January 23, 1967
Adjourned meeting of the Common Council of the city of Eugene, Oregon - adjourned from the regular
meeting held on January 9, 1967 - was called to order at 7:30'p.m. on January 23, 1967 in the Council
Chamber by His Honor Mayor Edwin E. Cone with the following councilmen present: Mrs. Lauris, Messrs.
McNutt, Anderson, Lassen, Mrs. Hayward, Messrs. McDonald and Wingard. Councilman Purdy was absent.
Minutes of the January 9, 1967 meeting, as maiE d to Council members, were approved.
NEW BUSINESS

10th and Oak ParkIDgAss~ment District - The City Manager's report was read with regard
to objections filed previously by Stanley Darling on behalf of the DeNeffe Estate prop-
erties on 11th between Oak and Pearl. Also read were affidavits of Dale Brueger, assistant
manager of Eugene Medical Center; Arthur R. Quackenbush, property owner; and John Porter,
planning director. The Affidavits concerned 'exempt' or 'non-exempt' parking status of
certain parking lots within the proposed district.

Robert E. Moulton, representing the 1st National Bank of Oregon as trustee for the
Fred Fisk Estate, owner of a parking lot at 11th and Oak, objected to the assessment
against the Fred Fisk property and joined with Stanley Darling in the matter.

Mr. Moulton claimed no substantial difference between certain lots in the proposed dis-
trict which have been exempted and the parking lot in the Fisk ownership. He stated
the Fisk property had been assessed $186,000, or 9% of the total_ cdst 6fthe fac1tity.
Stanley Darling, representing the DeNeffe Estate properties, reiterated his argument
that a double standard of assessment is being used, present use exempting some prop-
erties, others being assessed on proximity only. He asked that the parking assessment
district be re-initiated after complete examination and mentioned the possibility of
reassessment because of the change in 'exempt' or 'non-exempt' status of portions of
the Medical Center lots.
The City Attorney advised the hearing should be continued to February 6, 1967 Council
meeting in order to notify the Eugene Medical Center of ptDposed assessments on lots
not previously assessed (Parcel No. 33 - $34,540.33 and 54% of Parcel No. 42 - $49,738.07).
Mr. And~rson moved seconded:by Mr. Lauris to continue the hearing to February 6, 1967, with notices
to be sent to Eugene Medical Center. Motion carried.

7th and Wil1amette Parking Assessment District - Robert Elfers, attorney representing
Lane County, again stated the County's feeling that assessment using a formula based
on proximity only is in error. He said the value of property in governmental ownership
is not the same as that of commercial property.

Oscar Spliid, representing John Warren Hardware, said they were not protesting formation
of the 7th and Willamette par~ing assessment district, but wanted to call attention to
notice which had been given the Council previously with regard to property in Warren
ownership which is being converted to a parking lot.
No action was taken, pending consideration of ordinance (C.B.7827) forming district and levying
assessments.

1. Planning Commission Report - December 6. 1966 and January 3. 1967
a. Street Name Change. Pembroke to Parliament - The Planning Commission recommended
approval of a request from Allen L. Colburn to change the name of Pembroke Street
in Cambridge Park subdivision to Parliament. Street, providing new signing of the
street is done at the property owner's exp~nse. Mr. Anderson moved seconded by
Mr. McNutt to approve the recommendation. Motion carried.

b. Rezone to R-3. east side of Polk between Bailey and Cross. Barger - The Planning
Commission recommended denial of this request to rezone from R-2 to R-3 to allow
apartment construction. Crawford Lyle, representing the petitioner, said he felt
R-3 or R-4 density would be proper for this area because the location is sur-
rounded by C-3 and M-2 zoning and is cut off by highway construction. The Plan-
ning Birector reviewed the reasons the Planning Commission recommended denial -
(1) Approval would constitute spot zoning, (2) new zoning ordinance will permit
use similar to R-2 permissive, (3) area is included in North Central Eugene
Study, and (4) proposed development would result in density several times what
it should be, since 14 units would be allowed on this property under the new
ordinance, and 34 are proposed in the development fur which the R-3 is requested.
Mr. Lassen moved seconded by Mr. Anderson to deny the request. Motion carried.

