II Minutes of the regular meeting of the Common Council of Eugene held October 27, ,::
1947 at 7:30 P.M. The meeting was called to order by his Honor, Mayor Earl McNutt. ~:;'
Counci Imen present a t rollcall were - Crwnbaker, Ba iley, Johnson" Allen, Wells, ",',
and Pennington. Hawn and Davis absent.
Upon motion the minutes of the last regular meeting held October 14, 1947,
were considered read and approved.
1_, The City Manager presented for Council consideration the following bid on the
construction of buildings at the Swimming Pool site, which had been publicly
opened Friday, October 24, 1947 and scheduled as follows:

A report of the Public Safety Committee re: popcorn and concessiong stand in
5 Business District, was submitted and read as follows:
"The Public Safety Committee of the Council has reported to the Board of
I Appeals in the matter of a confectionary concession on West lOth Avenue in the
rear of Seymour's Cafe.
It was recommended that the petitioner, Mr. Ali Sivrioglu be permitted to
operate this mobile unit on a year to year permit, any renewal shall be subject to
the approval of the City Manager."
It was moved by Pennington, seconded by Allen that the report be received and
placed on file and that the recommendations contained therein be approved. Motion
carried.
A report of the Finance Committee re: Amazon Project, additional fire defenses
6 and park and recreational facilities, was submitted and read as follows:
"Your Committee on Finance to whom was referred the report of the City Manager
with reference to a financing program for the Amazon Channel Improvement, additional
fire defenses and park and recreational facilities, begs to report as follows:
That we have examined reports of the Finance Department with reference to
present and projected millage rates for City purposes and find that special levies
for sewers and City Hall construction, totaling 6 mills, will expire with the
fiscal year 1949-50 and that it would be possible to finance the bond or levy the
improvement proposals as set forth without seriously effecting the over-all tax
millage rate for the City of Eugene. We, therefore, recommend that the office of
the City Attorney be instructed to prepare three separate ballot proposals governing
I the improvement projects, these proposals to be processed by the appropriate com-
mittee of the Council before being processed with recommendations for formal
acceptance or rejection by the Council."
It was moved by Johnson, seconded by Bailey that the report be received and placed
on file and that the recommendations contained therein be approved. Motion carried.
A report of the Finance Committee re: Property offer and auditors report, was
? submitted and read as follows:
"Your Committee on Finance to whom was referred various matters, begs to re-
port as follows:
That in the matter of an offer of Paul W. Campbell for a metes and bounds
tract lying east of Block 6, Fairhaven Heights,Addition plus Lot 10, Block 6 in
the sum of $4500.00 be rejected and that a counter offer of $6500.00 be made sub-
ject to refusal from Mr. Clayton Lewis, Herbert A. Sain, and L. G. McInroe, all of
whom had previously filed options for purchase of portions of this tract.
The Committee further reports that it has examined the annual audit of the
City's finances and recommends the acceptance of the auditors report, including
proposal for an audit for the fiscal year ending June 30, 1948."
It was moved by Johnson, seconded by Bailey that the report be received and placed
on file and that the recommendations contained therein be approved. Motion carried.

8 A report of the Boaxd of Appeals was submitted and read as follows:
"A meeting of the Board of Appeals was held in the office of the Building
Department October 24, 194?, at 5 P.M. Present were Mr. Martin, Mr. Beardsworth
and City Attorney, Mr. Ea st.
I The following petitions were considered and recommendations made:
The petition of Mrs. Ward, 252? Agate Street for waiver of set-back for a
garage was again discussed, the questions being whether or not a non-conforming
garage could be altered and repaired and still remain within the meaning or intent
of the zoning ordinance.
The petition states that, had it not been legal to make the changes and repairs
the old structure would have remained in its existing location and would still be
non-conforming as to set-back which is nine feet from property line. Therefore,
since all work was upon the existing foundations and the street on which the garage
faces (25th Avenue between Columbia and Agate) being a dead-end street at both ends,
with visibility not impaired by the structure, it was decided to permit Mrs. Ward

PETITIONS AND COMMUNICATIONS
A communication from W. B. Scott re: alley opening between Van Buren and
9 Tyler, was submitted and read as follows: "

"I am writing you regarding the establishing of an alley between Van Buren and
Tyler Streets, in the block between West Broadway and 8th Avenue West, Eugene.
H. E. McGaugh, Dave Van Fossenn, and I are very desirous of having the alley
established. After talking to the Eugene Water Board, it is my belief that it
would like a city-owned alley here; it has six main wires on poles in the block,
and fourteen side wires strung across my property, very low over my buildings and ':
one of the pOles is set on my tract. The Telephone Company has a cable on these "

poles and it owns a one-half interest in the poles. This cable has 400 wires to :
make 200 circuits. The Te~ephone Company wo uld like to see a city-owned alley here .:;

I am further of the opinion that now is the time to get an alley before someone! I

seconded by Crumbaker that an order be placed with the Eugene.Water Board for the
installation of street lights at 1st and Monroe. Motion carried.

