Cone :with .the 'following councilmen present: Mrs.' L~uri~, Me~srs. Chatt,Swanson, Christensen, Devereil, Crakes, Hawk; and. Purdy. '- The invocation was given by Rev. Lemuel McKinnie of St. Mark's Christian Method- isb Episcopal Churrih. ' Minutes of the adjourned meeting held on August 24, 1964, as mailed to member.s a of the Council, were approved. ~ NEW BUSINESS 1 Mayor Cone welcomed a very large group of 9th grade st~ents from E~gene area schools attending the Council meeting for credit in their classes in citizenship. 2 An application for a Class B Dispensers liquor licens~ was submitted by Southern I Lounge of Oregon, Inc., (Frank Greco, Phillip M. Morris, William E. Haney), Box 208, West Highway 24, Topeka, Kansas, dba Holiday Inn Restaurant, Interstate 105 and Coburg Road, as approved by the Police Department. Mrs. Lauris moved seconded by Mr. Chatt that the application be approved. Upon further d'iscussion by the Council, Dr. Purdy moved seconded by Mr. Crakes that the application be tabled. Motion carried, Mr. Deverell voting no. 3 Mr. Robert A. Dykes of 4745 Brookwood Street, requested segregation of assessment for paving 43rd Avenue against property abutting 43rd Avenue west of Fox Hollow Road. The property had been subdivided into three lots, and the assessment of $3146.08 would be segregated $987.12 to Lot 1, $1403.58 to Lot 2, and $755.38 to Lot 3. Mrs. Lauris moved seconded by Mr. Chatt that the segregation of assessment be approved. Mrs. Lauris moved seconded by Mr. Chatt that the contract for storm sewer construction on 28th Avenue be awarded to Jeske Brothers on their bid price of $5,589.75. Rollcall vote. Mrs. Lauris moved seconded by Mr. Chatt that the contract for sanitary and storm sewer e construction on City View Street be awarded to Wildish Construction Company on their basic bid price of $$20,397.65. Fluoridation - A letter written by Mr. Howard L. Langston of Cottage I Grove and addressed to Mayor Cone and the City Council was passed around to members of the Council for their reading. The letter stated Mr. Langston's personal opinion and opposition to the use of fluorides in drinking water, and was received and placed on file. 2 2. Emerald Empire Roundup - The Assistant City Manager read a letter from the president of the Emerald Empire Roundup Association addressed to the City Manager Hugh McKinley expressing appreciation for the fine support and co-operation given them by the City of Eugene. The letter was re- ceived and placed on file. 3 3..Workable Program - A letter was read from Mr. Selwyn A. Bingham, Sr. , Bingham Construction, Inc. , of Portland, requesting that the City Council make every effort to have Eugene's Workable Program recertified. Bingham Construction had secured a loan commitment through the FHA and are con- cerned that the loan credit will be withdrawn since it is conditioned upon the operation of the Workable Program. In discussion by the Council, clarification was requested of procedures with regard to housing in- spection under the Housing Code. A report will be given on inspection procedure at a later meeting. 4 4. Retaining Wall on Orchard between 15th and Franklin Boulevard, Lew Wil- liams Chevrolet - The Assistant City Manager presented a drawing submitted by Balzhiser, Seder & Rhodes, architects for Lew Williams, which showed a I new layout for a proposed retaining wall and planters for a parking lot on Orchard between 15th and Franklin Boulevard. In the discussion which followed, it was understood that Lew Williams Chevrolet Company had been granted certain concessions with regard to use of a certain portion of the street right-of-way abutting the company's property. Mr. Hawk moved seconded by Mr. Crakes that the staff review these previous commitments and ask Lew Williams Chevrolet to submit plans showing the proposed de- velopment of their entire ownership, including the northeast corner of e 15th and Walnut, and to bring a recommendation back to the Council. Curb Sidewalk, 35th Avenue side of 3497 Kincaid, Onsrud - Mr. Jan Onsrud of 3497 Kincaid Street requested permission to construct a driveway which would allow for a sidewalk located at the curb on 35th Avenue at Kincaid. Commission on Human Rights Ordinance - Copies of a proposed ordinance I establishing and delineating duties of a Commission on Human Rights for the City of Eugene were distributed to members of the Council, and the Mayor asked Dr. Robert Campbell, a member of the present appointed Commission, if he wished to make' any remarks cOncerning the ordinance at this time. Dr. Campbell stated he hoped the Council would look favorably upon the ordinance and recommended its passage. In discussion of the terms and conditions of the