The regular meeting of the Common Council of the c~ty of Eugene, Oregon was called to order by His
Honor Mayor Edwin E. Cone at 7:30 p.m. ~n January 9, 1967 in the Council Chamber with the following
councilmen present: Mrs. Lauris, Messrs. Purdy, McNutt, Anderson, Lassen; Mr~. Hayward, Messrs.
McDonald and Wingard. .
Minutes of the Counda meetings he~d December 12, 16, and 22, 1966, as mailed to members of the
Council, were approved.
NEW BUSINESS

Oath of office was administered to re-e1ected Councilman Glen Purdy and to new Council
members Nancy M. Hayward, H. C. McDonald, and George Wingard by Deputy City Recorder
Keith Hedeen. Mayor Cone welcomed the new members.

Outgoing Councilmen R. G. Crakes and Ray Hawk were presented with engraved plaques and
certificates of service by Mayor Cone who commended them for their work while Council
members.

Election, President and Vice President of Council - Councilman Lassen nominated Catherine
Lauris as president. Councilman McNutt nominated Glen Purdy, and moved, seconded by
Dr. Purdy, tha~ the nominations be closed and written ballots cast. Motion carried.
The first ballot ~esu1ted in a 4-4 vote.

Councilman Purdy nominated Catherine Lauris for position of vice president. Mrs. Lauris
declined the nomination. Councilman Purdy nominated Lester Anderson for the position of
vice president. Mrs. Lauris moved, seconded by Mr. Wingard, that the nominations be
closed and a unanimous ballot cast for Lester Anderson for vice president. Motion carried
unanimously, and Councilman Anderson was declared vice president for the ensuing year.

Mayor's Message - Mayor Cone read his annual message to the Council and citizens of
Eugene, reporting on accomplishments during the year 1966 and suggestions for 1~61.
Appointments:j- Mayor Cone announced the appointment of Clare Hamlin for another term
ending January 1, 1971 as a member of the Planning Commission, and the reappoiomment
of Thomas McKeigue as a member of the Library Board for the term ending January 1, 1971.
Councilman Purdy recommended the appointment of W. R. Stephens, 2485 Pioneer Pike, and
Councilman Wingard recommended the appointment of Dr. Oscar Smith,2465 Fairmount Boule-
vard as member of the Budget Committee for the 'term ending December 31, 1969.

10th and Oak Parking Assessment District, DeNeffe Hearing - Mayor Cone explained that
representatives of the DeNeffe estate, owners of property on the south side of 11th
Avenue between Oak and Pearl Streets, and within the proposed 10th and Oak parking
assessment district, did not receive notices of the public hearing on formation of the
district held on November 21, 1966. He introduced Stanley Darling, attorney repre-
senting the DeNeffe estate, who presented objections to formation of the district.
Written objections were filed previously with the City by Mr. Darling. The thrust of
his remonstrance was against the assessment formula based on proximity of assessed
properties to the proposed parking structure. He called attention to the fact that
the DeNeffe property is 40 feet from an established City parking lot at 12th and Oak
which he felt would create a doubt of any benefit to the DeNeffe property to be de-
rived from the proposed facility at 10th and Oak. Mr. Darling objected also on the
basis that no other consideration was taken into account, such as present use, highest
use, distinction between present use and speculative use, future use, etc. He ques-
tioned the study leading to the conclusion that parking spaces are needed in this area,
and stated the City ordinance authorizing formation of an assessment district, because
of its provision that property used for certain types of public parking will not be
benefited and therefore exempted, creates a dual standard of assessment. Mr. Darling
specified certain parking lots within the proposed district which he felt were being
used for private parking but which are exempted from assessment as public parking lots.
He cited the difference in cost of the proposed structure at 10th and Oak and that of
a proposed parking lot at 7th and Willamette, noting the two facilities would serve
fue same type district. He also stressed the point that properties outside the proposed
district will derive benefits from the structure ,as well as those within the district.

