Cone by Council President John Chatt at 7:30 p.m. in the Council Chamber on March 29, 1965 with the following councilmen present: Mrs.Lauris, Messrs. Hawk, Purdy, Anderson, and Lassen. Councilmen Crakes and McNutt were absent. e Minutes of the regular meeting held March 8, 1965, special meeting held March 18, 1965,. and adjourned meeting he~d March ?2, 1965, as mailed to members of the Council, were approv~d. NEW BUSINESS 1 Resolution No. 1170 - Requesting Board of C9ntrol of Oregon School Activities Associa- tion to reconsider action taken to move the Class A-ill high school basketball tourna- ment from Eugene to Portland, was submitted and read ~n full. I Mr. Archie Zarewski, speaking in behalf of the Parents' organization, asked full sup- port for the resolution, stating that Eugen~ offers within a IS-block radius of McArthur Court all types of activities enjoyed by high school students, whereas the city of Portland could not furnish the types of restaurants, recreation, and lodging currently being offered by Eugene and its citizens. Mrs.Lauris moved seconded by Dr. Purdy that the resolution be adopted. Motion carried. 2 Dr. Purdy asked if the Willakenzie Road paving will be done this summer and was advised that the proje~t is under contr~ct for completion this summer. 3 Dr. Purdy also stated that it is his understanding that Pacific Northwest Bell will install underground cable along Coburg Road and suggested that this be done be- fore the Coburg Road paving is started. 4 Bids - Removal or Demolition of Houses 12th and Oak, Russell Property Opened March 24. 1965 I Eugene Building Wreckers Harry G. Director; 'and others.: 1. Sidewalk Both Sides Rustic Place from:Coburg to Sorre1- - A. petition was. presented for this sidewalk signed by owners of 44% of the abutting prop- erty. A remonstrance against, the project was -also presented :signed ,by owners of 56% of t:he property involved. :Messrs. Paul- Green and Robert M., Thompson were present to protest the sidewalk construction, and Mr. Green stated that at this time some of the property owners would like to have the project deferred because of the heavy assessment now levied for the sanitary sewer construction. Paving North Cleveland from Cross Street to Roosevelt Boulevard - A peti- tion was. pr:esented for' -this paving :signed by owners of 56.,7%, of. the abut- ting property. The public works department recommended paving Cleveland to a width of 44 feet even though the existing right-of-way is 50 feet, since the ar:ea is primarily industrial. . Paving Augusta from 18th to 26th - A petition for this paving was pre- sented bearing signatures' of owners of 50% of the'abut,ti:ng property. Ap- proximately: 700 feet of frontage owned by School District No. 4 was i:n- c1uded in the percentage figure. Dr. Purdy-moved seconded by Mr,~ Anders-on to approve the petition. Motion carried. 4. Paving. south .side' Highland Oaks: Drive from Wilson ,to Bowmont ~ Owners of 53% of the property to be assessed petitioned the paving of the south half of Highland Oaks Drive from Wilson to Bowmont. ~he public, works de- partment reported the north half of this street was paved befo-re the south half was annexed to the City. Dr. Purdy moved seconded by Mr.' Anderson to app!ove"the petition. Motion carried. I Mrs. Lauris moved seconded by Mr. Lassen to approve Items 2, 3, and 4 of the committee report. Motion carried. 5. Ordinance. Deferred. Assessment :for Sanitary Sewers :- Copies of a. proposed ordinance deferring sanitary sewer assessments in some instances were dis- t,ributed t,o Council 'member:s for s:tudy .:No action was taken. e ,6. Storm.Sewer Assessment Method: - _ The _public works dir.ector explained some of the: problems experi,enced. by the City. in the. s:torm: sewer construction program. The cost of storm sewer construction over the last several years has exceeded that projected in the storm and sanitary sewer study pre- sente~, to :the Counc_il in 1,961. Figures quoted by the public works di- rector indicate that a considerable portion of storm sewer const.ruction money was used in new subdivisions and in some areas not included in the ~ origi,nalsewer study area. : The: Council ~as discussed cost of .storm sewer construction previously. butnQ acceptaple plan has been established. A proposal is now presented for assessment of certain costs of storm sewer construction to ,bene:f:ited_:propertie~., . C,onsiderablediscussion followed' .by me~bers of the Coun~il, and que/3ti-on~ were asked by the city attorney with regard to certain situations involving civil law and dis- position of drainage waters. No action was taken. 7. A letter from Eugene-Springfield Home Builders Association was x.ead which commended Emile Mortier, superintendent of building inspection, for his time and co-operatfun in review and adoption of the Uniform Building Code, 1964 Edition.'~ I Mrs. Lauris moved seconded by Mr. Hawk to hold Items 5 and 6 for further considera- tion, and receive and file Item 7. Motion carried. 3/29/65 - 2 e 269~ e 3/29/65 I Committee meeting held March 18, 1965: "Present: Mayor Cone; Councilmen Chatt, Lauris, Crakes, Hawk, Purdy, McNutt, Anderson, and Lassen;.City Manager; Administrative Assistant; City Attorney; City Recorder; Public Works Director; and others, including several members of Downtown Study Committee. 