February 27, 1967
The adjourned meeting of the Common Council of the city of Eugene, Oregon - adjourned from the
regular meeting held February 6, 1967 - was called to order at 7:30 p.m. on February 27, 1967 in
the Council Chamber by His Honor Mayor Edwin E. Cone with the following councilmen present:
Dr. Purdy, Mrs. Lauris, Messrs. McNutt, Anderson, Lassen, Mrs. Hayward, Messrs. McDonald and
Wingard.
Minutes of the meeting held February 6, 1967, as mailed to Council members, were approved.
NEW BUSINESS
1
Appointment. Planning Commission - Mayor Cone announced the appointment of John E. Stafford, 2606
Spring Boulevard, as a member of the Planning Commission, replacing Duane Lafferty, resigned, for
the balance of the term ending January 1, 1969.

Dr. Purdy moved seconded by Mr. Anderson to affirm the appointment. Motion carried.

Clift House, 2423 Friendly - The Council's authorization was requested to bid on a house to be moved
to 2423 Friendly Street to replace the A. W. Clift's'home at that address. The Clifts, who live in
the housing code enforcement area, cannot remodel 'their existing home to comply with the housing code,
or buy a new one. It was estimated $1500 would buy and move the house. Homebuilders and suppliers
would donate the necessary labor and materials to establish the house in a livable condition. Funds
could be borrowed from the civic emergency fund and a lien placed on the property so that the amount
would be repaiq to the City. Mrs. Lauris moved seconded by Dr. Purdy to bid on the house. Rollcall
vote. All councilmen present voting aye, motion carried.

3 Transfer of Funds. Library - The Library Board requested transfer of $2,956.72 from the general fund
for the purpose of finishing the basement area. Dr. Purdy moved seconded by Mr. Anderson to transfer
the funds. Rollcall vote. All councilmen present voting aye, motion carried.
4 Laurelwood Golf Course Purchase - Terms of an agreement with School District 4 were outlined covering
transfer of Laurelwood Golf Course to the City over a three-year period for a total purchase price of
$361,640.72, including interest. The initial payment of $149,578.22, to be made by March 3, 1967,
would be covered by transfer of funds. Three annual payments thereafter - $73,937.50 by January 2,
1968; $70,687.50 by January 2, 1969; $67,437.50 by January 2, 1970 - will be paid either through a
bond issue or by borrowing from a non-profit corporation to be repaid over a 20-year period.
Dr. Purdy moved seconded by Mr. Lassen to approve the purchase as outlined. Rollcall vote. All
councilmen present voting aye, motion carried.

It was reported the developer approved the low bid for paving and sewers in Elm Park Addition, but
the Public Works Department recommended holding the award for two weeks on paving;and sewers:in"
Leahy Plat.
Dr. Purdy moved seconded by Mr. Anderson to award cQntr~cts to the low bidder.on each project, except
that the bids submitted for paving and sewers in Leahy Plat be held for two weeks. Rollcall vote.
All councilmen present voting aye, motion carried, ~xcept Mr. Lassen abstaining on award of contract
for paving Elizabeth Street.. '. __

Committee meeting held February 9, 1967:
"Present: Councilmen Purdy, Lauris, McNutt, Lassen, Hayward, McDonald, and Wingard; City
Manager and staff; and others.

1. Sidewalk Variance, 2358 Terrace View Drive, Per1ich - Council members viewed the side-
walk at this location before the meeting and talked with Mr. Per1ich regarding his re-
quest for permission to retain the asphalt walk. Mr. McNutt moved seconded by Mr.Lassen
to uphold the Council's previous decision to require concrete sidewalk according to the
City Code. Motion carried.
Dr. Purdy moved seconded by Mr. Anderson to approve Item 1 of the committee report. Motion carried.

