The regular meeting of the Common Council of the City of Eugene, Oregon, was called to order at 7:30, p.m. PDT on June 10, 1963 in the Council Chamber by His Honor Mayor Edwin E. Cone with the fo11ow~ng councilmen present: ,Messrs. Chatt, Swanson, Christensen, Deverell, Crakes, Hawk, and Purdy. Mrs. 'Lauris,was absent. The invocation ~as sung by the Eugene PTA Mother Singers, Mrs. Wm. Dugan leading. e Minutes of tl1e adjourned mee,tings of May 27 and June 3, 1963, as mailed to members of the Council, were approved. 1 NEW BUSINESS Mr. Swanson ra;i.sed the question of blind intersections around the City and called particular attention to 18th and W'ashington, and, 8th and Tyler. Mr. Crakes then men- tioned the intersection at 22nd and Frie~d1y as being a rather bad corner. These items were referred to the proper members" of the staff for investigation. A -.... 1. Patterson-Hilyard Assessment Policy - It was explained that this matter had been discussed and voted upon previously .wi th no agreement' and had been tabled. I 6/10/63 - 4 e 321 ~ 6/10/63 I n - J p~ .:c e I I e I e Mr. Chatt moved seconded by Mr. Swanson to approve Item 1 of the Committee report, Mr. Warren Coombs, speaking for himself and other property owners, read a statement as to the reasons why owners of abutting property on Hilyard Street objected to the assessment. Mr. Charles Porter was recognized and stated he was speaking for Mr. Horton and raised the question of the benefit to the abutting properties, stat- ing that there was considerable question as to whether the property along this street had been benefitted by the widening. Mr. Porter stated this probably could be settled in a court of law and suggested that perhaps this was the place to determine the benefit. After some further discussion, he then made the suggestion that both parties have the situation appraised by a competent appraiser and the information returned to the Council to be considered in their final decision. Mr. Swanson then moved seconded by Mr. Hawk to table the assessment procedure as out- lined in the motion above and to secure an appraisal to determine whether the proper- ties have been benefitted. Motion carried. 1 2. Rezoning 29th between Portland and Olive, Cascade Manor, RA to R-3G - The Committee considered a request from Cpscade Manor, Inc., for rezoning the property located between Olive and Portland Streets and from 29th to 30th Avenue, an area approximately 300 ft x 680 ft. It was explained that the rezoning was requested for a rest home to consist of a maximum of 138 units, 3 stories above ground level on higher side of property with day- light basement on lower level of lot. Necessary parking space will be provided. There was a question regarding sewer facilities in the area, and the Director of Public Works stated that the sewer would handle this although it was not designed for it. Mr. Swanson moved seconded by Dr. Purdy to approve the Planning Commission recommendation to rezone the property frbm RA Outer Residential to R-3G Garden Apartment Residential for use as a retirement home, providing the property is used only for a retirement home, to revert to RA if not used for retirement home purposes. Motion carried. (See Planning Commission report dated May 1, 1962.) Mr. Chatt moved seconded by Mr. Swanson to approve Item 2 of the Committee report. Motion carried. 2 3. P?ving Tabor, Inglewood to Goodpasture Island Road; Flintridge Court; streets in 2nd Addition to Flintridge; also sanitary sewer in Flintridge Addtion, and 1st and 2nd Additions to Flintridge - Mr. Deverell moved seconded by Mr. Swanson to approve the petition, except that Tabor Street be paved from Inglewood to one lot south of the intersection of T~bor and Corum. Motion carried. Mr. Hawk moved seconded by Mr. Christensen to cut off the paving at Corum Avenue, and to initiate paving of Tabor south of Corum to Goodpasture Island Road to be completed at a later date. Motion carried. 3 4. Diagonal parking, Ford's Dinner House, west side of Moss north of Franklin Boulevard - Mr. Frank Bocci, attorney for Mr. Brailsford of Ford's Dinner House, presented this request. He stated that the patrons of Ford's Dinner House have been angle parking in this area, and the owners desire to clarify the situation. The Brailsfords would paint the parking spaces themselves. A report from the Traffic Engineer stated that Moss Street is a 2-way street, that cars are parking contrary to flow of traffic, the angle park- ing uses 18' of a 42' street, cars are backing into traffic, and there had been complaints. The Committee moved to deny this diagonal parking. Motion carried. 4 5. Bid Opening Improvement Projects - June 4, 1963 - Mr. Swanson moved seconded by Dr, Purdy to accept the low bid on each of the projects. Motion carried. Annexation Gilham Road East - The City Manager pointed out the boundaries of a proposed annexation on an area map and. explained that .the Planning Commission had recommended an election be called. Mr. Chr~sten~en moved seconded by Mr. Hawk to proceed to set a date for an ann~~ation election in -the area. Motion carried, Mr. Swanson voting no. . . . The City Manager again pointed out the boundaries of the proposed annexation in which district an election had been recommended, and on discussion by the Coun~il it was proposed that the northern boundary line be closed in a straight line eliminating an island in the center of the piece recommended ~or annexation. Dr, Purdy moved seconded by Mr. .Crakes to approve the. calling of an election in the district and to correct the northern boundary and make a straight line across the ,northern edge of the area to be annexed. Motion carried, . ' 7. Paving and sanitary sewer in Linnea Pc:rk - 69% - Mt;. Christensen moved seconded by Mr. Swanson to approve the project with the proviso that the _peti.tioner would provide a bond ,to assure payment of entire assessmen~, excluding intersections." Paving Augusta from existing paving at 18th to 26th ~ 31.7% - Dr. Purdy moved seconded by Mr. Crakes to deny the petition. Motion carried. 10. Paving and sewer Pine Ridge Estates - 95% - Mr.Crakes moved seconded by Mr. Hawk to approve the project provided that discrepancies in the survey be resolved ,"prior to the public hea~ing on awar.d of the bid. Moti~n carried. 11. Paving Kincaid, 35th to 36th - 29% - Mr. Swanson moved seconded by Mr. Hawk to approve the project subjectto petitioner's' recording land sale contract. ,Motion carried. 12. Paving City View, 11th to 14th; sidewalk on north side 24th, Polk to . Chambers; sidewalk, 790 East 32nd Avenue - Mr~ Swanson moved seconded by Mr. Deverell to initiate these improvements. Motion carri~d. 13. ,Sewer location 8th Avenue - The City Manager read a letter from Cornell, Howland, Hayes' '&- Merryfiel<f regarding the" proposed location' of' the new -. east-west' sanitary'_sewer trunkline between', High' and Tyler StreeU',- At the time of' the 1961' sewer' study, it~was thought that.7th Avenue would be the best route, requiring less construction and less trench depth. It was thought that the opening of the Interstate No. 5 would substantially lessen recent traffic on 7th Avenue which 'carried eastbound traffic on U. S. Highway 99.
