The regular meeting of the Common Council of Eugene held April 12, 1948 at 7:30 P.M. The meeting was called to order by his Honor, Mayor Earl McNutt. Councilmen present at rollcall were - Crumbaker, Johnson, Hanns and Wells. Hawn - 8:45, Davis - 9:00. Bailey and Allen absent. Upon motion the minutes of the last regular meeting held March 22, 1948 were considered read and approved. ,.,... . ............ REPORTS OF COMMITTEES A report of the Public Works Committee re: right-of-way acquisitions for portion of U. S. Highway 99 from East Broadway to a dual connection with 6th and 7th Avenues East, was submitted and read as follows: "Your Committee on Public Works to whom was referred the matter of approval of right-of-way wacquisitions for that portion of the U. S. Highway 99 project from East Broadway to a dual connection with 6th and 7th Avenues East, begs to report as follows: We have examined the report of right-of-way acquisitions a$ submitted by Mr. W. F. Collins, Right-of-Way Agent for the Oregon State Highway Commission. We find that the prices offered by the State are based on findings of competent appraisers in keeping with present Oregon prices and that other costs, par- ticularly the moving of buildings and structures are based on the best available estimates. We, therefore, recommend that the report of the right-of-way agent be approved and that the proper city officers so notify the Oregon State Highway Commission." It was moved by Crumbaker, seconded by Johnson that the report of the Public Works Committee be received and placed on file and that the recommendation contained therein be. approved. Motion carried. A report of the Public Safety Committee re: restricted parking zones, etc., was submitted and read. "Your Committee on Public Safety to whom was referred various matters begs to report as follows: 1. Your committee has ,studied the results of four traffic count surveys made at the intersection of Charnelton Street with West 19th Avenue. While the count shows a heavy preponderance of east-west traffic at these two intersections, it is the committee's belief that the placing of stop signs for south bound traffic would probably constitute a greater traffic hazard than now exists at these inter- sections. We, therefore, recommend that the proper city officers be authorized to install "slow-danger" signs either upon the pavement or upon posts at. the inter- sections in question. 2. We recommend that Council Bill No. 323 prohibiting indiscrimina.te carrying of passengers on automobiles, motocycles, and other motor vehicles be amended to eliminate specific reference to students, and that the Council Bill as so amended be given second and final readings by the Council. 3. Your Committee recommends that the request of Northwest Christian College for a truck loading and unloading zone adjoining its commisary on East 12th between Alder and Kincaid Streets be granted and that the zone be established. 4. Your committee has studied the question of complaints arising from the operation of Ordinance No. 8670 of the City of Eugene which grants exclusive park- ing privileges in front of residential entrances. It is the unanimous opinion of the committee that Ord. No. 8670 is discriminatory and recommends to the Common Council that it be repealed." It was moved by Crumbaker, seconded by Johnson that the report of the Public Safety Committee be received and placed on file and that the recommendations contained therein be approved. Motion carried. A report of the Public Safety Committee re: installation of additional stop signs in the City of Eugene,begs to report as follows: "In recent months your committee has been repeatedly called upon to study requests from various sections of the City for installation of additional stop signs at residential inter~ections. While some of these requests have been granted, it is the Conwittee's considered opinion that the problem of traffic safety at these points cannot be solved by any other means than by reducing the over-all speed of vehicles using the City streets. _.__.__ ji ~ ~r2 ';" .;.~\ \-J> Z 'to Your committee, therefore, wishes to recommend to the Common Council that by appropriate action it convey to the proper city officials a request that the 25 mill speed limit on all city streets be rigidly enforced by the traffic de- partment with the cooperation of. the municipal court." I It was-moved by Hanns, seconded by Crumbaker that the report of the PUblic-Safety Committee be received and placed on file and that the recommendation contained therein be approved. Motion carried. REPORTS OF OFFICERS I 4 A report ,of the City Manager re: work on the Eugene Memorial Swimming Pool was submitted, and read as follows: "I am pleased to report that work on the Eugene Memorial Swimming Pool has been re-activated following settlement ,of the local carpenter strike; Form work on the bath house and equipment building is now underway and the contractor, Mr. Roy Stien, has advised my office that the work will be carried forward as rapidly as weather conditions permit. That portion of the building that will be used for housing of filtration, heating equipment, etc. will be placed first on the schedule for completion in order that the n,ecessary plumbing installations can be carried on without delay while the balance of the structure is being finished. We are also availing ourselves of an opportunity at the present time to obtain approximately 1,000 yards of top soil which is costing us only the hauling charge for removing the same, and this will be stock-piled at the swimming pool site in order that necessary ground improvements can be carried on.later this spring~ This for your information." It was moved by Crumbaker, seconded