Cone (arrived later in the meeting) with the following councilmen present: Mr.Crakes, Dr. Purdy, Mr. Anderson, and Mr., Lassen. Mrs. Lauris and,Messrs. Hawk and McNutt were absent. . , . Minutes of the adjourned Council meeting held July:2~, 1965, as mailed to members of the:Coun:il, were'approved. - , NEW BUSINESS 1 Workable Program - A letter had been received. from the Housing and Home Finance Agency concerning a e meeting between members of the Council and'Mr. John'J. Sulli~an, special'assistant to the'regional' administrator,for,conununity programs., A npon meeting on Monday, August 23, 1965~ was dec~d~d upon. , ' 2 Assessment Policy, Widening Coburg Road -The City Manager reviewed the'Coburg Road-widening' proJect, outlining participation in cost by Lane County, the City, ,and owners of abutting properties., - ' . Dr. Purdy moved seconded by Mr. Crakes to assess abutting'properties for cost of-curbs, gutters, and sidewalks., ' I ' , Mr. Ellis Jones read a lengthy prepared statement concerning the history otwidening Coburg Road and stated that he, and some of his neighbors feel the City should pay for.all of the p~oject except sidewalks. . Paving Hilyard from 13th to 23rd - The Public Works Director explained problems involved in the original construction of Hilyard Street and the asphaltic concrete overlay planned for the street. The overlay cost was estimated at $7000 or $8000. The Public Works De- partment had called for quotations on the project and was requesting the Council's per- mission to proceed with the project when the quotations were opened on July 22, 1965. Dr. Purdy moved seconded by Mr. McNutt to proceed with the overlay on Hilyard as out- lined. Motion carried. Mr. Crakes moved seconded by Dr. Purdy to approve Item 1 of the Committee report. Motion carried, all councilmen present voting aye. I 2 2. Planning Commission Report - June 28. 1965 a. Annexation 4722 Fox Hollow Road, Jackson (65-089) - The Planning Commission recom- mended approval of this petition for annexation. However, .two property owners whose land would be completely encircled by the City upon completion of the annexa- tion had been notified of the impending action, and one of these property owners had indicated his objection. Mrs. Lauris moved seconded by Mr. Lassen' to approve the petition for annexation. Motion carried. e 3 b. Variance 2387 Willamette. Bonson ( 65 -001) - A request for variance from regulations on the R-BG.District to allow use of the property for business office was tabled in the Planning Commission in January pending submission of plans by Mr. Bonson. Since that time nothing had been submitted by Mr. Bonson, and the Planning Commission now recommends denial of the request. Mrs. Lauris moved seconded by Dr. Purdy to deny the request. Motion carried. 4 c. Rezoning to R-3, 795 West 18th. Wilcox (65-032) - This request had been tabled in the Planning Commission in April for further study. The tract contains 99,500 sq.ft. , the house on the property is not within the required l60-foot distance from the' trunk, and the estimated assessment would be $5973. Onyx between 13th and 15th - The University of Oregon requested installa- tion of parking meters at this location. The Public Works Department 'recommended in- stallation of 27 meters on ,the south side of 13th between Onyx and Agate with parking prohibited on tne.north side. On Onyx between 13th and 15th, this request would authorize 42 additional meters, most of which would be 2-hour limit. The necessary meters are avail- albe and it was recommended installation be started prior to the University's fall term.. 'Taxicab Licen ses - Mr. Donald, Bach, representing one of the two taxicab companies in the City, requested that the City Council consider requiring a certificate, of convenience and necessity for new taxicab companies. A discussion followed relative to the number of cabs now in operation and present control of taxicab drivers and companies. 'Mr.Bach I suggested this 'requirement be enacted in order to limit the number of cab licenses that would be issued in Eugene. He stated that when a number of cab companies are in opera- tion over and above:requirements to do an economical job, :it is'difficult for anyone of them to operate profitably., The Council asked him to prepare a 'proposed ordinance for their consideration. Lane County, Council on ,Alcoholism - Reverend Carlton:C. Buck, : repre- senting the Lane.Connty Council on Alcoholism" ,explained the function of the organiza- t ion, stating that it is supported by voluntary help, membership dues, and State support of $150 per month. The organization provides education, treatment, and advice for al- coholics and their families, and families affected by alcohblism. He stated that the. organization works closely with Buckley House, and George Buckley is a member of the organization's Board. A copy of a proposed budget was presented and discussion followed relative to the re- sponsibility of the city of Eugene in these matters and the program now carried on by .Buckley House. Mrs. Lauris moved seconded by Mr. Crakes that the City appropriate $1200 to the Lane County Council on Alcoholism to be disbursed ,according to the wishes of the Lane County Council on Alcoholism. Motion carried. Dr. Purdy suggested that I a limit be put on expenditures from the emergency fund and a policy established re- garding the amount which could ultimately be paid out of the:~gency fund. Mr. Crakes moved seconded by, Mr. Anderson to approve Item 2 of the Committee report. Motion carried. 