Adjourned meeting of the Common Council of the city of Eugene, Oregon ~ adjourned from the regular
meeting held April 10, 1967 - was called to order by His Honor Mayor Edwin E. Cone at 7:30 p.m. on
April 24, 1967 in the Council Chamber with the following councilmen present: Dr. Purdy, Mrs. Lauris,
Messrs. McNutt, Anderson, Lassen, Mrs. Hayward, Messrs. McDonald and Wingard.
Minutes of the meeting held April 10, 1967, as mailed to members of the Council, were approved.
NEW BUSINESS

Helicopter Control - Councilman Lassen asked "the ~taff to bring to the Council for considera-
tion regulations or a model ordinance governing use of helicopters inside cities.

Height Limitation~ Skinnerj~ Butte Area - Councilman Purdy inquired regarding status of
control of height and limitations on high-rise buildings in the Skinner's Butte area.
He was informed this regulation is to be included in the new zoning ordinance, but the
matter will be reviewed to consider some temporary control until the new zoning ordinance
is enacted. . . ..-

Mayor Cone recognized the presence of Mr. Halvorson's University of Oregon journalism
class of about 25.

International Co-operation Awards - Philip George, chairman of the Mayor's International
Co-operation Committee, explained the purpose of the committee and the awards presented
by the Mayor. The following people were honored for their activities in the promotion
of international understanding and co-operation:

A letter was read from 'Wellette Constr~ction Canpany' as:king permission .tochange the,ir l~w hid'of
$27,423.55 to $31,616.65 becpuse 'of an 'omiss ion in their bid sub"mittal for' sewer 'construct ion: in
WS-67-3. The Public Works Department recommended the low bid on WS-67-3 be thrown out' and 'contract
awarded to the second low bidder, that contrqct award for sewer in BD-67-l7 be held over to allow
time for preparation of a comparative "report 'on alternat'e locat ion, and 'contract award' t9' tHe l,ow
bidder on each of the other two projects. " .
Dr. Purdy moved seconded by Mr. Anderson to approve the recommendation. Rollcall vote: All council-
men present 'voting aye, motion ca~ried.

1. Park Areas - Mrs. Hayward requested that the Parks Department make a study of an area
, l"tdj acent to Washburne Park on which the Planning Commission has received a request for
rezoning to see if it is feasible and logical for the City to: acquire the property for
future park use. It was reported that this property was available in 1963, and the
Council found at that time. the high coat of the property made its acquisition for park
use inadvisable. Mr. Anderson requested that the area between Palomino Drive and Sun-
Shine Acres south of Harlow Road also be studied for possible park use. ,

3. Community Goals Report - The Community Goals Committee report was presented t9 the
Council. A letter was read from the Committee requesting Council adopt the report
as official Council policy. Mr. Anderson moved seconded by Mrs. Hayward to schedule
a public hearing on the report at the next regular meeting of the Council on April 24,
1967. Motion carried.

Vince Farina, chairman of the Eugene Planning Commission, urged adoption of the policies set forth
in the Conference report, and said the proposals therein were merely suggested as guides for Council
consideration as the need may arise.
David Gibney, Willamette National Forest supervisor, called attention to the Federal controls recom-
mended on timber cutting in relation to water supply and pollution and asked deletion of that item.
He also asked deletion of the recommended State control of slash burning in relation to air pollution.
A letter from Mr. Gibney was noted in which he set forth reasons for deleting these items.
Dr. Miller cited instances of timber stands and cutover areas she had noted which appeared to refute
Mr. Gibney's arguments.

Dean Haley, a member of the Conference committee, favored adoption of the policies to effect purpose-
ful long-range planning.
Vern Gleaves, a Conference committee member, said he felt in many instances the report was unrealistic
in its approach to far-ranging problems, and that the contents of the report should be fully under-
stood before adoption.
Dan Herbert, architect, said he felt the program should be continuously reviewed and subject to ad-
justments as conditions dictate.

Betty Niven, Planning Commission and Conflerence committee member, reported on the number of people
participating in the Conference and stated the report reflected the ideas of a good cross-section
of the community.
Dr. Purdy moved seconded by Mr. Anderson to act on each chapter of the report separately. Motion
carried, Mrs. Lauris voting no.
Dr. Purdy moved seconded by Mr. Wingard to approve Chapter 1, Goals and Assumptions 1966-1986, with
the following amendments:
Goals, Item 1 - Delete the words "and raise a family."

