HomeMy WebLinkAbout08/24/1964 Meeting 11~ e 8/24/64 I Counc i1 Chamber Eugene, Oregon August 24, 1964 The adjourned meeting of the Common Council of the City of Eugene, Oregon - ad:" journed from the regular meeting held on August 10, 1964 - was called to order at 7:30 p.m. PDT on August 24, 1964 in the Council Chamber by His Honor Mayor Edwin E. Cone with the following councilmen present: Mrs. Lauris, Messrs. Chatt, Swanson, Christensen, Deverell, Crakes, Hawk, and Purdy. The invocation was given by Rev. Walter Berton of Our Redeemers Lutheran Church. e The minutes of the Council meeting held August 10, 1964, distributed to members of the Council, were approved. NEW BUSINESS 1 Councilman Swanson stated that the~e seemed to be an increasing number of traf- fic accidents during the last several weeks in the City of Eugene, and asked the I staff if there is any effort being made to reduce the number through traffic control and enforcement. The Traffic Engineer stated that investigation is made of all traf- fic accidents with a view to installing preventive measures, and that the reports of several of the recent accidents revealed that they were caused by failure to yield the right-of-way either to a pedestrian or to another vehicle. 2 Mayor Cone then asked if there had been anything done in relation to the noise made by Honda motor bikes in view of the anti-noise ordinance. The City Manager ex- plained that the City had recently purchased a noise meter, but the device had not been used by the Police Department as yet in traffic enforcement. However, at the present time, members of the Police Department are being instructed in the machine's use. 3 Councilman Purdy inquired whether anything further had been done in relation to telephone solicitation, and was advised by the City Manager that a report would be made in the very near future. 4 The City Manager read a letter, addressed to Mayor Cone, from Mayor Lee of Chinju, Korea, in which Mayor Lee thanked Mr. Cone and the people of the City of Eugene for his wonderful reception and the hospitality shown him on his visit to Eugen e. Mayor Lee was very appreciative of having the opportunity to attend the I dedication ceremony for the new City Hall and the privilege of speaking a few words to the citizens of Eugene. 5 This being the date set for the award of contracts for various improvement proj- ects, the following tabulation was presented of bids opened August 18, 1964: . With regard to paving and sewer within Southwood Addit~on, the Public ~orks recom- e mended deletion of the sidewalk item which listed a $40 per sq.ft. cost. Mrs. Lauris moved seconded by Mr. Chatt that the contract be awarded to the low bidder on the project, and that the sidewalk item be deleted from the job. Rollcall vote. Mrs. Lauris moved seconded by Mr. Chatt to pay the Dobsons $1500 for the property. Rollcall vote. All councilmen present voting aye, except Mr. Crakes voting no, motion carried. 1 An application for an auto wrecker licepse was submitted by Friendly Dodge, Inc. , 77 West 11th Avenue. Mrs. Lauris moved seconded by Mr. Chatt that the application be approved. Motion carried. e COMMITTEE REPORTS Committee meeting held August 20, 1964: "Present: Mayor Cone; Councilmen Lauris, Chatt, Swanson, Christensen, Deverell, Crakes, Hawk, and Purdy; City Manager; Assistant City Manager; City Attorney; City Recorder; Director of Pub- I lic Works; and others. 2 1. Fluoridation of Water Supply - The City Manager read a letter addressed to Mayor Cone from Dr. Robert Cougill, president of the Lane County Dis- trict Dental Society, requesting that the Mayor and Council place a meas- ure on the November 3, 1964 ballot which would authorize the Eugene Water & Electric Board to add fluorides to the City's water supply. Mr. Swanson moved seconded by Mr. Crakes to authorize placing such a measure on the November 3, 1964 ballot for the City of Eugene. Motion carried, Mr. Christensen voting no. Dr. Purdy moved seconded by Mr. Crakes to approve Item 1 of the Committee report. Several people present protested that they did not wish to see the fluorides added to the water, that the people of Eugene had twice turned down the proposal. Several people also spoke in favor of the addition of fluorides, including Mr. B. 1. Claska and Dr. Brinton. The