Adjourned meeting of the Common Council of the city of Eugene, Oregon - adjourned from the regular
meeting held September 12, 1966 - was called to order at 8:30 p.m. PDT on September 26, 1966 in the
Council Chamber by His Honor Mayor Edwin E. Cone with the following councilmen present: Mr. Hawk,
Mrs. Lauris, Messrs. Chat t , Crakes, Purdy, McNutt, Anderson, and Lassen.
Minutes of the meeting held September 12, 1966, as mailed to Council members, were approved.
NEW BUSINESS
1 Chlrine Price Fixing Suit - State of Oregon - A letter was read from the State Attorney General re-
porting that a treble-damage suit will be filed on behalf of the State against suppliers of chlorine,
charging price fixing in violation of the Federal antitrust laws during the period between 1955 and
e 1964, and explaining procedures to be used by cities and water districts which desire to join in
filing suit. It was explained that cities and water districts may file- independent suits or join
with the State and retain Lee A. Freeman, Esq. , Chicago, Illinois, who is the counsel for a number
of cities. Cost to the City, if joining with Oregon, would be a contingency fee of 20 percent of
the recovery, plus a maximum of $2000 in costs to be prorated among the co-plaintiffs in proportion
to their chlorine purchases.
I Mrs. Lauris moved seconded by Dr. Purdy that the city of Eugene join with the State in filing suit
and that Lee A. Freeman be retained as counsel. Rollcall vote. All councilmen present voting aye,
motion carried.

Mrs. Lauris moved seconded by Mr. Hawk to award the sewer contract to the low bidder, and that a new
bid call be issued on the two sidewalk projects. Rollcall vote. All councilmen present voting aye,

