HomeMy WebLinkAbout11/21/1966 Meeting . ,. ~ e 11/21/66 I Council Chamber E~e~, Oregon November 21, 1966 Adjourned meeting of the Common Council of the city of Eugene, Oregon - adjourned from the meetings of November 7 and November 14, 1966 - was called to order at 7:30 p.m. on November 21, 1966 in the Council Chamber by His Honor Mayor Edwin E. Cone with the following councilmen present: Mr. Hawk, Mrs. Lauris, Messrs. Crakes, Purdy, McNutt, Anderson, and Lassen. Councilman Chatt was absent. NEW BUSINESS 1 Parking Assessment District, 10th and Oak - Mr. Hawk moved seconded by Mrs. Lauris that construction of :a 5-level 668-car parking structure and formation of a parking assessment district for the structure at 10th and Oak be approved as outlined in the City Manager's survey and report. e The City Manager reported that as 'of 7:30 p.m. there were filed remonstrances from owners of 24% of the land area in the proposed assessment district representing 9.5% of the assessed valuation. He explained that the method of assessment is based on square footage of land area to be assessed and its location in relation to walking distance from the facility. This method of assessment is identical to that used in assessing the cost of the 7th and Olive parking district~ It was explained that assessments can be bonded to be paid over a 20-year period, with all net revenues from the parking structure credited I against the assessments and the assessments reduced by the amount of the net revenues. Also, any difference between the 6% interest charged on Bancroft bonds by the City (re- quired by law) and the interest paid on bonds sold to finance the structure will be credited against the assessments. Norman Jacobson, consultant in planning the facility, said his survey indicated the need for parking in the area is 811 spaces. The estimated cost of the structure is $1,155,000, land - $800,000, making a total estimated cost of $2,000,000. Construction cost is estimated at $1,535 per space. Mr. Jacobson recommended that a parking validation system would produce the most revenue. He also gave comparative costs of this structure with others in the Northwest. Ralph Robinson, Chamber of Commerce parking committee chairman, reviewed the assessment . credits pledged by the City, the location, and the financing. He said that there is a validation program already underway. He also remarked that the structure would make possible removal of on-street meters to facilitate traffic flow rn" the downtown area. Frank Shearer, chairman of the Eugene Development Agency, commented on the parking facility's relationship to the proposed Eugene Central Project. He said that this park- ing facility provides for good planning and development of the downtown area, and that it will spearhead the downtown project. Hale Thompson, president of the' Chamber of Commerce, said that the downtown area must become a shopping center itself and the parking structure would serve as an anchor. He I remarked that the property owners in this program are providing the facility themselves, aided by use of the City's legal tools. Kurt Neustadter, representing Kaufman Bros., owners of property in assessment Zone 4, said that that firm considered the proposed assessment against their property low com- pared to the benefit they would derive, even if there were no' refunds or credits. He said they felt they were doing no more than providing parking for their customers, and' they are very much in favor of the ticket validation program as part of the overall program. e LaVerne Johnson, representing Robert C. Wilson, owner of property between 10th and 11th on Willamette, supported the proposed district. Mr. Johnson, former city attorney of Corvallis, Oregon, spoke of that City's experience in the operation of one lot and re- marked that property owner opposition to formation of the district has virtually dissolved since the lot has been in operation. Stanley Stevenson, downtown property owner, opposed the method of assessment saying he felt those benefited the least were paying the most. He said he felt the assessment should be based on assessed value of properties. The City Manager explained that parking committee and previous committees had considered many other assessment formulas and had decided the proposed formula is as fair as any which could be devised. He said this formula had proven itself so far as ability to sell Bancroft bonds. Joe Labadie, trust officer for U. S. National Bank and representing an interest in prop- erty on which the parking structure is proposed to be constructed, objected on the basis I that owners of interest had not received notice of the'proposed assessment district and that the legal description of the property shown in the report was incorrect. Mrs. J. H. Hessel, 1129 Oak Street, owner of an apartment house in the district, objected to the method of assessment and said that the assessment amounted to more than the gross income from the property. She said that use of the land assessed should be given some consideration. Jim Stevenson, buying property within the district, objected on the basis that businesses e and offices outside the district boundaries receiving benefit trom the structure will not be paying any assessment. 