Cone present: Mrs. Lauris, Messrs. Chatt, Swanson, Deverell, Crakes, Hawk, was absent. Oregon - adjourned from the Pacific Daylight Time on with the following councilmen and Purdy: Mr. Christensen The invocation was given by Rev. Charles McCarthy, Minister of Education for the First Methodist Church. The minutes of the regular meeting held April 13, 1964, as mailed to members of the Council, were approved. e NEW BUSINESS 1 Mr. Crakes moved seconded by Mr. Hawk to approve the expenditure of $750 from the Civic Emergency Fund payable to Mr. George. Buckley to meet the payment of rent and utilities for the months of Jan- uary through June, 1964, and that Buckley House endeavor to become an authorized agency eligible to participate in United Appeal funds next year. Rollcall vote. All" councilmen present voting aye, motion carried. I 2 The City Manager read a letter of appreciation from W. Riley Matsler thankIng the Council, Mayor, and staff for the co-operation and assistance he had received over the years in carrying out the operation of the Parks and Recreation Department. The City Manager then read a letter signed by the Mayor and each member of the City Council in appreciation of the efforts of Mr. Matsler in behalf of the City of Eugene and the Parks and Recreation Department. 3 A proposed agreement between the City of Eugene and Lane County for the furnishing and operation of a Police Department crime laboratory in the new City Hall was submitted. Mrs. Lauris moved seconded by Mr. Chatt that the City Manager and City Recorder be authorized to sign the agreement for the City of Eugene. Rollcall vote. All councilmen present voting aye, motion car- ried. 4 Progress payments were presented as follows: Tab Products Co. 1st - City Hall furnishings $ 1,035.90 Chapman Bros. 2nd - City Hall furnishings 7,186.65 Johnson Furniture Co. 2nd - City Hall furnishings 6,048.90 I Paul Construction Co. 1st - Remodel tower building, Airport 2,321.10 Mrs. Lauris moved seconded by Mr. Chatt that the progress payments be approved and proper City offi- cials authorized to draw the necessary warrants. All councilmen present voting" aye, motion carried. e COMMITTEE REPORTS Committee meeting held April 16, 1964: "Present: Councilmen Swanson (presiding), Christensen, Deverell, Crakes, and Purdy; City Manager; City Attorney; Assistant City Manager; City Recorder; Director of Pub- lic Works; and others. 5 1. Eaton Drive Dedication - The City Manager stated that the Public Works Department had recommended the ded[cation of a 30-foot strip of land in the vicinity of Long- view Street and Eaton Drive between the Babb and Snellstrom properties. Mr. Harold D. Gillis, appearing before the Committee of the Whole in behalf of Mrs. Babb and Mr. Snellstrom, protested the proposed dedication of Eaton Drive. The Director of Public Works stated that there is some question concerning the ownership of the area proposed for dedication and, after furfher discussion by the Coun~il and a question to the City Attorney, Mr. Deverell moved seconded by Dr. Purdy to insti- tute proceedings to quiet title on the 30-foot strip. Motion carried. ;1 I Mrs. Lauris moved seconded by Mr. Chatt that Item 1 of the Committee report be approved. Motion car- ried. 6 2. Curb Cut, 1831 Kincaid, Wood - Mr. Hugh B. Wood of 298 Ridgewood Drive requested an oversize curb cut at 1831 Kincaid Street. The Department of Public Works recom~ mended denial. Council members having viewed the location of the requested curb cut, Mr. Christensen moved seconded by Mr. Crakes to deny the application for the extended curb cut. Motion carried. e .~ .~ r2 e 4/27/64 Mr. Hugh Wood was present and outlined his proposal for the improvement of his property at 1831 Kincaid Street relative to proposed building construction and ut ilizat{on of the parking area and the need for the oversize curb cut of 45 feet he had requested instead of the present '12-,foot cut. On discussion. by the Council, the question was asked of Mr. Wood if. a 5-year period would, be suff.icient :for him to com- plete the .entir~' projeci as he had outlined"it, and if he would ~e ag~ee~ble to ~igning a~ agree~ent with the City for the comple.tion' or the project. Upon receiving an affirmative ansy.rer, Mr'. Chatt moved sec,onded by Mrs. Lauri's tog1;"ant the oversize curb cut. as requested 'providing" Mr ~ Wood signed an