Rollcall vote. All councilmen present voting aye, motion carried. 1 The Assistant City Manager explained that the original bids of McKenzie Road & Driveway Company and Stanton W. Payne were $56,176.23 and $54,432.53 respectively and not as shown on the tabulation. The City Attorney stated the errors made in the City's specifications cannot be used as a basis to alter bid figures once bids are opened and award should be made to the low bidder or .reject all bids and start over. Mrs. Lauris moved EO reject all bids on paving C~l Young Road and call for new bids. Motion died for lack of a second. The City Attorney explained details of faulty specifications, and the Public Works Director stated a new bid call would postpone the project until next year and probably result in higher costs. A representative of Stanton W. Payne was asked if he would accept the project at the original b~d price, and he indicat.ed in the affirmative. 4It Mr. Crakes moved seconded by Mr. Anderson to award the contract for paving Cal Young Road from Co burg Road to Gilham Road to Stanton W. Payne on his original bid price of $54,432.53, which price shall include the cost of disputed curb section. Rollcall vote. All councilmen present voting aye, motion carried. 2 The Public Works Department recommended rejection of all bids and issuance of new bid call to be made I separately on sewers and paving on Polk Street from Railroad Boulevard to Bailey Street and on Cross Street from Railroad Boulevard to Polk Street. Mrs. Lauris moved seconded by'Dr. Purdy to approve the :ecommendation, r~jecting all bids, and issuing separate bid calls on sewers and paving. Rollcall vote. COMMITTEE REPORTS Committee meeting held July 14, 1966: "Present: Mayor Cone; Councilmen Lauris, Chatt, Crakes, -Purdy, Anderson, and Lassen; City Manager and staff; and others. 3 1. Report to Community, Eugene Human Rights Commission - Mr. Lassen moved:seconded by Dr. Purdy that the Council accept. the report and thank the Commission for a very fine report. Motion carried. It was also agreed that the Commission will work with the Council toward correcting adverse conditions in the City. Mrs. Lauris moved seconded by Dr. Purdy to approve Item 1 of the Committee report. Motion caFried. 4 2. Planning Commission Report ~ July 5, 1966 a. Rezone RA to C-2 east side of Coburg Road south of Adkins Street, Adkins - The Planning Commission recommended denial of this request. Mrs. Lauris moved seconded by Mr. Anderson the request be denied. Motion carried. I Mrs. Lauris moved seconded by Mr. Crakes to approve Item 2a of the Committee report. Motion carried. 5 b. Rezone R-1 to C-3P both sides of Jefferson between 18th and 19th, Ingram - Mr.Ander- son moved seconded by Mr. Lassen to deny this request for rezoning as recommended by the Planning Commission. Motion carried. . Stewart Rich, 2050 Madison Street, appeared to speak in support of the Planning Commission recommenda- tion to deny rezoning, stating that (1) commercial development would cause a general deterioration of the area; (2) an increase in traffic caused by commercial development would be a hazard to children 4It using Washington Park which is in the same neighborhood; and (3) there is no need for commercial de- velopment here as there is already a market in the area. Clarence Ingram, the petitioner, stated that this is a neighborhood of older homes, that it is quite a way to the downtown shopping area, and that many businesses cannot afford the prohibitive land- cost of the downtomarea, and that new areas should be rezoned for business use for the benefit of smaller businesses. Mrs. Jane R. Alward, 2100 Madison Street, also spoke in support of the Planning Commission recommendation, stating that the residents of the area wish to maintain the residential character of'the neighborhood. Mrs. Lauris moved seconded by Mr. Crakes to approve Item 2b of the Committee report. Motion carried. 6 c. Rezone R-l to R-3 or R-3G area at 375 Rustic Place, Houmes - Dr. Purdy moved seconded by Mrs. Lauristhat this request for rezoning be denied in accordance with the Planning Commission recommendation. Sanitary and Storm Sewers, Marlow Park Subdivision (east of Gilham Ro~d and north of Sally Way) - Petitioned by owners of 100% of the property t.o. be assessed. ,A drainage ditch which formerly ran diagonally across one corner of the property has been re- e located along the street, and the developer has petitioned t~e City to participate in , installation of stor,m sewer at the same time the paving and sanitary sewer are in- stalled. Cost estima~es are: ,'City ,- $8900; S~hool ,District '4 - $1175; Property Owner- $7325. It was explained that while money has not been budgeted specifically for this project, it would be possible to divert money to the project without endangering bud- ge~ed projects. . Appointment Council Representative on Central Lane Planning Council - Mrs. Lauris moved seconded by Dr. Purdy that Mr. Anderson be reappointed to represent the Council . on the CLPC. The City Council members will receive copies of, minut~s of CLPC meetings. I 6 7. Reopening West Coast 'Airlines-United Air Lines CAB Case- A letter was read from Harry A. Bowen, attorney of Washington, D.e., suggesting that Eugene-request reopen- ing the West Coast case, Docket 13415, pertaining to deletion of United service to Eugene, on the basis of a recent California case.' The' City Manager re ported that a -, telegram making'suc~.a request had been sent:to the Civil Aeronautics ,Board. After considerable discussion, it was agreed tha~ the Chambe!.ofCommerce should be asked for a recommendation. - e 7 8. Maughan Property, north of Belt Line east of Coburg Road - Mayor Cone report that this property, approximately 300 acres, has been placed on'the market. Motion carried. ~J -- 7/25/66 - 3 5/ ~ e :1 I Committee meeting held July 21, 1966: "Present: Mayor Cone, Councilmen Hawk, Lauris, Chatt, Crakes, Purdy, McNu~t, A~derson and Lassen; City Manager and staff; and others. 