11/21/66 - 1 ~~ I II rt2i8 . 1l/21/Q6 ..~..~ -- - - - ~._- -"-- ~ -_. ---~- - - -~-- ,- - Clif Culp, realtor, said that he felt the general public should pay for the facility since 1 they are the ones benefiting the most. He remarked concerning "inefficiency" of location of the structure, and said that the assessment district program is bas~d,on assumptions with regard to ,its paying for itself, cost per car, etc. He said that the City would be compet{ng'with itself, because of the parking lot at 12th and Oak. Mr. Cu1p also said he felt the proposed Valley River Shopping Center to be" located north of the Willamette R~ver would complement rather than detract from the downtown area. He said the district's pro- vision of additional parking in the downtown area should not be rushed because of the possi- bility of the Shopping Center. He said the whole matter of additional parking should be de- layed until p1a~ning is completed for the Central Eugene Project. In rebuttal, Ralph Robinson again commented with regard to the City's p1edge~ 'of revenues, to reduce assessments, and'iaid that the validation program provid~s free parking for the public patronizing validating stores. He also pointed out that on-street parking revenues or revenue bonds as a method of fin?ncing a parking structure had been previously rejected by the voters. . , , _ James Weaver, land developer, said that. developers of new. properties must'provide, part of their property for off-street parking, 'and compared the off-street parking structur,e as the manner in which downtown owners can provide parking: . LaVerne JfJohnson again spoke concerning the Corvallis assessment. district with regard to the test' case as to its legality, and said that all issues were resolved, in favor of the dis- 1 trict. He said experience had shown in Corvallis that properties surrounding the parking facility have improved dramatically, and that his client is very much in favor of Eugene's proposed district because they want the benefit they know" can be derived from it. Otto Poticha, architect, questioned the method proposed by City personnel for handling any traffic I;rob1em created by the facility. Norman Jacobson explained that an independent traffic engineer in Seattle was consulted on this phase of the planning. Mr. Jacobson also explained ~hat the shopping driver will be using the pa~king structur~ at~ifferent times than the working driver, so that peak traffic periods' will not coincide. He said that both 10th Avenue and Oak Street can be used for entrance and exit for the structure, and that any change in traffic on 10th and Oak can be accommodated by change in the entrances and exits of,the structure taken into account in the original ?esign. Betty Niven, Planning Commission member but speaking at the request o'f Gertrude Kaufman, prope~ty owner, supported' form'ation of the parking district. Vince Farina, Plannigg Commis- sion chairman, also supported formation of the district. Harry Ritchie) chairman of the Chamber of Commerce ticket validation committee', reported on his contacts with merchants in the downtown area and their favorabt'e response to the validation program. Minnie Schmidt; property owner, questioned the reason for large assessments during the first five years 6f~the program, and the City Manager explained it was because of the retirement of bonded indebtedness over the 20-year period. : C1ar~nce Brown, property owner, object~d to 10catio~ of the propose~ structure, and asked I" why ~t could not be located on the Med~ca1 Center lot on the east s~de of Oak Street. The City Attorney replied that private parking lots cannot be acquired through condemnation, and that it is improbable sale of the property could be negotiated. Pauline Hill, owner of part of the prope-r'ty on which the facility is to be built, objected because she ha'd not received any notice of the proposed dist.i:ict and said that she did not want to give up ownership of the property. C1if Culp again spoke for delay of the project, and"Jim Stevenson again asked why some of ~ the benefited properties were'not bein~ assessed. John Porter, planning director, ~om- mented on the parking facility's relationship with the Cen'tra1 Eugene Project saying that the structure would fit very well into the planned Project. Henry Lowry, property owner, stated he was very much in favor of the proposed district. The MayorHqilled2for a vote on the original motion to proceed with formation of the parking assess- ment district and construction of a 5-1eve1' 668-car parking structure on the west side of Oak Street at 10th Avenue. When this decision is made, there will be discussion with School Board 4 as to how to acquire the Laurelwood prop- erty if it is not to be used for s'chool purposes. . , . Annex Lot 9, Block 4', 1st Additi6n 'Calbrook'(west 'of Satre and south of Bail~y Lane, Archdiocese of Portland) - The Council had held a public hearing concerning annexa- tion of this property on August 24, 1964 at which time an ordinance was passed dis- pensing with election in the City, but the ordinance whic'h wo'u1'd have annexed the' e property was hel,d pending a la-foot dedication for street right-of-way. The Pl,an- ning Commission ~'now advises the require'd dedication has' been made and recommends approval of the annexation. Mrs. Lauris moyed ,seconded by Mr. Lassen to ppoceed with annexation. Motion carried. Mr. Hawk moved seconded by Mrs. Lauris to approve Item la of the Committee report. Motion carried. 