ordinance, the members of the Council asked several questions of Dr. Campbell , after which Dr. Purdy moved seconded by Mrs. Lauris that Subsection (h) of Section 1 of the pro- posed ordinance be amended making the Commission's authority to accept contributions and expend the same subject to the provisions of the Oregon Budget Law. Motion carried. Dr. Purdy moved seconded by Mrs. Lauris to approve the proposed ordi- nance as amended. Motion carried. The City Manager explained the wording of Subsection (h) of Section 1 in the proposed ordinance had been changed, and read the section as it now appears in the ordinance to be presented for passage. Swimming Pools and Community Buildings - Copies of a program outlining I needs for swimming pools and community recreation buildings in the City of Eugene, prepared by Lutes and Amundson, architects, were dis- tributed to members of the Council. !1 5. Report of Grand Jury No. 2, July 1964 - Copies of the report of Grand Jury No. 2 empanel led for the July 1964 term were presented to the Council mem- bers by the City Manager who asked if any of the Council had any comments. The Council indicated that since they had just received copies of the e report, they wished time to study the material having to do with the County-City jail, City Attorney, and Municipal Court iQ the report. Mr. Swanson moved seconded by Mr. Christensen to table this item until the September 17, 1964 Committee meeting. Motion carried. It was suggested that the City Manager report on the comments in the Grand Jury's report with regard to the jail and office of the City Attorney, and that the Municipal Judge make a report on the operation of the Municipal Court. ~ 6. Animals in City Parks - A "dead owl report" had previously been requested by the Council subsequent to publication of a letter written to the edi- tor of the Register-Guard concerning the condition of animal quarters in the City's parks. The City Manager explained that the Parks and Recrea- tion Director state the dead owl referred to had been removed the follow- ing morning and that it had died of natural causes. Also, the ro ndition I of the bear pens makes them difficult to maintain, but they are cleaned every day. Downtown Study Committee - Mr. Ray Hawk, chairman of the. Mayors Down- . town Study Committee, gave a report on the proposal for the establishment of a parking district.and the proposed,inethod of assessment: to finance the' district. A small City map was passed to members of the: Council showing the area encompassed by the district with the layout of the pro- posed' parking lots. Comments on' the district were made by the Planning Consultant and Mr. S. J. Kilpatrick, a member of the Committee, and others. Mr. Hawk then recommended that the Council adopt the proposed plan and implement its establishment of the district.- Mr. Christensen moved seconded by Dr. Purdy to adopt the proposed plan and proceed with the parking district project. Motion carried." Mrs. Lauris moved secohded by Mr. Chatt to approve Item 7 of, the Committee report. e Councilman Hawk was asked to brief the audience on the committee's work and the pro- posals presented to: the Council, and the recommendations on the method for financing the proposed parking district were also explained. -On call for: disctlssion, several members of the audience spoke, among them Messrs. Jac,k Foster, Howard Buford, Lewis Hoffman, John Luvaas, Robert Ferguson, Paul Lansdowne, S. J. Kilpatrick,' Archie Weinstein, and Dr. Shepard. Dr. Shepard, spe~king a~a representative of the Medical I Center Building, stated the Center has two separate parking lots which they are using as parking for their patients coming to the Medical:Center.and v~lidating tickets' from these particular parking lots. Dr. Shepard also indicated that the Study Committee had con~acted the Medical Center: group early inthe discussi0n of.the: proposed parking district, but they understood now that the second lot which h~d not previously been discussed was being considered. in the parking district: for a parking ~tructure. Mr. Max Wright, manager of the Medical Center, stated he felt there should be some clari- ficatio~ of the proposed method of assessing already: established parking facilities for the: public and: asked for. a more detailed' explanation of the committee recommenda- tion on this point. , Mr. Orchard of Orchard Auto Parts stated that his firm had provided ample parking space for their customers'for. the foreseeable-future, but that patrons of the post- office and other businesses close to his paFking area were using' the arm while con- ducting their business e1sewhere. Mr. Orchard also stated that he fat that a more equitable means of assessing