agreement with the City of the development of the project as he had' out1l.ned.it over the' 5-yeC;lr' period. Motion carried, Mr. Swanso~ voting no. I 1 3.' Parking Prohibition, west side 01 Baker Boulevard from 28th north - Mr. Robert' J. Reilly ~ of 2794 Baker Boulevard requested that the recently-installed parking prohibition on the west sid~ of Baker Boulevard from 28th north be repealed. ,However, since. the prohibition affects 'other resident's of the area who were not present a't the meeting, it was recom- mended that, and moved by Mr. Christensen seconded by Mr. Crakes to hold the item to . another meeting and give other people in the area involved an opportunity to be heard. Motion carried. e 2 4. Curb Cut, 21st and Olive, Rams"t,ead - Du'ring construction w,ork at Mr. Gordon Rams,tead's' prope'rty at 21st and 'Olive, the 'curb. had not been 're'placed', a.nd .the application 'for a permit ha.d not been written. The Council had viewed th.e prop'ert'y, and' Mr. Christensen moved sec'onded by Dr. Purdy that the Public Works' Department start proceedings to re'- place the curb and assess the cost of the installation against Mr. Ramstead's property. Motion carried... I 3 5. Planning Commission Report' - March 23, 1964 . a. AnnexatTon, Garden Way' Area, Braa'tz-Ruhenst'ein '-. The Plan'ning Commission had recommen'ded approval of the a'nnex,atio:n of an ar.ea south of Harlow R,ciad and west of Interstate 5 on both side's of Garden Wa'y, but excluding the'Vincent property on Honey,suckle .Lane inasmuch as its inclu,sion would creat.e a small one-lot island dUll,out'side the City., Mr. Dev,erell mov'ed sec'onde'd by Dr.Purdy to approve the annexation as recommended by the Planning Commission whicn ex- cludes the Vincent property. Motion carried. Mrs. Lauiis moved sec'onded by Mr. Chatt that Items 3, 4, and 5a o'f the Commit'tee re"pcirt be approved. Motion carried. 4 6. Abatement, 1601 West 7th, 660 and 676 Fillmore, Collins2- An extension on the original abatement order on the buildings at the above locations .from January 13, 1964.to April 1, 1964 had expired with no action having been taken by th~ owner. . The ~~per- i"nten'dent of Building Inspection recommended that 'the City proceed with the abatemeu"t'- Mr. Christensen moved seconded by Dr. Purdy to approve the abatement proceedings. Motion carried. . Mr. Collins was present at the meeting and stated that he had completely torn out ~he faulty wiring and had made other improvements and now felt that his property meets the. building depar,tment.,'regula- tions ana asked if another inspection could be made. Mr. Swanson moved 'seconded by Mr'-Chatt that Item 6 of the Committee report be held over for 30 days. Motion carried. I Mr. Coll~ns w~s informed the building department would make 'another inspection of 'his premises. 5 7. Building Code Amendment, Door Closers - The Eugene Spr~ngfiela Home .Builder~ Associa~ tion had suggested the removal' of the requiremerit for closers on doors fran 'house to garage. The Bui~ding Department recommended deletion of the requirement from the Code, and Dr. Purdy moved seconded by Mr. Crakes that the door closer requirement be deleted from the Building Code. Motion'carried. e Mrs. Lauris moved seconded by Mr. Chatt that Item 7 of the ~ommittee report be approved. Motion car- ried. 6 8. Tele-Trip Co.,Inc., Lease, Mdhlon Sweet - The City Manager presented a proposed agree- ment between Tele-Trip Co.,Inc., and the City of Eugene concerriing sale of flight in- surance t,hrough coin-op,erated v:ending ma,c hines and over-the-counter issuance of policies 'at the new tet~inal briildirig at Ma,hlon Sweet Airpqrt: Tele~Trip will pay' to the City of Eugene ori a 'monthlybasis 13% ofa,ll insurarice'premi,ums plus $l~ per month per coin-operated machirie (maximum two). Fire Trucks. Lane County Museum The "City Manager read 'a leeter from the Lane County Museum requesting the donation by the City of Eugene to the Museum of two pieces of fire fighting equipment which will be retired from servi~e.in the very near future. Mr. Christensen moved seconded by Dr. Purdy. 