation I am inclined to believe that the 5 persons whose names appear on "
both petitions had originally signed the petition opposing the annexation but had "

later changed to a position favoring the proposal. . 1

It was moved by Hawn, seconded by Pennington that the report be received and
I placed on file and that the City Attorney proceed to prepare necessary ordinances
providing for an annexation election to be held concurrently with the October ~~
general election. Motion carried.
A report of the City Manager re: bids for the operation and maintenance of
? the City Dumping Grounds, was submitted and read as follows:
"I have at hand two bids for the operation and maintenance of the City
Dumping Grounds for the fiscal year 1947-1948. It will be noted that there is
I a big difference in the bid price per Dlonth but I am of the opinion that the
purchase and use of a tractor at the dump site, as proposed in the bid of the
Sanitary Drivers Group, is an important factor. Also, the furnishing of gravel
to maintain a proper road bed for the trucks using the dumping grounds."
It was moved by Johnson, seconded by Crumbaker that the report be received and that
the matter be referred to the City Manager with authorization to negotiate a dump
ground contract for the fiscal year 1947-1948. An amendment to the motion was
offered by Councilman Hawn that any contract commitment to be made by the City be
held within the limits of the 1947-1948 budget appropriation for dump ground
maintenance. This amendment was accepted and the motion as amended was carried.
A report of the City Manager re: request to build a bakery shop, was sub-
8 mitted and read as follows:
"I have on hand a request received in the mail as of this date from Mr. Wallace
Gilzow with reference to the proposed construction of a bakery shop on property
located on West 2nd Avenue. Investigation discloses that the property in Question
in zoned for single family residence. Such construction could not be permitted
unless proper action were taken to re-zone the lot. I should, therefore, recommend
that this communication be referred back to the Manager's office and that the
petitioner be advised of the necessary procedures for the zoning request."
It was moved by Hawn, seconded by Davis that the report be received and placed on
file and that the recommendation be adopted.
'I A communication from Mayor Earl McNutt re: appointment to Planning COID~ission,
9 was submitted and read as follows:
"In accepting with regret the resignation of Mr. Walter M. Ransom as a member
of the Eugene Planning Commission, I should like to ask your confirmation of the
name ,of C. E. McLean as his successor to serve the unexpired term on the Commission.'
It was moved by Hawn, seconded by Bailey that the communication be received and
placed on file and the appointment of C. E. McLean be confirmed. Motion carried.

A request was received from Lee Ellis a-sking for a permit to erect a four car
garage at: 212 Pearl Street, waiving the set-.back requirements. This location is
at the head of a dead end street and at the ~oot of Skinner Butte. He has recently
acquired the old' Ankeny property and convert.ed the house into s.everal apartments
and is desirous' of providing garage space fo"r the apartments. . As this construction

