Cone at 7:30 p.m. on November 8, 1965 in the Council Chamber with the following councilmen present: Mrs. Lauris, Messrs. Chatt, Crakes, Purdy, Anderson, and Lassen. Councilmen Hawk and McNutt were absent. Minutes of the meeting held October-'25, 1965, as mailed to members of the Council, were approved. NEW BUSINESS 1 Traffic, Broadway and Mill - Councilman Purdy questioned the traffic engineer concerning paint lines placed on Franklin Boulevard at Mill Street. I Mr. Chatt moved seconded by Mrs. Lauris to approve the liquor license applications, except that of Orchard St. Grocery which is to be returned to the Council with more information at the November 22, 1965 Council meeting. Motion carried. 1 Condemnation. Kokkeler Property. Airport - The City Manager reported the Court had awarded $21,500 plus court costs and attorney fees to C. W. Kokkeler in the condemnation suit filed against him by the City for acquisition of airport property. e Mr. Chatt moved seconded by Mr. C~akes to authorize payment to the Kokkelers. Rollcall vote. All councilmen present voting aye, motion carried. 2 Safety Award - The City Manager reported that the City had been presented an award from the National Safety Council for its safety record. Eugene now enjoys a 50% reduction in premium costs due to better accident experience. Ben Massengill of the health department was commended for his diligence in promoting the City's safety program. 3 New City Hall - The City Manager called attention to an article concerning Eugene's new city hall appearing in the current issue of Nation's Cities on page 19. 4 West Coast Petition. CAB - The City Manager reported that the Civil Aeronautics Board had approved the petition for discretionary review of the hearing on West Coast Airlines' petition to delete United service at Medford, Eugene, and Salem. If the City wishes to continue, a brief must be filed with the CAB by December 6, 1965. I Mr. Crakes moved seconded by Dr. Purdy to employ Harry Bowe~,attorney, of Washington, D. C. , to file the brief and give oral arguments before the Board. Motion carried. One-way Couplet, Orchard and Walnut south from Franklin - The City Manager briefly out- 1 lined the proposed change of traffic flow on Walnut, Orchard, and Franklin as.recommended by the Public Works Department. Mr. Bob Fraser, attorney, presented on behalf of Lew Williams Chevrolet a written statement that a substantially higher incidence of rear-end collisions occur at Walnut and Franklin than at the average intersection. He stated that the proposed one-way couplet would be expensive for those people affected by the change in traffic flow at this intersection. : . Mr. Hale Thompson, attorney, stated that he thinks the intersection is improperly sig- nalized and that visibility of the signing is very poor after dark. He also suggested that this matter be heard at a regular meeting after all property owners in the area have had a chance to prepare arguments against the proposed change. Mr. Vern Gleaves, attorney representing Irish-Swartz, stated his client would be willing to close the curb cut on Orchard just south:of Franklin in-exchange for additional width on the alley curb cut behind their store. between Orchard and Villard, and assuming the traffic pattern would not be cnanged. e Mr. Bruce Avrit, attorney speaking for business firms along Franklin Boulevard, objected to the removal of parking from Franklin Boulevard and also _suggested that the Council conduct a rehearing which would allow business people to present their arguments. Councilman Chatt suggested that left turns be prohibited from Franklin to Walnut as well as left turns from Orchard to:Frariklin. Mr. Glen Clark, engineer from the Roseburg Division of the State Highway Department, 1 stated the proposed change has been under consideration for a considerable time for the purpose of reducing the accident rate at the two fntersections. . - - After further discussion, Mr. Crakes moved seconded by Mr. Lassen to hear further argu- ments at the November 8, 1965 Council meeting and also have the staff present an evalua- tion of the suggestions made at this Committee meeting. Motion carried. The traffic engineer explained turning movements on Franklin.Boulevard at Walnut and Orchard Streets as they are now and as they are proposed. He also explained .the problems which would result from prohibiting left turns from Franklin to Walnut and from Orchard to Franklin. Several people in the audience, including Mr. Alton McCully, Mrs. Muuz, and Mr. Sprague, had several sug~stions and ob- jections Attorneys speaking for their clients who were opposed to, the one-way couplet were Hale Thompson, Bob Fraser, and Vern Gleaves. Mr. Crakes moved that the left turns oeprohibited at Orchard and Walnut Street for six months. There was no second. After further dis~ussion, Mr.Cnatt moved seconded by Mrs. Lauris to approve the original recommenda- tion for a one-way couplet-, Walnut arid Orchard from Franklin south",: and proceed with its inst allation. Workable Program - It was reported that the single hurdle to Workable Program recerti- : fication is house-to-house neighborhood housing code inspection. The report indicated that this requirement- will be met. in the near future. e Mr. Chatt moved seconded by Mrs. Lauris that Item 3 of the committee report be received and filed. Motion carried. 