Regular meeting of the Common Council of the city of Eugene, Oregon was called to order at 7;30 p.m.
on April 10, 1967 inrthe Council Chamber by His Honor Mayor Edwin E. Cone with the foll:owing council-
men present; Dr. Purdy, Mrs. Lauris, Mr. Anderson, Mr. Lassen, Mrs. Hayward, Mr. McDonald, and
Mr. Wingard. Mr. McNutt was absent.
Minutes of the meeting herd March '27, 1967, as mailed to Council members, were approved.'

:Mayor Cone 'introduced IMr.: Yon See Chung; a public affair,s" assistant wi'th 'the American
Embassy in Seoul, Korea. Mr. Chung is visit :ii.ng Eugene as part of cl"toLir of th'e
United States.

Mayor Gone also recognized a radio and tel'evision' news cl'ass from the' University' of'
Oregon. The class was observing the Council meeting as part of an assignment from
their instructor, XarlNestv6ld.

Councilwoman Lauris' me'ntioned ,the' deplo'rabl'e 'condition of the Maso'nic cemetery located
.at 25t,h .and University and asked if "something could be done to get 'it cleaned up. She
suggested possible preservation of the area as an historic site. It was understood the
Masonic Lodge would be contacted 'and'~ report brought back to the'Couhcil.'

Councilman Anderson said he felt the maintenance of .cemeteries, is a legislative problem
and moved, seconded by Mrs. Hayward, to propose to 'the League of Oregon Cities that a
study be made of legislaeion affecting cemetery maintenance with the idea' of presenting
:something to the 'next 'sess'ion of the Legislature. Motion' carried.'

Councilman Purdy suggested a request be made for a feasibility study on a low-level dam
on ,the Willamette River' in the North B:ank P:ark area,. and moved, seconded' by' Mr :"Anderson,
that contact he 'made with the' Army Engi'nee'rs in this reg'ard: M6tion"carried, Mr.' Lassen
voting no.

Councilman -Anders'on asked' about the proposed "sign ordinance 'and was told the planning
office has nearly completed work on the draft.

, 'The 'Mar'ch-April.196T Grand Jury Report co:nce'rning the City/County jail was re'ad. The
report state the jail is understaffed; facilities for abtorneys, visitors, and medical
examiners are inadequate; and the kitchen is unsanitary.
The City Manager said the jail 'is not considered to he understaffed. He said that the
City realizes the inadequacy of visitors' facilities, but expansion plans for the,jail
were discontinued when it was decided to go ahead with the Central Eugene Project so
that. suitabledeterminiltion could ,be ,made as to the jail's l'ocat ion in relation t'o the
downtown area in the overall Project 'planni'ng.. ' The City Manager 'also st'ated that the
jail kitchen was inspected during the afternoon of April 10, 1967 by the County Sani-
tarian and'found'to be in ~atisfa~tory condition. The kitchen will "hereafber b~ in-
spected by the County Sanitari~n's office on a monthly schedule. No action was taken.

It was recommended the low bid be thrown out, since Emerald Tr,ee Service is opera'ted by
a City employe, and that the contract be awarded to the second-low bidder. Dr. Purdy
moved seconded by Mr. Anderson to award contract to Engelmann's Tree Surgery. Rollcall
vote. All councilmen present voting aye, motion carried.

2. Millrace Commission Report - Ken L. Morin, chairman of the Millrace Commission ap-
pointed to study and make recommendations regarding the lower millrace, commented on
the Commission's recommendations contained in its report, copies of which were pre-
viously distributed to Council members. The City Manager summarized the Public
Works Department review of the report. Clif Culp, member of the study COmmission,
said that it was the commission's intent that no City funds be spent for right-of-way
or easement acquisition, rather that dedications be worked out with owners of property
abutting the race. Mr. Anderson moved seconded by Mrs. Lauris that the City attempt
to acquire, develop, and maintain the lower millrace as a scenic and recreational
attraction, and that a commission be established to implement a plan of accomplishment.

Some discussion took place concerning costs involved in acquiring millrace easements or dedications,
necessity for determination of a firm plan before going to the owners of properties abutting the
millrace, and establishment of a permanent millrace commcLssion. It was the consensus of the Council
that the present study commission would be asked to take the matter into the planning stage and bring
back a proposal for improvement of the race. A vote was taken on the motion to approve the committee
action, and motion carried.

3.Sewer Assessment. BD-65-8; Gilbert:Property - The Council on January 9, 1967 deleted
from Ordinance 14637 two assessments totaling $25,685.46 levied against property
owned by Kenneth Gilbert and located at the Gilbert Shopping Center on Highway 99N.
The assessments were delted to allow levying of other assessments for the project to
proceed, and at the same time to allow Mr. Gilbert's attorney, Henry Camarot, to pre-
sent further information with regard to legal questions he raised on the Gilbert
assessment. The City Attorney's opinion, in a letter addressed to Mr. Camarot, stated
that the proposed assessment of the Gilbert property can be legally sustained. The
City Manager recommended that the Council proceed with the original assessment.'