l. Planning Commission Report - September 6, 1966 I
1 a. Rezone to M-l, 330 and 340 High Street, St. Vincent de Paul - This change of zoning
was requested to permit operation of a secondhand~store and chapel on the property.
The PUnning Commiss~on recommended denial because the area had previously been re-
zoned from M-l to R-3G in an effort to upgrade the area. Dr. Purdy moved seconded
.! by Mr. McNutt to deny the request. Motion carried.
2 b~.Conditional Use Petmit, 1800 Friendly Street, Nursery School, John Jones - The Plan-
ning Commission recommended approval of this request subject to the following condi-
tions: (1) That all requirements as to the R-l zoning be complied with on the de-
velopment of the site; (2) that additional right-of-way be dedicated on West 18th
Avenue; (3) that signs indicating this use should be limited to one l2-square foot
sign; (4) that the site be developed and mai~tained in a resid~ntial manner; (5) that
existing fenc'es and hedges along the southern portion of the property be maintained
as sit'e screening for the day nursery; four o"ff-stre'et parking. stalls be provided;
and (7) that the play area be fenced and also be in a locatio'n on the northwestern" e
portion of the lot. Mr. Lassen moved sec~nded by Mr. McNutt that a hearing be called
for October 10, 1966. Motion carried.
3 c. Annexation, between Quaker and Bailey Hill Road north of l5th~ Bonson - The Planning
Commission recommended approval of the 100% petition for annexatio~ of this property.
Mrs. Lauris moved seconded by Mr. McNutt to approve annexation~ Motion carried.
4 d. Annexation, south of 18th between Todd and Bailey Hill Road, McCornack-Breeden - I
This annex at ion, requested by a 100% petitio"n, was recommended for approval' by the
Planning Commission. Mrs. Lauris moved seconded by Mr. McNutt to approve the annexa-
tion. Motion carried.
Mr. Hawk moved seconded by Mrs. Lauris to approve Items la through ld of the Committee report. Motion
. carried.
5 e. Rezone to R-3G, area north of West Acorn Park, Bonson - The Planning Commission
recommended denial of this request. The Council concurred with the Planning Com-
mission in encouraging Mr. Bonson to proceed with a planned unit devel~ment, for about
146-148 units on the l5-acre parcel with the prospect that when he is ready, the
zoning ordinance will permit the,development. Otherwise, a program could be de-
veloped by contractual arrangement: Mr. Chatt'moved seconded by Dr. Purdy to deny
the rezoning request. Motion carried. .
Mr. Bonson showed his proposed plan for development of thIs area and requested the Council to short-
cut the usual proceedings followed in zoning newly annexeo areas. He stated that both the ~lanning
Commission and the Council have encouraged him to develop' this "Planned Unit Development Plan", and
that he would like to proceed immediately with the development. It was explained that legal problems
prevent granting such a request, that the City must follow State law which requires public hearings
to be held before annexations can become effective. It was suggested that Mr. Bonson request hearings
on both the proposed plan and the rezoning request at the same time so that the Pla nning Commission
can set conditions for a contractual arrangement or can incorporate appropriate conditions into the I
zoning ordinance. It was further suggested that a letter to Mr. Bonson be prepared stating that the
Council and the Planning Commission have encouraged him in developing this plan.
Mr. Hawk moved seconded by Mrs. Lauris to deny the rezoning request. Mot ion carried..
Mr. Hawk moved seconded by Mr. Chatt that a letter addressed to Mr. Bonson be prepared as outlined.
Motion carried.
6 f. Sidewalks, Highland Oaks Area - The Planning Commission recommended that the City e
Council adopt a standard plan for location of sidewalks in this area. In answer to
quest ions from Max Wright," it was explained that this action has been prompted by
complaints from some area residents and by inquiries from contractors now building
in the area and who are required to construct sidewalks within one year of comple-
tion of a residence. Mrs. Lauris moved seconded by Mr. Lassen to approve the plan
submitted by the Planning Commission. Motion carried.
7 2. SiClewalk, south side of Cal Young and west side of Oakway Road - The question of side-
walks for this area was raised because of the number of children walking to and from
school. Dr.Purdy moved seconded. by Mr. Lassen" that the Council initiate construction
of sidewalks on the south side"of, Cal Young-Road east of Oakway Road, and on the west
side of Oakway Road fr"om ,Fairway Loop to Coburg Road. Motion carried. 1
8 I 3. Curb Sidewalk, Friendly from 22nd to 24th - A letter was read from Ray Tuttle, pastor
of the Friendly St~eet Church of God, requesting a va~ianc~ to pe~mita curb sidewalk I
at this loeation. Mr. Lassen moved seconded by Mr. McNutt that the ,request be denied. I
Motion carried.
9 4. Bethel~Danebo Sewer Trunk C, Right-of-Way
a. Assessment Deferral, Smith and Jackson - The Public Works Department reqeusted per-
mission to defer assessment for Trunk Cagainst- properti.es'owred by William Smith and
Lydia Jackson south of 11th Avenue between Bailey Hill Roa~ and Wallis Street to
enable the City to obtain a permanent sewer easement for Trunk C. Mrs. Lauris
moved seconded by Mr.McNutt to approve the request. Motion carried. e

I 1 b. Condemnat ion, Sewer Easement, Rexius and Bartels - The Public Works Department
requested that the Council initiate condemnation proceedings for sewer ease-
ments against properties owned by William and Kathryn Bartels, and Solomon,
Raymond and Marvin Rexius south of 11th and west of Bailey Hill Road. Mrs.Lauris
moved seconded ~y Mr. McNutt to ~nitiate condemnation proceedings as requested.
Motion carried.
Mr. Hawk moved seconded by Mrs. Lauris to approve Items lf through 4b of the Committee report. Motion
carried.
2 5. Property Sale, area between Washington and Jefferson, 1st Avenue and SP tracks -
The State Highway Department has offered to purchas-e two parcels of City-owned prop-
erty in this area for $1875. It was reported that the properties were originally
reserved for future alleys but were never dedicated for public use. Mr. Crakes
moved seconded by Dr. Purdy to approve the sale. Motion carried.