c. Rezone to C-l. northwest corner 11th and Jefferson. Skillern - The Planning Com-
mission recommended denial of John Skillern's request to rezone two lots at this
location from R-3 to permit construction and operation of a service station.
Mrs. Lauris moved seconded by Mrs. Hayward to deny the request. Motion carried.

d. Variance from R-l to permit warehouse and office. 2074 Todd. Redfieid - The Plan-
ning Commission recommended the requested variance be granted Don C. Redfield
permitting a warehouse and office at 2074 Todd Street in an existing residence,
providing the variance is granted for two years only and that the property is
maintained in a residential manner and yard kept free of all debris. Mrs.Lauris
moved seconded by Mr. Lassen to grant a two-year variance, with review after one
year. Motion carried.

e. Variance from R-l to allow retail knitting supply shop, 3569 Willamette, Nielsen -
The Planning Commission recommended a variance for six months only from January 1,
1967 to Elizabeth L. Nielsen to operate a limited retail knitting supply shop in
her residence. Council members were told there were objections in the neighbor-
hood to the commercial use in the residential area, and that a traffic hazard was
created because of parking on both sides of Willamette Street. Mr. WJngard moved
seconded by Mr. Anderson to approve a variance for the period ending June 30, 1967
only. Motion carried.
Josephine Morgan, 60 East 37th Avenue, inquired concerning length of time the variance would be al-
lowed, and was told it would terminate at the end of six months.
Mel Murray, 3607 Willamette Street, submitted a letter of protest signed by residents of the area and
asked that the variance not be extended beyond the six-month period.

f. Zoning Newly Annexed Areas - The Planning Commission recommended the following
newly annexed areas be zoned RA Outer Residential:

2. Agreement with State, Traffic Island at Franklin and Moss - An agreement was pre-
sented between the State and the City concerning reconstruction of traffic islands
at the intersection of Moss Street and Franklin Boulevard. The work has been com-
pleted for a total cost of $2,840.08, contracted for and paid by the City, and this
agreement provides for the State's reimbursing the City for half, $1,420.04.
Mr. Anderson moved seconded by Mr. Lassen to approve the agreement. Motion carried.
Mr. Anderson moved seconded by Mrs. Lauris to approve Item 2 of the Committee report. Rollcall vote.

3. CAB West Coast Petition - ;he City Manager reported the CAB's decision that United
Air Lines service is to be retained at Eugene. He reported also that United stated
in a news release they would not appeal the decision.

4. Wheel Boots - The Council's reaction was invited with regard to the use of a device
(boot) displayed by the Assistant City Manager. The boot is being considered for
use in trying to reduce the number of unpaid traffic tickets and would be clamped
on the front wheel of a car found in violation, the owner of which is known to have
tickets previously issued and still outstanding. Impounding th~ car and towing has
proven to be awkward and expensive. Also, because information.is slow in ooming
from the State, very often the car's ownership has changed. The Council agreed
that consideration of use of the booting device should be further explored.
Mr. Anderson moved seconded by Mrs. Lauris that Items 3 and 4 of the Committee report be received and
filed. Motion carried.

5. Mapped-Streets Legislation - It was explained that in previous sessions of the
Oregon State Legislature mapped-streets legislation was sponsored by the League
of Oregon Cities which would enable cities to adopt ordinances empowering them to
designate location of major arterials in undeveloped areas and control development
in line with those major arterials. The legislation was not passed, and the Council
members were asked if they desired through the League again to ask the Legislature
to consider a mapped-streets law. Mrs. Lauris moved seconded by Mr. Anderson to
proceed to draft such legislation. Motion carried.

6. Transient Room Tax - Co.uncil members were asked if they wished to request enabling
legislation from this session of the Legislature to allow cities to levy a hotel
and motel room tax. This type of tax would provide funds earmarked for civic proj-
ects catering to trans ient -type business such as convent ion halls ,,,.Aluditoriums,
stadiums, etc. There.was general discussion bringing out some protect to earmarking
of any funds. Mr. Anderson mo~ed seconded by Mrs. Hayward to notify the League of
Oregon Cities of Eugene's desire for legislation enabling cities to levy a transient
room tax. Motion carried, Mrs. Lauris voting no.

