HomeMy WebLinkAboutAdmin Order 58-17-11ADMINISTRATIVE ORDER NO. 58-17-11 of the Traffic Engineer of the City of Eugene CLOSURE OF NORTH WASHINGTON AND NORTH LAWRENCE STREETS NORTH OF CHESHIRE AVENUE AND FLORAL AVENUE FROM NORTH WASHINGTON TO NORTH LAWRENCE STREETS. The Traffic Engineer of the City of Eugene finds that: A. EC 5.040 authorizes the City Manager or the Manager's designee to take administrative action to close or open any street to vehicular or pedestrian traffic. EC 5.055 sets forth the criteria the City Manager or the City Manager's designee should consider when taking administrative action authorized by EC 5.040. B. On September 24, 2009, the City Manager issued Administrative Order No. 58-09- 14 granting the Traffic Engineer and the Public Works Department the authority to exercise all of the duties and responsibilities specifically defined as those of the City Manager in Section 5.040 and 5.050 of the Eugene Code, 1971. C. By Administrative Order No. 58-17-08, the City Manager appointed me as the City's Traffic Engineer and delegated to me authority to exercise all duties and responsibilities granted to the City Manager by EC 5.040 and 5.050. D. Pursuant to the above -authority, I intend to close to vehicular traffic the follow three road segments: (1) North Washington Street north of Cheshire Avenue; (2) North Lawrence Street north of Cheshire Avenue; and, (3) Floral Avenue from North Washington Street to North Lawrence Street. In making the decision to close North Washington and North Lawrence streets north of Cheshire Avenue and Floral Avenue from North Washington Street to North Lawrence Street to vehicular traffic, I considered all of the applicable criteria set forth in EC 5.055, including the consideration of traffic engineering principles and traffic investigations. Based on the applicable criteria set forth in EC 5.055, the following findings support my decision to close North Washington and North Lawrence streets north of Cheshire Avenue and Floral Avenue from North Washington Street to North Lawrence Street to vehicular traffic: 1. North Washington Street from Cheshire Avenue to Floral Avenue is a local street approximately 260 -feet in length. It is bordered by four tax lots on the east side and Oregon Department of Transportation right-of-way to the west. Tax lots 1703303104600, 1703303104300, 1703303104200 and 1703303104100 are adjacent Administrative Order -- Page I of 3 to the cast side of the street and are undeveloped park land owned by the City of Eugene. 2. North Lawrence Street from Cheshire Avenue to Floral Avenue is a local street approximately 260 -feet in length. It is bordered by five tax lots on the east side and three tax lots on the west side. Tax lots 1703303103500, 1703303103400 1703303103200, 1703303103000 and 1703303102900 are adjacent to the east side of the street and are developed park land owned by the City of Eugene. Tax lots 1703303103900, 1703303103800 and 1703303103600 are adjacent to the west side of the street and are developed park land with community gardens owned by the City of Eugene. 3. Illegal car camping and dumping of trash and debris along North Washington and North Lawrence streets north of Cheshire Avenue and Floral Avenue from North Washington Street to North Lawrence Street have created safety issues and has placed a burden on City resources. 4. Closure of North Washington and North Lawrence streets north of Cheshire Avenue and Floral Avenue from North Washington Street to North Lawrence Street was requested and is supported by the City of Eugene and the Oregon Department of Transportation which own all adjacent properties and rights-of-way. 5. These segments of North Washington and North Lawrence streets north of Cheshire Avenue and Floral Avenue from North Washington Street to North Lawrence Street do not currently serve as a vehicular routes and closure will not cause any detriment to the public or the abutting property owners. The community garden west of North Lawrence Street is accessible from Cheshire and will not be affected by the street closures. 6. It is in the best interest of the public's health, safety and welfare to close the segments of North Washington and North Lawrence streets north of Cheshire Avenue and Floral Avenue from North Washington Street to North Lawrence Street to vehicular traffic. 7. The closed segments of the North Washington and North Lawrence streets north of Cheshire Avenue and Floral Avenue from North Washington Street to North Lawrence Street will remain accessible to emergency vehicles. 8. The closed segments of North Washington and North Lawrence streets north of Cheshire Avenue and Floral Avenue from North Washington Street to North Lawrence Street will remain open to pedestrians and bicycles. Administrative Order -- Page 2 of 3 9. The City's adopted transportation -related plans and policies do not require that these segments of North Washington and North Lawrence streets north of Cheshire Avenue and Floral Avenue from North Washington Street to North Lawrence Street remain open to vehicular traffic. On the basis of these findings, I order that: 1. North Washington Street north of Cheshire Avenue is hereby closed to vehicular traffic. 2. North Lawrence Street north of Cheshire Avenue is hereby closed to vehicular traffic. 3. Floral Avenue from North Washington Street to North Lawrence Street is hereby closed to vehicular traffic.
