The meeting was called to order by his Honor, Mayo~, Earl~cNutt. Councilmen present at rollcall were : Davis, Crumbaker" B~i.ley ,''Johnson, Allen, Wells," Hanns. Hawn absent~ Upon motion the minutes of the last regular meeting held Febru~ry 9, 1948 were considered read and approved. I ::'~ ,.(.,;; :-!: I 1 In the matter of bids submitted for the paving of the aQiey between Third and Fourth Avenues from Jefferson to Madison Streets, considered by the Common Council at its regular meeting January 12 and referred to the City Manage~, the Manager reported that remonstrances previously filed with the Council in ,con- nection with this improvement had been withdrawh and recommended that the low bid of F. W. Riddle in the amount of $2,681.25 be accepted. ' It was moved by Crumbaker, seconded by Davis that the bid of F. W. Riddle in the amount of $2,681.25 for the improvement of the alle~"between Third and Fourth Avenues from Jefferson to Madison Streets by pavingb'e "accepted and that the proper city officers be authorized to enter into a contract with Mr. Riddle for this work. Motion carried. REPORTS OF COMMITTEES 2 A report of the Public Works Committee re: Sewage Treatment Plant was sub- mitted and read as follows: "Your Committee on Public Works to whom was referred various matters begs to report as follows: At a meeting held Thursday, February 19 your Committee inspected the final revised plans and specifications for the Sewage Treatment Plant and discussed the same with the consulting engineer, Mr. R.C. Stockman. The projected disposal plant, designed for the city's current needs and providing for normal city growth within the next 20 years will cost approximately ~700,000 according to the esti-, mates contained in the engineer's report. The plant design would meet with the basic minimum requirements of the Oregon State Sanitary Authority. I .; Considerable discussion was given at this meeting to two phases of the pro- posed plant design. One involves comparative costs of drying and/or burning of sludge residue as compared to the operation of open sludge drying beds and the other involving a proper breakdown of plant ~ost with, reference to the handling of cannery wastes. At the Committee's request the engineers will submit a sup- plemental report covering these two matters. Your Committee recommends that further action on the report be held in abeyance by the Council pending receipt of the additional ~nfornlation requested. It was moved by Crumbaker, seconded by Wells that the report of the Public Works Committee be received and placed on file and,that the recommendation contained therein be approved. Motion carried. A report of the Finance Committee re: admissions tax ordinance was submitted, 3 and read as follows: "Your Committee on Finance to whom was referred CQuncilBill No. 86 being the proposed ordinance to levy an amusement admissions tax, begs to',report as follows: That your committee has further 'considered the matter and has conducted a hearing with interested parties and begs to report as follows: That we recommend to the Common Council that Council Biil No. 86 be brought on for consideration and be given third reading and final passage." I It was moved by Davis, seconded by Crumbaker that the report of the Finance Com- mittee be receive~ and placed on file and that the recommendation contained therein be approved. Motion carried. REPORTS OF BOARDS AND COMMISSIONS I A report of the Board of Appeals was submitted and read as follows: 4 "A meeting of the Board of Appeals was held 1!'riday February 20, 1948 to consider the petition of Dale H. J::__._,~_~_,.,. 12~ (1) To move the present garage at 390 West 12th Avenue to a position ten feet from the property line on Lawrence Street. (2) To erect a new duplex on the rear of the same lot with a setback of only six feet from the property line on Lawrence Street. The Board unanimously recommends that the petition be denied as the first proposition is contrary to City Ordinance No. 2637 and the second proposition is not in' accordance with established setbacks." ~ 'f'" . .f"MA It was moved by Crumbaker, seconded by Davis that the report of the Board be received and placed on file and that the recommendations contained therein be approved. Motion carried. 5 A permanent report of the Planning Commission was submitted and read as follows: "As a permanent report pursuant to the Resolution of said City, directing the City Planning Commission to prepare a report upon certain requests for reclassifi- cation and zoning of areas within said City, the City Planning Commission adopts as its permanent report the following: The Planning Commission recommends the approval of the following zoning and change of classification petition, viz. HENRY R. BYERS:, Lots 4, 5, 6, 7, 8, 17, 18, 19 and the West 10 feet of Lots 20 in Block 35 of the Amended Plat of Fairmount, as platted and recorded at page 12 of Volume 2, Lane County Oregon Plat Records, in Lane County, Oregon. Also~. beginning at the Northeast corner of Lot 22~ thencB South 89,0 08' VYest 65 feet to a one inch iron pipe thence bouth 0 15' West 90 feet to a one inch iron pipe, thence ~outh 890 45' East 65 feet to a one inch iron pipe at a point on the East boundary line of Lot 22, thence North 00 15' East 91.3 feet to the place of beginning, all in Block 35 of the ~ended plat of Fairmount, as platted and recorded at page 12 of Volume 2, Lane County Oregon Plat Records in Lane County, Oregon. It was moved by Bailey, seconded by Davis that the report of the Planning Com- mission be received and placed on file and that the recommendation contained therein be approved. It was moved by Crumbaker, seconded by Johnson that the motion be amended by striking the words "and that the recommendation contained therein be approve~." The motion as amended was carried by unanimous vote. , BETITIONS AND COMMUNICATIONS 6 A petition signed by L. V. Fish and 8 others for the improvement of Tyler Street from 13th to 15th Avenues West by installation of integral concrete curb and gutter and asphaltic concrete paving was submitted. It was moved by Crumbaker, seconded by Davis that the petition be received and placed on file and that the necessary ordinances be drawn. Motion carried. The following rezoning applications were submitted. 