Cone with the, following councilmen present: Mr. Cha~t, Mrs.Lauris, Messrs. Crakes, Hawk, Purdy, McNutt, Anderson, and Lassen. The invocation was given by Rev. Harold Schroeder of the Mennonite Brethren. Minutes of the meeting held May 10, 1965, as mailed to members of the Council, were approved. COMMITTEE REPORTS Committee meeting held May 13, 1965~ "Present~ Mayor Cone; Councilmen Chatt, Lauris, Crakes, Hawk, Purdy, Anderson, and Lassen~ City Manager; Administrative Assistant; City Attorney; City Recorder; Public Works Director; and others. 1 1. Urban Design - The third and final session was held at which Dean Creese of the Uni- versity of Oregon spoke concerning urban design. e 2 2. Widening 13th Avenue. Agate to Moss - The City Manager stated that the staff and Public Works Department recommend widening 13th Avenue between Agate and Moss Streets to 44 feet, and applying an overlay to 13th Avenue between Agate and Emerald Streets. Dean Creese, Dr. Lallas, and J. O. Lindstrom, all of the University of Oregon, spoke in opposiGion to the widening of 13th Avenue and requested that the street be rebuilt 36 feet wide and that parking be removed. Mr. Chatt moved seconded by Mr. Crakes to. pave 13th Avenue from Agate to Moss to a 44-foot width and to remove parking from on side of 13th from Emerald to Agate, the side to be determined by the staff. Motion carried, Mrs. La~ris and Mr. Hawk voting no. I No action was taken on Item 1. A letter was read from Mr. J. O. Lindstrom for the University of Oregon and from Mr. Tom Williams for Williams Bakery accepting the 44-foot paving of 13th Avenue between Agate and Moss with the additional 10 feet to be on the north side. The letter also stated that cost of construction will be borne by owners of abutting property, 78% financed by the University of Oregon, apd 22%, by Williams Bakery. Mr. Chatt moved secorrded by Dr. Purdy to approve Item 2 of the Committee report and include the terms contained in the letter written for the University of Oregon by Mr. Lindstrom and for Williams Bakery by Mr. Williams. Motion carried. 3 3. Height Variance. Cascade Manor. 30th and Portland - Builders of Cascade Manor requestep re- vision of the agreement made when this property was rezoned to allow additional structure height for elevator housing, roof top snack bar, and patio. After viewing a drawing and a picture of the proposed building sho~ing the added structure, Mr. Chatt moved seconded by Mr. Crakes to allow construction of the proposed elevator housing and snack bar, sub- ject to approval by the Planning Commission. Motion carried., Mr. Chatt moved seconded by Mr. Crakes to approve Item 3 of the Committee report. I The Planning Commission in a permanent report dated May 17, 1965 recommended approval of the variance. Mr. James Myers, Mmes. Davis, Sayers, and Robinett, all residents in the West 30th Avenue area, were present and objected to the additional height. Mr. Calvin Smith, speaking for Cascade Manor people, stated the builders are aware that the added height will obstruct the view to some extent; he also stated that property values in the area will be enhanced as a result of construction of the Manor. A vote was taken on the motion to approve the Committee report, and motion carried. e 4 4. Land Exchange. 4th and Pearl. Eymann - Mr. Richard Eymann, speaking on. behalf of a client, proposed that the City exchange a large portion of Tax Lot 5100, City-owned, for a portion of Tax Lot 5600, both north of 4th Avenue, if extended, and west of Pe~rl Street. The exchange would allow his client to accumulate, a single large tract of land for develop- ment. It was recommended that the City reserve a narrow strip along the south edge of Tax Lot 5100 for street right-of-way. Mr. Chatt moved seconded by Mr. Lassen to authorize the staff to negotiate the exchange of properties, reserving a strip as recommended. Motion carried. Mr. Chatt moved seconded by Mr. Lassen to approve Item 4 of, the Committee repart. Motion ~arried, on rollcall vote with all councilmen present voting aye. 5 5. Crash Truck. Airport - The City Manager reported that the airport crash truck had been tested in Los Angeles on Monday, May 10, 1965, and that Yankee Walter ~orporation had sent a list of corrections to be made before delivery of the equipment to Eugene. He also reporte~ that Councilman McNutt had recommended a 45-day extension be granted in which to make the corrections proposed. A verbal report was given by the Fire Depart- ment mechanic who had witnessed the testing. Also, a report was given of a conversation between the City Manager and Councilman McNutt who had also witnessed the testing in Los Angaes. They reported metal shavings had been found in the gear boxes after the testing. Mr. Crakes moved seconded by Mr. Chatt to cancel the contract for purchase of the crash truck from Yankee Walter Corporation. Motion carried. North Bank Park Co~operation Agreement - Copies ,of a proposed agreement between the City, ,Lane County, and University of Oregon,concerning planning and development of the North Bank Park area were distributed to Council members for review. The agree- ment will. be discussed at a "later meeting. I 2 7. Mission .Street' Reservoir .Site~EWEB - The Eugene Water &' Electric Board 'had -offered' : the City an area on Mission Avenue for possible park use which EWEB no longer needs for a reservoir site. The Parks and Recreation Department recommends against using the site for a park. Mr. Chatt moved seconded by Mr. Anderson to notify EWEB the City is not interested in using the property. Motion carried. , 3 8. Appointment, Building Code Board of. Appeals,' - Mayor': Cone announced the appointment of the following named persons as:memhers of the Building Code Board 'of Appeals: Richard A. Chambers, 1770 Skyline Boulevard, Builder