Adjourned meeting of the Common Council of the city of Eugene, Oregon - adjourned
from the regular meeting held February 8, 1965 - was called to order at 7:30 p.m. in
the Council Chamber on February 24, 1965 by His Honor Mayor Edwin E. Cone with the
following councilmen present: Mr. Chatt,'Mrs. Lauris~ Messrs. Crakes, Hawk, Purdy,
McNutt, Anderson, and Lassen. ' ..

NEW BUSINESS
The City Manager announced that Councilman. Crakes will attend the National Legis-
lative Conference in Washington, D. C., March~'3b-Apri1.'1, 1965. .Also,tha~ Mayor
Willard Marshall o~ Salem will attend the same confere~ce.
Street Tree Program. Jaycees - H. B.-~awkin~ and: Dick Sod~rberg of the Eugene
Jaycees by means of drawings and colored slides presented a tree planting program
which would extend over a number of years, beginning in the business'area of the City
and gradually working outward from the core area. The Jaycees propose to'plant a num-
ber of trees each year according to an organIzed plan. Mayor Cone commended the'Jay~
cees for their proposal, and several members of the Council also voiced their approval,
of the program. -. -. ' .

The City M~nager announced that a hearing would be held at the Capitol at 1:00 p.m.
on February 25, 1965 on S.B.142, which provides that all public wor~s improvements over,.
$1500 shall be constructed by private contractors.

1. Handbill Ordinance - The-City Attorney briefed the Council members on
the regulations. in: the active, Eugene handbill: ordinance., Mr. Uggen
then spoke, stating that he and his partner, Mr. Husing, proposed to
enter the handbill: and leaflet distribution: field .in Eugene.' H~:also
suggested that the current Eugene ordinance should be revised to allow
tw~ o~ more firms ~o be licens~d and bonde~ t~ distribute advertising
matter, leaflets, handbills, and' circulars'within the City on a door-
to:door, basis. Mr. Uggen suggested th~t this would allo~ better co~-
trol of delivery, keep handbills:an~ le~fl~ts fro~ clu~teri~g the
streets, woul~ make: one or more individuals responsible for legal dis-
tribution, and allow distribution at less cost than by U,S. mail.. Mr.
Uggen also suggested that people not,wtshing ~o have handbills and leaf-
lets delivered to their residences list their' names with'the police de-
partment,'and thi$ list would be scruttnize~ before each: delivery. .

After several comments by Council members and the police chief, the
item was referred to the Wednesday, February 24, 1965, Council meet-
ing.
Mayor Cone called for further information to be presented for the proposed amendment
to the handbill ordinance, and Mr. Uggen again stated their position and belief with
regard to this proposed ordinance.
Mr. Crakes moved seconded by Mr. Chatt to give the proposed ordinance a trial and ask
the City Attorney to prepare a sample ordinance to be presented to the Council for ap-
proval or rejection. Motion carried, Messrs. Hawk and Purdy voting no.

2. Progress Report, Swimming Pool and Community Buildings - The Parks
and Recreation Director briefed the new Cpunci1 members concerning
the swimming pool and community buildings program and the develop-
ment of the program thus far. Mr. Don Lutes, architect, described
layouts and types of structures proposed for tae Westmoreland,
Amazon, and Sheldon High areas. A brochure'was presented outlining
the size, type of materials, type of facility, and estimated cost of
each segment of the program. Mr. Hawk moved seconded by Mr.Anderson-
to accept the plans as presented and proveed with further develop-
ment of the several projects. Motion carried.

3. Airport Crash Truck - The City Manager stated-that not all the tests
had been completed on the airport crash truck but that several cor-
rections should be made to equipment and body of the truck before
acceptance. A yankee Walter Corporation representative will work
with the fire department mechanic in making the changes. Arrangements
have been made to use the fire department shop and some time of the
fire department mechanic, for which the Yankee Walter Corporation
would pay. Mr. Anderson moved seconded by Mr. McNutt to authorize the
use of the fire department shop and services of the fire department
mechanic on a reimbursable basis to complete the recommended changes.
Motion carried.
Mr. Chatt moved seconded by Mrs. Lauris to approve Items 2 and 3 of the Committee re-
port. Motion carried.

