Cone with the fol- lowing councilmen present: Mrs. Lauris, M~ssrs. Chatt, Swanson, Christensen, Deverell, Crakes, "and Purdy. Mr. Hawk was absent. Since the minutes of the regular meeting held May 11, 1964 were not, mailed to Council members, Mrs. Lauris moved seconded by Mr. Chatt to dispense with action on them. Motion carried. e NEW' BU SINESS 1 Proclamation - Canvass of votes cast in May 15, 1964 primary election showing the fol- lowing results was presented and read in full: Yes No I Measure No. 51 - Charter Amendment for Voter 7,010 14,700 Approval Use of Parks- Measure No. 52 - Charter Amendment for Repealing Limitations on Controlled Access Streets 12,038 9,303 Measure No. 53 - Charter Amendment for Authorizing Sewer Improvements and Bonds 16,694 4,700 Measure No. 54 - Charter Amendment for Authorizing Parking Facilities and Revenue Bonds 9,586 11,855 Measure No. 55 - Charter Amendment for Authorizing Penalty Increase for Ordinance Violations 11,708 9,390 Mrs. Lauris moved seconded by Mr. Chatt to accept the canvass of votes as read. Motion carried. 2 Councilman Swanson inquired whether the traffic situation at 29th and Willamette intersection and vicinity had been reviewed and whether any recommendation was ready to be made by the staff. The Traffic Engineer reported that the final tabulation of traffic count would be ready next week. 3 Mr. Swanson also, stated that the ingersections of Chambers and 18th, Chambers and 13th, Friendly and 18th, and Jefferson and 18th should be reviewed with the possibil- ity of establishing right-turn lanes at those points. I 4 Mr. Swanson also inquired' concerning the use of Electronic Data Processing equip- ment being purchased by Lane County by other governmental agencies. Also, that equip- ment being purchased by Eugene Wat,er & Electric Board being used by other governmental agencies. e 5 Mr. Swanson commented that the City of Eugene should take advantage of the pro- posal of a number of the businessment to form a group inthe downtown core area to work toward better parking an~ traffic situations. In this connection, Mr. Poticha ~ the Architects Association, said there is mctually more involved than parking in the down- town area. He asked the Council to again allow the architectural group to present their plan for total improvement of the downtown area. In this connection, Mr. Poticha was advised that perhaps his grou~ could present its project at the Thursday, May 28, 1964, Committee meeting, 6 Planning Commission Report - May 18, 1964 ,1. Variance to allow beauty shop in residence at 1507 Coburg Road, Armstrong (64-037) - The Council at its April 27, 1964 meeting had approved a variance, but the Planning Commission's recommendation was to deny it. Referred to a joint meeting of.tne Council and Planning Commission, the item was recommended to be tabled b~the Planning Commission. I After some discussion by the Council, Mrs. Lauris moved seconded by Mr. Chatt to permit the variance as requested with one operator and that there be no signs. Rollcall vote. All councilmen present voting aye, motion carried. 3 An application for Class A Restaurant liquor license' was submitted by William W.Y. and Ada O.L. Lee dba England Grill, 797 Willamette Street, as approved by the Police Department. e Mrs. Lauris moved seconded by Mr. Chatt that the application be approved. Motion carried. COMMITTEE REPORTS Committee meeting held May 14, 1964: "Present: Mayor Cone; Councilmen Lauris, Chatt, Swanson, Christensen, Deverell, Crakes, Hawk, and Purdy; City Manager; City Attorney; Assistant City Recorder; Director of Publ ic Works; Traffic Engin'eer; Superintendent of Building Inspection ; Fire Marshal; and others. I 4 1. Variance in Fire Code Requirements, Youth Study Board Building on Garden Avenue, Furtick-Weaver - James H. Weaver and Donald R. Furtick requested a variance in the Fire Code requirements of the Building Code concerning the use of wire glass windows as opposed to colored glass windows and the length of corridors in the Lane County Youth Study Board building under 5/25/64 - 2 e Ii II t~ r32 e 5/25/64 I / construction on Garden Avenue, with an 8~fqot setback wh~re a 10-foot set- back is required for use of colored windows and longer corridors., The Superintendent of Building Inspection stated that this requ~st is not a matter, of interpretation of the Code requirements or, a proposal 'for the use of: alternate materials and types of construction. Mr. Christensen moved seconded by Mrs. Lauris to deny the variance. Mr. Furtick stated that the Code could not possibly cover all. ,circumstances. The Fire Marshal said that the National Board of Fire Underwriters pays particular attention to how cities enforce their building codes. The .City Attorney explained that the Building Code provides minimum s,tandards of safety to prote~t the public. A Board of Appeals is prov{ded for in