HomeMy WebLinkAboutAdmin Order 58-17-19-FADMINISTRATIVE ORDER NO. 58-17-19-F of the City Manager of the City of Eugene INFLATIONARY ADJUSTMENT OF SYSTEMS DEVELOPMENT CHARGES FOR TRANSPORTATION SYSTEM, LOCAL WASTEWATER SYSTEM, STORMWATER SYSTEM, AND PARKS SYSTEM. The City Manager of the City of Eugene finds as follows: A. Section 2.020 of the Eugene Code, 1.971 (EQ, authorizes the City Manager of the City of Eugene to determine and set fees and charges to be imposed by the City for services, goods, use of municipal I property, and licenses and permits. EC 7.710(5) and Section 2.4 of the Systems Development Charge (SDC) Methodologies authorize the City Manager to adopt by administrative order pursuant to EC 2.020, a change yin the amount of a reimbursement fee or an improvement fee if the change in amount is based on: (1) the periodic application of an adopted specific cost index (inflationary adjustment); or (2) a modification to any of the factors related to rate that are incorporated in the established methodologies. However, pursuant to Section 2.4 of the SDC Methodologies, revisions of such fees in an amount greater than five percent within any 12 -month period must be established by resolution of the City Council. B. The SDC Methodologies were adopted by Resolution No. 4900 effective May 7, 2007, and have subsequently been amended by Resolution Nos. 4929, 4977, 4991 and 5100. Inflationary adjustments to SDCs for the Regional Wastewater System, Parks System, Local Wastewater System, Stormwater System, and Transportation System have been adopted, most recently by Administrative Order No. 58-16-14-F, effective July 1, 2016. In addition, amendments to the MWMC Capital Improvements List and MWMC SDC Fee Schedule for the Regional Wastewater System were adopted by Administrative Order No. 58-17-02-F, effective March 10, 2017. C. In accordance with the procedures set forth in Sections 2.020 and 7.710(5) of the Eugene Code, 1971, after considering the applicable policies, enactments and directives of the City Council, the amount charged for these services by the City in the past, the full costs of providing these services supported by the fees, the amounts charged by other comparable providers, and the revenue needs of the City as determined by the adopted City budget, on August 4, 2017, 1 issued Administrative Order No. 58-17-19, proposing to implement inflationary adjustments to SDCs for the Transportation System, Local Wastewater System, Stormwater System, and Parks System rates as shown on Exhibit A attached to that Order. General descriptions of the adjustments are described in Findings D and E below. D. Based on the Engineering News -Record 20 -City national average Construction Cost Index of 3.7% (May 2016 through May 2017), it is necessary to amend the Transportation System, Local Wastewater System, and Stormwater System SDCs by implementing a 3.661/o increase for those SDCs. As such, these increases will not result in a 5% or greater fee revision within a 12 -month period. Administrative Order -Page 1 of'2 E. Based on: (1) the park development/renovation cost adjustment using the Engineering News -Record 20 -City national average Construction Cost Index of 3.7% Index (May 2016 through May 2017), and (2) the park land acquisition cost adjustment using the Lane County Assessment & Taxation office's published 2016 Sales Ratio Report, it is necessary to adjust the Parks System SDCs by implementing an average 2.6% increase in the Parks System SDC for residential development, and an average 2.7% increase in the Parks System SDC for nonresidential development. As such, these increases will not result in a 5% or greater fee revision within a 12 - month period. F. The 'inflationary adjustments are consistent with adopted policies of the City, are in conformity with applicable state law, are authorized by Section 7.710(5) of the Eugene Code, 1971, and should be implemented effective September 1, 2017. G. Notice of the proposed inflationary adjustments was given by providing copies of Administrative Order No. 58-17-19, including Exhibit A (the proposed amendments) and Exhibit B (the Notice), to the Mayor and City Councilors; making those documents available for inspection by interested persons at the office of the City Engineer, Public Works Department, 99 East Broadway, Suite 400, Eugene, Oregon, 97401; and by posting those documents at two locations at City Hall on August 15, 2017. In addition, Notice of the adjustments was published in the Register - Guard Newspaper on August 25, 2017, and persons who requested notice of the amendments were mailed informational postcards as notification of the proposed amendments. H. Notice provided that written comments would be received for a Period of 15 days from the date of posting and publication. No comments were received within the time or in the manner set forth in the Notice. On the basis of these findings, I order that: 1.