4 4. Sidewalk, 1st from VanBuren to Adams - The Public Works Department _recomiriended con- : struction of sidewalk on the south side of 1st Avenue from VanBuren to- Adams to serve more pedestrians in utilizing the traffic signal at 1st and VanBuren. Mr. Anderson moved second~d by Mr. Lassen to approve the. recommend~tion.. Motion carried. 5. Parking Prohibition, Willamette from 23rd to 24th - Mr. William E. Eaton requested re- moval of parking from the east side of Willamette between 23rd ~nd 24th and establi~- ment of one-way traffic south on Wi11amette between 20th and 24th. The Public Works.- Department recommended parking prohibition on both sides of Wi11amette between 23rd and 24th but would not recommend approval of one-way traffic as requested. Council Redevelopment Committee - The City Manager suggested that this committee meet with Mr. Richard Mitchell of the Housing an~ Home Finance Agencywhen~he is in Eug~ne to view' possible redevelopment of the downtowQ area~' The meeting was scheduled for 7:30 a.m. on Saturday, November 13, 1965. e ..... 11/8/65 - 4 42~ e 11/8/65 I 1 7. Cookies and Coffee - The City Manager stated the Eugene Education Association had in- vited Council members for cookies and coffee after some evening Council meeting. The invitation was accepted. 2 8. Civil Defense - A letter from Frank Elliott, Lane County Commissioner, was read in- viting Council members and various staff members to a Civil Defense conference on December 8, 1965, 3: 00 p. m. to 6: 00 p. m. , in Harris Hall. The conference is pre- sented by the Division of Continuing Education of Oregon State System of Higher Educa- tion for instruction in civil defense and disaster readiness. 3 9. Police Complaint, Dunca n, 2560 Wood Avenue - A letter addressed to Mrs. Patrick Duncan, 2560 Wood Avenue, from the Police Chief was read explaining response to a vandalism complaint call from the Duncan residence on October 12, 1965. 4 10. Downtown Redevelopment - A letter from Mr. Glenn Jackson of Pacific Power and Light e Company was read indicating approval of Eugene's interest in a redevelopment program. Mr. Chatt moved seconded by Mrs. Lauris that Items 6 through 10 of the Committee report be received and placed on file. Motion carried. 5 11. Sewer, Gilham Road Elementary School - School District No. 4 requested approval of construction of a pressure sewer line at the expense of the School District to the Gilham Road Elementary School outside theCity limits scheduled to open in the fall of I 1966. No formal action was taken but approval was given to the idea of providing sewer service at School District expense until the property is legally eligible for annexation. Mr. Chatt moved seconded by Mrs. Lauris to approve Item 11 of the Committee report. Motion carried. 6 12. Bid Opening, Traffic Islands Hilyard between 30th and 31st, October 28, 1965 - The Public Works Department submitted quotations received on an informal bid call for construction of traffic separator islands: Robert L. Davis (Low) $ 1,792.00 Fred Stubbert 2,425.00 Mr. Chatt moved seconded by Mr. Anderson to award the contract to Robert L. Davis on his low bid of $1,792. Motion carried." Sewer Assessment WS-64-5, Properties Withheld (Pickett, Palanu;, Hansen (Bedortha), Determan, Gardner - The Council had previously deferred assessments for sanitary sewer in Willakenzie Sanitary Sewer Improvement District WS-64-5 (Ordinance 13996, June 28, 1965) against properties of Loris J. and Frances Pickett, Julian P. and Dana Lynne Palanuk, James P. and Dorris A. Determan, Curtis L. and Zula E. Hansen (Wallace Bedortha), and Ruth W. Gardner c/o Edward T. Gardner. The deferment was to allow the e property owners time in which to arrange subdivision plans or other plans which would help them payoff large sewer assessments. The planning consultant had met with the property owners twice in an attempt to work out a solution, but no action by the property owners has been forthcoming. The City Manager explained the proposed assess- ments. After further discussion, Mr. Anderson moved seconded by Mr. McNutt to present the proposed assessment ordinance for first reading at the November 8, 1965 Council meeting. Motion carried. 