March 8, 1965
The regular meeting of the Common;Council of the city of Eugene, :Oregon, was
called to order at 7:30 p.m. in the Council Chamber on March 8, 1965 by His Honor
Mayor .Edwin E. Cone with the following . c'ouncilmen :present: Mes-srs. Chatt,- Hawk, Purdy;
McNutt, and Anderson. - Councilmen Lauris, Crakes, and Lassen were absent.
The minutes .of the adjourned meeting :held --February 24, 1965, as mailed to members
of the Council, were approved.

NEW BUSINESS
e
Mr. Eric Cooper presented a statement at the-Eugene City Council from the Citi-
zen's Council Against Water Fluoridation, copies of which were distributed to Council
members and the staff. The City Manager read the complete statement for the benefit
of the Council and :members of the audience.
Dr. Purdy moved seconded by Mr. Hawk to receive the statement and place it on file.
Motion carried.

The City Manager distributed copies of his report on the recommendations of the
Grand Jury concerning the City/County jail, municipal court, and city attorney's office.
No action was taken.

The City Manager also stated that changes had not been completed on the new crash
truck and that other tests are stili to be run. He said that the truck has not yet
been accepted by the City.

1. Ambulance Ordinance - 'The City Manager stated that for several months
Mr. Bill Le'onard of Eugene 'Ambulance Service and the city attorney's
office had been revising the section of the ~ugene City Code regarding
ambulance regulations. The assistant city: attorney explained the' pro-
pose~revision to the ~ode, and copies of the proposed ordinance were
'distributed to members of the Council. Mr. Leonard was present and
stated that he would like to see the prqposed ordinance adopted by th~
City. Follqwing discussion 'by the 'Counc::n, Mrs'. ,Lauris moved se,condid

The Planning Commission had recomniended 'approval of the MC,Kay 'Invest-
ment Compa'ny request fOI: waive,r of sidewalk req~iremerit so that ,no
sidewalk would have to be constructed oritne north side of Oakmont
Way from Coburg Road to the west end of Frontier Park. ,Mr., ..Crakes

b. Brewer Avenue Paving - The Planning Commission reported this item
had been tabl~d ~qllowing referral by the,Cq~I1cil pending agre~ment,
on special paving 'of Brewer Avenue west ,of GiIham ,Road among owners
of property involved. Mr.Chatt moved :seconded by Mr. Crake,s 't,~ re-
ceive and place on file. Motion carried.

4. Planning Commission Report - March 2, 1965
a. Annexation additional area at 30th and Agate, Tillman - Mr_. and Mrs.
Tillman had requested 'annexatio'o of" a "smarr area north of 30th Avenue
in the Chula Vista Park area, and the Planning Commission recqmmend~d
approval. Mr. Chatt moved sec<;:mded by Mr. Crakes, to approve the anriex,.?-

abutting the north end 'of Watkins Lane reques'ted vaca tion of that
portion of .the street. Both the Planning Commission and P.ubl,ic Works

c. Vacation portion City View Street. Cascade Title Company - Cascade
Title Company had requested vacation of a portion of City View
Street from the south end of Wilson Street to the city park. The
Planning Commission and Public Works Department 'recommended ap-
proval of the vacation since Cascade Title Company had deeded to
the City a new right-of-way through Cascade's unplatted owner-
ship for access to the city park. Mrs. Lauris moved seconded by
Mr. Anderson to a~prove the vacation. Motio~ car~ied.
5. Paving 'Highland Drive from Woodland Drive east to south boundary of
street; Cresta de Ruta from Highland Drive south to existing paving;
Woodland Drive from Highland Drive to south boundary of Malabar Hill
plat _Owners of 91% of the property abutting these streets peti- _
tioned the paving, and Mr. Chatt moved seconded by Mr. Crakes to ap-
~rove the petition. Motion carried.

6. Paving Potter Street from East Amazon Drive north to existing paving -
Owners of 33.4% of the property abutting this s~reet petitioned this
paving. T~e Public ~orks Department reported that an additional 10
feet of right-of-way on the east side of the street would be necessary,
the owners of which did not sign the 'paving petition. The Department

11. Repayment Planning Funds HHFA. Bethel-Danebo Sewer - It was explained
that Lane County had received planning funds in the amount of $55,932.12
from the HHFA for preliminary planning on sewers in the Bethel-Danebo
area before it was annexed to the city of Eugene. The agreement under
which these funds were advanced provided repayment to be made at the
time actual construction is started. The. Bethel-Danebo area has since
been annexed to the City, and ~he City has issued and sold bonds and has
started construction on the sewer system for whice the planning funds
were advanced. HHFA is now billing Lane County for $11,488."46" b.ase.d
on the proportion of sewer construction now underway. Since the area
is now within the City, and the work has been contr~cted by the City,
there is a question as to the responsibility for repayment of the plan-
ning funds. After discussion by the Council, Dr. Purdy moved seconded
by Mr. Anderson that the City pay the billing for $11,488.46. Motion
carried.

1. Variance from R-3G to allow 4-plex with studio units at 235 East 2nd. Johnson
(65-004) - This item had been referred back to' the Planning Commission pend-
ing agreement on paving the alley abutting the property on which the variance
is requested. An agreement having been reached with Mr. Johnson concerning
the type of alley paving, the Planning Commission now recommends granting the
variance with permission being granted the petitioner to lay a temporary
strip of asphalt on the alley. .

A question was asked from the audience about certification of petitions which had
been presented to the city recorder concerning addition of fluoride to the City's
water supply. The city recorder stated that the petition calling for withholding
of fluorides from the water system had more than the required number of certified
signatures of legal voters, but that the petition which would authorize the City
to dispense free fluorides to those asking for it had only about 2800 signatures
and that the total number required to place the issue on the ballot is 3552.

At the close of the discussion which followed, Mayor Cone stated that the Council
would consider a special election after further study of the matter. No action
