1947 at 7:30 P.M. The meeting was called to order by his Honor Mayor Earl McNutt. ,"-
Councilmen present at rollcall were - Crumbaker, Bailey, Johnson, AJ.,len, Pennington .....;...-..
and Wells. Hawn and Davis absent.
Upon motion the minutes of the last regular meeting held August 25, 1947 were
considered read and approved.
I 1 The City Manager presented for Council consideration the following bid on the
improvement of Kincaid Street from 25th to 28th Avenues East, which had been publicI
opened Tuesday, September 2, 1947.
The Manager reported the bid to be in proper order and accompanied by a certi-
fied cJ:;.eck.
Del R. Beebe Construction Company $27,211.75
It was moved by Bailey, seconded by Wells that the bid of the Del R. Beebe
Construction Company be rejected and the call for bids be re-advertised.
2 Monthly estimates and approval for progress payments were submitted by the
City Engineer as follows:
First and Final payment - sidewalk on 13th Avenue between $
Chambers and Grant Streets 121. 95
It was moved by Crumbaker, seconded by Bailey that the estimate as approved be re-
ceived and placed on file and that the proper City officers be authorized to make
payment in accordance with the approved estimate. Motion carried. All Councilmen
present voting AYE. Hawn and Davis absent.
Second and Final payment - sidewalk on Kincaid between
I 26th and 27th Avenues East 577.50
It was moved by Crumbaker, seconded by Bailey that the estimate as approved be
received and placed on file and that the proper City officers be authorized to
make payment in accordance with the approved estimate. Motion carried. All
Councilmen present voting AYE. Hawn and Davis absent.
First and Final payment - sidewalk on Kincaid Street between

It was moved by Crumbaker, seconded by Bailey that the estimate as approved be
received and placed on file and that the proper City officers be authorized to make
payment in accordance with the approved estimate. Motion carried. All Councilmen

First payment - pavement on Tyler Street between 8th Avenue
and West Broadway 180.00
It was moved by Crumbaker, seconded by Bailey that the estimate as approved be
received and placed on file and that the proper City officers be authorized to make
payment in accordance with the approved estimate. Motion carried. All Councilmen
present voting AYE. Hawn and Davis absent.

It was moved by Crumbaker, seconded by Bailey that the estimate as approved be
received and placed on file and that the proper City officers be authorized to make

"Your Committee on Public Works to whom was referred the matter of the proposed I'
assessment ordinance covering the Riverwood District Sewers, begs to report as follows: I

That pursuant to action of the Common Council, your committee conducted a li

hearing on the proposed ordinance September 4th at which time arguments were heard
from protesting property ovvners. These protests were based on the contention that
a number of properties ,had been previously and adequately served by private sewers
and that the properties in ~uestion should therefore be not subjec~ to assessment
for the lateral system.
Your Committee feels that the proper sewerage of the district as a whole justi-
fied the installation of the sewer system and, therefore, recommends that Council
:;,..... Bill No. 239 be given final passage following amendment of the ordinance title in a
manner to provide an exact description of the sewer locations."

It was moved by Crumbaker, seconded by Bailey that the report be ~eceived and placed
on file and that the recommendations contained therein be approved. Motion carried.
A report ot the Judiciary Committee re: peddlers ordinance, etc. , was sub-
4 mitted and read as follows:
"Your Committee on Judiciary to whom was referred Council Bill No. 255 govern-
ingthe licensing a.nd regulation of .itinerant peddlers, begs to report as follows:

That we have further considered the Council Bill and recommend that it be
amended in the following particulars:
That the waiver on payment of the required license fee be limited to honorably I
discharged veterans, giving adequate proof of 40% or greater disability and the
b,lind. We further recommend that the Council Bill as amended be read the second and
third times and gi~en final passage~"

REPORTS OF OFFICERS I
5 A report of the City Manager, was submitted and read as follows:

"During the past week we received copies of the National Traf~ic Safety Contest
Reports for the year 1946.
We are pleased to note that_ the City of Eugene placed high in cities of its
population group for the period covered by the report. In the classification of
traffic law enforcement for 1946, the City of Eugene ranked: first among all cities
of its class. This is an increase in rank from 64th place in 1945.

Other contest factors included school Safety, Public Education, Traffic
I Engineering and Accident reporting. The City of Eugene showed an axtremely fine
increase in rating, bringing the total grade from 24.6 in 1945 to 58.3 in 1946. ~:;
Total grade points possible for all sections is 70." ~

6 A'report of the City N~nager re: IC1'v1A Co~ference, was submitted and read as
follows:
I "The International City Manager's Association is holding its Annual Conference
at San Diego, California October 5 - 9, marking the second time that the ICW~ has
conducted its Annual meeting on the Pacific Coast in the period of the last 20 years.
As a result, practically all of the Manager cities on the Pacific' Coast are'a will be
represented.
I should like permission of the Council at this time to attend the annual
meeting, expenses for which have been provided in the regular budget for the City
Manager."