2. Planning Commission Report - November 1, 1966 3 a. Rezone to C-3, 328 Willamette, Shirley - The Planning Director explained the Plan- ning Commission had recommended denial of John 'Shirley's petition for rezoning this area from M-2 primarily because oj its location in the prob~ble lst-4t~ connector alignment north of the Southern Pacific tracks at the end of Willamette Street. A recent North Central Eugene study included, this area as R-3G, and the Planning Com- mission suggested that the property be rezoned R-3G at this time. Mr. Shirley-did not wish the R-3G zone. Dr. ?urdy, moved seconded by Mr. Lassen to deny the request. Motion carried. I Mr. Hawk moved seconded by Mrs. -Lauris to approve Item 2a of the Committee report. Motion carried. - 4 b. Amend Zoning Ordinance, Front ~~rd 'Parking in R-3 and R-4 Zones - As a result of a recent request for rezon~n~ in the 2900 block on South .Willamette in order to elimi- nate front yard parking in that' area, the Planning Comm~ssio n recommended changing requirements in all R-3 and R-4 zones to eliminate front yard parking within the required setback. If automobiles are forced to back,into the street right-of-way, -- the setback will be increased to 20 fee~. Di. ,Purdy moved seconded by Mrs. Lauris to approve the amendment. Motion carried. l 11/21/66 - 4 L1';~ e 11/21/66 I Mr. Hawk moved seconded by Mrs. Lauris to approve Item 2b of the Committee report. A letter was read from Wayne Johnson, president of Rental Property Owners of Lane County, asking that the amendment be denied until the Rental Property Owners can work out a more equitable plan with the Planning Commission. George Keating spoke from the floor stating the proposed amendment would work a severe financial hardship on property owners and loss of property to owners. He asked that time be given to allow a more flexible plan to be worked out. The Planning Director said the Planning Com- mission felt flexibility was provided in the amendment through use of variances. Betty Niven, Plan- ning Commission member, also explained the basis for the Planning Commission's recommendation. With the consent of the second, Councilman Hawk withdrew his motion to approve the amendment. Mr. Hawk moved seconded by Mrs. Lauris that the Rental Property Owners being back to the Council for a January meeting an alternative approved by the Planning Commission to gain the results the City is seeking. Motion carried. e Councilman Anderson left the meeting. 1 c. Annex "Mistletoe Island", north and south of 18th east of Bailey Hill Road - This area, containing approximately 39.89 acres, is completely encircled by the City, and had been brought to the Planning Commission's attention, by the County's build- ing and sanitation division because of sanitation problems in the area. The Plan- I ning Commission recommended annexation. Mrs. Lauris moved seconded by Mr. Anderson to proceed with the annexation. Motio'n carried. 2 d. Annex "Wi11amette Island", west of Willamette south of 40th - This area is about 84.5 acres with only one house on 1.23 acres, the balance being cemetery property. It is completely encircled by the City, and the Planning Commission recommended annexat ion. Mr. Anderson moved seconded by Mrs. Lauris to approve the.recommenda- tion. Motion carried. 3 e. Annex "Belt Line Island", south of Belt Line east of Coburg Road - An area of 2.26 acres, completely encircled by the City, if annexed would provide for better develop- mentof the area. The Planning Commission recommended annexation. Mrs. Lauris moved seconded by Mr. Lassen to annex the area.. Motion carried. Herbert Hansen, property owner in the Belt Line area, stated the County has not yet acquired the Co burg Road right-of-way from his property; and questioned if this made any differ,ence with re- gard to the proposed annexation. The Public Works Director explained that the County is obli- gated to pick up the right-of-way so that it would be no problem. 