HomeMy WebLinkAboutAdmin Order 58-17-25ADMINISTRATIVE ORDER NO. 58-17-25 of the Traffic Engineer of the City of Eugene CLOSURE OF CHARNELTON ALLEY FROM THE NORTHWEST CORNER OF ASSESSOR'S MAP 17-03-31-43 TAX LOT 9300 TO THE SOUTHWEST CORNER OF ASSESSOR'S MAP 17-03-31-43 TAX LOT 9300. The Traffic Engineer of the City of Eugene finds that: A. EC 5.040 authorizes the City Manager or the Manager's designee to take administrative action to close or open any street to vehicular or pedestrian traffic. EC 5.055 sets forth the criteria the City Manager or the City Manager's designee should consider when taking administrative action authorized by EC 5.040. B. On September 24, 2009, the City Manager issued Administrative Order No. 58-09-14 granting the Traffic Engineer and the Public Works Department the authority to exercise all of the duties and responsibilities specifically defined as those of the City Manager in Section 5.040 and 5.050 of the Eugene Code, 1971. C. By Administrative Order No. 58-17-08, the City Manager appointed me as the City's Traffic Engineer and delegated to me authority to exercise all duties and responsibilities granted to the City Manager by EC 5.040 and 5.050. D. Pursuant to the above -authority, I intend to close Charnelton Alley from the northwest corner of Assessor's Map 17-03-31-43 Tax Lot 9300 to the southwest corner of Assessor's Map 17- 03-31-43 Tax Lot 9300 to all traffic. In making the decision to close Charnelton Alley from the northwest corner of Assessor's Map 17-03-31-43 Tax Lot 9300 to the southwest corner of Assessor's Map 17-03-31-43 Tax Lot 9300 to all traffic, I considered all of the applicable criteria set forth in EC 5.055, including the consideration of traffic engineering principles and traffic investigations. Based on the applicable criteria set forth in EC 5.055, the following findings support my decision to close Charnelton Alley from the northwest corner of Assessor's Map 17-03-31-43 Tax Lot 9300 to the southwest corner of Assessor's Map 17-03-31-43 Tax Lot 9300 to all traffic: 1. Charnelton Alley from the northwest corner of Assessor's Map 17-03-31-43 Tax Lot 9300 to the southwest corner of Assessor's Map 17-03-31-43 Tax Lot 9300 is a 12 -foot wide unimproved alley with a sidewalk connecting West 16th Avenue to Charnel Mulligan Park. It is bordered by Assessor's Map 17-03-31-43 Tax Lot 9300 on the east side and Assessor's Map 17-03-31-43 Tax Lot 7800 on the west side. Neither tax lot takes access from the alley. 2. Illegal activities occurring in this section of the alley have created safety issues for residents, park users and City staff. The alley has provided a relatively concealed location Administrative Order -- Page 1 of 2 for these activities, as well as a convenient route to leave the site quickly when police are patrolling. 3. Closure of Charnelton Alley from the northwest corner of Assessor's Map 17-03-31-43 Tax Lot 9300 to the southwest corner of Assessor's Map 17-03-31-43 Tax Lot 9300 was requested by the City of Eugene Police and Public Works Departments, and is supported by the Jefferson Westside Neighbors, and the majority of neighbors and citizens who were involved in the extensive public engagement process for renovation of Charnel Mulligan Park. The public engagement process began in 2012 with notification by mail to nearly 5,000 neighborhood addresses, and over the course of three years included five public meetings, three web surveys, and regular updates to a list of about 100 separate email addresses. 4. Charnelton Alley from northwest corner of Assessor's Map 17-03-31-43 Tax Lot 9300 to the southwest corner of Assessor's Map 17-03-31-43 Tax Lot 9300 does not currently serve as a vehicular route and closure will not cause any detriment to the public or the abutting property owners. Removing the pedestrian access through the alley to Charnel Mulligan Park will add some additional out -of -direction pedestrian travel for people accessing the Park from the northwest; however, the minor additional travel distance of 208 -feet for pedestrians accessing the path from the northwest resulting from the alley closure is acceptable in order to improve the safety of Charnel Mulligan Park and surrounding properties. 5. It is in the best interest of the public's health, safety and welfare to close Charnelton Alley from the northwest corner of Assessor's Map 17-03-31-43 Tax Lot 9300 to the southwest corner of Assessor's Map 17-03-31-43 Tax Lot 9300 to all traffic. 6. The closed segment of Charnelton Alley will remain accessible to emergency vehicles. 7. The City's adopted transportation -related plans and policies do not require that this segment of Charnelton Alley remain open to traffic. On the basis of these findings, I order that: 1. Charnelton Alley from the northwest corner of Assessor's Map 17-03-31-43 Tax Lot 9300 to the southwest corner of Assessor's Map 17-03-31-43 Tax Lot 9300, is hereby closed to all traffic.