3 6. Variance Extension, Andy's Catering Service, 2292 DeVos - A. W. Caldwell requested l-year
extension of a variance to operate a catering service at this address. He explained
, that due to the present tight-money situation, it has been impossible to obtain financing
for a new building. Dr. Purdy moved seconded by Mr. Chatt to approve extension of the
I variance for one year on condition that the Caldwells comply with the City's building
ordinances at the present location. Motion carried.
4 7. Variance Extension, Small Animal Clinic, Villard Street, York - A letter was read
from Lutes and Amundson on behalf of Gordon C. York requesting a six-month extension
of a variance for the construction of a small animal clinic on Vilfard between Frank-
lin and Garden. It was explained that because Dr. York has not been able to dispose
of his present property to the University of Oregon, construction on this project
has not begun. Dr. Purdy moved seconded by Mr. Chatt to approve a one-year extension
of the variance. Motion carried.
5 8. Gas Code Amendment - The Gas Advisory Board recommended adoption of an amendment to
Section 22A.28 of the Gas Code. It was explained that the changes are mostly technical
and would not affect residential gas service. Mr. McNutt moved seconded by Mr. Crakes
to adopt the proposed amendments. Motion carried.
Mr. Hawk moved seconded by Mrs. Lauris to approve Items 6 through 8 of the Committee report. Motion
carried.
6 9. Census, Estimated Cost Increase - The Central Lane Planning Council has notified the
City that estimated cost for the County-wide census, in which participation was
authorized by the Council at a cost of $8200 at the meeting of August 8, 1966, has
been found to be too low because of the additional cost of making the count in rural
areas, where it is possible to obtain only 200 names a day instead of the 300 names
I a day originally estimated. Increased cost for the city of Eugene was estimated at
$1800. All participating agencies will share proportionately in the increased cost.
It was further explained that a census in the rural areas is valuable to the City
in planning and annexation questions. Mr. Chatt moved seconded by Dr. Purdy that
the additional cost for the census be approved. Motion carried.
Mr. Hawk moved seconded by Mrs. Lauris to approve Item 9 of the Committee report. Rollcall vote. All
councilmen present voting aye, motion carried.
e 7 10. Parks and Recreation Bonds - It was reported that the Supreme Court is expected to
hand down a decision within a few days concerning the placing of the l~% property
tax limitation measure on the ballot. If the decision is not to place the measure
on the November ballot, the Council should act at the meeting of September 26, 1966
to sell the bonds as speedily as possible in order to be able to take advantage of
the bid for construction of the Westmoreland Park building submitted by Vik Construc-
tion. No action.
A memo was read from the Finance Director outlining possible plans for selling the $1,750,000 Parks
and Recreation bonds authorized by the voters at the May 24, l~66 election. Mr. Hawk moved seconded
by Mrs. Lauris to offer $1,000,000 of the bonds for sale'at this time. Rollcall vote. All council-
men present voting aye, motion carried.
8 11. Closing East Park, 8th to South Park, Christmas Village - A letter was read from
the Christmas Village Council requesting temporary closure of this street for the
I period from November 25, 1966 to December 26, 1966. Mr. Chat t moved s eco nded by
Dr. Purdy to approve the request, and also to request the Christmas Village Council
to remove wires from the trees in the park between Christmas seasons. Motion carried.
Mr. Hawk moved seconded by Mrs. Lauris to approve Item 11 of the Committee report. Motion carried.
9 12. Bids Improvement Pro;ects - A tabulation of bids as opened September 20, 1966 was
submitted. Mr. Crakes moved seconded by Mr. McNutt that the contract for sewer in
e the McLean Boulevard area be awarded to the low bidder. Motion carried. Since no
bids were received on the sidewalk projects on 28th Avenue and on Cleveland Street,
the Public Works Department was authorized to issue another bid call.

3 15. DC-9'Inaugural Flight - West Coast Airlines - ~he Mayo~ and CQuncil members and City
Manager were 'inviLed to be guests of West Coast Airlines on the inaugural flight of
the DC-9 Monday, September 26, 1966, "for a flight to San Francisco, leaving Eugene
at, 4:05 p.m. and returning at 7:25 p.m. Dr. Purdy moved seconded by Mr. McNutt to
postpone the business' session of the Council meeting on' that evening until 8: 30' p. m. e
in order to permit acceptance of the invitation. Motion carried.

3 Resolution No. 1344 - Authorizing abatement at 1570 Acacis Street (Jordan) was submitted, not
read, and held over. Donald Jordan appeared and indicated to the Council that he had been working
on the house as time and money permitted. The Council voted to delay action for 60 day?, if Mr. Jordan
would complete the framing, install- doors and windows, roof and sideing, and, paint the exterior,. . If
not accomplished in 60 days, the Council, will proceed'with the abatement.