City Manager a~so read a letter from the Eugene Water & Electric Board which stated that the Board had voted in favor of adding fluorides to the water and that the approximate cost per person per year would be $.13. A vote was taken on the motion, and the motion carried, Mrs. Lauris and Mr. Christen- sen voting no. 3 The City Manager asked the Council .if they would be in favor of issuing a voters I pamphlet listing the ballot measures for the November 3, 1964 election, stating that the approximate cost for printing and mailing would be $1500. Mrs. Lauris moved seconded by Mr. Chatt to authorize publication and mailing of a voters pamphlet for the November 3, 1964 election. Rollcall vote. All councilmen present voting aye, motion carried. 4 2. Millrace - Mrs. Lauris brought up the question of improving and clean- e ing the millrace so that the area along the banks could be improved and a pathway provided for pedestrians and/or bicycles. Also, that certain areas on the banks of the millrace be provided for th~ use of tourists and others who wish to use them for relaxation. Mrs. Lauris then moved, seconded by Dr. Purdy that the staff make a cost estimate of the amount required to make these improvements and to acquire any necessary easements to assure public use of the area along the millrace banks. Motion carried, Mr. Swanson voting no, Architect Otto Poticha stated that the architectural group would be happy to work with the Council on this matter and would bring back to the Council for discussion their previous plan for improvement of the millrace area. Mrs. Lauris moved seconded by Mr. Chatt to approve Item 2 of the Committee report. Motion carried. I 5 3. 6th and 7th Avenues - As the first phase of a plan to solve the traffic problem on 6th and 7th Avenues, the City Manager recommended that 6th and 7th Avenues be widened to 52 feet from High to Lincoln Streets, and that'curb parking be removed from 6th and 7th Avenues from Lincoln Street westward. This plan would remove only two trees from the parking areas 8/24/64 - 3 e ;, t.. II r116 e 8/24/64 -, --~_...---- - I and would provide three mpving lanes of traffic with some parking left in the downtown core area on one side of the streets. On discussion by the Council, it was suggested' that sin'ce' the. members cif the audience were very much interested in this quest:ion, the Council vote on' the plan, giving some indication as to their thinking. Mr. Swanson moved seconded by Dr. Purdy to appr~ve the proposal as out- lined by the City Manager; motion carried, Mr. Christensen and Mr.: Crakes voting no. On the Mayor', call for di,cu.'ion of the motion, member, of the aud~e Groef!t~1 including Messrs. Poticha, Coburn, Mather, Peterson, Boetling,--and-Mrs. e Lester Reed, and others expressed their opinions as to why they thought this plan should not be implemented. Objections were raised to the widening of the streets, to removal of any trees, and to the removal of parking. Several questions were asked by members of the audience 'and were: answered by the City Mahager' and Traffic Engineer'. Mrs. Veola Wil- mot suggested that perhaps parking could:be removed from these two , r streets for a: period of six months or more: during which time'?~study I could be made to see if thi& would help the tr~ffic movement. Mr.Archie Weinstein stated he is in favor of the proposed plan and answered a question from another member of:the audience concerning the use of a proposed assessment district in:the affirmative; that he had talked ~o several people who seemed to be in favor:of this ,method of improving: the parking: situation on West 6th and 7th Avenues. Mayor Cone then suggested that the matter would again come up for final actioI1 at the regular Council meeting on:Monday evening, August 2'4,1964. Mrs. Lauris moved seconded by Mr. Chatt to approve the plan proposed by the staff and to present it to the Oregon Stabe:Highway Depirtment for their approval and participa- tion to the extent of 75% of the cost of widening 6th and 7th Avenues between High and Lincoln Streets, and the:removal of certain parking; , On call for discussion, several people in the audience:again voiced their opinions with arguments being given both pro:and con. Mr. Archie Weinstein read a lengthy prepared:speech in which he outlined