Dr. Purdy moved seconded by Mr. Anderson to approve the appointments. Motion carried.

Because Council members felt ample time should be given to reply to the objections presented,
Mr. Anderson moved seconded by Dr. Purdy to continue the hearing to January 23, 1967 Council meet-
ing. Motion carried.

7th and Wi11amette Parking Assessment District - The City Manager briefly reviewed the
survey and report on formation of an assessment district for a parking facility on the
northeast corner of 7th and Willamette, and presented written protests from owners of

property within the proposed district. Remonstrances represented 28% of the total value
within the district, and 26% of the total area.
Robert Elfers, legal counsel for Lane County, presented the County's protest on the
basis of the County's provision of off-street parking for the Courthouse. Written ob-
jections were filed previously with the City by the County.

V. Edwin Johnson, owner of property within the proposed district, spoke in favor of
its formation and cited the percentage of property owners who petitioned formation of
the district.
Dr. Purdy moved seconded by Mr. McNutt to continue the public hearing on this district also ,to the
January 23, 1967 Council meeting. Motion carried.

Payment. Bethe1-Danebo Sewer Easement. Pearl - A statement was presented from Dr.Robert
Pearl for $1,001.85 for sewer easement in Bethe1-Danebo and damages to property and
p1antings.

Dr. Purdy moved seconded by Mr. Anderson to approve payment. Rollcall vote. All councilmen present
yoting aye, motion carried.
Councilwoman Lauris left the meeting.

1. Parking Assessment District, 10th and Oak - Reporting on progress in formation of an
assessment district for a parking structure at 10th and Oak, the City Manager said a
law suit had been filed by First National Bank on behalf of Fred Fisk asking for two
writs of review, one challenging the assessment formula and one because of deferment
of assessment of off-street lots within the proposed district. He further reported

2. Trailer House for Caretaker, Poole's, 1790 Highway 99N - A report from the Superin-
tendent of Building Inspection recommended Council reconsideration of Poole's
request for permission to have a caretaker live in a mobile home on their property.
The report indicated all violations had been resolved. Mr. McNutt moved seconded
by Mr. Lassen that the item be reconsidered at the January 9, 1967 Council meeting.

3. Sidewalk Var{ance, 2358 Terrace View Drive, perlich - Gordon Perlich requested per-
mission to retain the asphalt sidewalk in front of his residence on Terrace View
Drive instead of replacing it' with concrete walk as required by Code. ; The asphalt.
was installed at the time of construction of the residence to facilitate entrance
to the property by the building contractor. Mrs. Lauris moved seconded by Mr. Lassen

4. Holiday Compen$ation' - It was reported that in City 'departments where employes
are required to work on a shift basis, unifermity is lacking in compensation or
compensatory time off for those having to work on a holiday as part of their normal
work week. It was recommended that personnel :rules be amended to provide shift pe~~
sonnel a day of (or ~n extra day's pay for holidays, regardless of whether ihe holiday
falls on the employe's regular work shift. Dr. Purdy moved seconded by Mrs. Lauris '
to amend the personnel rules as recommended. Motion carried.

5. 18th Avenue Alignment - The Public Works Department presented two alternates for
alignment of 18th Avenue at Oak Patch Road as requested by the Council to eliminate
a curve at this location. Alternate No. 1 was recommended because it would maintain
an existing right-of-way and would not create double frontages for some of the abut-
ting properties. Alternate No. 2 would result in a 13% grade which the Public Works
Department considered too steep for an arterial. It was also recommended that the
section from City View to Oak Patch Road be done next summer and the balance com-

6. Vacation Alley between Almaden and Fillmore south of 7th - A report from the City
Attorney was presented explaining vacation of this alley accomplished July 25, 1966
failed to reserve utility easements. A new ordinance was presented which would
repeal.;the original vacating ordinance, then vacate the alley with reservation of
utility easements. It was agreed to present the correcting ordinance for passage
at the January 9, 1967 Council meeting.

