An adjourned meeting of the Common Council of the City of Eugene, Oregon _
adjourned from the regular meeting held May 9, 1966 - was called to order at
7:30 p.m. PDT in the Council Chamber by Council President Ray Hawk. with the
following other councilmen present: Mrs. Lauris, Messrs. Chatt, Crakes, Purdy,
Anderson, Lassen. Mayor Cone arrived later and Councilman Mc Nutt w~s absent.

Cone had appointed Dorothy Johnson, 309 Clark Street as a member of the
Committee on Neighborhood & Community Affairs for the term ending January 1,
1969.

Mrs. Lauris moved seconded by Mr, Chatt that the bonds be sold to First National Bank of Oregon on
their bid price of $100.002 per $100.00 par value at an effective interest rate of 3.7405%. Rollcall
vote. All councilmen present voting, aye, motion carried.

,Liquor License Application for Restaurant Class A was submitted by Freeway Investments Company for
establishment (no trade name submitted) at 1035 Ferry Street (new), approved by the Police Department.
Mrs. Lauris moved seconded by Mr. Chatt that the license be recommended for approval. Motion carried.
COMMITTEE REPORTS
Committee meeting held May 12, 1966:
"Present: Councilmen Hawk, Lauris, Crakes, Anderson, and Lassen; City Manager and staff;
and others.

1.:Plumbing Code - The City Manager pointed out that the Building Department had been
working on a proposed plumbing code for about a year, and the ordinance presented
for Council consideration is a variation of the Western Plumbing Officials Associa-
tion plumbing code with amendments. Mr. Lassen inquired as to whether any other
cities in Oregon had adopted their own plumbing code. He was advised the staff is
not aware of any other city in Oregon which had adopted their own plumbing code,
but there is definitely a need for the city of Eugene to do so. Mr. Anderson asked
if plumbing products are tested, and was advised there is no testing program known
to the staff. No action was taken.

The City Manager reported the State Board of Health had requested the City delay action on this item
for three weeks in order for the State to work out any differences they might have 'with the City
on the Code that is now being developed by the State. He also commented the Code is important to

the City because of the City's commitment to the Department of Housing and Urpan Development, and
the proposed ordinance had been approved by the local Homebuilders Association and the local
plumbers' .organization.

2. Protection of Scenic Vistas - A memorandum from the Planning Office was read with
reg@rd to height restrictions to visually protect Skinners Butte. The Council,~di~-
cussed the need for a list of all areas in the City which might require protection
for scenic vistas. Mrs. Lauris moved seconded by Mr. Anderson that the Planning
staff be directed to prepare a detailed report on protection of scenic vistas, and
also to prepare a model ordinance for the Council's consideration. Motion carried.

3. Resolution of dhtent to Rezone, Conditional Zoning - A memorandum from the Planning
Of~ice was read with regard to conditional zoning, .and discussion followed on the
use of "resolution of intent" now being used by the city of Springfield. Mrs. Lauris
moved seconded by Mr. Lassen that the staff prepare a proposed ordinance on condi-
,tiona1 zoning for the Council's consideration. Motion carried.

4. Sister-City Committee - A letter from the chairman and vice chairman of the Sister~
City Committee.was read thanking the City Council ~embers and Maypr for the contribu-
tion of $47.60 to the dimes and dollars for the Chinju fund.

5. Sidewalk, Amazon Parkway - A letter was read from Jess Hayden, 2800 Spring Boulevard,
who requested that a sidewalk be installed on Amazon Parkway from 19th' to, 27th, pri-
marily for the use of high school students going to and from~chobl. The City
Manager advised the Council h~ wQuld writ~ to Mr. ijayde~ to infqr~ him the City is
aware of the problem and is attempting to work out.a so!ution.
Mrs. Lauris moved seconded by Mr. Chatt that Items 4 and 5.of the Committ~e r~port be file. Motion
carried.