2. Planning Commission Report - February 7, 1967
a. Sidewalk Lights, 58 West Broadway - Both the Planning Commission and the Eugene De-
velopment Agency recommended denial of the Wi1msen, Endicott, and Unthank request
to install 34-inch diameter lights on 9-foot standards at the corner of Broadway
and Wi11amette instead of the usual outdoor advertising signs. The recommendations
were based on the premise that this installation, being on an individual basis, may
not fit into the overall plan for the downtown area. However, it was suggested a
temporary permit might be considered requiring removal of the lights should they
not conform with later development of the downtown area. Discussion touched on
further use of the public right-of-way for private use, location of the lights in
relation to parking meters and other equipment, legal problems, possible use of
the light standards for meter poles, possibility of hanging the lights from the
buildings, etc. James Bernhard, representing the architects, said they would
consider a temporary permit and assured the Council the ,installation would not
interfere with other equipment. Mrs. Lauris moved seconded by Mrs. Hayward to
grant a revocable permit allowing installation of the lights. Motion carried,
Messrs. Purdy, Lassen, and McDonald voting no.

3. Metropolitan Park Study, CLPC - A letter from the Central Lane Planning Council was
presented explaining that a planning grant has been approved by the Department of
Housing and Urban Development for funds for a metropolitan park study to be under~
taken by the Bureau of Municipal Research and Service. Local matching funds of
$8,834 were prorated on,a population basis to the city of Eugene, Lane County, and
Wi11ama1ane Park and Recreation District, with the University making a lump sum
payment. Eugene's share will be $3,048. Mrs. Lauris moved seconded by Mr. McNutt
to participate in the study to the extent of $3,048. Motion carried.

4. Curb Sidewalk, south side 23rd between Patterson and Hilyard, McKenzie Green -
Council members looked at the are in question with regard to a request from McKenzie
Green for a review of previous Council action denying location of the sidewalk at
the curb. Mrs. Lauris moved seconded by Mr. Lassen to uphold the original decision
to require installation of the sidewalk at the standard setback location. Motion

8. NLC Legislative Conference - The 3rd annual National Legislative Conference will
be held March 12-15, 1967 in Washington, D.C. This Conference is sponsored by the
National League of Cities and provides an opportunity for city officials to meet
and discuss with Congressional and Administration leaders the nature and status of
critical city legislation.

9. Street Financial Report, 1965 - A report from the State Highway Department was pre-
sented showing comparable amounts of expenditures for streets in various Oregon
cities during 1965. Included were amounts spent for capital outlay and for total
expenditures which covered capital outlay~ maintenance, traffic controls, etc.
Revenue sources were also shown.

10. CAB West Coast Petition - Council members were informed that West Coast Airlines
filed a petition with the Civil Aeronautics Board for reconsideration of its
order not suspending services of United Air Lines at Medford and Eugene, and
asking for revision of the condition of West Coast's certificate with regard to
subsidy on nonstop services between Medford and San Francisco. Mrs. Lauris
moved seconded by Mr. McNutt to submit an answer to the petition opposing re-
consideration of the Board's decision. Motion carried.

1. Planting Agreement, 2835 Wil1amette Street, Baronti - A report from the Superin-
tendent of Building Inspection was read explaining the events leading to Dr.August C.
Baronti's appeal to the Council for permission to retain the asphalt paving to the
curb line of Oak Street adjacent to his property at 2835 Willamette Street in viola-
tion of a 1964 landscaping agreement. Cecil Stickney, attorney representing
Dr. Baronti, distributed pictures of the area and said the planting strip is not
now feasible, that four or five off-street parking spaces will be lost, and that the
screening has no purpose. Mr. Stickney said that Dr. Baronti is willing to install
the planting if residences are constructed on the east side of Oak Street., Delos
Shinn and Oscar Spliid, tenants, and Dr. Baronti also spoke in support of the appeal.
It was explained that because of the changing character of the area sidewalk in-
stallation requirements were waived and that sidewalk installation depends upon
initiation either by the Councilor by owners of abutting properties. It was pointed
out that the purpose of the original planting agreement was to provide a green belt
to enhance the appearance of the area rather than to screen or block the view of the
property. Mrs. Hayward moved seconded by Mr. Wingard to require compliance with the
original agreement. Motion carried.