8. Sewer Assessmerr, BD-65-8 ~ Council members had toured the area of sewer construction
in Bethel-Danebo for whicha public hearing on assessments will be held January 9,1967,
and general discussion was held concerning assessment onGilbert Subdivision and Shop-
ping Center.

9. Policy, Lateral Sewer Connections - Council members were asked concerning policy with
regard to running sewer stubs to property lines or requiring each property owner to
make his own connection. It was agreed the policy would remain unchanged, and stubs
would be run to property lines at the time laterals are constructed. The question
was also raised whether to make the lateral installations behind the curb or in the
street, and it was agreed that each case would be considered at the, time of connection.
Council members further agreed that lateral systems should be completed in the West
11th, West 18th, and Acorn Park areas. With regard to sewers in. the northwest corner
of Bethel-Danebo, it was decided to consult the County Health Department concerning
need, and then to inform the residents of the area and request an indication from
them as to whether they wish the City to proceed with installation of sewers."

1. Traffic Safety Awards - Venita Howard of the State Department of Motor Vehicles was
introduced. Miss Howard, on behalf of the Oregon Traffic Safety Commission, pre-
sented an award to Richard J. Rementeria for the New Car Dealers Association for
their vehicle safety check program in Eugene. She also presented an award to Mayor
Cone for the city of Eugene in recognition of the traffic record improvement made
in 1965, commenting that it is one of. only three awarded in the State and that it
recognized a reduction in traffic accidents and in injuries and deaths resulting
from traffic accidents.

2. Skinners Butte Cross - The City Attorney reported that Judge Fort ruled the City
does not have authority under State law or under its Charter to permit a religious
symbol on City park property, and that the Cross atop Skinners Butte should be re-
moved. The Judge did not rule on any constitutional issues involved. Mayor Cone
suggested the item be scheduled on' some future agenda to determine whether to
take the issue to a higher court.

3. Bethel-Danebo Sewer Assessment, Pro;ect BD~65-8 - A summary cr. this project from the
Public Works. Department was read. The summary reviewed the bids submitted and
stated there were no objections at the public hearing when the. contract was awarded.
The cost estimated at that time was .3~ less than the actual cost of 6~ per square
foot computed upon completion of the project. The Public Works Director again ex-
plained the policy change which now requires construction of stubs to the property
lines instead of lateral sewer construction only. He also commented on the extent
of the contractor's obligation with regard to street repair after completion of
the proj ect.

4. Sewer Assessment, Gilbert Shopping Center, BD-65-8 - Kenneth Gilbert requested re-
lief from assessment for the sewer constructed from Fairfield Street east through
his property to serve. the Shopping Center and three properties not in his ownership
facing Highway 99N. A report was read from the Public Works Department outlining
the history of design and construction of this line, and stating the only possible
relief might be deferment. of assessment againstthat portion of the property now un-
developed until such time as buildings are constructed and sewer connections re-
quested. Kenneth Gilbert was present and reviewed his request for relief on the
basis that at no cost to the City he granted the easement through his property on
which the sewer is constructed, and on the basis that he could have served his prop-
erties from the line constructed on Fairfield. No action was taken.

consideration with two written protests from Lawrence E. Ferrell, 3496 Royal Avenue, and Flossie
Armstrong, 550 Wellington Street.
Both letters commented on the condition of the street and property after completion of the construc-
tion. Henry Camarot, representing Kenneth Gilbert, requested continuance of the hearing on this
assessment to allow time for him to prepare a remonstrance protesting assessments levied against
Tax Lots 17-04-23-3-1800 (Item 290-$10,126.01) and 17-04-23-3-1900 (Item 292-$15,559.45),properties
in the ownership of Kenneth Gilbert. He requested the continuance to the first Council meeting in
February which normally would fall on the 13th. Since February 13, 1967 is a legal holiday for
the City, the Council agreed that the first meeting in February. would be held on the 6th.