8 2. Fox Hollow-Dillard Road Intersection Realignment - The Public Works Director explained, by means of a layout map, the proposed realignment of Fox Hollow Road between East and West Amazon Drives at its intersection with Dillard Road. Mr. McNutt moved seconded by Mr. Crakes to approve the basic plan as recommended, with the staff to return cost estimates of the proposed interchange. Motion carried. 9 3. Walk-Wait Signals, Downtown Intersections - The City Manager stated that the walk- I wait signals at the pedestrian crosswalks in the downtown area are not controlling pedestrian traffic as well as had been anticipated. He recommend~d that the signals be changed to allow pedestrians to start with the green light, and that the time on the pedestrian "wait" signal be lengthened to allow more time for cars to move through the intersections after the pedestrian movement has stopped. Dr. Purdy moved seconded by Mr. Crakes to approve the recommendations. Motion carried. 10 4. Abatement 26th and Potter, Reilly - The Superintendent of Building Inspection reported- that there has been no satisfactory response by Robert J. The Building Department' recommends that abatement proceedings be I started in accordance with Section 11.38 of the City Code. Dr. Purdy moved seconded by Mr. Anderson to proceed with abatement. Motion carried. Mr. Chatt moved seconded by Mrs. Lauris to approve Items 1 'through 4 of the Committee report. Motion carried. 1 5. Speed Zone, Chambers from 18th to Lorane Highway - Darrell Smith, chairman of the Com~ mittee on Neighborhood and Community Affairs, requested that the speed limit on Chambers Street between 18th Avenue and the Lorane Highway be reduced to 25 mph. The City Manager explained that ~peed limits are set by the State Speed Control, Board and that the . Council could request a study of this area. Mr. Lassen moved seconded- by Mr., Crakes to retain the present speed as posted. After further discussion, Mr~ Anderson moved sec~nded by Mr. Crakes.to table the request. Motion carried. Vacation 17th, east of Friendly, Archdiocese of Portmnd - The P1~nning Commission recommended approval of the vacatton of a portion of 17th,Avenue e~st of Friendly Str~et,as requested by the Archdiocese' of Portland. The Public Works Department reported, that the Ctty had' paid $643.26_ for' a portion of the paving of Friendly Street ahd that the- fair ~arket value placed op the property by the Assessor's office I is $400. Dr. Purdy moved: to approve the vacation. , There was no second. After further discussion, it was recommended that the staff give this request fur- ther cons~deration,and repor~ at a lat~r date. 3 7. Planning Connnission Report - November 2, 1965 a. Vacation east/west alley between 10th and 11th from Charnel ton to Lincoln, Archdiocese of Portland - The Planning Commission recommended denial of this request. ,Mr.Lassen moved seconded by Mr. Crakes to deny the vacation. Motion carried~ 4 8. Agreement, Soil Conservation Service on Lower Amazon-Flat Creek Drainage' - The City Manager briefly explained terms of an agreement between the City,"a10ngwith 11 other units of 10ca1,governm~nt, a~d the Soil Conservation. Service with regard to proposed flood control and drainage program for the Lower Amazon'and_F1at Creek water sheds.' Mr. Lassen moved seconded by Mr. Crakes to approve participation'in the agreement. Bids Sewer, 23rd and Onyx - A tabulation of bids received was submitted, and Mr.McNutt moved seconded by Mr. Crakes to award the contract to Howard Nelson Construction Company on their low bid of $5,359.10. Motion carried. 6 10. Bids Walks and Wading Pool, South'Amazon Park" - A tabulation of bids. received was I submitted. Dr. Purdy moved seconded by Mr. McNutt to'award the contract to R. C. Parsons and Son on their low bid of $13,342. Motion carried. 7 11. Ordinance, Towing Cars Obstructing Street Construction ~ A proposed ordinance was submitted which would perm it tbe City to tow cars parked in construction zones. In discussion concerning the proper wording to be used on signs,it was recommended. that the word "in this block" be deleted. Mr. Anderson'moved seconded by Mr. ,McNutt to present tne ordinance as amended at the November 8, 1965 Council meeting. e Motion carried. 8 12. Parking Restriction, 19th west of Agate~ Belisle - Jessie Belisle, owner and ma~ager of the Bungalow For'Beauty at 1461 East 19th, requested 2~hour parking on,19th be- tween Agate and Emerald.
