The meeting was called to order by his Honor Mayor Earl :4o;J McNutt. Councilmen present at rollcall were - Hawn, Davis, Crumbaker, Bailey, Johnson, Wells and Hanns. Allen absent. Upon motion the minutes of the last regular meeting held December 8, 1947 were considered read and approved. I 1 The City Manager presented for Council consideration the following bids on the construction of the second unit of the Swimming Pool, which had been publicly opened Thursday, December 18, 1947 and scheduled as follows: Stien Bros. Box 180 Eugene, Oregon $62,497.50 $11,640.00 $50,857.50 John Kovtynovich $83,595.00 $13,927.00 $69,668.00 4215 East 17th Eugene, Oregon It was moved by Bailey, seconded by Johnson that the bid of Stien Bros. be accepted and the Mayor and City Manager be authorized to enter into a contract with the successful bidder, such contract to contain a Saving Clause providing that the City shall limit the work to be performed under the contract to the amount of money on hand or provided for in the Swimming Pool Levy Fund and the contract approved as to form by the City Attorney. Monthly estimate and approval for progress payment was submitted by the City 2 Engineer as follows: I First and'final payment to R. C. Parsons for construction of sidewalks on 25th Avenue East from Harris to Potter. $285.50 I It was moved by Hawn, seconded by Davis that the estimate as approved be received and placed on file and that the proper city officers be authorized to make payment in accordance with the approved estimate. Motion carried. Rollcall - All Council- men present voting AYE. Allen absent. REPORTS OF CON~rrTTEES The Finance- Cownittee submitted the following report re: property offer. "Your Committee on Finance to whom was referred the matter of the sale of a 3 certain tract of City-owned property along Fairmount Blvd. begs to report as follows: An offer for this property in the sum of $4500.00 was received some weeks ago by the Committee and at that time a counter offer of $6500.00 was made to the applicant, Mr. Gordon Tripp. However, this matter was then ordered held in abeyance pending the survey of a possible road site through the tract to connect the property with the road in Malibar Heights Addition adjacent to the tract. This survey has been completed and shows that the construction of a road through this tract and making the connection would be impractical because of the steep grade and curvature. Your Committee, therefore, recommends that the tract described as follows: - 'That metes and bounds tract lying east of Block 6, Fairmount Heights Addition ad- joining Hendricks Park and also Lot 10 of Block 6, Fairmount Heights Addition, less I that part covered by road right-of-way, being all the land in this particular tract now owned by the City of Eugene' be sold to Mr. Gordon Tripp for $6500.00 cash, the property to be conveyed free and clear with insured title." It was moved by Davis, seconded by Hawn that the report be received and placed on file and that the recommendation of the Committee be adopted. Motion carried. REPORTS OF OF:WICERS 4 A report of the City Manager re: swimming pool bids was submitted and read as I follows: "Acting in accordance with instructions from the Council, bids were opened at 2:00 P.M. ' I, :1 While this procedure might be considered somewhat irregular, I am of the i opinicin tliat the City cianncit hope to dd better for the building unit than the figure as represented in the low bid received this week. If the pool is to be completed for use sometime during the summer of 1948, it is imperat~ve that the final con~ract be gotten underway as soon as practical and I would strongly urge the Council to accept at this time the low bid of Stien Bros. in the amount of $50,857.50 and by mQtion go on record as pledging the necessary surplus monies existing in the City Budget for the completion of the work next summer. To await action by the Budget Committee for the fiscal year 1948-49, and the transfer of additional funds would mean that this work would be 'held up until the spring of 1949. While the cost of the pool will, of course, exceed earlier estimates, it is i, interesting to note that the value of the equipment purchased from Camp Parks, ': California will represent a saving to us of approximately $30,000. This figure ; is,oased on an analys.is of contract awards of recent da, te in other cities in the :' I' Pacific Northwest, the most recent being that of the construction of a pool in ,; the City of Renton, Washington which was awarded on a low bid of $145,000.00. " This pool was of a similar design to the Eugene pool, but the tank was smaller :; than the one which we have constructed. . ) .' i' While the low bidder, Mr. Roy Stien, has indicated a completion time of six ,I months, he)has assured me that if awarded the contract by the Common Council that the work will be pushed as rapidly as possible with the hopes that the pool will be ~eady for use by Eugene's youngsters sometime in the month of June. '. . ,. !~ '/, A report of the City Manager re: Naval Armory was submitted ,and read as :, follows: ; , ' it 5 "I have at hand a proposed form of lease with the U. S. Navy for the rental I: . of City-owned property near 13th and Chambers Street for the erection and main- ,I tenance of a Naval Armory. While the Council has previously given me authorizati04 to execute this lease, there if? a'matter that has come to my attention which I fee~' I should pass on to the Council at this time before taking further action. l !; At the time that this property in question was sold to the Medical Center I' Assn., we ~ere approached by repre~entatives of the Seventh Day Adventist Church, . asking that that organization be allowed to purchase grounds immediately"adjacent ' to the Seventh Day Adventist School and bordering on the tract in ~uestion. ~ . This understandfng was confirmed by the Council at the time the property was originally sold to the Medical Center 'Group but' final action on the transaction I: was withheld pendin~ the plans for development of the property by the Medical ~ Group which, as the Council is aware, failed to materialize. At that time my I: office was contacted by representatives of the Seventh Day Adventist School as to I the status of the piece of ground in which they were interested in view of the development on the balance of the tract. I assured them at that time that the ( Council had given no indication that they would withdraw their offer to sell this ;: piece of ground. At a later date, the representatives of the U. S. " 1; ;i " ~ ~ 89 -- -.