4. Building Permit, 1555 EmRay Drive, Morse - The City Manager stated
that the city of Eugene, the city manager, the superintendent of
building inspection, and Mr. and Mrs. Clinton Morse had been summoned
to appear in court in answer to a complaint by several neighbors of
the Morse's. The complaint asked revocationof a building permit issued
to Mr. Morse and to enjoin Mr. Morse from renting a part of his build-
ing at 1555 EmRay Drive as a duplex unit. The City Manager then briefed
the Council members on the circumstances and p11icy under which the per-
mit had been issued, and a map showing the location of the lot in ques-
tion was presented. No action was taken."

Coburg Road (64-031) - The Planning CommissiOn recommended zoning
to RA Outer Residential, R-3G Garden Apartment Residentiai and 'C-2
Neighborhood Commercial the area north of Wi1lakenzie.Road and east
of Coburg Road annexed to the City by ordinance 13596 on August 10,
196~. Dr. Purdy moved seconded by Mrs. Lauris to approve the recom-

2. Rezoning,toC-3P area 'at Coburg and Willakenzie (Olson)(65-006) - The Cquncil
on January: 25, 1~65'approved a variance,to permit an ice cream store on this
property after consideration 'of a.Planning.Comffiiss~on recommendation to deny
requested rezoning to C-3P.: The matter was referred: too a joint Planning Com-
missiop./ Council meeting,at w~ich time the Planning Co~is~i6n again recom-
mended denial <?f the rez<?ning and also d~nia~.-of a, variance. Mr~. Lauris
moved to ~pprove the:Planning.Commission recommendation. Th~ motion was not
seconded.

-3. Curb Sidewalk, 40th 'and Donald, Unitarian:Church :.. The UnitarianChurch re-
quested permission to install curb sidewalks on 39th and 40th Avenues near
Donald Street. The Public Works Department ~eported that a curb sidewalk
has already been established for the 39th Avenue side of th~ir property 'but
recommended denial of' the request for a cu'rb sidewalk em the 40th Avenue
side~ Mr. Hawk moved seconded by Mr. Anderson to deny the ,request ,for
a curb sidewalk on the 40th Avenue side of the Unitarian Church property
near Donald Street. Motion carried, Mrs~ :r:.~uris voting no.

Street sides of their property. They requested ~ermission to locate
the sidewalk at the standard setback with a parking strip of lawn
from the curb to the property line. The Public Works Department
recommen~ed .thqt the requirement be waived for the 11th Avenue side
and a conditional waiver be granted for the Patterson Street side
until pedestrian volume warrants the full width sidewalk. Mrs.
Lauris moved seconded by Mr. Chatt to approve the recommendatwn.

Mr. McNutt to approve a 100% petition for .paving and sewer in Birch-
wood Park. Motion carried.

This petition carried signatures of pwners of 71% of the total front

7. Paving all street.s in Chevy Chase Addition - Dr. Purdy moved seconded
by Mr. Anderson to approve a 100% petition for paving all streets in
Chevy Chase AdditiQn. Motion carried.

8. Paving Tabor Street from Goodpasture Island Road. to south boundary
of Cow Palace Addition. and Jeppesen Avenue in Cow Palace Addition -
Mr. Chatt moved seconded by Dr. Purd~ to approve a 100% petition
for paving these streets. Motion carried.
Mr. Chatt moved seconded by Mrs. LauDs to approve Items 4 through 8 of the Committee
report. Motion carried.

