The adjourned meeting of the Common Council of the city of Eugene, -Oregon - adjourned from the
regular meeting held November 8, 1965 - was called to order at 7=30 p.m. on November 22, 1965 in the
Council Chamber by Council President John Chatt in the'absence of Mayor Edwin;E. Cone with the follow-
ing councilmen present: Mrs. Lauris, Messrs. Crakes, Purdy, Anderson, and Lassen. Councilmen Hawk
and McNutt were absent: .
The minutes of the meeting held November 8, 1965, as mailed to members of the Council, were
approved. ' .

Committee meeting held November 18, 1965:
"Present: Mayor Cone; Councilmen Chatt, Lauris, Crakes, Hawk, Purdy, and Anderson; City
Manager; Assistant City Manager; Administrative Assistant; City Attorney; City
Recorder; Public Works Director; and others.
I 2 1. Union Pacific-Rock Island Merger - William Peebles, representing Southern Pacific Com-
pany, and Jack Atherton, representing Union Pacific, spoke regarding a proposed merger
of Union Pacific and Rock Island railroad companies, and a subsequent sale of a portion
of Rock Island southern properties to Southern Pacific. The proposal has been pre-
sented to the Interstate Commerce Commission, and the two railroads now seek the City
Council's support of the proposed merger and recommended adoption of a resolution to
that effect. Mr. Chatt moved seconded by Mr. Hawk to agree to approve a resolution if
e a study by the Chamber of Commerce indicates that the merger will benefit Eugene and
should be supported and receives the support of the Eugene Chamber of Commerce. Motion
carried.
3 2. Vacation east/west alley between 23rd and 24th, Patterson and Hilyard, McKenzie Green
(Rubenstein) - The Public Works Department had investigated the request for vacation of
this alley and reported a fair market value of '50~ per square foot based on records in
the Lane County Assessor's office. Also, the City has spent $129.58 for paving and
sidewalks adjacent to the alley, which should be recovered. The City Manager read a
letter from McKenzie-Green which offered $300 plus the $129.58 street and sidewalk
assessments for the property. Dr. Purdy moved seconded by Mr. Crakes to maintain the
established policy for setting value of vacated land, and vacate the alley on payment
of $1120 (50~ per sq. ft.) plus the $129.58 assessments. Motion carried.
4 3. Sewer. Area west of Henderson south of Interstate 5. Weaver - James Weaver of Freeway
Investments Co. requested sewer service to a building project on Henderson Avenue south
I of Interstate 5. He also asked that the sewer construction be done on private contract.
The Public Works Department recommended an agreement between the City and Freeway In-
vestments covering conditions of the sewer construction, with the City doing the
engineering work. Mr. Chatt moved seconded by Dr. Purdy to tentatively approve sewer
service requested, subject to execution of an agreement as recommended. Motion carried.
Mrs. Lauris moved seconded by Mr. C'rakes the Items 1, 2, and 3 of the Committee report be approved.
Motion carried.

1 4. Laurelwood Supper Club Lease - A letter was read from Max A. I~gerson, attorney for I
Don Adams, manager of the ~aurelwood Supper Club, conce~ning' negotiation for exten- h,
sion of Mr. ,Adams' lease wl..th the City on the b-asis of a report of revenues received
by the Supper Club over the last'two years. Mr. 'Chatt moved seconded by Mr. Anderson
to negot iate a new lease and that, the lea'seper'iod conform with the City's lease of
the Laurelwood property from ,School District Nd. 4. Motion carried.
Mrs. Lauris moved seconded by Mr. Crakes to 'approve'I~em 4 of the Committee report. Rollcall vote.

2 5. Widening Alley. Alder to Hilyard between 11th and '13th. Sacred Heart - The Public Works
Department qad previously recommended widening .this alley to '24 feet, taking the acldi-
~ional 10 feet from the north ~ide. The ~ddiiional 10 feet ,would be acquired and
dedicated by Sacred Heart Hospital in line 'with an agreement, made at the time 12th
Avenue was vacated. Dr. Donald B. Slocum, Med'ical Specialties Building, Inc., in-
quired concerning the City's intention at this 'time with regard to widening the alley,
whether Medical Specialties would have air righ~s ,ov~r the ~idened right~of-way, and ~
how the setback distance would be affected. After', a statement made by Dr. Slocum and
discussion by Council members, Mr. Chatt moved second~d by Dr. Purdy to request Sacred
Heart to acquire the additional 10 feet for right~of~way on the north side of the
alley to allow Medical ~pecialties to build to the ~etback and to allow~ir rights,
under conditions approved' by the 'City. Motion carried. .
3 6. Bids Paving Alley 18th to 19th between Kincaid and Harris - A tabulation of bids sub- I
mitted on this project 'and opened 'November 16, 1965"was presented, and the Public Works
Department recommended awarding the contract to F~ed Stubbert on his low.bid of
$3,820.40, but to recon~ider the completion date of March'l, 1966. Mrs. Lauris moved
seconded by Mr. Chatt to award the contract to Fred Stubbert and tp negotiate the com-
pletion date. Motion carried.
4 7. Exemption from State Fire Safety and Prevention Regulations - The Superintendent of
Building 'Inspection and the Fire Marshal recommended approval df an application to
the Oregon State Fire Marshal for exemption ,of the City from,certain rules ~~d regula-
tions with respect to fire ,safety and prevention and 'bLiilding construction requirements
for fire safety. If ,approved, the exemption would effect considerable ,savings in plan
checking fe~s leVied 'by the State Fire Marshal's office and elimination of duplication
of inspections and confusion caused by conflicting regulations. The State Fire Mar-
shal 'os 'office would c'ontinue i~spection Clf LPG "installations. Mr'- Chatt moved seconded
by Mr. Crakes to approve filing the application. Motion carried.
5 8. Snorkel Specifications - The City Manager stated specifications for a 75-foot elevating
platform apparatus for the Fire Department had been submitted to several c()mpanies .for
suggestions and recommendations. The staff now feels the specifications are ready 'for
iss~ance of a bid call. The Council gave approval to proceeding wit~ a bid call.