'J. O. Olsen, 271 West 7th from R-2 (Multiple Family) to 1-2 (Light Industrial) classification. ? Mrs. C. L. Dolynook, 558 West 1st from R-l (Single Family) to R-3 (Multiple Family) classification. It was moved by Davis, seconded by Crumbaker that the applications be referred to the Planning Commission by the necessary resolution. Motion carried. 8 An application for Package Store Class A license was submitted by Everett and Clifton Christian - Christian's Market, 1711 West 11th. It was moved by Davis, seconded by Allen that the application as approved by the Chief of Police be endorsed. Motion carried. 9 An application for roomin house license was submitted by D. F. Carey, 537 Linco n. It was moved by Davis, seconded by Allen that the application as approved by the Hea th Police and Fire Departments be endorsed. Motion carried. Motion carried. The City Manager submitted and matter of a petition by Raymond R. and Leta M. Huffman for relief of assessment in the amount of $64.30 for sidewalk improve- 11 ment on the East side of Filmore between West Broadway and 11th Avenue. The Manager reported that prior to this improvement the .pe~itioner had installed a walk and driveway at his own cost, bearing the entire expense for the same and that this walk and driveway did not correspond to the grade, allignment and lo- cation of the new walk. . . It was moved by ~ailey, ~econded by Davis that the matter be referred to the Public Works COInmittee. A communication from the U. S. Naval Reserve seeking permission of the Council 12 for a temporary installation of radio antenna atop temporary Navy Armor~ in t~e Red Cross Building, was submitted. "Reference is made to City Ordinance_ 3010 which prohi bi ts, the insta).laJio.n of certain antennae across city stree~s. It is requested that the provision of this ordinance be waived and that permission be granted th~, Eugene Division of the U. S. Naval Reserve to rig a transmitting antenna from a pole atop our temporary armory in the ~ed Cross Building. By way of explanation it is pointed out that not the ,antenna proper, but rather a guy wire from the Tjffany Building to the end of our antenna, will cross the stre~t in the proposed installation. Furthermore the installation would be only temporary and would be removed as soon as the new Reserve Armory is completed. I I ^ . For your information, the mission of the Communications Department of the local Res~rve Diyis~on is primarily the development and maintenance of technical skills in'radio operators and technicians. ORDINANCES , 13 Council Bill No. 314 - He: Levying assessments for the construction of sidewalk on the West side of Chambers from 13th to 14th and on the South side of 13th from Chambers to Grant Streets, read the first time February 9, 1948, was brought on for second reading. The City Manager reported no remonstrances on file. It was moved by Davis, seconded by Johnson that the Bill be read the second time by title with unanimous consent of the Council. Motion carried unanimously. It was moved by Davis, seconded by Johnson that the rules be suspended and the bill be read the third time by TITLE with unanimous consent of the Council. Motion carried unanimously. It was moved by Davis, seconded by Johnson that the bill be approved. All Councilmen present voting AYE, the Bill was declared passed and numbered 9103. Council Bill No. 315 - Re: Levying assessments for the construction of 14 sidewalk on the South side of Clark Street between Lincoln and Lawrence Streets read the first time February 9, 1948 was brought on for second reading. The City Manager reported no remonstrances on file. It was moved by Davis, seconded by Bailey that the Bill be read the second time by TITLE with unanimous consent of the Council. Motion carried unanimously. It was moved by Davis, seconded by Bailey that the rules be suspended and the Bill be read the third time by TITLE with unanimous consent of the Council. It was moved by Johnson, seconded by Crumbaker that the Bill be tabled pending adoption of the New Zoning Ordinance. Roll call - Crumbaker, Johnson, Wells and Hanns voting AYE; Davis, Bailey and Allen voting NO. Motion carried. Council Bill No. 317 - Re: Improvement of the alley between 11th and 12th, 16 Patterson and Ferry Streets, was submitted and read the first time in full. It was moved by Davis, seconded by Bailey that the Bill be read the second time by TITLE with unanimous consent of the Council. Motion carried unanimously. It was moved by Davis, seconded by Crumbaker that the rules be suspended and the Bill be read the third time by TITLE with unanimous consent of the Council. Motion carried unanimously. It was moved by Davis, seconded by Grumbaker that Council Bill No. 86 be amended, substituting the word "licenses" for word "taxes" in line 5 of. the Title. Motion carried'. O. OlSEN: The West 9.2 feet of Lot 7 and the East 15.8 feet of Lot 6, all in Block Three (3), Packards Addition to Eugene, Lane County, Oregon. Property located at 271 West 7th Avenue. I A Resolution - Re: Opening of 24th Avenue from Alder to Harris Streets was 25 submitted and read as follows: " In the matter of the proposed opening of twenty-fourth Avenue from Alder to Harris Street in the City of Eugene, Oregon. WHEREAS, the Common Council of the City of Eugene, by Resolution duly adopted September 8, 1947, determined to open, layout and establish Twenty-fourth Avenue from Alder Street to Harris Street in the City of Eugene, Oregon; and, WHEREAS, the report and plat of the City Engineer for the opening of said street was duly made and filed and thereafter duly adopted by the Common Council by Ordinance No. 9076 passed by the Common Council November 10, 1947, and approved by the Mayor on November 11, 1947; and VlliEREAS, the viewers duly appointed by said Ordinance made and filed a report of their findings of benefits and damages to the property benefitted and property damaged by the proposed opening of said street; and I vY.HEREAS, after due notice of the consideration of said report the same was duly adopted by Ordinance No. 9076, and which was passed by the Common Council on November 10, 1947, and approved by the Mayor on November 11, 1947; and VffiEREAS, the damages sustained by the taking of property in said street opening belonging to Harlow E. Hudson and Kathryn K.