will in no way interfere with any other property owners, the Board recommends that
I the request be granted.
A request was received from R. E. Harrell asking for a waiver of setback for. ~,
a Service Station on the southwest corner of the intersection of 7th Avenue and
Washington Street. He is asking for a twelve foot setback from the property line
on 7th Avenue and a 10 foot setback from the property line on Washington Street.
Owing to the congested traffic on 7th Ave., the Board feels that this construction
would create a serious hazard and therefore recommends that the request be denied.
I A request was received from the Eugene ~elders Supply Co. to erect an addition
to their present structure at 1574 West 6th Avenue. The proposed construction con-
sists of a wooden frame covered wi tl1 sheet metal and does not meet "the requirements
of Fire Zone No. 2. The Board recommends that the request be denied.
A request was received from Architect D. L. Hardin asking for a waiver of
setback for the proposed new Fairmount Church of Christ at the northeast corner
of the intersection of Columbia Street and 17th Avenue. The plans indicate the
same setback from Columbia Street as at present, ten feet and ten feet from 17th
Avenue instead of the present two feet. The Board recommends that the request be
granted.
A request was received from C. A. Dyck asking for a waiver of setback on the
lot at the southwest corner of the intersection of 23rd Avenue and Emerald Street.
This is a fractional corner lot. The Board recommends that the request be granted,
on condition that no portion of the building is placed less than 20 feet from the
Emerald property line.
A request was received from Chris Jensen to be allowed to make extensive
improvements to his Auto Service business located at the southwest corner of the
intersection of 11th Avenue and Hayes Street. The Board recommends that this re-
quest be referred to the Planning Commission.
A request was received from Capp Bros. asking to be allowed to erect a Quonset
I type structure for an automobile repair and paint shop at 565 - 4th Avenue West.
This location is in the Single Family Zone. As there is no data available as to
the fire rating on this type of construction, the Board recommends that the request
be denied.
A request was received from Deane Seeger asking to be allowed a 20 foot set-
back from Chula Vista Street and a 10 foot setback from 26th Avenue on the southeast
corner of the intersection. After carefully considering the plot plan accompanying
the request, the Board recommends that he be ~llowed the 20 foot setback from Chula
Vista Street and 15 feet from 26th Avenue."
Upon motion of Councilman Crumbaker, seconded by Councilman Hawn that portion of
the report relating to the application of the Capp Brothers was ordered segregated
from the report and the balance of the report approved. In the matter of the
application of the Capp Brothers, it was moved, seconded and carried that the per-
mit as sought be granted, subject to building requirements for fire zone No. 2.
Motion carried.
A permanent report of the Planning Commission on various applications for re-
12 zoning was submitted and read as follows:
"As a permanent report pursuant to Resolution of the Common Council of the City
of Eugene directing the City Planning Commission to prepare a report upon certain
requests and recommendations for reclassification and rezoning of certain requegtw
and r~commend~tions for recl@ssific@tion end re~oninB of cert~in areas in said City,
I the City Planning Commission hereby adopts as its permanent report, the followiilg::
The Planning COlnmission recommends the following rezoning and change of
classification, to-wit:
SPENCER R. COLLINS: Lot 4 and North 20 feet of Lot 5, Block 2, Christian's
Addition to Eugene, and Lot 8 a nd South 14.10 feet of Lot 5, B.lock 2, Christian's
Addition, except the West 53 feet of said tract. Property located on Pearl Street
between 11th and 12th Avenues. Requested change from multiple family residence to
I business classification.
And the Planning Commission recommends the denial of the following petitions for
change of classifications, to-wit:

mission re: Spencer Collin's application. Mr. Collins appeared before the Council ~
on behalf of the application. ' . .

right-of-way for the extension of Onyx and/or Inavale Street to intersect with (..-

We believe that this change in the intersection of Inavale Street and Emerald
Street will eliminate a very definite traffic hazard which is occasioned by the
present "Y" split of the extension of Emerald Street into Inavale Plat. This "Y"
is at the foot of a steep hill which services some 15 or 20 residences of the
I Inavale Plat as an entry to the present city streets and views at this intersection
are badly blocked by the growth of blackberry bushes, willows and other growth so
that there is a definite traffic hazard there at all times and the signers'
observations have been that a number of fatal accidents have been avoided there more
by good luck than any other reason as there have been a number of narrow escapes,
especially of small children, at this intersection.
This change would also provide a shorter and safer street layout, cutting
down maintenance costs and paving costs when these improvements are made and these
improvements should be made, or at least arranged for, at an early date due to the
rapid growth of the building up of Inavale Plat before the situation becomes more
complicated.
In addition to the vacation of Inavale Street South from the South line of
lot 12, there would be left a small triangular piece of property adjoining Emerald
Street on the East and the newly projected short line of Inavale Street on the South
which should be deeded by the Dity to the owners of lots 1, 2 and 3, Onyx PIa t.
This arrangement would make possible the extension by the property owners of
Block 4, Onyx Plat, to construct a sidewalk from the end of the present sidewalk
on the West side of Emerald Street to the city limits, thus completing standard side
walks from the center of town to the city limits on the west side of Emerald Street.
We attach hereto a rough sketch showing the proposed change, of which we
respectfully request that the Honorable kembers of the City Council make proper
I investigation and pass upon it favorably, both in the interests of the undersigned
property owners and the general developments of the City of Eugene."