6 9. Sign Variance. 17th and Chambers. Wardrobe'Cleaners - ,The 'Sign ~eqLiest~d is ~bout
25 square feet to be erected at a 4~o angle from the corner of the building. ' Mr.Ander-
son moved seconded by Mr. Hawk to grant the variance. Motion carried. I

7 10. Package:Store Class B' Liquor License AppHcation. Safeway Stores~ 1840 East 13th 7
Councilman Hawk stated that in his opinion this store is located in what is considered
a "dry zone" around the Univers'ity campus' and established by. th~Oregon Li'qtlor Corttr6l
Commission several years ago. Becau~e of ,the store's location, the ~olic~ Depart~ent ~
did not recommend approval. Mr. Chatt moved seconded by Mr. 'Crakes to recommend re- -
je~tio~ of the application. Motion carried.

8 11. Sidewalk.' East Side Oak; North of 7th - The Public Works "Department recommended in-

9 12. Change Order Sewer Design. 'Royal Avenue - The City Manager 'stated that due.to"soi~ con-
diti~ns'and depth o~ ~ewet ~oristruction the Public Works Department had redesigned the
sewers alo~g Royal Avenue to substit'ute shallow 'l~terals ~or ris'ers eo ,deep trunk lines
to serve abutti'ng properties. 'A slight additional expense is anticipated (Sanitary
Sewer T~unk"A", q-::13l2). l1rs. L.auris moved se~onde4 by Dr. Purdy to approve the change
order as recommended. Motion carried.

I 1 13. Traffic Control. City View from 18th to 27th - The Public Works Department recommended
that City View Street from 18th Avenue to 27th Avenue be designated a collector street
, and all intersections posted with "yield" signs for traffic entering City View. Mr.
Chatt moved seconded by Mr. Anderson to approve the recommendation. Motion carried.
2 14. Parking Re~triction. 5th from Lawrence to Washington. A.- B. Scarlett - After review,
the Public Works Department recommended approval of a request from A. B. Scarlett
to extend the 2~hour parking limit on 5th Avenue to Washington Street from Lawrence
Street. Mr. Anderson moved seconded by Mr. Chatt to approve .the recommendation. Motion
carried.
3 15. Parking Prohibition. West Side of Walnut Between Lew Williams Driveways - This prohibi-
tion was requested by Lew Williams Chevrolet because of the installation of the Orchard-
Walnut I-way couplet. The Public Works Department recommended approval. Mr. Chatt
moved seconded by Mrs. Lauris to prohibit parking as requested. Motion carried.
e 4 16. West Coast Petition. CAB - Notice was received of the GAB's order dismissing Eugene's
motion to reopen the record for further hearings on West Coast's petition to delete
United service. The Board had found the motion an unauthorized pleading since the
Board has exercised its discretion to review the Examiner's initial decision. Notice
was also received that oral arguments will be heard on December 15, 1965 at 10:00 a.m.
in Washington, D. C. And notice from the Board of time allotted for oral arguments
I in the review - 15 minutes to the city of Eugene. No action .was taken.
5 17. .Widening 6th and 7th - A letter was read from the State Highway Engineer advising he
would recommend approval of widening and removing parking on 6th and 7th Avenues to
the Highway Commission at the first opportunity. No action was taken.
6 18. Civil Defense Conference. December 8. 1965 - Announcement was again made of this
conference presented by the Division of Continuing Education of the Oregon State
$ystem of Higher Education.
7 19. National Association of Housing and Redevelopment Officials - Announcement was made of
workshop of the Association to be held in Seat.tle, Washington on December 2, 1965.
The workshop will center around provisions of the Housing Act of 1965 and the role of
the new Department of Housing and Urban Development. No action was taken.
8 20. NLC Congress of Cities - The City Manager distributed copies of the proceedings of
the July 24-28, 1965 42nd Annual Congress of Cities, "Communi-ties in Acti on", pub-
lished by the National League of Cities.
9 21. Jail Report. Eugene Ministerial Association - The City Manager also distr'ibuted copies
of a November 1, 1965 report of the committee of the Eugene Ministerial Association
appointed to examine the jail."
Mrs. Lauris moved seconded by Mr Crakes to approve Items 13 -through 21 of the Committee report.

10 Council Bill No. 7289 - Levying assessments for sanitary sewer in Willakenzie Sanitary Sewer Im-
provement District No. WS-64-5 on properties withheld from Ormnance 13996 dated June 28, 1965 (Pickett,
Palanuk, Determan, Hansen c/o Bedortha, Gardner), submitted :and read -t.he first time in full on Novem-
ber 8, 1965 and held over for proper notice of assessment to be given owners of affected properties,
e was brought back for consideration with no written protests on file.

I Alex Burkhart, attorney representing owners of the property, E. L. and Bernadene Gesme, stated his
client wished the building which had moved onto the property by Robert Reilly removed. Several other
residents of the area were present and also stated they would like to see the building removed from
the property.
Mrs. Lauris moved seconded by Mr. Crakes to adopt the resolution. Motion carried.
1 Resolution No. 1245 - Authorizing lease agreement with Donald p. Adams on Laurelwood Golf Course
supper club, was submitted and read in full.
Mrs. Lauris moved seconded by Mr. Crakes to adopt the resolution. Rollcall vote. All councilmen
present voting aye, motion carried.
Upon motion duly made, seconded, and carried, the meeting was adjourned.