9. Airport Commission Report - February 17. 1965
A. Fixed Base Operation Lease - The Council had previously receLved
a request from Mr. Jack York and associates to take over the lease
of Mr. Ruberg for a fixed base operation at Mahlon Sweet Airport
and had referred the m~tter to the Airport Commission for a recom-
mendation. The A~rport Commission now recommends that the Ruperg
lease be canceled, and that Mr. York be permitted to lease the old
United ~ir Lines building for 12 months, with a 6-months extension
privilege, at $250 per month, for a fixed base operation. Dr. Purdy
. moved seconded by Mr. Chatt to approve the recommendation. Motion
carried.

10. Downtown Study Committee Report - February 12. 1965
a. 10th and Mill Lot. Coen - Mr. Coen had offered to sell this lot to
the City to be included in the off-street. parking assessment dis-
trict. The Downtown Study Committee reported that that committee
felt the Coen lot had no bearing on the downtown parking ~istrict
at this time. However, that the lot could be considered at a later
date for possible inclusion in the project.

b. 10th and High. Bronson - Mr. Bronson had offered to lease this Ipt
to the City of us~ in the off-street parking project. After study-
ing the proposal made by Mr. Bronson, the committee reported they
felt they were not prepared to make a commitment on the property
at th is. time. and recommended the City take .no act ion to lease the
property.
Mr. Chatt moved s~conded by Mr. Crakes to accept the report of the Down-
town StudyCommitt~e, and no further action was taken. Motion carried.

11. Abatement 2130 Pierce Street. Milton - Mr. Clarence Milton of 2130
Pierce Street had been notified by the Public Wprks Department in
October 1964 to correct certain deficiencie~ in the building~ on his
property. An inspection was made on February 5, 1965 by the building
department, and it was reported the property had further deteriorated.
The superintenqent of b4ilding inspection ~QW .re~ommends. ~hat the exist-

12. Abatement 777 East Broadway. Crystal Ice-Campbell -:Mr. C. F. Campbell
of 252 Pearl Street had been:notified by the superintendent of.building
inspection in October 1964 regarding the condition of h{s:property.at
777 East:Broadway and pointing out specific corrections to be made to
:bring the property and building up to standard sanitary. conditions;
Since no action had been taken by the owner to correct the condition,
the superintendent of building inspection now recommends that abatemenG
proceedings 'be started for the 'wrecking and removal 'of the: bliilding. ',and
debris. Mr. Chatt moved seconded by Dr. Purdy~toapprove abatemen~

13. Parking Prohibition Ferry Street north of 11th - The Public Works De~
partment :recommended that :parking be prohibited on the west side of '
Ferry',Street north of ,11th Avenue. ~ Also, :that parking be limited to,
two .hours at 9.00, to the .center1ine of the street on the east side :o~f :
Ferry Street adjacent .to the .U-Lane-O:Corporation building north,of
11th Avenue. Mr. Chatt moved seconded by Dr. Purdy to approve the

14. Parking Meters. Alder from 11th-Millrace - Edwin M. Wheeler 'of Westwood
Furnishings requested installation of parking meters on Alder from 11th
north to the millrace. After investigation; the'.Ptib1ic Works Department
recommended that no extension of parking limitations', either by metering
or signing; be made at this time. On further discussion, it :was recom-
mended to defer this matter until' the pr-evious :p1an for tr-affic movement
and parking in the Alder Street area can be reviewed. No action was taken.

15. School Zone Signs. 16th and Jefferson - A petition was. 'submitted '~e-
questing consideration of installation of school zone signs at the
intersection of 16th and Jefferson ,near the- entrance of. St. Ma~y'supper
schoo1~ :After investigation, the Public'Works Department reported that
a painted crosswalk had been installed as a r-esul.t of the :investigation

17. Vacation portion Oak Grove Drive. Campbell - Mr. Joe H. Disch as agent
for Mr. Paul Campbell requested action :on a reques't for vacation:of a
portion of :Oak Grove Drive near Sprin&Bou1evard which ,was tab1edb~
the Council in. March 1954.:, The -location of Oak ,Grove Drive :was to
have :beenchangedto make a right .ang1e intersection with ,Sp~ing :

18. Motel Sign. G1enwood Interchange Interstate 5. :Weaver - ,Mr. James H.
Weaver requested permission to lease from the City for $75. per year
enough ground upon which to erect a sign to advertise a motel in the

19. Welfare Workers -: The parks 'and recreation director :submitted a :report

Butte, Spencers Butte, and North Bank Parks by men on welfare who had
worked 137 days (1037 hours) during January. The report was filed.