1 1.. Drainage Ditch - Avalon Street and Wil1hi' Street. A petition was read, opposing the digging of a drainage ditch along Avalon Street and Wi1lhi Street in the Bethe1-Danebo area. Present City policy with regard to unimproved streets pro- vides for a gravel shoulder of minimum width and a small ditch along the street to provide drainage for the pavement. The property owners take the position that since they had a 4-inch drainage tile which was removed by the contractot when installing the sewers, the City should replace the tile without cost. The Public Works Department reported that the old 4-inch tile was encountered whea sanitary sewer construction was started in the area, and that it would be difficult to maintain a grad~ by replacing the ~ile in the top of t?e sanitary sewer line e trench. Public Works also advised that the 4-inch drainage tile does not meet City standards. Mr. Las~en moved seconded by Mrs. Lauris to insta1i the drainage tile according to the property owne!s request at the City's expense with the under- standing that the City will not maintain the tile. Motion carried. Several residents of Avalon and Wil1hi Streets asked if the ditch ~n these streets would be fi1ied and the property restored to the same condition as existed before sewer construction was begun. I Mr. Hawk explained that re-insta1ling t~e 4-inch tile was at best only a temporary solution. Mr. Lassen re-emphasized that the City will not maintai~ the 4-inch tile installation. Planning Commission Report - July 11, 1966 a. Annexation - Van Duyn Street between Sisters View Street and Westward Ho Avenue, Jackson. Mr. Hawk moved, seconded by Dr, Purdy to approve this annexation as recommended by the Planning Commission. Motion carried. b. Rezone - 110 Danebo Avenue, AR to M-3, Van Deinse and Allum. Mr. Anderson moved seconded by Mr. McNutt to approve this rezoning according to Planning Commission recommendati~n subject to the condition that the petitioners' enter into an agreement with the City that there will be no gravel excavation other than on-site use and that if the subsequent relocation of Highway 126 should result in any M-3 land lying north of the Highway, it is understood that there will be reconsideration and probable rezon~ng of the property to whatever zone is appropriate at the ~ime. Sanitary Sewer Easement - Pioneer Pike, Hannum. ~he Public Works Department has I determined that installation of the sewer line across the property owned by Roger Hannum (Tax Lot 5300, 17-03-29-12) provides the only practical method of providing the residents of the Pioneer Pike area with sewer service. Since Mr. . Hannum's prop- erty would receive no benefit from the sewer through the back hal~ of his lot, it was recommended that the assessment for his property be deferred until such time as the property requires use of the system for ~hat portion of land outside of the 160-foot assessment for the existing residence. Dr. Purdy moved, seconded by Mr. Lassen that the easement be acquired according to the Public Works Department re- commendation at a cost of $662.25. Library - Magazine Research Center, Basement. Plans and specifications were pre- sented showing the plans for the proposed Magazine Research Center to be constructed in the basement of the Library. The Library Board has approved the plan. Mrs. Lauris moved seconded by Mr. Chatt to approve construction. Motion carried. Mrs. Lauris moved seconded by Mr. Crakes to approve Item 4 of the Committee report. Rollcall vote. All councilmen present voting aye, motion.carried. 5 5. Oakway Golf Course Purchase. The City Manager explained there were several methods whereby the City could acquire Oakway Golf Course. The best method, at the present time appears to be filing of an application for a 50% Federal Open-Space grant and I the formation of a non-profit corporation which would issue bonds and pledge revenues to retire the bonds for the balance of the cost. He recommended as a first step that the City make application for Federal Open~Space funds. Mr. McNutt moved seconded by Dr. Purdy to make application for a Federal Open-Space grant for the purchase of Oakway Golf Course. Motion carried. Mrs. Lauris moved seconded by Mr. Crakes to approve Item 5 of the Committee report. Rollcall vote. Sidewalk Overhang, Register-Guard, 10th Avenue and High Street. A permit to allow I construction of a sidewalk overhang was requested by the Regi~ter~Guard in connect~.'on with plans for construction of a second story on the bliilding,at ,10th Avenue and H~gh Street. The second floor roof projection would extend as far as the marquee on the first floor. Dr. Purdy moved seconded: by Mr; Chatt to approve a revocable permit for this overhang construction. Hicks. et al , vs City of Eugene, et al. The City Attorney' reported that th'e Court has dismissed the action brought by a group of' property owners in the Oakway Road: area seeking to nullify the rezoning of McKay property between Oakway Road,'Coburg Road and'Oakmont Road, and that the rezoning is ~alid. .He further stated that he was not aware of any move to appeal the case to the Oregon Supreme Court. 3 8. Right-of-Way Option, Dillard Road at Fox Ho-ilbW Road, S'Varverud. Personnel Consultant. Two proposals for'conducting a salary survey and. developing wage and salary sched~les for the City of Eugene were presented, one by Public Administration Servic'e for $4,000 and one by Eric Carlson and Assoc-iat'es for $1,500. -It was e~plained that Mr. Carlson's firm -has made surveys in the past for the City, and the work ha~ been very satisf~ctory.