1 1. Downtown Parking District - Copies of the city manager's survey and report concerning formation of a downtown parking assessment district had previously been distributed to members of the Council. The re- port was,considered, and after some discussion Mrs. Lauris moved seconded by Mr. Crakes to adopt the survey and report. Motion carried. e Mrs. Lauris moved seconded by Mr. Hawk to approve Item 1 of the committee report and call a public hearing. Motion carried. 2 2. Fluoridation - A memo from the city recorder was presented which stated that 3613 signatures had been certified by the Lane County elections department on a petition which would prohibit the use of fluorides in the City's water supply. This number of certified signatures is more than enough to ensure placing the measure before the voters at a future election. The city attorn~y's opinion as to when an initiativepetition is presented to the voters stated that.the Council need not call a special election on the issue but could wait and place the petition on the ballot at the general election in November 1966. He also stated in his opinion that the Council could, if it so desired, call a special election to vote upon the issue. Mr. Anderson moved seconded by Mr.Hawk to place the measure on the general election ballot in November 1966. Motion carried, Mrs. Lauris, and Messrs. Chatt and Lassen voting no. I Mrs. Lauris read a prepared statement in which she stated five reasons why she thought fluorides should not be added to the City's water. She also recommended that the Council set an early date for a special election and request the Water Board to delay the fluoridation process until after another vote is taken. Councilman Anderson asked the city attorney about the legal requirements with regard to a referendum petition. The city.attorney stated that the issue must be submitted to the voters either at the November 1966 general election or at any 'prior special election. He also said that the report of the city recorder regarding the petition should be acted upon. I Mrs. Lauris moved seconded by Mr. Lassen to accept the city recorder's report certi- fying that sufficient names had been certified as legal registered voters of the city of Eugene on a petition to prohibit addition of fluorides to the City's water to place the issue before the voters. Motion carried. Mrs. Lauris .moved seconded by Mr. Lassen to call a special election within the Gity on the issue of prohibiting fluorides in the City's water on July 6, 1965. Motion carried, Dr. Purdy voting no. e Mr. Bob Moulton, speaking for the committee .against addition of fluorides to the City's wate~ supply, asked further consideration in suggesting that the Council di- rect the Eugene Water & Electric Board to delay adding fluoride to the water supply pending the outcome ~f the July 6, 1~65 election on the issue. Dr. Roy Hanford of Roseburg also spoke, g~v~ng some technical observations and re- sults of a survey he had conducted, and counseled against the use of fluoride in the water. After some further discussion, Mrs. Lauris moved seconded by Mr. Lassen to request the Eugene Water & Electtice Board to defer adding fluoride to Eugene's water supply pending the outcome of the July 6, 1965 election on the issue. The city attorney ruled the motion lost, Mrs. Lauris and Messrs. Chatt and Lassen voting yes; Messrs. Hawk, Purdy, and Anderson voting no. 3 3. Skateboards - A report from the police chief was read in which he recommended issuance of citations to individuals violating Section 28.26 of the City Code which prohibits the use of roller skates or coasters or similar toy devices on streets or alleys in the City. No action was. taken. I Mrs. Lauris moved seconded by Mr. Lassen that Item 3 of the committee report be re- ceived and placed on file. Motion carried. 3/29/65 - 3 e ll~ r270 e 3/29/65 I 1 4. State Liquor Revenues - A letter from Representative Jason D. Boe was read which requested the City's support of H.B.1478 which would in- :~rease, the ci~ies' share.of State liquor revenues. Dr. Purdy moved seconde~ by Mr. -L~ss~n to support the b~ll. Motion carried. Mrs. Lauris moved seconded by Mr:. Lass~n to approve Item 4 of the committee report. Motion carried. 2 5. Parking Restriction. Hilyard between 8th and Broadway - Mr. George Coffee, 820 ~ilyard Str~et, requested: l-hpur parking instead of 24- minute truck load,ing zone on Hilyard between 8th and Broadway. The public works department recommended ipstallation of a ~-hour park- .ing zone on. the ~~st side of Hilyard from 8th Avenue to the south about 82 feet,: which wo~ld provi9-e space for: three parking stalls. Mr.Chatt moved seconded by Mrs. Lauris to approv~ the recommendation.. MotiOn carried. e 3 6. Stop Signals., Railroad, Crossing Monroe Street -The public works de- partment recommended in~t~llation of a stop sign,: stopping traffic on Monroe Str~et at the Sputhern Pacific railroad crossing. Crossing Signals. ' SP&S, -At the request_of, the public works department, the Spoka!le, Pqrtland and Seattle Railway. Company, had their assistant engineer work with Eugene'straffi,c engineer to:make recommendations c~nce~ning protecti9n_for Oregpn, Electric crossings inside Eugene. The SPqcS set <?ut these_ recornI~J.