'to appro've .the dona'tion of these :two pieces' of 'apparatus .to the Lane County Pionee~ Museum. Motiori carried. I e ~ ~ u e 4/27/64 I The City Manager read a letter from Mr. ~at Flynn, president of the ~ugene Firefighters Association, stating they are interested iQ obtaining the ladder truck now based at th~ Airport, to maintain it in running order, and, in co-operation with the Lane County Museum, to provide a place for storing the apparatus. Since the Lane County Museum is also interested in obtaining the equipment, Mr. Swanson moved seconded by Mr. Chatt to refer. the i.tem to the staff for a recommendation. Motion carr:ied. 1 10. Stop Signs, 37th and Donald - The City Manager and the Public Works Department had received several Qbjections to the previously-authorized removal of stop signs lo- cated at the intersection of 37th Avenue and Donald Street. The Traffic Engineer stated that a traffic count is being taken at the corner, and Mr. Christensen moved seconded by Mr. Crakes to withhold removal of. these stop signs pending.a report from the Traffic Engineer. Motion carried. 2 11. Emerald National Bank, Depository - A request had been received from the Emerald National Bank for consideration as a legal depository for City of Eugene funds, stating the Bank is now in a position to pledge U. S. Government bonds to cover any deposits which the City may make. Mr. Christensen moved seconded by Mr. Deverell to approve the Emerald National Bank as a depository for City of Eugene funds according to the laws of the State of Oregon. Motion carried. e Mrs. Lauris moved sec.onded by Mr. Chatt that Items 10 and 11 of the .Committee. report be approved. Motion carried. I 3 12. Rodeo Association, Street Cleaner and Flusher - The Rodeo Association requested the use of a City sprinkler and street cleaning equipment at the rodeo grounds during rodeo week. Mr. Christensen moved seconded by Mr. Crakes to approve the loan of. the equipment providing a recQrd is kept so the City will know the cost of the opera- tion. Motion carried. Mr. Chatt moved seconded by Mr. Crakes to allow the loan of the equipment to the Rodeo Association pro- viding the Rodeo Association pays for the operators' time and cost of water used. Motion ca~ried. 4 13. Paving Leigh from north boundary 2nd Addition Randall Subdivision to existing paving on Leigh (approximately 180 feet south) - A petition was receiv~d ~or this improye- ment.signed by owners of 100% of the abutting properties. Mr. Deverell moved seconded by Mr. Crakes to approve the petition. Motion carried. 5 14. Paving and sewers in Whitwood Addition - The petition carried the signatures of owners of 100% of the properties to be assessed. Dr. Purdy moved seconded by Mr. Deverell to approve the petition.for paving and sanitary sewers. . Motion carried. 6 15. Paving Calvin Street from Elwing Street to south in 1st Addition to Mountain Vista - This petition for paving carried~gnatures of owners of 100% of abutting properties to be assessed. Mr. Deverell moved seconded by Mr~ Crakes to approve the petition. Motion carried. I 7 16. Paving and sewers in replat of Lots 6 and 7, Block 6, Sunny Hollow This petition for paving and sanitary sewers carried signatures of owners of 78.8% of properties to.be assessed, but would require a 6-foot easement for construction purposes. It was recommended that the owner should furnish a temporary construction easement. Mr. Christensen moved seconded by Mr. Crakes to approve. the petition for paving and sanitary sewers providing a temporary construction easement is obtained. Motion carried. e 8 17. Segregation of Assessment, 40th & Hilyard, Carlton - Mr. Bill Carlton requested segregation of assessment against property at the northwest corner of 40th and Hilyard, for paving and sewers on 40th from Willamette to Hilyard and paving Hilyard. The total assessment is $1,610.77, and Mr. Carlton desires to make two parcels - one 70'x819.35' with an assessment of $587.03, and one 108.7'x89.35' with an assess- ment of $1,023.74. Mr. Christensen moved seconded by Dr. Purdy to approve the segregation request. Motion carried.1I Mrs. Lauris moved seconded by Mr. Chatt that Items 13 through 17 of the Committee report be approved. Committee meeting held April 23, 1964: I "Present: Mayor Cone; Councilmen Chatt, Swanson, Christensen, Deverell, Crakes, Hawk, and Purdy; City Manager; Assistant City Manager; City Attorney; City Recorder; Director of Public Works; and others. 