March 13, 1967
Regular meeting of the Common Council of the city of Eugene, Oregon, was called to order at 7:30 p.m.
on March 13, 1967 in the Council Chamber by Councilwoman Lauris with the following other councilmen
present: Mr.Lassen, Mrs. Hayward, Mr. McDonald, and Mr. Wingard. Councilmen Purdy, McNutt, and
Anderson were absent. Mayor Cone arrived later in the meeting.
Minutes of the adjourned meeting held February 27,1967, as mailed to Council members, were corrected
to show Councilwoman Lauris voting 'no' on the motion supporting permissive legislation only with
regard to collective bargaining agreements with public employes (S.B.I07), and were approved as
corrected.
NEW BUSINESS

House Moved to 955 East ~3id - Henry Baitis, 1930 Buck Street, told the Council that a
house moved onto the lot next to 945 East 43rd Avenue, on which he is building a new
house, is not compatible with planned development of the area. He said the house was
set on the property on February 14, 1967 and no work other than excavation for footings
has been accomplished; that the house in its present state is proving to be a detriment
to property values in the area.

Mr. Wingard moved that Council members look at the house before taking action. There
was no second.
Mr. Lassen moved seconded by Mrs. Hayward to place a 'stop 'work' order on the house and
look at it prior to the committee meeting scheduled for March 23, 1967, and that the
owner of the house be contacted and informed of the situation. Motion carried.
Councilman Lassen commented that he felt strict regulations should be enforced with re-
gard to moving houses. Also, that minimum standards on new construction should be
strictly enforced.

"Present: Mayor Cone; Councilmen Purdy,. McNutt, Anderson, Lassen, Hayward, McDonald, and
Wingard; City Manager and staff; and others.

l. 10th and Oak Parking Assessment District, Fisk Property - Robert E. Moulton, attorney
representing First National Bank as trustee for: the Fred Fisk estate, presented a
chart comparing the use of the Fisk property, east of the Montgomery Ward store on
11th between ~illamette and Oak, with that of two properties exempted from assessment
for the proposed parking facility at lath and Oak. Mr'. Moulton claimed the ratio of
assessment to actual value of the Fisk property was excessive, ,and that there was no
substantial difference between the' use of the parking portion of this property and
other exempted properties, except that it is under a long-term lease whereas the
others are under a 30-day lease arrangement. He asked the Council to consider exempt-
ing that, portion of the property used for parking, thereby reducing the assessment
approximately $80,000.

The City Attorney remarked that there is no relevancy so far as the ratio of assess-
ment to property value is concerned; that the only consideration should be because
of the similarity of the lease and use of the Fisk property to that of the Khox and
Etter properties.' Hr further stated'any, legalities would be decided in court because
of the suit now pending (DeNeffe properties). Reduction of the Fisk assessment by
r about $80,000: (s ':estimated to incr'ease other assessments' in the distri'ct by approxi-
mately 4%.

Roubert Moulton, attorney representing First National Bank, trustee for the Fisk estate, told the
Council that upon passage of the ordinance changing th~ assessment against the Fisk property, h~
would file papers to drop the law suit brought~ against the City by the Fisk estate"
Stanley Darling, attorney for the DeNeffe property, asked if there would be reassessment of prop-
erties in the proposed-district at this time, and was told any adjustment in assessments would be
made after construction of the facility. Mr. Darling also asked if other properties' also would be
exempted if property owners brought in affidavits with regard to use of their properties for public
parking when present leases expire. The City Attorney replied the assessment is made on present
use only.
Mayor Cone entered tha meeting and assumed the Chair.

2. Curb Sidewalk.-Sweet Gum Park - Wyatt S. Rogers requested permission to locata side-
walks at the curb in Sweet Gum Park south of' Harlow Road. The Public Works Department
recommended denial since there are no topographic or right-of-way problems involved.'
Mr. McNutt moved seconded by Mr. Anderson to deny the request. Motion carried.

3. Appointments. Human Rights Commission - Mayor Cone announced the reappointment of

the Human Rights Commission for the term ending January 1, 1970. Dr. Purdy moved
seconded by Mr. McNutt to affirm the reappointments. Motion carried.

4. portland Meadows. Eugene Day - A letter was read from Harold Younkers,' director of

5. Willakenzie Land Us~ Plan ~ Copies of the land us~ plan for' the Willakenzie area,
prepared by the Central Lane Planning Council, were distributed to Council members.
A public hearing onthe plan is scheduled for March 9, 1967,.'7:-30 p~m., in the
Council Chamber, before both County and City Planning Commissions. Considerable
discussion.foll6wed with re~ard to rezoning requests recently submitted which would
allow location of automobile sales co~pan~es in the Willakenzie area. One of the
requests (motorama at.Coburg and Belt Line Roads) has been'tabled by the County
Planning Commission pending study and adoption of the land use plan. . Councilman
Purdy commented that a policy should be set-requiring properties contiguous to the
City to annex to the City if they petition a zone change in the County. Mr.Anderson
moved seconded by Mr. McNutt to recommend to the Lane County Commissioners that they
table any request for zone change in the Willakenzie area, pending completion and
adoption of the Willakenzie Land Use Plan, and that the City Planning Commission be
instructed to render whatever assistance they can in this regard to the County Plan-

