Mr. Swanson moved seconded by Mr. Hawk th'at the contract for the paving' of Pearl Street
from 24th to 30th and the frontage road on High from 24th Pl to 27th be awarded to
Wildis,h Construct ion Company on the ir low bid price of $87,264.80. Rollcall vote.
Motion carried, Mr. Chatt, Mrs. Lauris, Messrs.' Swanson, Crakes, Hawk, and Purdy voting
aye; Mr. Christensen voting no.
Mrs. Lauris moved seconded by Mr. Swanson that the contract for construction of the
sanitary sewer on 24th Avenue from McMillan to between Olive and Charnelton be awarded
to Northway Construction Company on their bid price of $4,724.50. Rollcall vote. All
councilmen present voting aye, motion carried.
Mrs. Lauris moved seconded by Mr. Swanson that the contract for the constr~ction of
storm sewer in t'he area between 39th Avenue and 39th Place from West Amazon Drive to
Dillard Road be awarded to Northway Construction Company at the Public, Works Department
estimated cost of $3,900.00. Rollcall vote. All councilmen present voting aye, motion
I carried.
Mrs. Lauris moved seconded by Mr. Swanson that the contract for the construction ot
storm sewer on Snell Street from West Rillsilde:DI'ive to Larkwood Street and on Manzanita
Street from north of Sprague Street to south boundary of Pineridge Estates be awarded to
George A. Moore & Associates, Inc. , on their low bid price of $25,150.75. Rollcall vote.
All ,councilmen present voting aye, motion carried.
e Mrs. Lauris moved seconded by Mr. Swanson that the contracts for the construction of
sidewalks on Cal Young Road, Willakenzie Road, and Oakway Road be awarded to the low
bidder on each of the projects, with the sidewalks on' Cal Young and Oakway subject to
final transfer of street jurisdiction from the County, and allowing a flexible comple-
tion date' for the sidewalk on Willakenzie due to fill variations. Rollcall vote. All
councilmen present vot ing aye, motion carried.

1. Airport Commission Report - September 11, 1963
I 1 a. Fixed Base Operator - A proposed lea~e agreement between R. D. Green and
the City of Eugene had previously been referred for recommendation to the
Airport Commission, and the Airport Commission now presented their report
and recommendation on the proposed agreement. Upon a motion by Mr.Gius-
tina seconded by Dr. Hemphill the Airport Commission voted unanimously

to approve the proposed lease agreement between R. D. Green'and the City of Eugene
wherein the City will waive an annual base fee for improvements at the Airport in re-
turn for removal of the exclusive services feature of Green's contract and recommended
Council approval. Mr. Chatt moved seconded by Dr. Purdy to approve'the'proposed lease
agreement with R. D. Green. Motion carried.,
Mrs. Lauris moved seconded by Mr. Swanson that Item la of the Comm~ttee report be

1 2. Basement SprinklercOrdinance Revisions - A draft of the proposed amendment \
to Section F of the Basement Sprinkler ordinanc,e was submitted' to the Council I
for its consideration. Th'e a,mendment would permit, the owner, agent" or other I _"
person having control of certain premises where the Fire Marshal of the City ..,
of Eugene had directed a sprinkle'ring system to be installed to appeal to 1-
the Board of Appeals of the City of' Eugene within certain time limits, and
would further allow the property owner to make a final appeal to the City I
Council if he should feel the decision of the Board of Appeals was nqt to
his liking. Mr. Swanson moved seconded by Mr. ,Deverell to approve-tne pre-
sentation of the proposed ordinance' at tfie regular Council meeting: Motion

2 3. Planning Commission Report - August' 26 1963
a. Variance 3190 Willamette, Hawthorne - The Planning Commission recom-
mended approval of a request for a variance at 3190 .willam'rtte Street
for the construction of an additional living unit in the downstairs
of a residence (previou's request: for rezoning denied and Council re-
ferred back for consideration of' a'variance). Mr. Swanson moved secorided
by Mr. Hawk to ,approve the variance. Motion carried.
3 b. Widening, High,- 6th to 11th - The Planning Commission 'recommended the
street widening of ,High' Street between 6th a'nd 11th Avenues to a'n ulti-
mate width of 44 feet as reque'sted by the Publ'ic Works Department.
Mr. Chatt moved seconded by Mr. Crakes to approve the street widening.
Motion carried.

4 4. City-County Jail - The City Manager read a report from the Lane County Grand 11

the women's and trust'ies' quarters,- (2) recommend'ed mattress covers be used,
and (3) 'that better facilities for Um'ndering bedding be provided. In a

Police Chief explaine,d that the City is now studying the possibility of more

to allow the University to back a truck up to the building. Mr. Chatt

Committee meeting held September 19, 1963:

2 1. City Hall Art Work - Membe'rs 'of the City Council visited the site of the
new City Hall and with the members of the architectural firm of Morin &
Longwood viewed the proposed art work for the new City Hall building.
Council approval of the art work being re'quired according to the terms of
I the art agreement, Mr. Hawk moved seconded by Mr. Crakes to approve the
proposed art work according to the terms of the contract. Motion carried.
Mrs. Lautis moved seconded by Mr. Swanson that Item 1 of the Committee report be ap-
proved. Motion carried.
3 2. Quitclaim Millrace at Patterson Street - A request was presented by
Mr. John Laurila for a quit~laim deed for the north 10 feet of property
owned by the City at the edge of the millrace near Patterson Street. The
City was asked to quitclaim the north 10 feet of their property in return
for which an easement could be given for the maintenance of the millrace
to the City of Eugene. After some discussion by the Council, Mrs. Lauris
moved seconded by Mr. Chatt to approve the quitclaim request in return for
an easement to the City of Eugene subject to the restrictions which would
allow a walkway and for the installation of utilities in this lQ-foot strip.
Motion carried.
Mrs. Lauris moved seconded by Mr. Swanson that Item 2 of the Committee report be ap-
proved. Rollcall vote. All councilmen present voting aye, motion carried.
4 3. Planning Commission Report - September 3, 1963
a. Rezoning i5th and Walnut, Brandt (No.63-ll2 and 63-113) - A request
for rezoning had been made by Mr. John Brandt of Cougill & Hansen,
realtors, for that piece of property owned by the State Highway Depart-
I ment on the southeast corner of Walnut Street and Franklin Boulevard
and East 15th Avenue, and al so property at 2233 and 2243:'East 15th
Avenue. The request was for a change of zone from Public Land to M-l
Limited Industrial and from R-l Single Family to M-l Limited Industrial.
Mr. Brandt outlined the proposal on behalf of his clients and also stated
that a zone change to C-3P would be acceptable, or the M-l Limited Indus-
trial. Mr. Bob Thomas of Birch Lane spoke on behalf of a number of resi-
dents in the area opposing the rezoning request. Mr. Hawk then moved
~ seconded by Mrs. Lauris to uphold the Planning Commission in denying
~ the request for rezoning. On further discussion by the Council, Dr'.Purdy
then moved seconded by Mr. Chatt to table the item. Motion carr'ied.
Mrs. Lauris moved seconded by Mr. Hawk to approve Item 3a Committee action.Motion carried.
Mr. Swanson moved seconded by Mr. Chatt to take the item from the table. Motion car-
ried, Mrs. Lauris voting no.
Mr. John Brandt of Cougill & Hansen, realtors, again spoke promoting the change of zone
from Public Land to M-l Limited Industrial and from R-l Single Family to M-l Limited
Industrial. Mr. Brandt stated again that C-3P would be acceptable also to the Highway
Department, arid he then proceeded to show the proposed layout of the installation, point-
ing out the used car lot, the curb cuts requested, and the proposed location of the
building. '
Mayor Cone arrived at the meeting at this point and assumed the Chair.
I Other opponents of the proposal present were Mr. Bob Thomas, Mr. Warlick, and Mr.Howard
Ramey, a resident in the area.
Councilman Deverell arrived at the meeting at this point.

Senator Fadeley was present and made th.e statement that ,in his knowledge the Highway
Department had not made a request in their budget for new buildings and location for
this area, that he felt there is no urgency in this matter.
Further discussion by the Council relative to the proper, zoning for the area re- .
sul ted in:,'a motion by Mr. Swanson seconded by Mr., Hawk to refer the' matter back to
the Planning Connnission for a report on the best use allowed for this particular
piece of property. Motion carried.
1 b. Filing Fees for Rezoning and Variance Petitions - A reconnnendation from
the staff of the Planning Connnission regarding the change in :the minimum
fees for rezoning pet{tions and variances presented to the Planning Com- -
misiion was, presented to :the Council, with Dr. Purdy moving seconded by 1

1 The subject of placing trees according to the proposed tree plan study was introduced
by Mrs. Laur is, and after some discussion Mrs. Lauris moved seconded by Mr.Deverell
00 to keep in mind the tree plan as the streets are being widened and according to the
plan proposed by the Parks Department. Motion carried.

~ 2 3. Variance Extension, NE corner 13th and Monroe - Mr. and Mrs. Paul H.

:c Cagle request extension of variance allowing ~ive units on property
:0 at 13th and Monroe, originally granted by Resolution No. 888 on
August 27, 1963. Since considerable time had elapsed since the variance
was granted, the Council members wished to view the property again and
orient their thinking on the site, resulting in a motion by Dr. Purdy
seconded by Mr. Christensen to refer the item to the Committee meeting
e scheduled for Thursday, September 26, 1963. Motion carried.
3 4. Easement Vacation, Between Lots 13 and 14, Block 2, 5th Add it ion to
Highland Oaks - The Public Works Department recommended that the
vacation of the easement be approved.
Mr. Chatt moved seconded by Mrs. Lauris to approve vacation of the easement. Motion

4 5. Renewal of Contracts with Rural Fire Protection Districts - Fire pro-
tection agreements were presented for renewal for the period ending
June 30, 1964 with River Road Water District, Wil1akenzie Rural Fire
Protection District, and Eugene Rural Fire Protection District No. l.
Mrs. Lauris moved seconded by Mr. Chatt that the contracts be renewed. Rollcall vot e.
All councilmen present voting aye, motion carried.
5 6. False Reports to Police - The City Manager read a draft of an ordinance
proposed for the benefit of the Police Department in the prosecution of
people giving false reports.
Mr. Chatt moved seconded by Mrs. Lauris to approve the ordinance for future presenta-

6 7. Progress Report Sewer Construction Program- Copies of a written report
on the progress of the sewer construction program by the Public Works
Department were distributed to the Councilmembers (dated September 17,
1963).

I 7 8. Chamber of Commerce Space, new City Hall - The City Manager presented a
revised schedule of rental fees for space required by the Chamber of
Commerce in the new City Hall building which would give a net result of
$341.61 per month rental for a proposed period of five years. Providing
the City is not in need of the space after the 5-year period, the renewal
rate would be negotiated at that time.

space rental in the new City Hall to the Chamber of Commerce. Motion defeated.
8 9. Parking restriction west curb East Amazon Drive, and offsetting center
stripe 14 feet instead of 18 feet - This request was made by the Department
of Public Works to assist in eliminating a traffic hazard at this par-
ticular area.
Mr. Chatt moved seconded by Mrs. Lauris to approve the parking restrictions as recom-
mended. Motion carried.
