Completion Date: May 31, 1966 The Public Works Dircector stated that bids received on paving Broadway from Almaden to Chaooers were higher than the average cost of jobs'of this nature because existing soil conditions require extra base material. H~ further stated there is only one property owner involved with paving and s~orm sewer in Portlfrnd Park. Addition, and the property owner requested that the bids be rejected and a new bid call issued later. On all projects except the Portland Park Addition, on which the Public Wor,ks Department made no recommendation, the Public Works Department recommended acceptance of the low. bids. I Mrs". Lauris moved seconded by Mr. Chatt that contracts be awarded to .the low bidder on each project as recommended, subject to working out an agreement with subdividers on storm sewer construction costs, exoept paving and storm sewer in Portland Park Addition on which bids were rejected and new bid call to be issued later. Mr. and.Mrs. -David Pubols, 24.23 Emerald, who own property abutting the requested improvement, spoke in favor of the imrpovement stating that during the summer the alley is a dustbowl due to the use by the many apart- ment dwellers in the area, and that it extremely difficult for women to dry clothes outside during that period of the year. Mrs. Lauris moved seconded by Mr. Anderson to approve the petition. ,Motion carried. Mrs. Robert Boord, 1355 Washington Street, commented that all of the signatures on the petition were those of property owners on the west side of the alley which was all commercial property. She further stated that she is opposed to the paving project and would receive no benefit from it. The staff noted that owners of 54% of the abutting property had signed the petition and that two of the properties were on the east side of the alley in the R-l zoned area. Other property owners present who spoke in favor of the project were Samuel Williams, 458 West 13th, and Dave Pubols, 2423 Emerald; ppposed, C. W. Peterson, 2162 Jefferson. 1. Motion carried. 3 Ordinance, Weed Control - The City Manager explained that the present weed mowing program is unsatisfactory and that pro~ucition is very negligible. He further stated there are problems of collection, and that under Oregon statute the City does not have the authority to certify unpaid weed mowing bills as a lien against real property. An ordinance was presented to the Council which would allow the Public Works Department to mow all weeds and grass not taken care of by the property owner as opposed to mowing on a complaint basisl and to bill the respective property owners for a minimum of $12, or ~10 per hour, whichever is greater. The ordinance would also allow the City to cite those property owners who are delinquent. for nonpayment with a violation of the ordinance and summon them into court. Mr. Chatt moved seconded by Mr. Anderson that the ordinance be passed. Motion carried. 2. 4 3. . Offer to Purchase Cit - The Council was ad- vised that only one bid was reeeived for City- owned property located north of 27th Avenue and west of Pearl Street in Frasier Hyland Addition. The bid was received from Gary A. Bernik who later offered to increase his bid to $10,000. The',property is zoned R-3G and is approximately 7000 sq. ft. in size. An appraisal received by the City indicates the property in question might possibly be worth $18,000.. It was suggested by the staff that the City had three alternatives: (1) Sell the property for the $10,000 offer; (2) Hold the property; or (3) Turn it over to a real estate agent. The Council dis- cussed the three possibilities and decided to hold the property for the present time. Mrs. Lauris moved seconded by Mr. Chatt to approve Items 2 and 3 of the Committee report. Storm Sewer Assessment, New Subdivisions - The staff advised that bids would be presented to the Council at its meeting on May 9, 1966, for paving projects which include storm sewer installations. Porter, Bach and'Dwyer, attorneys, on behalf of ~erminal Taxi Service, was read. The letter requested that Council give consideration to ammending the ordinance covering taxicab rates in the City. The present rates are $.50 for first ~-mile and $.10 for each additional \-mile. Termin~l raxiService.requests the rate be modified to $.50 for the first 2/5ths mile and $.10 for each additional 1/5th mile. Paving and Water, Shasta Loop - The Public Works D~partment recommended the City attempt to secure right-of-way for North Shasta Loop according to a map presented by the Department. ,The realignment recommended by the Public Works Department would start at the termination of Agate Stre~t and was not in concurrence with that recommended by the County. The Publi~ Works Department also recommended the City improve that portion of North Shasta Loop with the City limit~ that is not involved in the re- alignment. Mr. W. J. Mason, a property owner to the south of the street in question,. stated that his property had been annexed to the City previ- cously at a time when he was not aware or the annexation, that he could not reach his property through City streets, and that he doubted seri- ously if a fire truck could gain entrance if they were needed. Motion carried. I - 8 12. Amend Building Code, Hospitals - An ordinance was read to the Council which would amend the City's building code to agree with State Fire Marshal requirements. The Eugene building code ~ould be amended by adding provisions to Section 3801 or the Uniform Building Code, 1964 Edition, dealing with regulations pert~ining to new construction or. additions ~o institutional or Group D occupanci~s (hospitals). ;his amendment would permit exempt status for the City by the State Fire Marshal's office. ~t was explained to the Council that even though the.se sections are not: now in the City's building code, anyconsOtruction of this type would still have to comply with State requirements. Amend Code, Filing Improvement Petitions, Cutoff Date - The Public Works Department recommended the City Code tre amended to change the cutoff date for submitting petitions for local improvements from April 1 of each year to January 15. Other agencies, such as the Eugene Planning Commission and Eugene Water & Electric Board, are on record in favor of changing the present date. Motion carried. 14. Remodeling Library Basement, Contract - A letter was read from Architects Hamlin & Martin with regard to an explanation of architect fees for remodel- ing the Library basement. The letter stated the architectural fee would not exceed 10% of construction cost, and it was the hope of the architects the cost might be less because of their knowledge of the building. Any savings would be passed on to the owner. . Mr. Hawk questioned why the architectural fees were above the usual 6% to 7% for remodeling when the architect had originally designed the building. It was explained the remodeling is not a duplicate of the original building, and there- fore demanded a htgher rate for architectural services. The proposed contract was recommended by the Library Board. Dr. Purdy moved seconded by Mrs. Lauris the contract for architectural services by approved. Traffic Report, Whiteaker School Area - The Public Works Department sub- mitted a report which in summary recommended: 1. Madison Street be given right-of-way, installing 'stop' signs at Clark. 2. Clark west of Madison and to Jackson be assigned right-of-way, installing '.stop~ signs on all intersecting streets. I.. , , I '.' I . 3. Lawrence Street from 5th to north be assigned right-of-way, installing 'stop' signs on all intersecting streets (1st and 4th already assigned). 4. Denial of request for traffic signal installation at 1st and Monroe. 5. The Council consider closing crosswalks across Jefferson at 1st and across 1st at Washington. 6. Whiteaker School PTA Safety Committee work toward estab- lishing routes to and from school and that the Block Parent Program provide this routing to ensure compliance by school children. 7. The City encourage Davidson Bakery and Billy's Market to develop off-street parking to lessen pedestrian problems in the area. Three women from the Whiteaker School PTA spoke in favor of the recommendations, although they indicated 'they wished more.could be done.