A communication from Mrs. John R. Chapman, Secretary of the Westmoreland
12 Improvement Assn. requesting the installation of street lights on 18th Avenue,
west of Chambers St., was submitted and read.
It was moved by Crumbaker, seconded by Johnson that the communication be received
apd placed on file and that the City Manager place an order with the Eugene Water
Board for the installation of these lights. Motion carried.

15 Council Bill No. 262 - Levying assessments 'for the construction of concrete
sidewalk on the North side of 12th Avenue between Polk and Taylor (Improv. Ord.
No. 9040), read the first time October 14, 1947, was brought on for second reading.
It was moved by Crumbaker, seconded by Bailey that the ordinance be read the second
time.
It was moved by Crumbaker, sedonded by Bailey that the rules be suspended by
unanimous consent and the ordinance be read the third time and given final passage.
All Councilmen present voting AYE, the ordinance was declared passed and numbered
9070. Hawn and Davis absent.
Council Bill No. 263 - Levying assessments for the construction of concrete
16 sidewalk on the West side of Taylor between 3rd and 4th Avenues West (Improv. Ord.

time.

State of Oregon, by and through the County Court of said County, hereinafter referr~d
to as County, and CITY OF EUGENE, a municipal corporation of Lane County, Oregon, by; I
.and through its City Manager, acting pursuant to Resolution of the Common Council I,
of said City, hereinafter referred to as City, : ~

WHEREAS , Jefferson Street within said City and County, is considered a primary
street for the flow of North and South traffic through said city and leading
directly thereto particularly from the junction of said Jefferson St., if extended,
with the Lorane Highway, a County Road, and,

WHEREAS, it is deemed to the best interests of said County 'and said City that
provision be made for the ultimate opening, construction. and improvement of said
-Jefferson Street from the corporate limits of said City southerly to the junction
of said street with the aforesaid Lorane Highway, ahd, further, provision for the
proportion which each shall contribute towards the cost of such construction and
improvement.
NOW, THEREFORE, pursuant to the premises and powers vested in said County and
City by Section 100-2410, O.C.L.A., it is mutually agreed between the County and
City as follows:
1. The County shall forthwith take .the necessary steps to acquire, by purchase
or eminent domain, good and sufficient title for county roadway purposes to neces-
sary lands for an extension of said Jefferson Street betweffnYoung's Lane and the
Lorane Highway, and the County sha 11, upon acquiring such lands, declare the same I
a County Road.

That the proportion which the City shall contribute towards the cost of such
construction and improvement shall be the cost of acquiring title by the County
as above agreed, and the City~agrees to pay ail costs of whatsoever nature arising
or growing out of the acquisition of title to said lands directly to the persons or
parties invol ved ~nd to save the County free and harmless from any liability cost.

3. That the proportion which the County shall contribute to the cost of 1
construction and improvement of said roadway shall be the cost of construction and '.
surfacing Jefferson Street between Young's Lane and the Lorane Highway aforesaid, , ;

within two years from the date of acquiring the lands aforesaid, construct and L

4. The remainder of said Jefferson St. extending southerly from the City

It was moved by Crumbaker, seconded by Wells that the agreement as presented be
accepted and proper officers of the City authorized to sign said agreement.

Mr. Robert Cross, representing Eugene Recreation Commission appeared before the
22 Council and orally requested consideration of an additional appropriation of
$71,000.00 per year for a three-year period in the budget for the Bureau of Parks
& Recreation. Upon motion the report was ordered referred to the Finance Com-
mittee for further study.
Mr. Hoffplan appeared before the Council with reference to his pending request
23 for waiver of set-bac~ on East 24th.
It was moved by Crumbaker, seconded' by Bailey' that the Board of Appeals be
authoriz~d by the Common Council to' take final action on Mr. Hoffman's application
without further referral to the Council. Motion carried.
Mr. Hoffman is the attorney for Mr. Frank Pickell, owner of the property.