the incidents over a period of several years relating to parking in the downtown area and what had happened in the various 'com- mLttees which had endeavored to solve the problem. He also recommended that the City use:the tOQl which it has .in the way of the Banctoft Bonding Act:to institute park- ing districts. . A vote was taken on the motion, and motion cartied. Realignment C-3P zoning Coburg and Cal Young Road, Safeway Stores '- The Planning Commission recommended approval of realignment of the C-3P zoning for the area located west of Willakenzie Road as dedicated north of Cal Young Road as follows:: :C-3P to be extended westerly to the westerly right-of-way line of the relocated Willakenzie Road, w:Ft h I the balance of the property in their .ownership to revert to RA Outer Residential, and any land west of: the rel~cated_route remaining in . their: ownership after pFoperty exchange betweeh'School: District and 9ity Parks Department would be: subject to planting requirement~ Also, 8/24/64 - 4 e ~ ~ 117 e 8/24/64 I . ! a 40-foot strip immediately adjacent to the westerly right-of-way tine of the relocated Willakenzie Road from Cal Young Road north to the limits of their ownership would be improved by massed plantings of evergreens, etc., with a performance bond executed in the amount required to complete the same; a building setback line would be established 250 feet parallel to the north/south section of the relocated Willakenzie Road; and a separate agree- ment is to be made covering all of these requirements and signed by petitioner prior to change of zone. Mrs. Lauris moved seconded by Mr. Chatt to approve the Planning Commission recommenda- tion and implement the rezoning when requirements have been met. Motion carried. e 1 b. Annexation area south of Center Way, General Properties (64-093) - The Planning Commission recommended approval of the 100% consent petition for annexation of an area south of Center Way in Section 20, T18S, R3W, W.M. Mrs. Lauris moved seconded by Mr. Chatt to approve the annexation as recommended. I Motion carried. 3. Planning Commission Report - August 4, 1964 2 a. The Planning Commission recommended zoning to RA Outer Residential District the following areas recently annexed to the City: (1) Lematta Estates, annexed January 13, 1964 by Ordinance 13266 (63-173) (2) Area south of City View, annexed January 27, 1964 by Ordinance 13284 (63-180) (3) Area east of East Amazon Drive, annexed January 27, 1964 by Ordinance 13286 (63-179) (4) Area on both sides of Gilham Road, annexed March 9, 1964 by Ordinance 13340 (63-188) (5) Area on both s~d~s of Garden Way, annexed May 25, 1964 by Ordi- nance 13485 (64-021) (6) Area south of Centennial Boulevard, annexed May 25, 1964 by Ordinance 13487 (64-039) (7) Area south of 30th Avenue and east of Agate Street, annexed June 8, }964 by Ordinance 13516 (64-023) b. Vacation alley between Willamette and Oak, 26th and 27th (Hafdahl) ~ I Milligan and Brown, attorneys for Walter Hafdahl, submitted the re- quest for vacation of the alley in this block running along Lots 12, 13, 14, and 15, Block 26, Frasier-Eyland Addition. The Public Works Department had no objection to the requested vacation if Mr. Hafdahl is willing to construct a sewer manhole on_ the south boundary of his prop~ty and if agreement can be reached as to the fair market value of the land proposed to be vacated. The Planning Commission also recommended approval of the vacation. , e Mrs. Lauris moved seconded by Mr. Chatt to approve the recommended zoning of newly- annexed areas as recommended by the Planning Commission, and to approve the vacation of the alley as recommended by the Public Works Department and Planning Commission. Planning Commission Resolution re: Central Business District rezoning - The Planning .Commission adopted a resolution of their intent to rezone from C-3P to C-3 any properties in the Central Business District which may fall within a parking assessment district. Mr. Christensen moved seconded by Mr.Chatt that this item be held over.. Motion car- ried. 5 4. Terminal Building Leases, Mahlon Sweet ~ Agreements were presented for leasing space in the terminal building to National Car Rental, A. B. I Scarlett Transportation Rental, and Ronald Hilton (Avis Car Rental). Mrs. Lauris moved seconded by