Commission recommended denial. It was explained the Commission does not want
to extend commercial zoning all along Coburg Road into a strip along the entire
road and that commercial areas should be clustered, Mr. Camarot, representative
for Clair Adkins, stated that because of increased traffic and commercial develop-
ment in the area, the property directly adjacent to Coburg Road is no longer suit-
able for residential development, Mrs. Niven commented that the FHA does not ap-
prove of direct access to residential property from arterial roads, She further
mentioned the possibility of a planned unit development. Vincent Farina, president
of the Eugene Planning Commission, stated the Commission looks at the area as a
whole when considering zoning changes, that enough commercial zoning already
exists to serve the neighborhood and that continuation of "bits andpieces" zoning
is not desirable if the comprehensive zoning plan recently adopted is adhered to.

cited the regulation that prohibits re-application for rezoning with six months after denial, explain-

Councilwoman Hayward asked if notice of the proposed parking prohibition was given to residents in the
area and was assured accounts had been carried in the Register-Guard. George Marx, 2587 Willamette
Street, said he was aware of the proposed change and that he knew of several others in the area who
knew of it, and 'there were no obj ect ions.
A vote was taken on the motion to approve, and motion carried.

6, Rezoning County Land Contiguous to City - A resolution from the planning Commission
was read which recommended that zone change requests for property which is contiguous
or substantially contiguous to the City, or which directly affects the future land
use of the city of Eugene, should be referred to the city of Eugene for recommendation
prior to final action.by the Lane County Commissioners. Mr. Farina commented that
this policy change would have far-reaching effects. He further stated that cities
are also part. of the county and that future plans of the city need to be considered
by the county. It was suggested that the Council meet with the County Commissioners
to explain the resolution was under consideration by the Council, and that Council
desired the Commissioners' thoughts and suggestions before taking formal action.
Mr. Anderson moved seconded by Mr. Lassen that the Council meet with the County Com-
missioners to discuss the matter prior to the next regular meeting of the Council
on April 24, 1967, Motion carried.

7. Legislation
a, Enabling City Income Tax - The City Manager explained that a measure is being con-
sidered by the State Legislature w"l'1~ch would enable ciFies of more than 25,qOO
population to levy a city income tax. He also stated the City badly needs addi-
tional revenue to cover existi'ng City services, It was also explained that ad-
ministrative costs' for collection of such a tax would be low because existing
State machiDery could be used. Mr. Anderson moved seconded by Mr. Wingard the
City Council support this legislation with the recommeDdation that the clause
concerning the size of the City be deleted. Motion carried, Mr. McDonald voting no.

b. Mandatory Annexation Where Health Hazard Exists~- A bill being considered by the
Legislature would allow cities to annex adjacent areas where health hazards exist
which the city could alleviate. Mr. Lassen moved seconded by Mr. Anderson ,to
support tpis legislation. Motion carried.
Dr. Purdy moved seconded by Mr. Anderson to approve Items 7a and 7b of the Committee report. Motion
carried.

8. State Speed Control Board Report, Bailey Hill Road - The State Board has notified the
City that in response to the City's request of February 11, 1967 the speed limit for
this section of Bailey Hill Road has been revised to 30 mph, with recommendation that
the City provide a walkway along the road."

2. Appeal, Conditional Use Permit for Day Nursery at 2340 Cal Young Road, Champion -
A letter was read from George and Gloria Champion, 1689 Charnelton Street, appealing
the Planning Commission's denial of their request for permission to locate a day
nursery at 2340 Cal Young Road. Paul D. Clayton, attorney, representing the Champions,
stressed the need for a day nursery in the area and said all regulation would neces-
sarily be met by the Champions in order to be licensed by the State. He said they
felt the Planning Commission denial was due in part to lack of .personal acquaintanc~
with the Cham~ions, since they are new to Eugene, and to misrepresentation of amount
of noise generated. in a regulated day school. Mr. and Mrs. Champion also answered
several questions from the Councii. Mrs. Lauris moved seconded by Mrs, Hayward to
grant the conditional use permit, subject to review if use of the land is changed or
if the property is sold. Tie vote, Mrs. Lauris, Messrs. McNutt and Anderson, and
Mrs. Hayward voting yes; Dr, Purdy, Messrs. Lassen, McDonald, and Wingard voting no.

Moe Thomas, Planning Commission member, said he felt the proposed location met all criteria set by
the present zoni~g regulations for location of a day nursery, and asked a change in the ordinance if
it was felt the day nursery would not be satisfactory at this location.
Mrs. Champion said they would be willing to accept a restriction of not more than 40 children in the
nursery, and explained plans for provision of adequate off-street parking.

A vote was taken on the motion to approve the permit, and motion was defeated, Mrs. Lauris and
Mrs. Hayward voting yes.

Mayor Cone remarked concerning an. ordinance on day. nurseries, allowing them in residential neighbor-
hoods, and it was explained that day nurseries are permitted in residential neighborhoods under
certain conditions, as in the case of two in the Wi11akenzie area located on corners. Councilwoman
Hayward also commented concerning the financial problems of day nurseries resulting in necessity of
locating in certain areas.

3. Urban Beautification Grant - The Parks & Recreation Director outlined an. amended
program to be submitted to the Department of Housing and Urban Development with an
application for a $21,343 grant under the Urban Beautification Act. The amended
program as required by HUD is for.a three-year period, rather than one year, and
provides for landscaping various areas in the City. Richard Unruh at the same time
presented an amended urban beautification program for the University of Oregon to
be submitted along with the City's program. Dr. Purdy moved seconded by Mr. McNutt
to approve both programs and file the application for funds. Motion carried.