Louis F. Sanitary sewer in area between:Coburg Road, Oakwa~ Road, andOakmont Way - This ,petition was submitted by owners of 100% of the p~operty:to be assessed. Mr. Chatt moved seconded by Dr. Purdy to approve the petition. Motion carried. I 5 10. Paving and sewers, 10th Addition to Edgewood Estates - Owners of 78% of the property to be assessed petitioned this improvement. Expense to the City wa's est imated at $6000 for sanitary trunk sewer, and :$17,000 for :storm sewer. :ThePublic Works Department recommended, paving Donald Street tnrough:to Fox Hollow Road a,t the same time. Dr.Purdy moved seconded by Mr.' Chatt to apptove. the petition, including paving Donald Street 'from Edgewood 10th Addition to Fox Hollow Road. Motion carried. Parking AssessmentIDastrict ~ Tt was reported thab since the Aprit 26, 1965 publfc hear~ ing, the Downtown Study Committee had met several times t? review remonstrances presented at the hearing. The Study Committee now reaffirms its recommendation that,the City move ahead with the p~oposed .off.-streetparking assessment district as previously presented to the Council. Speaking as opponents t,o the propos:ed 'dist=rict were Mess'rs:..Paul Lans- downe, Harold Edmunds, :and Herb Robbins. Also, Attorney Ralph Hillier requested additional time,: pointing out that the Stl.1dy Committee had been meet'ing for' a year: or more and the opponents would have ten days or less in which to prepare an.:-.altern?te. proposal. .Mr. . Report on Single Transient Males - Mr. Darrell Smith, chairman of the committee on Community and Neighborhood Affairs, explained the written report submitted by his committee. He suggested that the Mayor appoint a committee to investigate location of a new site for the Eugene Mission, since the Mission Board had been told that the present location will be used by the Oregon State Highway Commission in the near future. Mr. Chatt moved seconded by Mr. Crakes to receive and file the report, and to recom- mend that the Mayor appoint a committee to assist in the relocation of the Eugene Mission. Motion carried. 3. Bids. South Amazon Park. Opened Ma'y 6. 1965 - The Parks and Recreation Director stated that two bids had been received for the improvement and construction of structures at South Amazon Park. One was from Krumdieck Bros:, $50,623; the other' was from Howard Nelson, $54,894; and both were approximately $14,000 more than the cost estimated by the Parks Department. It was recommended that the bids be rejected and a new bid call issued. Mr. Chatt moved seconded by Mr. Lassen to approve the recommendation. Motion carried." Coast Apparatus Company - The City Manager reported he had received a communication from Howe Apparatus Company in which they said they had assumed the contract from Coast Apparatus Company to furnish the city of Eugene a 1000 gpm pumper truck. He also reported that a performance bond covering delivery of the truck as contracted for had been received from Howe Apparatus Company. Mr. Chatt moved seconded by Mr. Lassen to approve assignment of the contract for purchase of the pumper truck to Howe Apparatus Company by Coast Apparatus Company. Rollcall vote. All' councilmen present voting aye, except Mrs. Lauris voting no, motion carried. 4 ' 5 6 2. Planning Commission Report - May 4.' 1965 a. Vacation portion Oak Grove Drive at Spring Boulevard. Campbell - The Planning Commission recommended approval of this vacation. b. Relocation. Eugene Fruit Growers - Upon referral by the Council, the relocation of the Eugene Fruit Growers plant in the Bethel-Danebo area at some future date was recommended for approval by the Planning Commission. (See Council action on May 10, 1965.) c. Rezoning 8th and Almaden. Postoffice - The Planning Commission requested per- mission to hear a request for rezoning the northeast corner' of 8th and Almaden, to allow a branch postoffice location, at its regular monthly meeting June 1,1965 rather than the regular quarterly zoning meeting in July. 7 Mr. Chatt moved seconded by Mrs. Lauris to approve Items 2a, 2b, and 2c. Motion carried. 8 3. Paving Larkwood Street in 3rd Addition to Pine Ridge Park - A petition was submitted for this paving by owners of 100% of the abutting property. 4. Paving Elanco Lane from Norkenzie Road to 220 feet east; and sanitary sewer in area between Elanco Lane and Holly Street from Norkenzie Road to 200 feet east - This petition was submitted by owners of 50% of the affected properties. The Public Works Department r~ported that a reserve strip will be retained along the south side of Elanco Lane to restrict access until additional right-of-way is dedicated. The peti- tioner would be required to pay all paving costs until the additional right-of-way is dedicated. Mr. Chatt moved seconded by Mrs. Lauris to approve Items 3 and 4 for paving and sewers. Motion car- ried. 9 5. Segregation of Assessment. Prince - Mr. George T. Prince applied for segregation of assessment for paving and sewers on 38th Avenue between Willamette Street and Watkins Lane. Mr. Prince division of the total assessment against Tax Lots 200, 201, and 202 ($2571.70) so that it could be applied to four lots - A. $522.07, paving, $91.61, sewer; B. $483.40, paving, $30.92, sewer; C. $602.71, paving, $47.89,' sewer; D. $570.13, paving, $222.97, sewer. Mr. Chatt moved seconded by Mr. Crakes to approve the requested segregation of assessment. Motion carried. 6. Census - The City Manager reported that a recent population count in the Acorn Park area had resulted in a certification of 830 additional Eugene the State Census Board, making a total certified population at this' time of newly annexed residents to 71 , 140 . 7. National League of Cities Conference - The City president of the NLC, which called attention to 28, 1965, and urging Council members to attend.