20. Municipal Court. Davidson - A letter was read from Mrs. Eugene David-
son, 489 Pinto Way, apologizing to Mayor Cone and the 'Council for her
criticism of the municipal court and Judge John Barber.

21. Auditorium - Mr. Lee Bishop, president of the Lane County Auditorium
Association, in a letter dated February 1, 1965 and upon recommendation
of the Site and Access Committee of that Association, asked that offi-
cials of Lane County, Eugene, and University of Oregon authorize a
survey of the North Bank Park area with a view to presenting to the
public the locations for the various facilities which it is anticipated
might be placed on that site. .

22. Traffic. Broadway and Hilyard Intersection. Mill Street On-ramp to
Ferry Street Bridge (Co burg Road Bridge) - The State Highway Department
had been asked to make a survey of the traffic condit.ions at the inter-
section of Broadway and Hilyard, and on Mill Street at the on-ramp to
the Ferry Street Bridge for northbound traffic. As a result of their
investigation, the State Highway Department concluded in their letter
dated February 5, 1965 that the single left-turn lane at t~e inter-
section of Broadway and Hilyard is adequate and should be retained.
Also, that the State Highway Department would stripe the northbound
section of Mill Street between 8th Avenue and the gore point for the
ramp to relieve the congestion for vehicles approaching the ramp.

23. International Festival Reception - A letter of invitation was read
from the Chamber of Commerce extending to all City and- County offi-
cials an invitation to attend the International Festival. Also, the
reception to be held Friday evening, February 19, at 11:00 p.m. i~
the Eugene Hote, and the reception to be held at 11:00 p.m. at Gerlinger
Hall on Saturday, February 20.

24. Urban-Rural Conference - The City Manager announced an Urban-Rural
Conference to be held in the home economics auditorium at Oregon State
University, Corvallis, Oregon, on February 25, 1965. Registrations
should be mailed to the Chamber of Commerce in Corvallis.
Communications in Items 30 through 24 were received and placed on file.1I

port be received and placed on file. Motion carried.

Rezoning area on west side Madison between 25th and 26th (Jensen)(65-002) -
Held over from the Council meeting on February 8, 1965 and now brought back,
this item had been recommended for denial but held on request of petitioner.
A Mr. Anderson, speaking on behalf of Mr. Jensen, now requested reconsidera-
tion of the recommendation to deny the requested R-3G zoning.

Mrs. Lauris moved seconded by Mr. Lassen to deny the requ~sted rezoning.
Motion carried.

Segregation of Assessment. Vaughn - Mr. Earl J. Vaughn requested segregation
of assessment for paving Hayes Street on Lots 3 and 4, Block 9, Chambers
Addition. The total assessment of $811.52 was made against the two lots,
and segregation was requested to assess $405.76 to Lot 3, and $405.76 to
Lot 4.
Mr. Chatt moved seconded by Mrs. Lauris to approve the segregation request.
Motion carried.

Council Bill No. 6941 - Levying assessments for sanitary sewer in Willakenzie Sanitary Sewer
Improvement District WS-63-3 was submitted and read in full on-February 8, 1965 and held over for
proper notice of assessment to be given owners of affected property and brought back for considera-
tion with no written protests on file.

Mr. Chatt moved seconded by Mrs. Lauris that the bill be read the second time by council bill number
only, with unanimous consent of the Council. Motion carried unanimously and the bill was read the
second time by council bill number only.