those businesses which have provided ample parking space should be worked out in the parking district proposal. Mr. Paul Lansdowne of the Eugene Hotel stated that he felt that to charge for all the floor area of the upper: residential floors of the Hottel would be out of line.with-the charges to other businesses. Mr. Lansdowne stated that the upper floors of the Hotel should be considered in the same category with residences, even if they were just overnight, r.esidences. Mr. Lansdowne also stated that the Hotel is now. providing par~ing space:for its guests and also some hourly and monthly charge public parking. I : The City Manager read a letter from the Oregon Bank, Mr. Robert Ferguson, manager, which letter stated that the Oregon Bank had used approximately two-thirds of their total land area for parking purposes. -This parking was for,their own employes 'and customers and approximately some 30-odd spaces were rented to merchants and employes of other business establishments. The Oregon Bank stated they'felt they had provided more than their share of public parking, and that itwould:be very inequitable to be charged for:other off-s~reet parking in addition to:providing more t'~an:ample parking e for their o~n business. . , : Mr. Archie Weinstein said he felt that the City:Council should utilize the existing ordinance which would allow a parking district to be set up under a specified portion of the Oregon statute and recommended that the C6uncil:consider:several small ~rking districts instead of trying to combine the whole area into:one large parking assess- ment district. . . . Vacation portion of Potter Street at East Amazon Drive - Mr. Fred Steinkamp had requested the vacation of a triangular shaped piece of property at the southeast corner of East 'Amazon Drive and Potter Street. The Public Works Department recommended the property be vacated subject to the owner's paying $362.50, the amount of the paving assessment on East Amazon Drive. The petitioner had re- quested permission to pay the $362.50 over a 10-year period in a manner similar to the Bancroft Act procedure. e Mrs. Lauris moved seconded by Mr. Chatt to approv~ the vacation and permit payment of the assessment over a 10-year period. Curb Cut, 11th at Pearl, Firestone Stores - Fireston~ Stores requested a curb cut the full length of their property abutting 11th Avenue at Pearl Street in conjunction with the widening of 11th Avenue because of the room needed by log trucks to turn into their property for servic- I ing. The Public Works Department reco,mmended a 70-foot curb cut begin- ning 25 feet east of the alley between Oak and Pearl and a 30-foot curb cut beginning 30 feet east of the east end of the 70-foot cut. They also recommended that the property owner be notified that their ~xisting pumps be moved to allow sufficient clearance between them and the prop- erty line to allow servicing of vehicles without their having to be parked on City sidewalk. Mrs. Lauris moved seconded by Mr. Chatt to approve the recommendation of the Public Works Department. Motion carried. 3 4. Sanitary Sewer, Crest Drive School - School District No. 4 had requested the City to extend the sewer line to serve the new Crest Drive School. The Public Works Department reported it would be necessary to obtain an easement over unplatted property belonging to Mr. Ray Cheney, who has agreed to grant this easement providing the assessment for the sewer con- struction is deferred until the property is subdivided. The total cost estimated is $24,020, of which $15,820 would be assessed now against property of Mr. Cheney fronting on Lorane Highway, other property owners, School District No. 4, and the City of Eugene. The amount to be deferred which would ultimately be assessed against the unplatted property outside the City would be about $8,200, (at such t_ime as that' property is annexed). Mr. Chatt moved seconded by Mr. Swanson to proceed with the sewer construction requested I by the School District, assessing the costs as recommended by the Public Works Depart- ment. Voters Pamphlet - The City Manager announced that October 2, 1964 will be the deadline for statements to be placeg in the vo~ers pamphlet which would be sent out on the two ballot measures for the November 3, 1964 election. e Mr. Chatt moved seconded by Mr. Swanson to place a statement from the Council in the voters pamphlet in favor of the mall proposal. Motion carried. 5 6. League of Oregon Cities Convention - Announcement was made of the League of Oregon Cities convention in Eugene on November 15-17, 1964. The City Manager stated the League office would be happy to receive any suggestions or ideas which could be used for topics in the convention. 6 7.