7 3. CABHearing~West Coast Petition. Examiner's Report.,. The City Manager stated that the Civil Aeronautics Board ,examiner had recommended to:the:CAB that United Air Lines serv- ice"be deleted at Eugene, Salem, and Medford. Also that if the City wishes to appeal this recommendation, it has 25 days in which to do so. If ,an appeal is not ,filed with; e in 25 days, the recommendation of the CAB Examiner becomes effective. The City Manager ~ 8/9/65- 7 37~ e 8/9/65 I I! stated that the City has invested more than $18,000 and that the appr04imate cost of an appeal would be between $2500 and $3000 more. The City Attorney stated that Mr. Harry Bowen, the City's counsel in Washington, has said that h~ is very pessimistic about the chances of winning an appeal. After some discussion, Dr. Purdy moved seconded by Mr. Lassen not to appeal.the CAB Examiner's recommendation. Motion carried, all councilmen present voting aye, except }J:r. Crakes voting no. The City Manager read excerpts from a resolution of the Medford City Council which recommended that Eugene join with Medford in petitioning for a review of the CAB Examiner's decision. Mr. Abe Johnson, speaking for the Chamber of Commerce aviation committee, strongly urged the Council to reconsider its committee decision and submit a petition for discretionary review. The City Manager submitted other information which would indicate that the situation might change in the near future. Also, letters were submitted ask~ng that the City Council t~'file an appeal. Mr. Crakes moved seconded by Dr. Purdy to appeal the CAB Examiner's deGision to delete service by e United Air Lines at Medford, Eugene, and Salem, and to retain Mr. Harry Bowen of Washington, D. C. as counsel. Motion carried. 1 ' 4. Property Purchase. Sharon Way and Tandy Turn - The City Manage~ stated that 1-1/3 acre of ground at 'this location in the Willakenzie area has been designated as a neighbor- hood park in the Parks Department planning since the 1961 election. He stated that the piece of land is smaller than desirable, but it is the only property available for park I purposes in that neighborhood. He also stated the property owner will sell for $17,500, but that the appraised value is $7500. Mrs. Lauris moved seconded by Mr. Lassen to initiate condemnation proceedings on this 1-1/3 acre, but to negotiate with the property owner in the meantime. Motion carried. Anderson to the Gas Advisory Board for the term ending ~anuary 1, 1968. 3 6. Parking Prohibition. Frontier Drive west of Coburg Road - George Hathaway, 2405 My De Court, requested restricted parking at this location, and the Public Works Department recommended that parking be prohibited on the southwest side of frontier Drive from Coburg Road to Antelope Loop since parking is now allowed on both sides leaving room for only one lane of traffic. Mr. Chatt move~ seconded by Mr. Lassen to prohipit parking as recommended. Motion carried. 4 7. Overlength Curb Cut. Patterson Street south of 19th Avenue - The Public Works Depart- ment recommended a 70-foot curb cut at the entrance to South Eugene High School on Patterson Street south of 19th Avenue to allow safer movement of bus traffic. Mr.Lassen moved seconded by Mr. Chatt to approve the curb cut. Motion carried. 5 8. Southern Pacific. Shasta Daylight - The City Manager explained that the Southern Pacific Company has applied to the Interstate Commerce Commission to discontinue the Shasta Day- I light'. Since there has been no discussion by the Chamber of Commerce, it was suggested that any action by the City be deferred until SOme recommendation is made by the Chamber. Mr. Crakes moved seconded by Dr. Purdy to approve Items 5 through 8 of the Committee report. Motion carried. 6 9. Workable Program - Mayor Cone and Councilman Purdy reported on a meeting in Detroit with Mr. Kermit G. Bailer to ,discuss HHFA's refusal to recertify Eugene's Workable e Program on the basis of (1) dormitory sleeping rooms provision in Eugene's City Code, (2) no neighborhood analyses function in operation, and. (3) no ~ouse-to-house housing code inspection program in operation. Discussions had also been held with officials of other cities to gain information concerning steps taken in an attempt to meet re-. certification requirements of the HHFA. Councilman Chatt suggested that the City write to Congressman Duncan or Senator Morse to ask for suggestions as to what they think Eugene's position should be. No action was taken.