the Bulldihg Code,'but there is no provision for taking an ap~eal concerning Building Code enforcement from the ~oard of Appeals to the Council. The Sign Co. stated they felt it would be a definite 'disadva'ntage ,to,- the Steak ,House, if the sign were placed completely inside the property line, and that if 'need be in the future the sign would be removed at no cost to the City upon the City's request.' The Public Works Department poInted out that if the sign is allowed where requested, it'would be located within the street right-of-way, and that although the City has allowed slgns'within setback areas, it has not been the policy'to allow them in street right~-of~way. ,Mrs. Lauris moved seconded by Mr. Chatt to deny the requested variance. Civil Defense' Emergency irepa'redness C.onferen~e - The City Manager read an announcement-concerping an, Emergency Prepareqness Conference to be held by the State Divisiop of Continuing Education in Harris Hall on.' May 27, 1964. I 3 4. Stop Signs, 37th 'and Donald - The tity Manager recommended retaining the stop signs at 37th Avenue and Donald Street and the installation'of marked crosswalks at that intersection with' proper -Warning signs. The. Manager added that this re<;oj1IDlendation did not agree with the report of the Traffi~, Engineer. Annexation 52nd and Willamette, Associated Properties (64-059) The Planning Commission had recommended approval of the 100% consent petition for annexation of an area' north of 52nd Avenue and,west of Willamette Street. B~ley et al - Linn Buley, Stewart Elder, and Mrs. Robert G. Beckley, owners of 100% of the property fronting on the portion of City View petitioned for'vaca- tion, will dedicate right-of-way for street purposes to replace the portion vacated and to provide a connector to 27th Avenue. The Public Works Department recommended approval of the requested street vacation, as did the Planning Commission. Mrs. Lauris moved seconded by Mr. Chatt to approve the requested vacation." Renaming certain streets..north 'of Ferry Street Bridge - Both the Public Works Department and the Planning Commission recommended nam- ing streets just north of the Ferry Street Bridge as follows: (1) Country Club Road - That road which is an extension of Country Club Road and connects Country Club Road under the Ferry Street Bridge with Centennial Boulevard. (2) Club Road - That part of the old Country Club Road and patt of the new road which connects Country Club Road with Coburg Road (3) Southwood Lane - The frontage road which connects Oakway Road and Country Club Road (4) Centennial Boulevard - From Coburg Road to the east It was also recommended,that the name "Coburg Road" be given that portion of the street which extends south over Ferry Street Bridge and the overpass to 8th Avenue and Mill Street. Dr. Purdy moved seconded by Mr. Hawk that the street name recommenda- tions be approved. Motion carried. 3 6. Appointment Relocation Committee - Mr. Christensen moved seconded by Dr. Purdy that Mrs. Lauris be appointed as a member of' the Relocation Committee (Housing Authority Low-Rent Housing project), Motion carried. 4 7. Housing Code Enforcement - The City Manager reported that the cost of hiring an inspector to enforce Housing Code regulations would be ap- proximately $6200 per year, including rentat of equipment and other City costs. He also stated that hiring this inspector would meet the re- quirements of the Housing and Home Finance Agency with regard to re- certification of Eugene's Workable Program. The Manager said he wished to explore the matter further before making a definite recommendation. 5 8. Budget 1964-65 - Mr. Chatt moved seconded by Mrs. Lauris to set June 22, 1964 as the date for a public hearing on the 1964-65 budget.' Motion carried. 6 9. Paving and sanitary sewer within replat of Lots 24.25.28. 2nd Addition Sunny Hollow (West Amazon Court from West Amazon Drive to the west-Cummins Park) - A petition from owners of 100% of the property to be assessed for this paving and sanitary sewer was recommended for approval on a motion by Mrs. Lauris, seconded by Mr. Christensen. Motion carried. Mrs. Lauris moved seconded by Mr. Chatt to approve Items 3 through 9 of the Committee report. Motion carried. 7 10. Curb Sidewalk Location 38th Avenue from Hilyard Street to West Amazon Drive - Owners of 63% of abutting property petitioned for location of the side- walk at the curb on 38th Avenue between Hilyard Street and West Amazon Drive. There was no recommendation for curb sidewalks at this location because of the terrain. There was a discussion regardl.ng policy for granting requests for curb sidewalk locations. Mr. Chatt moved seconded by Mrs. Lauris that the request be granted. Motion defeated. Mr. Christensen moved seconded by Dr. Purdy to ask the Planning Commission to review the policy on location of sidewalks. Motion carried. Mr. S; L.