6. Property Exchange, McLean Boulevard Reservoir Site,EWEB-Slocum.- A letter was reaq
from the Eugene Water & Electric Board requesting the Council's approval of a resolu-
tion authorizing excha!1ge of certain propertie1' with.-Donald B. Slocum in the McLean
Boulevard area. Mrs. Lauris moved seconded by Mr. Anderson to approve the r~solution.
Motion carried.
Mrs. Lauris moved seconded by Mr. Chatt that Item 6, of the Committee report be approved. Rollcall

7. Traffic Signals, 6th and 7th ~:Xhe Traffic Engineer gave a slide presentation on
traffic intersection sigpalization.: The presentation included pictures of various
cable installations in the City, and pole- and bridge-type installations from
other - c~ties' around the country. ~ Mr. Anderssm ~oved seconded by Mr. Lassen that
action be deferred on this ~tem-unti1 the Development Agency has reviewed the
variOl s types of installations;_, Motion carried.

8. Parking Prohibition, East Side Willamette, 24th Place to 25th - The Public Works
Department recommended prohibition of parking at this location. The recommenda-
tion is based on'discussions with the manager of, Irish's market pertaining to
problems of ingress to and: egress from the off-s,treet: park ing facilities in the
area created by cars parked on the street. Mr. Anderson moved seconded by Mr.Crakes
to appr?ve the recommendation. Motion car!ied. -

9. Paving 1st between Lawrence and alley east of- Lawrence - Petitioned by owners of
50% of the property to be assessed. It was expained that curbs and gutters are al-
ready installed. Mr. Crakes moved seconded by Mr. :[:.ass.en, t() accept the petition:., '

1. Storm Sewer Assessment Policy - Henry J. Camarot,.attorney for the Eugepe Homebuilders
Association, explained to the Council that he had recently been appointed to repre-
sent the, .Homebui1ders Association with regard to the policy on assessment of storm
sewers. He stated,that he had not had sufficient time to fully review the problem
and requested the Council delay action tor 30 days. The staff explained that if con-

tracts on storm sewer construction for 1966 are delayed for 30 days, there will be
insufficient time to complete construction before bad weather arrives; Ken Gilbert
of the Homebuilders Association indicated that he, and probably other' home builders,
would be willing to sign a letter indicating they would abide by any future de-
cision by the Council if time could be obtained to study the moethod of assessing
storm sewer costs. The City Manager explained the City does not have a budget to
pay for the proposed 1966-67 storm sewer projects, therefore the present contracts
previously approved by the Council would have to be delayed. The Council and
other persons present discussed a number of aspects with regard to assessing storm
sewer costs, and it was finally determined there is ill method which would satisfy
all parties involved. Mrs~ Lauris moved seconded by Dr. Purdy the Council adopt
a policy of requiring'subdividers to pay the cost of storm sewer installation in -
new subdivisions up to 24 inches in size. Motion carried.
After a general discussion on the question of assessing storm sewer costs in new subdivisions, the
Council indicate it's intent to meet with the HomebuiMers Association again in the 'future on. this
item whenever necessary.
Mr. Hawk moved seconded by Mrs. Lauris to establish Council policy of assessing costs of storm sewers
in new subdivisions up to 24 inches in size, or the equivalent cost of 24 inches, at a fixed con-
tract price for the subdivision. Motion carried.
Mr. Lassen commented that the Council should have further discussion on the policy considered last
year with regard to the City's paying their share of the cost of storm sewers in new subdivisions
from the $12.8 million bond issue. He further explained that-it was his understanding the original
intent in the bond issue was to provide funds for storm sewers in the older section of town, not
the new subdivisions.