(~ndattons in a letter addl;'essed to the public works director (dated February 19, 1965) for crossbuck signs and ad- vance warning and stop ~igns at the various crossings of the Oregon ,Elec~ric tracks. The Railway CQmpany asked assurance that:the City ~ould purc~ase, ~r~ct, and maintain the,stop and advance warning signs; the Railway Company.will:furoish the crossbuck'signs. The public:works department recommended authorization for the signing as set out by the SP&S, i~cluding the City's prQviding the:stop:signs:at the Bethel Drive crossing. Bendix - Mr.Paul :Bend~x r~q~ested a vari~nce frQm C-3P sidewalk requirements to allow Construction of sidewalk at the standard setback Location on Frontier Drive just west of Coburg Road. His request included permission to p'ut:plantings in the -parking strip. Central Lane Planning :Council - The city manager explained :that representatives ,of :Lane County, Springfield, and Eugene had di~cussed :and' recqrnmended :empl:oyment of a cons.ultant to make an organizational study of the Central Lane Planning C.ounci1. Thestudy was recommended with a view to some reorganization of the Planning I 3/29/65 - 4, - ~ 27~ e 3/29/65 I Council's staff to provide personnel for advance planning work only and others for current planning and zoning and day-to-day operation of the staff work. Also, the Planning Council had requested replace- ment of one of their automobiles which had been completely wrecked. Mrs. Lauris moved seconded by Mr. Anderson to authorize expenditure of funds to join with Lane County and Springfield in hiring a con- sultant for the organizational study of the Central Lane Council office, and for Eugene's proportionate share of replacing the Council's (Central Lane Planning) wrecked automobile. Fluoridation - The city manager stated several letters had been re- ceived opposing fluoridation or requesting de1ay.in fluoridation of the water supply. No action was taken." I Mrs. Lauris moved seconded by Mr. Hawk that Item ~2 of the committee report be received and placed on file. Motion carried. Improvement petitions were presented as follows: 2 1. Paving north/south alley between 12th and 13th, Mill and Ferry - The petition for this paving carried signatures of owners of 70% of the abutting property. Mrs. Lauris moved seconded by Mr. Hawk to approve the petition. Motion carried. 3 2. Paving Madison from 28th to Lorane Highway - This petition carried signatures of owners of 50% of the abutting property and also requested location of the sidewalk at the curb. The petitioner also requested preservation of trees which would necessitate moving the street centerline 4 feet east. Mrs. Lauris moved seconded by Mr. Hawk to approve .the petition, moving the street centerline 4 feet east and permitting location of the .sidewa1k at the curb on the east side of the street but standard location on the west side. Motion carried. 4 3. Paving Miramar from 53rd to north in 9th Addition to Edgewood - This petition was submitted by Breeden Bros., owner of 100% of the property abutting the project on the west side. Property abutting the east half of the street is outside the City limits. Mrs. Lauris moved seconded by Dr.. Purdy to approve the paving, subject to Breeden's agreeing to pay for the entire width. Motion carried. All councilmen present voting aye, the bill was declared passed and numbered 13826. 1 Council Bill No. 6993 - Dispensing with election in City concerning annexation of Northwood Estates (Crescent Avenue area), and Council Bill No. 6994 - Annexing Northwood Estates, were submitted but not read, since it was learned that one of the petitioners for this annexation did n~t own land ~redited to him. The~efore, there was insufficient ownership represented to annex under the triple 2/3rds provisions. Mrs. Lauris moved seconded by Dr. Purdy to refer this annexation back to the Planning Commission. Motion carried. RESOLUTIONS 2 Resolution No. 1164 - Calling hearing on April 26, 1965 concerning off-street parking assessment district in downtown area was submitted and read in full. e Mrs. Lauris moved seconded by Mr. Lassen that the resolution be adopte~. Motion carried. 3 Resolution No. 1165 - Authorizing facsimile signatures of E. E. Cone, Mayor; Hugh McKinley, City Manager; and Thomas Beaty, Recorder-Treasurer on checks drawn on the U. S. National Bank of Oregon, was submitted and read in full. I Mrs. Lauris moved seconded by Mr. Lassen that the resolution be adopted. Motion carried. 5 Resolution No. 1167 - Traffic - l-hour parking Hilyard for 82 feet south of 8th Prohibiting parking north side 24th for 80 feet west from Polk Stop sign on Monroe at SP cros~ing, north and south Stop signs Bethel Drive and Roosevelt Boulevard before crossing Oregon Electric tracks (SP&S) SP&S authority to install and maintain standard crossbuck signs along Oregon Electric tracks in City (5th Avenue) was submitted and read in full. Mrs. Lauris moved seconded by Mr. Lassen to adopt the resolution. Motion carried. 6 Resolution No. 1168 - Abatement Crystal Ice, 777 East Broadway (Campbell), was submitted but not read. I Mr. Campbell was present and asked for reconsideration and that the Council be shown through the premises at 777 East Broadway. The Council approved the date of Thursday, April 22, 1965, at 11:00 a.m. for a tour of the plant. 7 Resolution No. 1169 - Abatement 2130 Pierce Street (Milton), was submitted but not read. Mr. Milton was present and said that due to a serious illness he had been unable to complete the work specified but that he has now engaged help and plans to reconstruct the house. He asked for an ex- tension of time to allow completion of the work. . e Mrs. Lauris moved seconded by Dr. Purdy to withhold abatement for six months and review the situation again at that time.