7. Census - The City Manager reported Eugene'i population is now certified at 75,303.

8. Oakway Shopping Center - A 1e-tter from Miles McKay was presented concerning pro-
visions of the agreement with regard to the Oakway Shopping Center. . Mr. McKay
stated temporary screening around the loading and un10adi ng area was installed as
required, outside disp1.ay of merchandise was discontinued, and an additional 1~'
was added to the planting area so that parked autos do not overhang- the planting area._
Mr. Anderson moved seconded by Mrs. Lauris that Items 7 and 8 of the Committee report be received and
filed. Motion carried.

9. House Moving - The Superintendent of Building Inspection outlined the procedure now
used when permission is requested to move- a house in the Cfty. - In addition to an
inspect ion of the building to be moved-~ the site to which- ft is to be moved, and
payment of a $15 fee, there is also necessary a $500 performance bond t? be posted
by the mover, and a 120-day limit is imposed for issuance of a certific-ate of occu-.
pancy. Questions were raised about limiting the areas into which houses can be
moved, restrictions in the new zoning ordinance, limiting age of structures which
can be moved, requiring a $1000 cash bond to ensure completion of a project after
a house is moved, establishing a set of rules on which :to base a decision as to
whether a house should be moved or razed, establishing a board of review to enforce
aesthetics involved, and possibility of deed restrict:ions to contro 1 types of
h?uses moved. The houses in the Washington-Jefferson bridge area'were mentioned on
which decisions will have to be made soon as to whether to move or raze. Ml:Anderson
moved seconded by Mr. Lassen to refer the item to the Planning Commission for recom-
mendations for developing a program~;for providing control over house moving, and
that the Building Department enforce to the'nth' degree present house moving activi-

1. 7th and Wi1lamette -Parking Assessment District -In answer. to Lane County's remon-
strance the City Attorney recommended deletion of assessment for the 7th and Willamette
off-street parking district against the County's property on the north side of 7th
Avenue between Willamette and Oak (Parcel 20 - $22,375.00). The deletion is :recom-
mended on the b~si~ that this property is publicly owned with a fixed use not deemed
to benefit by the proposed facil~ty. It was recommerided that the proposed assessment
district be formed and assessments made against properties .as proposed, excepting the
one County parcel. The approximate 10% increase to :benefited properties resulting
from the deletion of the one County property is estimated to result in a total aSsess-
ment less' than originally calculated, since the petitioner s excluded all of the
County's property within the proposed district in their initial estimate of cost to
benefited properties. No action was ~aken.

2. Skinners Butte Cross - Brian Obie, president of the Junior Chamber, stated the Jay-
cees are interested in three objectives with regard to the Cross on Skinners Butte:
(1) That no more public funds be spent in connection with the Cross; (.2) that the
objection be removed (i.e., its location on public property); and (3) that the people
should decide its disposition. He said the Jaycees are prepared to take the lead
in raising funds to cover the cost of a Council initiated special election on a
Charter amendment which would permit sale of the land on which the Cross stands to
a private individual or group.

Dr. Purdy moved seconded by Mr. McDon'ald that the Council initiate such an election,
that expense of t~e election be defrayed by fllnds raised by the Jaycees and at no
cost to the City.
Councilman Anderson suggested an alternate method of resolving the issue - that in-
dividuals interested in retaining the Cross seek another site on private property,
construct a new and perhaps larger Cross to be located on:the new.site, and give the
Cross on Skinners Butte to the city of Creswell. . General -aiscussion ensued touch~
ing on re'solution of the issue by relocation of the 'Cross, legal points. which could
or could not be raised if a Charter. amendment is adopted, an~ possi.bilit-y of citizens
init iat'ing a ballot measure.