2. Ribbon Park Association, Green-Circle Park - Mrs. Florence Murdock presented the
Ribbon Park Association's Green-Circle Park proposal and requested the Council's
support of the general concept of connecting existing City-County parks together
with any new parks by trails under public control. She asked Council authorization
for the appropriate City staff and departments to work with the Association in de-
veloping preliminary plans and information. It was suggested development of such a
plan could be included in the Metropolitan Park Study soon to be started by the
Bureau of Municipal Research and Service. Dr. Purdy moved seconded by Mrs. Hayward
to authorize the City staff to assist on the Green-Circle program in every way
possible. Motion carried.

3. Collective Bargaining Agreements - Robert L. Ferrar, on behalf of the officers and
executive board of Local 1724 of the American Federation of State, County, and
Municipal Employes, requested a meeting with the Council to discuss collective
bargaining agreements. It was agreed a hearing would be held at the regular Feb-
ruary 27, 1967 Council meeting.
Fred Mohr, 2112 Agate Street, recommended the City establish a system of collective bargaining with
its employes.

Robert Ferrar, representing Loca 1724, asked formation of a permanent employment committee compr~s~ng
two councilmen and the City Manager to meet with any City employe to discuss a written contract
governing terms of employment. He maintained that a written contract provides a formal means of
employe-employer relationship, higher operating efficiency, ,and that without it employes are subject
to unfair and unequal treatment. He also maintained that the City's failure to enter into a written
agreement on collective bargaining constitutes a refusal to bargain.
Richard Beck, member of Local 1724, and Patrick Flynn, representing the Lane County Central Labor
Council, also urged Council action with regard to establishing a collective bargaining agreement
with City employes.

4. Skinner's Butte Cross (Lowe vs city of Eugene)- A memo from the City Attorney informed
the Council that Findings of Fact and Decree were filed by the plaint~ffs in,this case
on F'bruary 9, 1967. He further informed the Council that if the City intends to
appeal the case, the proper'legal action will have to be taken no later than Monday,
February 20, 1967. Discussion followed concerning alternatives to an appeal, the fact
that the private.parti~s in the suit do plan to appeal, and financing of a limited
appeal. Mr. Lassen moved,secondedby Mr. McDonald to proceed with preparation of
legal wor,k necessary, at no e~pense to the City, in the event an appeal is, decided
upon at the February 27, 1967 Council meeting. Motion carried.

The,District also -requested that bid procedure be waived and a contract for the work
in the amount of $1,584 'be.awarded .to Willis Mechanical Contractors., Mr. Lassen
moved seconded by Mr. McDonald to grant the waiver and award the contract as requested.

6. West .Coast San Francisco/Los Angeles Service- West Coast Airlines asked the city of
Eugene to intervene witq other cities in,support of a brief submitted to the Ciyil
AeroQautics,Board by West Coast for expedited hearing 'on their reques~ to establish'
service betw~en San Francisco and Los Angeles. A favorable decision by the CAB would
allow West Coast to terminate their flights at Los Angeles rather than San Francisco.
Any brief filed by the City must be fil~d by February 20, 1967. Dr. ~urdy moved
seconded by Mr. McDonald to refer the item to th~ Airport Commiss~on and to the
Chamber of Commerce Aviation Committee, and request an extension of time for filing
a City:brief. Motion carried.
A letter was presen~ed from Fred Brenne, Chamber of Commerce manager, reporting that the Chamber's
aviation committee favored supporting West .Coast's request for expedited hearing on San Francisco/

H. B.1339 - Would _ permit establishment ,of metropolitan study commissions in Euge:ne
and Salem, whereas it 'is now permitted only in Portland. Members of a metropolitan
study commission would be appointed by legislators. Its function would be to make
recommendations with regard to additional forms of government, improvement of local
government services, establishment of boundaries including consolidation of local
jurisdictions with other cities, county areas', or special districts, and in other
areas of ,metropolitan co ncern. D:r:. Purdy moved seconded by Mr. Wingard to go. on '

S.B.l07 - Would make collective bargaining with public employes mandatory. The
present law 'permits' collective bargaining with public employes. The League of

9. J&T Construction Company, 3871 Royal Avenue - A report was presented from the City
Attorney concluding that the present use by J&T Construction Company of land north
of the ditch running through their property for storage of heavy equipment is an
expansion of use as defined by the zoning ordinance. He also stated the City has
no jurisdiction in the use of helicopters; this is governed by regulations of the
Federal Aviation Agency. The Superintendent of Building Inspection was instructed
. to enforce the zoning ordinance and inform the property owners they may not con-
tinue the expanded use of the property for storage purposes."