Mr. Chatt that the leases be approved and proper City officials authorized to execute. Frank Decker Jackson, Fire: Department, Commendation - The City Manager read: a letter of commendation from the Commanding Officer bf the U. S. Naval and Marine Corps Reserve Training Center citing the action of Hospital Corpsman Second Class Frank Oecker,Jackson,.a member of the Eugene Fire Department, in saving the life of a civilian specialist who had been struck with 3000 or more: volts of electricity. The letter credited Corpsman Jackson for contributing directly to saving the life of the'injured man,: through his' expert knowledge and skillful use of first aid, and cited it as an.outstanding examPle of the rescue training and performance of the Eugene Fire Department. , . Dr. Purdy moved seconded by Mr. Chattto receive the letter and pl~c~ ~n file, and to: direct a letter of commendation from the City Council to Mr. Jackson commending him '_ for his action.' Motion:carried. . 2 6. 2-hour Parking, 16th from Wil1amette to the alley between Willamette and Oak, L&L Market - The Public Works Department recommended the parking restriction be put into effect as requested, on both sides of the street. , , . - Mr. Christensen moved seconded by Mr. Chatt to approve the installation.of 2-hour park- I ing restriction as recommended. Motion carried. 3 7. Parking Restriction, 5th between Olive and Willamette, U.S~Postof~ice - Ethan Newman, postmaster, requested the prohibition of patking 6n both sides of 5th Avenue in the ~est-half of the block betweenWillamette and Olive Streets" between the hours of,lO:O,O p.m. :and 3:00 a.m. The request was initiated because of the larger vehicles transporting mail to Eugene and t,he need ,for room to turn into the postoffice driveways. The Public Works Department recommended approval of the prohibit io n. : "- Mrs. Lauris moved seconded by Mr. Chatt to put the parking prohibition into effect'as recommended between th~ hours of 10:00 p.m. and 3:00 a.m. Motion carried. - 4 8. Curb Cut 5th ,between Fillmore and Chambers ," Star Lumbel? - The Star Lumber Company requested a 110-foot curb cut on 5th Avenue from,Fillmore Street to the. west o,n their property:frontage, to be a valley~type reinforced curb. Board of Appeals Decision, Roof at 3185 Willamette, Furtick - Mr. Donald . - Furtick requested an appearan'ce before the Cou'ncil to appeal the deci- .sion of the Board of Appeals on August 12, 1964 to deny permission for substitution of materials in a dental clinic at 3185 Willamette Str-eet. It was reported that the plans approved for issuance of the building per- mit had specified 3-ply built:-up roofing" but that standard shakes of. 1/2" to 3/4" nominal thickness had been' used whereasc; the Building Code require~ shakes to be of ~-inch nominal ~hickness. All other requirements for use of a shake roof had been met; The Board of Appeals had ruled that the shake roof installed in violation of the Code would have to be removed. . ' , , , Mr. Christensen moved seconded by Mrs. Lauris to uphold the Board of Appeals and re- quire compl ianc"e with the Building Code. : Motion carried,. Messrs. Chatt, H'awk,. and Purdy voting no. : I 7 ***The City Manager asked the Council whether the City of Eugene would support West Coast: Air Lines in their petition for non:-s:top: s:ervice. between Medford and San Fran- cisco. Mr. Chatt moved seconded by Dr. Purdy that the council bill be read the second time by council bill number only, with unanimous consent of the Council. Mr. Chatt moved seconded by Dr. Purdy that the bill be read the second time by council bill number I only, with unanimous consent of the Council. Motion carried unanimously and the bill was read the second time by council bill number only. Mr. Chatt moved seconded by Dr. Purdy that the bill be read the third time by council bill number only, with unanimous consent of the Council. Motion carried unanimously and the bill was read the second time by council bill number only. I 4 Council Bill No. 6778 - Dispensing with election in City concerning annexation of an area in the 2800 block on Spring Drive (Mayer) was submitted and read in full. Mr. Chatt moved seconded by Dr. Purdy that the bill be read the second time by council bill number only, with unanimous consent of the Council.