Mr. Camarot, speaking for Mr. Gilbert, said an easement was given for in,stllation of
the line across the Gi1bertprop~rty to serve properties fronting on Highway 9~N,
and it was Mr. Gilbert's assumption at the time he granted the easement that its grant-
ing was a courtesy and that there would be no assessment for that portion betw~en the
properties facing Fairfield Street and those facing Highway 99N. 'Mr. Camarot also '
stated there was no mention of assessment at the time the easement was ~equested.

The City Attorney reviewed Charter provisions with respect to sewer and paving assess-
ments and said there is no Charter limitation on distance from an improvement for mak~
ing assessments, that it is a matter of policy to as~ess the abutting property within
160 feet. Councilman Lassen "asked how deletion of the two assessments would affect
assessments on other properties in the project, 'and was told that either the City
would have to pay the amount deleted or that the other properties' would have to be
reassessed.
Dr. Purdy moved s'econded by Mr. Wingard to hold this item until the April 10,1967
Council meeting. Motion carried.

Henry Camarot, attorney, stated he was representing Kenneth Gilbert and K. D. Gilbert, Inc." and in-
formed the Council that because of possible later court action he had arranged for a court reporter
to make a verbatim record of his presentation to the Council on behalf of Mr. Gilbert. -Mr. Camarot
then reiterated arguments contained in the committee report. In addition, he stressed, that the
Charter, by authority of which assessments are made, specifies assessments for improvements are' to
be made against properties abutting a street, and argued that no d~dicated street exists where the
sewer was 'installed. He further argued that the Charter specifies improvement costs must be estimated
by ordinance, that the assessment formula is not uniformly applied, and stated that had Mr. Gilbert
known "an assessment was to be levied he would have refused the easement". They. s,pe,cifically request'ed
relief from $15,000 of the assessm~nt.

The City Manager pointed out the future potential benefit from the improve~ent and the increased value
of the :property because of the sewer installation. He said connections have been made to the line
and stubs have been provided for future connections.
A vote was taken on the motion to proceed with the original assessment, and motion carried, Mr.Wingard
voting no.

4. Willakenzie Land Use Plan - A letter was read addressed by the Eugene Development
Agency to the Lane County Commissioners and Lane County Planning Commission opposing
recent requests for rezoning to allow location of automobile dealerships in the
Willakenzie area. The ,letter urged careful consideration of the effects of such re-
zoning on the central Eugene business district."

consideration at the April 13; 1967 committee meeting.

3. Sanitary Sewer, WS-67-1 - A letter was read addressed by ,the Pubiic Works Department
to owners 'of properties in the Westward, Ho area polling the owners' preference for
construction of:the sanitary sewer in the street or behind the 'curb. A reply to
this lette~ fiom Jarold Kief~erwas 'also r~ad, expressing objection to,i~e City'~
letter insofar a~ it explained the iimit of the conirac~~r(s o~ligation for returning
a street to its original condition if the line i~ installed in'the street. Results
of the poll, shown by a map of the area, indicated preference for construction behind
the curb except on Roan Drive and on Pinto Way, with no 'majority for either location
on Country Lane. Mr. Anderson moved seconded by Mrs. Hayward to award the contract on
the low basic bid, except that the alternate (construction in the street) be taken on

10. Paving Hayes, 14th to 15th, and 15th, Grant to Hayes - This paving was delayed from
last year when paving of other streets in the area was initaited by the Council,

interfere with these two streets. The Public Works Department now recommends pro-
ceeding with paving Hayes and 15th because the Parkway construction will not be
accomplished for ~me time. Mr;Anderson moved seconded by Mr. Lassen to initiate

indicating the Springfield City Council has designated June 5, 1967 for a meeting with

to discuss metropolitan sewer problems common to all three age~cies.

27. Uniform Plumbing Code - The City Manager read a list of cities and other jurisdictions
throughout the western states which have adopted the Uniform Plumbing Code. The list
was supplied by the International Association of Plumbing and Mechanical Officials at
the request of the city of Eugene as the result of questions arising from Eugene's
adoption of the Uniform Plumbing Code.

28. West Coast Application for Exemption - A letter from West Coast Airlines was presented
which asked Eugene's support for West Coast's application for exemption from restric-
tions which prohibit originating flights at cities south of Portland if these flights
serve both Medford and San Francisco. It was understood the letter would be referred
to the Chamber of Commerce Aviation Committee for recommendation.

29. Legislation, H.B.1721, Annexation Procedure - The City Manager explained 1egisl,ation
which would change election procedure for consent annexations and create local agency
boundary boards to~review annexation proposals. The proposed legislation was to be
explored further before any stand is taken by the City.
The City Manager suggested authorization be given to question method of appointment of boundary boards
and authority of boundary boards to call elections on 100% or triple two-thirds consent annexations.
He recommended opposition to the legislation if it eliminates "consent" annexations.
Dr. Purdy moved seconded by Mr. Anderson to write to State Legislators in line with the recommenda-
tion. Motion carried.