9 1. Double Wall Construction ~ The Superintendent of Building Inspection submitted copies of the Building Code sections pertinent to the double wall construction topic, point- ing out the sections which would be amended or deleted, and a letter of recommendati9n was also submitted in which it was pointed. out that Sections 2507.and 1707 would seem to be adequate to obtain a weathertight building and to prevent deterioration. The Superintendent of Building Inspection recommended that the amendments be made to the e II L. ~4 / e 4/27/64 present Building Code. the Code as outlined. Dr. Purdy moved seconded .by :Mr ..Swanson to :adopt the changes to. .Motion carried, Mr. Christensen voting no. I 1 2. Planning .Commission Report. -April 7,: 1964 a. Rezoning to .M-2 both sides of Cross Street between Bertelson Road and Waite Street, Sutley (64-020) - Andrea A. Sutley had requested .the change of zone fran RA Outer Residential to M-2 Light Industrial, and the Planning Gommi~sion had recommended approval of the request. Motion made.by Mr. Chatt seconded by Mr. Hawk to approve the zone change. Mot~on.carried. Mrs. Lauris moved:seconded by Mr. Chatt that Items 1 and:2a of the Committee report be approved. Motion carried. 2 b. Rezoning to C-3P area on 6th between Polk and Tyler, Eugene Ambulance (64-041) - This :item was withdrawn fran the agenda on the request ..of the petitioner, Mr. Bill Leonard of Eugene Ambulance. e Mrs. Lauris moved seconded by Mr. Chatt that Item 2b of the Committee report be received and filed. Motion carried. 3 c. Rezoning to C-3P:westside:ofOak Street between 28th. and 29th, Mikesell (64~038) - Wilbur B. Mikesell had requested change of zone from R-l Single Family Residential . to C-3P Commercial. The Planning Commission recommended approval of the zone change. subject to:completion of a performance .sgreement for buffer:ing.the east side of the property in the same manner as Eugene Hardware~ Mr. Chatt moved. seconded by Mr. Swanson to approve the recommended zone change with the completion of the agreement for buffering the east side of the property. Zoning Ordinance Amendments:reR-2 and R-4:requirements - The Planning Commission recommended approval of amendments to Zoning Ordinance 10691 with regard to single . family residential use. in R-2 zones (Section. VII, A. Use), and r.educing from 300 sq.ft. to 200 sq.ft. the area requirement for each occupant of fraternities, sororities, dormitories, aRd bbardi ng houses in R:..4 zones (Sec~ion IX, E.Area)..: Mr. Deverell moved seconded by Dr. Purdy to approve. the amendment with regard.to R-2 Two Family Residential zones. Motion carried. After some discussion on the R~4 Multiple Family amendment, Mr. Deverell moved seconded by Mr. .Chatt to approve the amendment. Motion carried. Mrs. Lauris moved seconded by Mr. Chatt to approve Item 2d of the Committee report. Motion carried, Mr. Crakes.voting no.. 5 e. Variance to allow CR use, including beauty school, at 1342 and 1350 Chambers, Clarke (64-032) - The Planning Commission recommended denial of the request of Dr. Clifford R. Clarke for a variance to allow moving his dental office to a residence at 1342 Chambers Street and. reriting the dental. office at. 1350 Chamb~rs for allowable uses in CR zones, including a beauty school. Mr.. Dave Andrews, representing the owner; spoke briefly in behalf of the petition for ~he variance. After some further discussion, Mr.: Swanson moved seconded by Mr. Deverell to up~ hold the recommended denial. Motion carried. . After discussion by the Council, Dr. Purdy moved seconded by Mr. Crakes to refer the item back to the Planning Commission for further con- sideration. Motion carried. 7 g. Variance to allow beauty shop at 1507 Coburg Road, Armstrong (64-037)- This was a request for a variance to allow a beauty shop with a single operator in a home at 1507 Coburg Rbad in an RA Outer: Residential zone. The Planning Commis- sion had recommended denial of the request, but on further discussion by the Council, Mr. Chatt moved seconded by Mr. Deverell to gran~ the variance. Motion carried.. : I 8 h. Planning Commission Report - April 13, 1964 a. Variance to allow two less parking spaces than required in R-4 zone at 1442 East 18th Avenue, Council (Bernik) (64-042) - On an appeal flUm a Board of Appeals de- cision regarding construction of an apartment house by Gary Bernik at 1442 East 18th Avenue, the Council had initiated a request for Planning Commission con- sideration of a variance which would allow two less parking spaces than