4 f.Vacation portion Graham Drive north and west of McLean Boulevard, Jones - James Jones requested vacation of a curved portion of Graham Drive to allow a proposed new subdivision, including realignment of this portion of the street. The Plan- ning Commission recommended approval. Dr. Purdy moved seconded by Mr. Anderson to proceed with the vacation. Motion carried. I 5 g. Vacation portion alley between 12th and 13th, Alder and Hilyard - Sacred Heart - Supposedly, this area had been vacated by Council action in September 1963, but a portion of the area requested to be vacated had been inadvertently omitted in the final vacating ordinance. The Planning Commission recommended that portion now be vacated. Dr. Purdy moved seconded by Mr. Anderson to proceed with the vacation. Motion carried. : 6 h. Vacation portion 5th Addition to Echo Hollow Park, including Willhi and Juhl Streets, e Sorenson - This vacation would allow replatting of the west end of 5th Addition to Echo Hollow Park necessitated by an intersection of Belt Line with portions of Will- hi and Juhl Streets. The Planning Commission recommended approval. Mr. Lassen moved seconded by Mrs. Lauris to proceed with the vacation. Motion carried. : 7 i. Vacation portion of old City View Street at 28th, Shields - Clifford Shields peti- tioned vacation of 20 feet on the east side of old City View Street north and south of 28th Avenue as platted in Monta Vista Park Subdivision. The old street is no longer needed in the area, and the vacation would allow development as now planned with the 10-foot balance of the right-of-way to be used for a pedestrian way north and south. The Planning Commission recommended approval. .Mr. Anderson moved seconded by Mr. Crakes to vacate the street as requested. Motion carried. 8 j. Vacation portions of Larkwood Street south of Snell, Balzhiser-Chatt - Vacation of the easterly 20 feet of Larkwood Street in Maholo Hills and 1st Addition to Pine I Ridge Estates was requested to allow realignment and replatting. The Planning Com-. mission recommended approval. Dr. Purdy moved seconded by Mr. Crakes to proceed. Motion carried. 9 k. Sidewalks, Shasta Gardens - The Planning Commission recommended installation of side- walks in Shasta Gardens subdivision, north of Barger Drive between Echo Hollow Road and Golden Gardens Street, as shown on site development plan submitted by the Shasta Development Company architect. The plan submitted is a new concept in subdivision layout since it provides for setback sidewalks on both side of the street in some e areas and one side only in other areas, with sidewalks and common open space ill rear II 11/21/66 - 5 \\~ -"~- rtp~- e 11/.21/.66 -. .. .~ - ~ ~ - -- '. yards. There was some discussion indicating concern of Council members ,whether I property owners would install sidewalks at the rear yard locations. Attorney assured the Council, if the ,plan presented :j..s adopted by the Council', it would constitute authority to enforce installation of sidewalks at locatioris shown on the plan. Dr. Purdy moved seconded by Mr. Anderson to approve ~he plan' as presented subject to. an agreement betw~en the City and the subdivider to provide that walks will be built at the rear of the lots'on private properties'at the time each lot is de- veloped. EWEB Release Right-of-Way Crocker Road and Irvington Drive, and Access Easement Across Leaburg Canal Property - The Eugene Water & Electric Board requested Council authoriza- It tion for release of certain rights-of-way near. Crocker Road and Irvington Drive for electric distribution line at the request of property owners in exchange for their pro- viding necessary rights for service ~o the area. The Board also requested authorization for'granting a IS-foot access ~asement across its Leabutg Canal property to Marvin and Josephine McClure. Mr.. Anderson moved seconded by Dr. Purdy to approve the petition, includ- ing 221 feet of Pattison Street. Motion carried. . ' Paving and Sanit'ary Sewer Minda Drive from Norkenzie', Road. to Gilham Road- Petitioned " 3 5. by owners of 59.7% bf affected property. The Public Works Department reported the right-:-of-way on Minaa Drive varies from 40 to 60 feet and recommended, a 36-foot pav- ing on a 60-foot right-of-way. Paving Alley Between Ferry and Mill, 18th to 19th - Petitioned by owne~s of 67% of the abutting properties. Mrs. 'Lauris movea seconded by Dr. Purdy to approve the petition. Motion carried. 5 7. Paving Elizabeth Street, from Royal Avenue to south boundary of' 2nd Addit ion ,to M. P. Lassen Plat - Petitioned by owners of 59% of abutting properties. This street has not been repaired. since sewer' construction, and the City would participate .in cost only i~ the, amount 'provided in the sewer, co'ntract 'to bring the street to condition before sewer construction started. There is no storm drainage problem. Dr. Purdy moved seconded by Mrs. Lauris to approve the petition. Motion carried. I 6 8. The change would also involve landscaping that portion of the public right-of-way be- tween the sidewalk and property line. Olive Street width is now 34 feet and very likely will be widened to 44 feet in the future since it is a commercial arterial. For this reason, it was recommended that if the variance is approved, an agreement be required providing for removal of any encroachment in the' right-of-way at no ex- pense to the C{ty should widening of Olive Street occur. Variances had been granted in the central business district I where existing development extended to the alley property line, but this type of variance had not been granted in outlying commercial and industrial areas. The 3-foot setback would allow a 20-foot alley which would facilitate turning movements and make possible 2-lane traffic. Dr. Purdy moved seconded by Mr. Hawk to deny the requested setback variance.