by Johnson that the report of the City Manager be 'received and placed on file. Moti()n carried. A report of the City Manager re: West-side sewer system,' was submitted and read as follows: I 5 "Plans, specifications and contract documents for the West-side sewer system, Sections 1, 2 and 3 together with pwnping plant have been completed by the con- sulting engineers and the job is ready for bid call. Authorization is therefore requested for the proper city officers to issue a formal call for bids on Sections 1, 2 and 3 of the West-side sewer system, together' with pumping pJ..ant, bids to be opened by the City May 10, 1948." It was moved by Crumbaker, seconded by Hawn that the report of the City Manager be ~eceived and placed on file and that authorization to issue bid call be granted by the Common Council. Motion carried. . A report of the City Manager re: Sewage Treatment Plant; was submitted and 6 read as follows: "I wish to advise that my office has received the final supplemental reports on Eugene's proposed Sewage Treatment Plant from the consulting engineering firm of Stockman and Stockman. This final report, recently requested by the Public Works Committee of the Common Council, and dealing with alternate methods of dis- posal of digested sewage sludge, completes the engineering report. We now have on hand in addition to reports complete sets of blue prints, specifications and contract documents pertaining to the plant. The report, plant design and specifi- ' cations have received the approval of the State Sanitary Authority. I If it is a desire of the Common Council to proceed with plans for the con- struction of the plant, it will be necessary to resolve the following questions: 1. Ways and means of prOViding construction funds over and above the $200,000 Sewage Disposal fund now on 'hand. On the basis of present engineering estimates, the amount to be raised, will be approximately:$485,OOO. 2. A determination if, and to what extent the Eugene Fruit Growers Assn. and the University of Oregon might be requested to assist in the financing of plant construction based on load factors affecting plant capacity and deSign. This matter is thoroughly covered in the main report of the .engine,ers. I 3. An examination into the present sewage disposal rates and determination of ;' future rate structures that would insure the amortization of a construction bond issue and to supply necessary funds for plant ,operation. ~ I I I I I 1. '''3~ o 4. A final determination as to the type of digested sludge disposal and the matter of acquiring additional land within the vicinity of the'plant for con- struction of sludge drying beds. A report of the Board of Health re: meat and milk inspection, was submitted 11 and read as follows: "The Board of Health for the City of Eugene meeting in regular session April 12, 1948 adopted the following motion: 'It was moved by Dr. Fox, seconded by Dr. Furrer that the Board of Health recommend to the Common Council that the milk ordinance for the City of Eugene be amended to provide for the collection from all licensed milk distributors milk inspection fees based on 1/2~ per pound of butter fat on all milk sold in the bottle and can trade within the City of Eugene as a means of providing necessary funds to support a rapidly expanding milk inspection program; and that the ordinance be further amended to make its provisions con- form to State Milk Sanitation regulations. Motion unanimously adopted. ' In submitting this recommendation, the Board desires to call the Council's attention to the increasingly heavy milk consumption within the City of Eugene which has made it necessary to extend dairy inspection to the coast area, Grants Pass and Mount Angel." It was moved by Hawn, seconded by Davis that the report of the Board be received and placed on file and that the matter be referred to the City Attorney for pre- paration of the requested ordinance amendments. PETITIONS AND COMMUNICATIONS 12 An application from the Oregon Electric Railway Company to construct a spur track across Filmore Street and on West Fifth Street, was submitted and read. "The Oregon Electric Railway Company hereby petitions your honorable body to grant to it a revocable permit to construct a railroad spur track across Filmore Street and on West Fifth Street, in the City of Eugene, Oregon, the center line of said spur track being described as follows: Beginning at a point in the center line of West Fifth Street, said point being the center line of the main track of the Oregon Electric Railway Company as now constructed and 12.8 feet east of the east line of Filmore Street; thence westerly through a 60 ft. lead, Number Seven turnout to the right ?O feet; thence on a 15 degree curve to the right through an angle of 50 12' 30" a distance of 34.? feet to the point of compound curve6 thence on a 15 degree curve to the left through an angle of 13 22' 30" a distance of 89.2 feet; thence tangent to last curve parallel with and 10 feet southerly from the north line of West Fifth Street a distance of 55.? feet. "In accordance with instructions received from the Public Employes Retirement System, the Eugene Water Board hereby requests that the Common Council of Eugene recommend ,to the Public Employes Retirement System that the following Eugene Water Board "over-age" employee be retained on the Eugene Water Board payroll for a period of one year, May 1, 1948 to May 1, .1949. 