required in an R-4 zone at this address. The Planning Commission had recommended ap- proval of the variance. The Council at its April 13, 1964 meeting, on verbal report from the Planning Commisson, had also approve9 the variance and passed a resolution at that meeting putting it into effect. Mrs. Lauris moved seconded by Mr. Chatt to approve Item 3a of the Committee report. Motion carrieq, Mr. Swanson voting no. b. Annexation of area on Centennial Boulevard, Chase (64-037) - This was a 100% con- sent petition for the annexation of an area south of Centennial Boulevard near Chase Gardens, and the Planning Commission recommended approval. Mr. Chatt moved seconded by Mr. Hawk to approve t~e requested anne~ation. M~tion carried. c. Annexation area west of Agate, south of 30th, Warren, Bayly, et al (64-023) - Mr. Chatt moved seconded by Mr. Deverell to approve the petition for annexation under the triple 2/3rds provision upon the recommendation of the Planning Commis- sion. On discussion, the Director of Public Works stated that a trunk sewer would have to be constructed through Laurelwood Golf Course to reach this property, and a letter was on file from Philip Tillman stating he had a recorded sewer easement through the Golf Course property which he would transfer to the City provided the City would construct the ~runk sewer. With the approval of the second, Mr. Chatt withdrew his motion. ," J Mr. Swanson moved seconded by Mr. Chatt to refer the item to the staff for fur- ther investigatio~ and recommendation. Ex officio Council member to represent University students - The City Manag~r read a letter from John Luvaas, Jr., Senator-at-Large of the Associated Students of the University ot Oregon, asking the Mayor and Council toconside~ the appointment of an ex offici? 'Council member who would represent the Student Body of the University of Oregon. The members of the Council gave approval to the idea of appointing an ex officro member from the Student Body to attend Council sessions. However, upon fur- ther'discussion of the idea by Councilman Hawk and others, Dr. Purdy moved seconded by Mr. Swanson to refer ~he item to the staff for a recommendation. Motion carried. Mrs. Lauris moved seconded by Mr. Chatt to approve ,Items 3b, 3c, and 4 of the Committee report. Motion carried. 5 5. Sewer Service Charge - Mr. Ralph Roderick of Cornell, Howland, Hayes & Merryfield ex- plained the revised sewer service charges regarding charges for ,u1tiple housing units, including dormitories, etc., and some commercial rates. Mr. Swan~oQ moved seconded by Mr. Hawk to approve the ad opt ion of the new rates as recommendeq.'" Mot ion carried. Mrs. Lauris moved seconded by Mr. Chatt to approve Item 5 of the Committee report. Resignation Banks from Planning Commission - Mayor'Con~ announced that Walter Banks had resigned as a member of the Planning Commission due.to ill health. Mr. Hawk moved seconded by Mr. Crakes to accept the resignation and send Mr. Banks a le~ter of thanks for his work on the Planning Commission. Motion carried. Mrs. Lauris moved seconded by Mr. Chatt to approve Item 6 of the Committee repor~. Motion carried. 7 7. Appointment Library Board. Keever - The Mayor also an~ounced the appointment of Mrs. J. C. Keever, 2137 University Street, as a member of the Library Board for the balance of the term ending January 1, 1965, replacing Mrs. Frank Forney, re- signed. Mrs. Lauris moved seconded by Mr. Chatt to approve the appointment of Mrs. Keever as a member of the Library Board for the term ending January 1, 1965. Motion carried. 8 8. Paving alley" between Lincoln and Charnelton, 13th and-14th - This request'for paving' the alley was signed by owners of 53% of the total front footage of properties to be" assessed. However~ the City Engineer stated there i~ a s~nitary sewer in-the alley which .should be reconstructed. The Council requested that this item be held over until they could view it. I 3 11. EWEB~ElPaso Natural Gas Exchange of Properties - The Eugene Water & Electric Boa~q: requested execution of . a bargain a~d sale:deed'conveying to El Paso Natural Gas' Company certain properties alo~g Interstate 5 between the Beltline Road and Q Street in exchange for properties in the same area for right-of-way purposes. The exchange of properties is'covered:by a~ agreement between the two parties dated September'lO, 1962.