Mr. Wingard moved to remove the Cross now and proceed with the election. The motion
was not seconded.
Richard Miller, attorney, said the Cross should be removed now and a new location
and new Cross sought. Some doubt was expressed that the City would be able to call
a special election without spending some funds, and Mr. Obie stated the Jaycees would

be willing to post a bond should there be any question with regard to that organiza-
tion's paying any expense involved.
A vote on the motion to initiate a Charter amendment was taken, and motion defeated,5-3.
Mr. Anderson moved seconded by Mrs. Lauris that Item 2 of the Committee report be tabled. Motion
carried.
Mrs. Lillian T. Hamilton, partner in Hamilton Electric, 232 West 5th Avenue, and Leslie Erb, 610
East 39th Avenue, requested the Council to explore every possible manner in which the Cross may re-
main 0n Skinners Butte.
3. Student Dormitory north of Wi11amette River, Sewer Service - MaY9r Cone explained
that a proposed student dormitory north of the Wi11amette River adjacent to the
Chase property could more efficiently be served by the Springfield sewage treatment
plant. Such service requires a request from the Eugene ~ity Council since the pro-
posed development lies within the city of Eugene. Mrs. Lauris moved seconded by
Mr. A~derson to request Springfield to provide sewer service under such conditions
as are suitable to both Eugene and Springfield, Motion carried.
4. Planning Commission Report - December 6, 1966
a. Rename Paragon Road to Bertelsen Road - The Planning Commission recommended chang-
ing the name of Paragon Road south of 11th Avenue, which is in line with Bertelsen
Road north of 11th, to Bertelsen Road. Mr. McNutt moved seconded by Mr. Lassen to
approve the name change. Motion carried.
b. Annex southeast corner Lorane Highway and Chambers, Steinmu11er - The Planning
Commissiol) recommended approval of the 100% petition to annex about 1.18 acres
at this location subject to an agreement with the City to provide that the peti-
tioner pay the cost of pump station and trunk sewer to serve the,property.
Dr. Purdy moved seconded by Mr. Anderson to approve. the annexation as recommended.
Motion carried.

5. Housing Policy Statement - The Eugene Development Agency referred to the Council for
consideration and possible concurrence a housing policy statement adopted by the
Agency. The statement supports preservation and conservation of 10w- to.midd1e-cost
standard housing, especially adjacent to the downtown area, and delineates justifica-
tion for removal of such housing. Copies of the statement will be reproduced, dis-
tributed to the Council, and brought back for consideration at a later date.
Mr. Anderson moved seconded by Mrs. Lauris that Item 5 of the Committee report'be received and filed.

6. EWEB Exchange, Bloomberg Park - The Eugene Water & Electric Board advised the Council
by letter they are ready to proceed with the exchange of Bloomberg Park properties
for construction of a substation to serve Lane Community College and other develop-
ment in that area. City property at the northeast corner will be exchanged for EWEB
property west of the City's ownership to allow more efficient location of the sub-
station. Both the Parks Department and School Board 4 staff recommend approval.
Mrs. Lauris moved seconded by Mr. McNutt to proceed with the exchange. Motion carried.
Mr. Anderson moved seconded by Mrs. Lauris to approve Item 6 of the Committee report. Rollcall vote.

7. Sidewalk Lights, northwest corner Broadway and Willamette - Wilmsen, Endicott & Un-
thank, architects, requested permission to install several sidewalk lights adjacent
to the curb beside the recently remodeled building at this location. James Bernhard,
representing the architects, said the owners of the building will be responsible for
installation, maintenance, replacement, etc., and that no other exterior signs on
the building will be permitted if the lights are insa1led except small name plates
over each window. Mrs. Lauris moved to grant permission for the sidewalk lights.
It was suggested the item should be referred to the Planning Commission and to the
Eugene Development Agency for recommendation. Dr. Purdy moved seconded by Mr.Anderson
to refer to the Planning Commission and to the Eugene Development Agency., Motion carried.

8. 12th and Willamette Pedestrian Crossing - A report from the Public Works Department
was presented with regard to possible change ,in marking or signing the pedestrian
crossing on Willamette at 12th. The report said the basic problem in this area is

House Joint Resolution which, if adopted, would freeze Oregon cities' tax base at the

to be submitted to the people. He said if such legislation is adopted there would be
no fle~ibility for the Budget Committee and: Council without: an election to take care
of any increase in services or inflat ionary trends,' and could result in' an election