14814 Parker, Augustus, Equip. Motion carried. A petition by R. W. McInnis for installation of street lights on 18th Avenue at Patterson and Ferry was submitted. I 15 It was moved by Crumbaker, seconded by Davis that the petition for street lights be approved and that an order be placed with the Eugene vVater Board for instal- lation of the same. It was moved by Hawn, seconded by Davis that the applications as approved by the Police, Fire and Health, Departments, be endorsed. Motion carried. I 17 A petition to rezone property at 2305 East 15th from R-l (Single Family) to R-2 (Any :size apartments) classification, was submitted by Ly:nn and Floye Norman. It was moved by Johnson, seconded by Hanns that the petition be referred to the Planning Commission by the necessary resolution. Motion carried. A petition sfgned by Rovert A; Holland and 8 others for the installation of a 18 sanitary sewer on Onyx from 26th to 28th, was submitted. It was moved by Crumbaker, seconded by Hawn that the petition be received and placed on file and that the necessary improvement ordinance be drawn, and that the engineer prepare a report for consideration by the Council for further extension of sewers in the balance of the Inavale area. Motion carried. A petition for the improvement of Taylor Street 'between 11th and 12th Avenues 19 West, was' submitted' by R. C. Wical and 6 others. It was moved by Crumbaker, seconded by Hawn that the petition be received and placed on file and that the City Attorney be instructed to prepare the necessary improvement ordinances. ,Motion carried. 20 A petition for the vacation of Short Street between Spring Boulevard and 23rd Avenue was submitted by John Ski,ll.ern and 2 others. It was moved by Crumbaker, seconded by Johnson that the petition be received and placed on file and that the matter be referred to the Public Works ,Committee. Motion carried. · A communication from Olif Culp requesting vacation of the alley betwe'en 5th 21 and 6th, Pierce and Filmore for one-half block, was submitted and read. I "A request is hereby made of the Common Council for favorable consideration to;, a petition for vacating the alley between 5th and 6th and Pierce and Filmore in Block 3 of Grand Prairie Addition, for one-half block. ' I ~ I I I I I ~ 147 This vacation is requested to allow for orderly business expansion of the property abutting the alley. The alley at the present time is not open and has never been used by the public. Furthermore, the alley, if opened, would not serve through traffic nor be necessary for egress and ingress for all parties concerned. ...... ~ -J :.......,.. It was moved by Crumbaker, seconded by Wells that the communication be received and placed on f.ile and that the matter be referred to the Public Works Committee. Motion carried. 22 A petition signed by N. C. Whities and 3 others for the installation of a sanitary sewer on the East side of University from 27th to 28th Avenues East, was submitted. It was moved by Crumbaker, seconded by Davis that the petition be received and placed on file and that the necessary improvement ordinance be drawn and that the matter be referred to the City Engineer for preparing a report on sewers for the entire area involved. 23 The following applications for liquor licenses were submitted as follows: Hilyard Street Grocery, 1698 Hilyard Street. Bowman's West side Market, 657 Jefferson St. Veterans Memorial Association, 1626 Willamette It was moved by Hawn, seconded by Davis that the applications as approved by the Chief of Police be endorsed. Motion carried. 24 A communication from the Police Department requesting that permission be granted Officer Neet to reside outside the City limits was submitted. "Officer Neet owns property at 30th and Jefferson, which includes a house and two lots. This property is 1.9 miles from the City Hall, is in the Eugene Telephone Exchange. and, on the bus line. His present residence is to be torn down after the 1st of June as it is on University property, and the site is to be used for a warehouse. I believe his request to live at 30th and Jefferson should be, granted as the housing situation in the City Limits is very difficult." It was moved by Hawn, seconded by Hanns that the request be granted. Motion carried. The following report was submitted by the City Recorder. "Ae.tion was started on February 24, 1948 by the Eugene Recreation Commission under the provisions of the Initiative, Referendum and Recall Section of the Charter to initiate a charter amendment for consideration of the voters which would authoriz a two mill levy for three years for parks and playgrounds. The charter section provides in part as follows: "not less than fifteen per cent of the legal voters of the City of Eugene, computed upon the total number of votes cast for the office of Mayor at the last preceding gener~l election at which the Mayor was elected, shall be required to propose any measure by the initiative." There were 8,372 votes cast for mayor at the general election held November 7, 1944, the last general election at which a Mayor was elected. Fifteen per cent of this number is 1,256. I am submitting with this letter 121 signed petitions proposing the amendment and a certificate from the County Clerk indicating the signatures thereon have been checked and that 1277 signatures are genuine. This represents an overage of 21 signatures, above the 1256 required to propose the measure." It was moved by Hawn, seconded by Johnson that. the initia~ing. petition be received, the report of the City Recorder approved and the necessary ordinance prepared and submitted by the City Attorney for Council consideration. The matter of a request by the State Highway Commission for waiver of the 52 26 foot setback regulation on STATE-owned property at the easterly end of, Franklin Blvd to allow for the placing of houses to be moved by the State Highway Commission in conju~ction with the U.S. 99 improvement project, was brought before the Council by the C~ty Manager. .
