Adjourned meeting of the Common Council of the city of Eugene, Oregon - adjourned from the regular
meeting held March 13, 1967 - was called to order at 7:30 p.,m. on March 27, 1967 in the Council
Chamber by His Honor Mayor Edwin E. Cone with the following councilmen present: Dr. Purdy,
Mrs. Lauris, Messrs. McNutt, Anderson, Lassen, Mrs. Hayward, Messrs, McDonald and Wingard.
Minutes of the meeting held March 13, 1967, as mailed to Council members, were approved.

The Public Works Department recommended holding award of contract on Rocky Lane '45 days" pending
acquisition of right-of-way, and to award contracts to low bidders on each of the other projects bid
March 15, 1~67. Council members were informed the owners requesting improvements in Cummins Park
and Brunner Park approved the low bids submitted.

With regard to sewer installation in WS-67-l, the Public Works Department recommended award of con-
tract to the low bidder on the basic bid; except Roan Drive on which the alternate (installation in
the street) was recommended. JaroldKieffer, 5'54 Pinto Way, and L. W. Campbell, 3063 Dapple Way,
commented about saving the 'trees .on some .of the sereets. Discussion followed in .this regard, and it
was explained that installation of the line in th~ street in the entire area to avoid removing trees
would cost ~bout $43~000 more than the basic low bid~
Mrs. Lauris moved seconded by Dr. Purdy to approve the Public Works Department. recommendation, except
Rocky Lane, subject to polling property owners in the WS-67-l area with regard to their preference
for sewer installation in the street to avoid r'emoving trees or behind the c'urb. Rollcall vote. All
councilmen present voting aye, motion 'carried;'

Dr. Purdy moved seconded by Mr. Anderson to approve acceptance of the low bid on Rocky Lane paving,
but to delay award of the contrac~ 45 days. Ronald' Allen 1985 Gilham Road, owner of property needed
for right-of-way, was present, and there was some discussion about negotiations in progress on
acquisition of necessary right-of-way from him to permit the Rocky Lane paving; A rollcall vote was
taken on the motion. All co~ncilmen pr~se:pt voting aye, except Mrs. Lauris voting no, motion carried.

1. Willakenzie, Bethel-Danebo Storm Sewers (P-Ore-3273) - Copies o~ a report prepared
by Cornell, Howland, Hayes, and Merryfield with regard to storm drainage systems' in
the Willakenzie and Bethel-DaneQo areas were distributed to Council members. The
report was summarized by Sidney Lasswell and Gary Graham of CH2M who explained the
firm's recommendations and alternates for constructing and financing the drainage
systems. Mrs. Lauris moved second~dby Mr. Anderson to accept the report and recom-
mend re.imbursement of Cornell, Howland, Hayes and Merryfield from a Federal advance-
planning loan. Motion carried. '
Dr. Purdy moved seconded by Mr. McNutt to refer the report to the Council's sewer

2. Audit Report 1965-66 - Harry Jacobs and Don Wall of Winn & Co., the City's audicors,

records. Copies of the report were previously distributed to Council members for

3. Paving North Polk and Cross Streets - A public hearing on this project is scheduled
for the March 27, 1967 Council meeting, and a number of protests from owners of
property which would be assessed were received. The project, which includes paving
C~oss Street from Polk to Railroad Boulevard, was initiated by the Council in March
1966, but deiayed when it was found a sanitary sewer would have to be installed;

A report from the Public Works Department gave the history of the line now in use on
Polk Street, and a sketch was shown indicating private connections and properties
not previously assessed for use of the sewer. The Public Works Department recommended
delay of the Polk Street paving if it is decided not to c'Onstruct the sewer at ,this
time, and to proceed with paving Cross Street. No action was taken.

The City Manager again reviewed the history of the sewer line now in use on North Polk, and explained
that only owners of those properties no having been assessed will have to pay an assessment for con-
nection to the new line. He said construction is necessary to complete the separation of storm and
sanitary sewers in this area. James D. Campbell, 1360 S~nny Drive and owner of property at 280 North
Polk; Mrs. Wallace Stein, 93 North Polk; and Mrs. K. W. Peterson, 273 North Polk stated their objec-
tions to the new line. Councilman Anderson asked whether property owners could take legal action
against the City for assessment against their properties if they had already entered into a contract
with the City in 1914 for sewer service. The City Attorney said there is nothing which would legally
prevent the City from installing the sewer and levying the assessment.
Dr. Purdy moved seconded by Mr. Anderson to proceed with paving Cross Street. Rollcall vote. All
councilmen present voting aye, motion carried.

4. Assessment. Paving and Sidewalk 27th from Columbia to Spring. Boulevard - Council members
were apprised of reasons for increased amount of actual assessment over the original
estimated costs. A public hearing is scheduled for the March 27, 1967 Council meeting.