3. Planning Commission Report - May 3, 1966
a. Rezone to R-l area' on south side 18th Avenue between' Friendly and Tyler,
Planning Commission (66-073) - The Planning Commission recommended this area
be rezoned from R-3 Multiple Family to R-l Single Family. Mrs. Lauris moved
seconded by Mr. Crakes to rezone as recommended. Motion carried. '
Mr. Hawk moved seconded by Mrs. Lauris to approve Item 2a of the Committee report ;nd concur with
Mr. Don Hammar's request that should his multiple-use structure at 980 West 18th Avenue be destroyed
by fire, or removed in any other way,' the Council would look with favor upon the structure's being
replaced to the extent of the existing use even though now in an R-l zone. Motion carried.

b. Rezone to R-3G area west of Acorn Park Subdivision, east of Bailey Hill Road,
north of 18th Avenue, Bonson (66-008) - The City Manager explained that although
no action is required of the Council, he felt they should acknowledge the tabling
action of the Planning Commission. Mr. McNutt moved seconded by Mr. Chatt to
acknowledge Planning Commiss~on action. Motion carried.'

c. Annexation area east of Interstate 5 and south of Judkins Road, Weaver (66-076) -
The Planning Commission reported this item had been held over for further study.
Mr. McNutt moved- seconded by Mr. Chatt to acknowledge this item had been held
by the Planning' Commission. Motion carried.
Mr. Hawk moved seconded by Mrs. Lauris that Items 2b and 2c of the Committee report be approved.

3. Bids Improvement Pro;ects, May 17, 1966 - Tabulation of bids was submitted on two
improvement projects. Dr.Purdy moved seconded by Mr. McNutt to award contracts
to the low bidders on each project. Motion carried.
Action on this item was taken earlier in the meeting under New' Business.

4. Sidewalk, Friendly and 28th - A report from the Public Works Department was read
which indicated a poll of property owners shows that 32% were in favor, 39.5% were
opposed, and 28.5% made no reply as to attitude toward construction of sidewalk on
Friendly from 22nd to 28th. With regard to tbe sidewalk on 28th from Friendly
to Washington, the poll indicated 34% for, 52.5% against, and 15.5% no reply. The
committee decided to look at both areas before making a decision.
This item was held over pending the Coupctl's looking at the area.

5. Signals, 6th and 7th - It was explained the Eugene Development Agency recommended
mast-arm construction for signalization of 6th and 7th Avenues, since ,the State
is participating with the City in the cost of -installation. Dr. Purdy moved seconded
by Mr. Anderson that mast-arm signla installation involved in the State program for
widening 6th and 7th be approved. Motion carried.
Mr. Hawk moved seconded by Mrs. Lauris that Item 5 of the ,Committee report be approved. Motion car-
ried.

6. Property Exchange, McKay - It Mas explained that Miles McKay had deeded a portion
of his property adjacent to Ayres Subdivision in error in that he had conveyed more

upon taking the pauper's, oath, be released from jail. -Mr. Chatt moved seconded by,
Mr. Crakes'that such an ordinance be approved. Motion carried.

Road. Condemnation proceedings had authorized $1,660, and the compromise settlement
recommended is $2,310. Mr. Chatt moved seconded by Mr. Lassen to purchase the prop-

9. Right-of-Way, Cal Young Road, Wesley Methodist Church - The Public'Works Department
recommended-purchase of th~onor~h 20.feet of Wesley M?thodist Church property at

18. Diagonal Parking, Low-Volume Streets - The Trafffc Engineer presented a r~ort explainin~
that under existing parallel parking plan some 125 to 130 vehicles can be parked at the
curb. The proposed angular parking plan would provide approximately 115 parking spaces
in the same amount of space used 'for parallel :parking.
19. OakwayGolf Course - The Mayor requested the'-staff to study'and report on methods
of financing the City's acquisition of Oakway Golf Course~" '

Council Bill No. 7224 - Rezone to C-3P Commercial District area at 1700 Highway 99 North be-
tween Pattison Avenue and Dove Lane (Hedrick), subject to performance agreement on right-of-way
dedication and screening, submitted and given three readings on August 9, 1965 and held pending com-
pletion of agreement, now brought back for final passage with the agreement completed.