1. H.B.1338, Annexation - Councilwoman Hayward asked if the Council has taken a posi-
tion on H.B.1338. The bill provides for annexation by ordinance of adjacent areas
having sanitation problems or conditions dangerous to the public health if the
annexing city can provide sewers within a given period of time. The bill is sup-
ported by the League of Oregon Cities. Mrs. Hayward moved seconded by Mr. Wingard
that the city of Eugene support the measure. Motion carried.

2. Commendation, Police Department - Councilman Purdy informed other Council members
that at a recent conference on the campus University of Oregon President Flemming
mentioned the excellent working relationship between Eugene's police department
and the University. He said this is one of the few campuses without its own police
force, and that the University appreciated the professional help received with re-
gard to narcotics and drugs.

3. New Zoning Ordinance - A sheaf of letters was presented from various realtors,
appraisers, builders, rental property owners, and others requesting a six-month
delay in consideration of the new zoning ordinance now before the Planning Commis-
sion. The letters requested that during the six-month period representatives of
each of the groups mentioned meet with the Planning Commission for review of the
ordinance, and that someone other than a member of the Planning Commission moderate.
Planning Commission members present stated it is the intention of the Commission to
hold hearings until all sections of the new ordinance are considered, then further
hearings will be held on those sections on which objections are received. Also,
that work ~~~~ibns will be held wit~ representatives of the various groups before
the hearings are finally concluded. It was the general feeling that a six-month
delay wouid accomplish nothing that cannot be accomplished by tho~ough considera-
tion of the ordinance in the Planning Commission's hearings. It was suggested
that an outline of the ordinance be prepared for those attending the hearings,
and Vince Farina, Planning Commission chairman, said a summary was prepared com-
paring the old and new ordinances where changes were made, and that more will be
printed. The letters were received and filed.

4. Bicycle Agreement, J&W Towing - An agreement was presented between J&W Towing
Company and the City wherein J&W would accept for storage abandoned or stolen
bicycles picked up by the police department. Owners would retrieve their bikes
from J&W, eliminating the need for patrolmen's time and making it easier for the
public. For this service, J&W will receive the net profits from sale of unclaimed
bicycles, which has be averaging about $500 to $600 per year. Mr. McNutt moved
seconded by Mrs. Lauris to approve entering into the agreement. Motion carried.

Street have been obtained and 'a 100-unit apartment house is planned for property
directly in the 1st-4th alignment opposite Charnel ton and Lincoln and between the
Southern Pacific's railroad tracks and Skinner's Butte. The area is now ,zoned M-2.
Acquisition 'of the pro'perty at this time would involve $i50,000. The St'ate Highway
Department has not placed the 1st-4th connector on the State highway system and has
no legal authority to intervene. The connector could skirt the property, but, if so,

11. Traffic Control, 8th and Madison - The Public Works Department recommenped prohibition
of parking for an additional 40 feet in all directions at the intersection of 8th and
Madis'on a's the 'result of a r'equest froni the First Church ,of the Nazarene for traffic
control at that intersection. State law now' prohibits parking within 25 feet of any
intersection. The Public Works Department reported that neither traffic volumes nor
conditions at that corner warrant 'stop' or 'yield' signs. Mr. Lassen moved seconded
by Mrs. Lauris to approve the recommendation, with a review at the end of six months.

Shop, requested parking limits along the, east and west turbsof Mill Street south

16. S.B.36l, Plumbing Code - This measure, if enacted, provides th~t any city which has
adopted the Western Plumbing Officials Code and which maintains satisfactory plumb-
ing inspection procedure would be granted the privilege of exemption from jurisdic-
tion of the State Board of Health or State laws with respect to plumbing regulations.
The bill was introduced at the request of the city of Eugene so that cities may al-
low more modern plumbing methods and materials i~ construction under their jurisdic-
tion. Mr. McNutt moved seconded by Mr. Lassen to support the legislation. Motion