6. Truck Loading Zone. Lincoln Street north of 28th Avenue - School District 4 ~equested
installation of a 25-foot truck loading zone at the east curb of Lincoln Street north
of 28th Avenue for access to the Francis Willard School cafeteria. The Public Works
Department recommended approval. Dr. Purdy moved seconded by Mr. McNutt to install
the requested loading zone. Motion carried.
7. Sale City Property. 27th and High - An inquiry was received regarding sale of the
City's property at 27th and High. The City Manager explained bids previously had
been called, and the highest offer submitted was $10,000. The property is appraised
at about $18,000. Mr. Wingard moved seconded by Mr. McNutt to call for bids at this
time. Motion carried.
Mrs. Lauris moved seconded by Mr. Lassen to approve Items 6 and 7 of the Committee report. Motion
carried.
8. Sales Tax - General discussion took place with regard to possible enactment of a 3%
sales tax by the State Legislature, the proceeds to be used entirely by local
governmental agencies - cities, counties, school districts. The discussion also
included possibility of local taxing authority and alternative methods of accomplish-
ing flexibility in financing for local .agencies."

Committee meeting held March 9, 1967:

City Manager and staff; and others.
1. Improvements. 7th Addition Highland Oaks - C. H. Morgan requested waiver of the
January 15 cutoff date in order to complete public improvemen~ in 7th Addition to
Highland Oaks during the 1967 construction season. The Public Works Department
recommended .approval since it.. ~s a relatively s,mall area and ,no problems are
anticipated. Mr. Lassen moved seconded by Mrs. Hayward to include the work in
this year's program. Motion carried.
2. Culvert Extension. 6th Addition Bar M - Clair L. Adkins and Oscar Offet requested
extension of the existing culvert on the drainage channel run~ing through the 6th
Addition to Bar M Ranch subdivision for a distance of about 600 feet north and west.
The Public Works Department estimated the cost of the extension at $14,665.00 and
recommended approval of its installation with Adkins-Offet paying a portion of the
cost equivalent to a 24-inch diameter line. That portion would amount to $4,157,
and the City's share would be $10,508. Both Mr. Adkins and Mr. Offet commented
that the open ditch is a hazard. Mr. Lassen moved seconded ,by Dr. Purdy to approve
extension of the culvert as recommended. Motion carried.
3. Paving 38th, Willamette to Knob Hill Lane - Petitioned by owners of property east
of the proposed paving, none of whom own property abutting the project. The Public
Works Department recommended Council initiation, since the unimproved street is a
short section connecting paved areas. Dr. Purdy moved seconded by Mrs. Hayward to
initiate the paving of 38th from Willamette to Knob Hill Lane. Motion carried.
4. Curb Sidewalk. Hayes Street north of 17th - McKenzie Green requested sidewalk loca-
tion at the curb on the west side of Hayes from 17th to the north end of the cul-
de-sac. There was no objection. The sidewalk on 17th to which it would connect
is located at the curb. Mr. Wingard move4 seconded by Dr. Purdy to grant the re-
quest. Motion carried.

5. Model Cities Grant Program - David Hunt, Eugene Development Agency director, out-
lined possible achievements under the Grant Program. A deadline of May 1, 1967
has been set for submission of the first round of applications. Mr. Hunt said the
Federal government will provide funds to cities on a selective basis equivalent to
80% of the total non-Federal share of existing related Federal grant-in-aid programs.
Selection would probably be made on the basis of greatest need and most imaginative
program. The City Manager said he felt an application would be difficult to justify
when comparing Eugene's needs to those of other cities. Council members agreed to
continue the discussion at the March 13, 1967 Council meeting.
Further discussion took place, with Eugene Development Agency Director Hunt explaining procedures in-
volved in filing of an application are complicated and would mean gathering detailed information on
all related grants now in force in the City. Also, that funds appropriated for this program are very
limited considering the probable number of cities which will apply.
Mrs. Lauris moved seconded by Mr. Lassen to table consideration of application for funds under the
~odel Cities Grant Program for one year. Motion carried.

6. Non-compliance Sidewalk Construction. Fircrest Drive - In June 1966 the Council denied
a request to delay construction of the sidewalk on Fircrest Drive. None of the side-
walk :has .been constructed, and a new petition has now been r,eceiv-ed "re-q-uesting recon-
sideration ,of the Council's action. Council members viewed the area prior to the meet-
ing. Mr. Lassen :moved second'ed by Mrs. Hayward to, uphold the 'previous action and requi.re

4. Legislation. PERS - Comparative figures were submitted by the Administrative Assistant
with regard to employe and employer contributions and employe benefits under the present
Public Employes Retirement System and .thosepr9posed in two measures before the Legisla-
ture. One :measure, H. B.'1077, is designed to provide, aft'et 30 years employment, a: total
retirement benefit both from PERS and Social Security equivalent to 50% of the average
salary for .the ,last five'years of employment. The:other measure, H.B.1264, would try
to proyide a retirement benefit of 50% of.the ~verage salary for the last five years of
employment,' pIus the Social Security payments.