9 A permanent report of the Planning Commission was submitted and read as
follows:

"As a permanent report, pursuant to the Resolution of the Common Council of :,;\
the City of Eugene directing the City Planning Commission to prepare a report upon 1t,1
certain requests for reclassification and rezoning in areas within said City, the ..."
'City Planning Commission hereby adopts as its permanent report, the following:
The Planning Commission recommends the following rezoning and change of
classification, to-wit:
I CHRIS JENSEN: Lot 1, Block 9, Chambers Addition to Eugene.
Property located at 1940 West 11th Avenue.
Requested change from single family residence to business classification.
and the Planning Co~nission recommends the denial of the following petition for
change of classification, to-wit:
FRANK WILLS: Lot 8, Block 9, of Elias Stewart's Addition to
Eugene, as platted and recorded at page 29 of Volume 2, Lane
County, Oregon Plat Records.

It was moved by Crumbaker, seconded by Allen that that portion of the report re:
the application of Mr. Wills be segregated. Motion carried.
It was moved by Crumbaker, seconded by Johnson that the balance of the permanent
report of the Planning Commission be adopted. Motion carried.

It was moved by Crumbaker, seconded by Pennington that the matter of Mr. Will's
application be referred to an appropriate committee of the Common Council to be
named by the Mayor. Motion carried.
I Mayor McNutt announced the appointment of the following committee to further study
and report on the Will's application, this committee to consist of Councilmen Hawn,
Crumbaker and Bailey.
10 A special report of the Planning Commission held September 6, 1947, was sub-
mitted and read as follows:
"At a special meeting of the Planning Commission held September 6, 1947, the
Commission discussed the need for protecting property values in various areas in the
City by immediate action. It was felt that in some cases construction allowable by
the present zoning ordinance would prove to be detrimental to the proposed plan and
the introduction of undesirable uses could easily occur before the proposed ordinance
could become effective. The N.W. corner of 19th Avenue East and Hilyard was re-
garded as a critical area.
It wa s, therefore, moved, seconded and carried that the Council be requested
to reclassify Lots 5 and 6 9fBlock 9 of Driverton's Addition to Eugene from a
Business Zone, B-2 to a Multiple Family classification, R-3.
A motion was also made, seconded and unanimously carried that the Planning
Commission protest to the Common Council the following:
1. Considerable discussion has ensued and certain actions have been taken by
the COffinlOn Council and the City Manager's Office regarding the leasing of a parcel
of lands for a Naval Reserve Training Unit. At no time has the Planning Commission
I been advised as to the proposed plans nor have they been asked to express an opinion
or study the effect of such a development in a residential area. According to
Paragraph 8 of Ordinance #4846 passed by the Common Council on May 25, 1925, es-
tablishing a Planning Commission, it is believed that a study of any plan to lease
or use public land is a duty of the Planning Commission.
2. Irrespective of the many weaknesses of the present zoning ordinance, a
stricter application of its intent could possibly eliminate some of the injustices
now being rendered in residential areas. Although the present zoning ordinance
I allows doctors to establish offices in residential areas, the code implies that
buildings designed or converted for office use shall conform in character and
appearance to the type of structures within the district. The building recently
approved by the Building Inspector for a doctor's office on the corner of 11th
Avenue and Jackson Street does not comply to these provisions and has introduced
into a residential area an undesirable building which will prove to be detrimental
to resale values for adjacent structures."

"The Oregon Motor Stages has had repeated requests for an extension of s~rvice '
over the Elmira Road from HighvJBY 99, in add~tion residents and workers of the City
of Eugene in the area north. of Chambers St. along 6th and 7th Sts. have also re-
quested service. . I
In the past, due to sh~rtage of equipment, we were unable to definitely promise'~ . _
any relief to these areas. However, we are now in a position to give this additiona~ ~
service. We are therefore starting Monday, September 8, 1947 a trial period of '

"This is to confirm our discussion regarding the Rodent Control work for the
Ci ty of Eugene. .
As I told you, I am planning on turning in my resignation to the Fish and
Wildlife Service and doing rodent control on a contract basis for the cities par-
ticipating in the work in Lane County. This change would not entail any additional
funds from the city above what has already been budgeted for rodent control work.
Also, there would be no change in my responsibilities as rodent control officer for
the City of Eugene.

Mr. L. M. Cheney and I are forming an organization to be known as the
Professional Rodent Control Service, and under that name we would like to make you
this proposition on the rodent control work. Starting on September 15th there will
be $2730.00 left in the rodent control fund which we would like to have divided
into monthly payments of i273.00 each. For this monthly payment we would furnish
bait supplies, transportation, and other materials to be used for the rodent control
work and furnish the City with the same type of service that I have endeavored to
furnish under the present setup."

"We wish to advise, as a result of discussion with you, Mr. Sweet, and Mr.
Snyder, and after making a physical survey and reviewing the master plan for the
development of the Eugene Airpark, it is the informal opinion of this office that
the proposal, if carried to completition, would constitute a hazard to aerial
navigation.
The above conclusion is premised on proposed relocation of the north-south
runway. If' the project were to be abandoned it is quite possible that the smoke-
stack and antenna in connection with proposed armory could be so located and marked
that they would not be considered as serious hazards.
Should you desire assistance in determining whether or not the north-south
runway should be relocated and put into active use and also for a definite decision
on the above matter we suggest you contact Mr. Don Harper, Civil Aeronautics Ad~
ministration, District Airport Office, 460 High Street, Salem, Oregon.
If this,office can further assist, we will gladly do so upon request from you."