5. House Moving. 955 East 43rd - The City Attorney's op~n~on was read with regard to com-
plaint from Henry Baitis concerning a house moved to 955 East 43rd, and on which a
"stop work" order was issued. The opinion stated unless the permit was issued in
error or as a result of misrepresentation, it cannot be revoked. Mr. Anderson moved
seconded by Dr. Purdy to rescind the "stop work" order. Motion carried.
Some discussion ensued as to time limit for completing the house and requirements for
landscaping, and on general rules and regulations governing house moving in the City.
The Superintendent of Building Inspection said a detailed outline is being drafted of
more restrictive procedures o:n house moving which will be presented to the Council
for consideration.

Henry Baitis, 1930 Buck Street, owner of property adjacent to 955 East 43id Avenue, offered to pay
the fee to have three appraisers determine the life of the house after being moved to this location.
He again stated his objections, drawing attention to what he felt were features detrimental to the
area. Also voicing objections were George Houts, 4130 West Amazon Drive; Ronald Dykes, 4745 Brook-
wood Street; and K, J. Braun, 5550 West Amazon Drive. Elmer Sahlstrom, 715 Fair .Oaks Drive, one of
the owners of the house moved, commented on work planned to bring the house to Code requirements.

A vote was taken on the motion to rescind the "stop work" order, and motioq carried, Mrs. Lauris
voting no.

6. Public Works Bids. Opened March 15. 1967 - The Public Wqrks Department recommended
holding award of contract for paving Rocky Lane for 45 days pending right-af-way
acquisition; award of contract to low bidder for paving streets in Cummins Park,
subject to approval of the developer; and award of contracts to low bidders on' each
of the other projects. Mrs. Lauris moved seconded by Dr. Purdy to approve the recom-
mendations. Motion carried.

7. Public Works Bids. Opened March 21. 1967 - Basic bids'submitted for sanitary sewer
installation iq Willakenzie Sewer Improvement District WS-67-l covered installation
of the line' behind the curb, 'except on Rustic south of Sorrel and a portion of' Dait-
moor south of Harlow Road. In those two' areas the basic bids were 'for {nstallation
in the street. Alternates submitted by the low bidder were shown for installation
in the;street in ni~e different area~~ and' ranged 'fiom an additional'~/10ihs~e~t
to 81:2<; per square foot. . Mrs. Lauri ~ moved seconded by Mr. "Anderson to award con-

8. Property Purchase. 7th and Willamette Parking District - The City Manager informed
~he Council that options taken on the Millican property for $70,000 and on the Steen
property for $55,0~0 ~ill expire April 1, 1967. He stated the prices of both prop-
erties, located in the quarter-block at the northeast corner of 7th'and Willamette
to be acquired for off-street parking; are reasonable. Mr. Anderson moved seconded

1. Electrical Code Amendment - A proposed ordinance was read which would -amend the
Electrical Code to provide minimum standards no lower than required by the State
Electric& Code. The Electrical Board recommended its adoption.
No action was taken (see action under Ordinances).
2. Beautification Program - It was requested that .the Mayor be authorized to appoint
an ad hoc committee representing various civic committees in the community to
develop a three-to five-year urban beautification program.
Dr. Purdy moved seconded by Mrs. Lauris to proceed with the committee appointment. Motion carried.
3. Legislation
S.B.180 - Enactment of this bill would limit campaign expenditures for election
to a City office to $500.
Mr. Anderson moved seconded by Dr. Purdy that the item be tabled. Motion carried.
H.B.1753 - Would provide for issuance of State bonds to finance assistance to
municipalities for community development programs, but would become effective
only if State Constitution were amended to authorize bond issues. There was
no information as to how the bonds would be retired.
Mr. McNutt moved seconded by Mr. Anderson that the item be tabled until further information is re-
ceived. Motion carried.
S.B.386 - Enactment would make mandatory vote of the people on initiation of
any public housing of more than ten dwellings, whereas authority now rests
with local governmental agencies.
Mayor Cone left the meeting during this discussion, and Council
President Purdy assumed the Chair.
Mr. Anderson moved seconded by Mrs. Lauris to oppose S.B.386. Motion carried.
4. West Coast Petition - Council members were informed of the CAB order denying West
Coast's petition for reconsideration of the Board's decision to deny West Coast ex-
clusive service to Medford, Eugene, and Salem. The Board did amend its former ruling
with regard to the subsidy on West Coast nonstop service between Medford and San
Francisco or Oakland. The City Manager also reported on increased activities at
Mahlon Sweet Field.
No action was taken.
5. Resignation, Chief of Bethel Volunteers - The City Manager reported that Chief
Byron Barnes of the Bethel Volunteer Fire Department has resigned after some
24 years of service, and that a letter of appreciation has been sent to him.

against his property on the basis that the assessment was not of record at the time he bought the

Mrs. R. A.' Chambers, 1770 Skyline Boulevard, read a statement from McKenzie River Motors pro.testing
the assessment against property at 2225 Coburg Road. The protest was based on the annexation of the