4. Bids. Public Works Improvement Proiects. Opened April 17. 1967 - A tabulation of
bids was presented, and estimated unit costs were explained. The Public Works De-
partment recommended contract award to the low bidder on each project, Winfrid K.
Liepe, attorney representing M. L. Martin~on and United States Nationa~ Bank of
Oregon, trustee, presented their objections to proposed location of the BD-67-17
trunk sewer along Stewart Road and Wallis Street to serve Silica Park. He said
the Martinson property, north of 11th Avenue between Bertelson Road and Wallis
Street, is undeveloped and now subject to a $30,000 assessment for the 5th Avenue
sewer trunk and a $26,000 assessment for the Bertelson Road sewer. The proposed
location of the BD-67-17 sewer would subject this prop'erty to an additional esti-
mated $8000 to $8500 assessment. Mr. Liepe suggested an alternate location for
the sewer along the north line of Amazon Creek and eastward on Bufton Avenue to
serve the interior of Silica Park. He also stated owners of property abutting Ste-
wart Road have objected to construction of the sewer. Bob Shirley, contract buyer
of property to the east, questioned location of the sewer on Stewart Road, and said
it was his understanding the 5th Avenue trunk would serve the entire area. It was
suggested the contract award on the BD-67-l7 sewer be held in order that the Public
Works Department may bring back a comparative report on the alternate location
presented by Mr. Liepe.

5. Parking Restriction. 3rd between Pearl and High - A petition was presented from
residents of the area requesting limited parking on 3rd between Pearl and High.
The petitioners' request resulted from all-day parkers' utilizing the area, leav-
ing no spaces open for use by residents or their visitors. The Public Works De-
partment had no objection to installation of limited parking. Mrs. Lauris ~oved
seconded by Mr. McDonald to install 2-hour parking on 3rd between Pearl\and High.

trian traffic. The School District agreed to maintain the plantings so as not to
interfere with visibility of vehicular traffic. The Parks Department recommended
approval. Mr. McNutt moved seconded by Mr. Anderson to approve the plantings.

9. Stop Sign. Donald at 37th - The Public Works Department recommended. removal of the
stop signs for traffic on Donald Street at 37th Avenue and installation of a yield
sign on 37th. Jim Bernhard, 3755 Donald Street, said he felt the stop s'ign at its
present location ,is necessary because of the brow of the hill at' 37th, and because
Donald would tend to become an arteria12type street were it not for the 'stop sign
to stow traffic. Mrs.' L'auris moved seconded by Mrs. H"ayward to leave the stop signs
on Do:nald. Motion carried, Mr. McNutt voting no. It was understood a ,check of the
accident record of: that intersection would be made 'and a report brought back to the

A report on the accident record at this intersection revealed one in 1957. At the suggestion that a
three-way stop be established,' the Traff'ic Engineer said experience has shown a three-way stop would
probably cause more violations because of drivers on Donald Street knowing the side street (37th) was
contro lled.

11. Sidewalk Variance, Fircrest ,Drive- A petition was .pres,ented from Larry J., Anderson,
on behalf of himself and other owners of property on Fircrest Drive, applying for
temporary non-compliance of sidewalk construction. The temporary permit was re-
quested until further development of the .area and .to al~ow the petitioner to in-
stall drainage facilities for his property. . The Public Works Department reported
there is nothing to hinder installation of drainage facilities at the time of
sidewalk construction.

12. Paving Rocky Lane - The Council previously authorized purchase of right-of-way
property for improvement of Rocky Lane from Ronald Allen for $350. A letter from
Mr. Allen was noted in which he explained the basis for his request of $1700 for
the property. He requested delay of the project Eor one year. It was explained
that owners of the property to the north had petitioned the improvement, and had
not been notified the matter would be discussed at this meeting.

14. Legislation
a. S.B.428 This bill is sponsored by the Associated General Contractos and would
require public works projects of more than $5000 to be let for bid. The City
Manager said Eugene probably would rarely be hindered, however there' may be
occasions when it would be to the City's advantage to do such work with City
forces. He recommended opposition to the bill on the basis that local govern-
ing bodies should have authority to determine the method of doing their own
public works, projects. Councilman McNutt explained that in some areas cities
and counties are operating as construction ,firms, and said he felt the minimum
should be $20,000 instead of $5000.
Dr. Purdy moved seconded by Mr. Anderson to oppose the bill. Motion.carried, Mr. McNutt voting no.
b. H.B.1444 - This bill would enable creation of agencies to provide services of
a metropolitan nature, limited to sewers, water, airport planning, street
lighting, etc., and is supported by Portland and three contiguous counties in
that area. The League of Oregon Cities opposes the legislation.
Mr. Wingard moved to support the bill. There was no second. It was agreed that more information
should be brought back to the Council before a stand is taken.