- - - --~_.- ------- --------- --------- -----~ --- ~-- It now develops that the representatives of the Seventh Day Adventist School -- were interested, not only in the 150 foot strip which was set aside for sale to I their group, but an additional piece of ground that would extend this holding to 00,' the east line of Almaden Street. This additional tract would take in a piece of :~ the ground proposed to be leased for the Naval Armory. ',' ...... Through an apparent misunderstanding on my part, at the time these con- versations took place, I was acting under the impression that the school and church were interested only in the original piece of property with 150' frontage on 13th, while the Adventist group contends that our conversations embraced the entire piece east to Almaden Street. In the meantime, 'negotiations have proceeded I for the leasing of the tract for the Naval Armory and we now have a conflict betwee the requests and applications of these two groups. I have extended my apoligies to the Seventh Day Adventist representative but have assured him that it was my understanding that their concern had been solely with the piece of ground which has been held for them and that it was only through misunderstanding and not bad faith that no further consideration was given to their plan of development at the time the negotiations were carried on for the Armory site Unfortunately, at this time if we are to consider the Seventh Day Adventist's request for the additional property to the east line of Almaden, it would mean an entire revision of the lease with the U. S. Navy and would also raise a serious question as to whether or not we could re-locate the Naval Armory building and still keep it without the airport approach zone which as you recall posed a serious question at the time the lease was negotiated. However, I do wish to present all the facts in the case to the Common Council at this time and seek a determination as to whether or not I should seek any re- negotiation on the Armory site or proceed to execute the lease as previously authorized by the Council. I have nevertheless, discussed this matter with Navy representatives recently and have asked them to cooperate with all parties concerned in the placing of the building so as to leave as much space as possible for the development of an adequate playground site just west of the adventist School. This cooperation has been assured." I It was moved by crumbaker., seconded by Davis that the report of the Manager be re- ceived and placed on file and that the City Manager be instructed to complete the proposed lease with the U. S. Navy for the establishment of the Naval Armory and to complete negotiations with the Seventh Day Adventist Church for the sale of that certain tract of property adjacent to the Seventh Day Adventist School as per previous agreement. Motion carried. A report of the City Manager re: continuation of Group Life Insurance for retired employes, was submitted and read as follows: "In connection with the retirement on January 1st of several employees of the 6 City of Eugene, the question has arisen as to the City's policy with reference to the continuation of Group Life Insurance coverage~ An investigation discloses that in cities where Group Life Insurance is in effect, varied rulings have been made with respect to this matter. However, I feel that the City could easily absorb the small additional cost for car~ying on this protection for its retired employes which amounts to approximately $2.13 per month per $1,000 of insurance. I should, therefore, like to recommend to the Common Council that authorization be given to carry a retired employee, on the Group Life Insurance plan up to $1,000 coverage, with the City to pay the premium for such coverage. Any additional insurance now carried under the group plan by any given employee would be paid for I by himself or herself. Trusting that this policy might meet with your approval, I a ' It was moved by Bailey, seconded by Johnson that the report of the Manager be re- ceived and placed on file and that the recommendation as outlined be adopted as the policy of the City until July 1, 1948 with further consideration to be given by the 1948-49 Budget Committee as to continuance of this policy. "At a meeting of' the Executive Board of the Westmoreland Improvement'Assn., on December 11, 1947 the Board members voted to petition the City Council to :; , abandon the City Air Park as such, for the following reasons: l; I " " i' . .. 1. Hacker and 9 others requesting that the pro- perty bounded by Orchard Ave. on the east, 14th Ave. from Orchard to alley on the north; 15th from Orchard to alley on the south; and the alley from 14th to 15th on the west be reclassified from residential to limited industry, was submitted. It was moved by Wells, seconded by Crumbaker that the petition be received and placed on file and that it be referred to the Planning Commission. Motion carried. ORDINANCES Council Bill No. 286 - Re: Vacating a portion of Inavale Street from Onyx to 16 Emerald, was submitted. Upon motion the hearing was ordered continued to the next regular meeting of the Council and the proposed vacation referred to the Public Works Committee for in- vestigation and report. Council Bill No. 287 - He: Adopting Survey, Plat and report of the City 17 Engineer re: opening of the alley between 8th Avenue West and West Broadway, Van Buren and Tyler, was submitted and read the first time. I It was moved by Hawn, seconded by Crumbaker that the rules be suspended by unanimous consent and the ordinance be read the second time. It was moved by Hawn, seconded by Crumbaker that the rules be further suspended and the ordinance be read the third time and given final passage. All Councilmen present voting AYE, the ordinance was declared passed and numbered 9085. Council Bill No. 288 - Re: Levying assessments for construction of sidewalk on 18 the South side of 25th between Harris and Potter Streets was submitted and read the first time. It was moved by Hawn, seconded by Crumbaker that the ordinance be laid over and that notice be given to the affected property owners. Motion carried. Council Bill No. 289 - Re: Levying assessments for the construction of side- 19 walks on the West side of Harris Street from 23rd to 25th Avenues West, was submitte and read the first time. Council Bill No. 290 - Re: Improvement of the alley between Third and Fourth 20 Avenues West from Jefferson to Madison by excavation, drainage and concrete pavement, was submitted and read the first time.