systematized numbering or naming of streets or numbering of houses in any of these
suburban areas, and
WHEREAS the two aforementioned cities are closely linked by the reason of the
rapid growth of intervening and adjacent suburban areas, and
vVHEREAS a street numbering committee of the Lane County Planning Commission
I have outlined a plan for an overall numbering system covering all the streets of
the two aforementioned cities and all adjoining subdivisions, which plan, if carried
out, would constitute a simplified means of locating "addresses in any part of these
two cities or their subdivisions, and will further provide for extending the same

Third: It is the opinion of the Common Council that the City of Eugene should

tenance of the millrace, if and when title to all lands needed for right-of-way ~

facilities of the millrace are dedicated to the public for park purposes.
Fourth: If only limited access to the facilities of the millrace are provided "
for the public, it is the opinion of the Common Council that the City should share ",
in the expense of repair and maintenance to the extent that the area of banks of the
I millrace open to public use and enjoyment are proportionate to the area of the land
immediately contiguous to its banks.
. Fifth: If owners of millrace properties choose to retain full privacy to all
properties abutting on the millrace, it is the opinion of the Common Council that
repairs and maintenance should be at the expense of such property holders and such
others as may wish to contribute voluntarily to the project, but that, if desired,
the City should make available its organization and equipment to carry out the work
for which finances are supplied."

The City Manager reported that Mayor Earl McNutt had appointed Councilmen Hawn,
Bailey and Pennington and City Attorney, East, as the members of the special com-
mittee to meet with the millrace property owners association group with reference
to plans for the restoration and future maintenance of the millrace.

"WHEREAS, the Common Council, by Resolution adopted on April 28, 1941 afforded ~
city fire fighting equipment and services to industrial plants adjacent to but ~
outside of the corporate limits of said Ci ty upon certain conditions and payments I
therein provided for; and,
WHEREAS, there are other types of property that desire such protection. and
service.
. NOW, THEREFOF.E, BE IT RESOLVED, by the Common Council of the City of Eugene,
that the owners of any residential or. agricultural properties adjacent to but '
outside of the City limits of the City of Eugene, will be entitled, during any
fiscal year of the City, to one service by the Eugene Fire Department not to
exceed five (5) hours, upon the condition and provided that such owners shall have
firs t paid the sum:..of $100.00 unto the City. In the event the first call exceeds
5 hours of service there shall be paid to the City of Eugene $20.00 per hour or
fraction thereof per piece of equipment. :

Additional payment to the City for all calls in excess of one shall be paid at
the rate of $20.00 p~r hour or fraction thereof per piece of equipment.
The aforesaid annual sum of $100.00 shall be for the fiseal.year of the City, I
or any portion thereof, and any unused portion of such sum shall revert to th.e City
upon the close of the fiscal year. r

Provided, however, that the protection afforded as. above provided and con-'
templated in this Resolution, shall be secondaFY and subsequent to the City's ':
own need and that the City shall have the first use itself of its fire department t
and fire service, and the ;City shall incur no liability whatsoever because of fail- :
ure to answer calls or because of unsatisfactory or insufficient service or for any I.

A motion on the proposal resulted in the following votes: AYE - Davis, Crumbaker, I,
Bailey, Johnson; NO - Hawn, Allen, Pennington and Wells. It being a tie vote, the ~
Mayor cast his vote in favor of the motion which was declared carried. I
The matter of the operation of a general contracting business by the Beebe :'
Construction Co., at Third and Taylor'Streets; in violation of the City zoning ~
44 ordinanc~ was introduced from the f~oor. The City M~nager reporte~ that he had i: I
been advlsed by the Beebe Constructlon Compsny that lt was purchas1ng a new lo~ ~
cation outside the Ci tyLimi ts and that he had been advised by the company that it !.
was attempting to make arrangements for removal to this new site. r f' r
