Regular meeting of the Common Council of the city of Eugene, Oregon was called to order at 7:30 p.m.
on May 8, 1967 in the Council Chamber by His Honor Mayor Edwin E. Cone with the following councilmen
present: Dr. Purdy, Mrs. Lauris, Messrs. McNutt, Anderson, and Lassen, Mrs. Hayward, and Mr. McDonald.
Mr. Wingard was absent.
The minutes of the meeting held April 24, 1967, as mailed to Council members, were approved.

The City Manager announced a reception is to be held in the McNutt Room
May 15, 1967, for 15 Secondary Education advisors from South Viet Nam.

Bids. 27th and High Property - Bids received for City-owned property at 27th and High were:

The City Manager explained that this is the same property which previously was offered for
sale on which only one bid was received. There is a $1222 paving assessment against the
property. An informal appraisal indicated an approximate value of $17,000.
Dr. Purdy moved seconded by Mr. Anderson to reject the bids. Motion carried, Mr. Lassen voting no.

Paving Rocky Lane - John Steinmuller of TransWestern Investors, Inc., owner of property
north of Rocky Lane, said this improvement was originally petitioned in 1964 by owners
of 53% of abutting properties. It was found at that time necessary right-of-way was not
in public owne~ship and, as a result, roadway dedication was obtained by July 1966 from
owners of 90% of abutting property. Mr. Steinmuller suggested the City proceed with the
project except for the portion abutting the property of Ronald G. Allen, who did not
convey the necessary right~of-way. A letter from McKenzie Road & Driveway was presented
stating they are willing to accept the contract, deleting the west 145 feet, at originally
bid unit prices if awarded before May 12, 1967.
Mrs. Lauris moved seconded by Dr. Purdy to proceed with paving Rocky Lane, exclusive of the west 145
feet. Rollcall vote. All councilmen present voting aye, motion carried,

1. Park Land. Fox Hollow Area - Councilwoman Lauris proposed acquisition of approxi-
mately 112 acres in the Fox Hollow area south of the City. She said the land is
Qot suitable for subdivision and is ideal for park purposes. It can be purchased
for $2500 per acre, possibly over a la-year period for about $30,000 per year plus
interest. She suggested that Lane County be invited to join inthe purchase, and
moved, seconded by Mrs. Hayward, that the staff investigate the possible purchase
of the land. Motion carried.

2. Planning Commission Report - May 2, 1967
a. Willakenzie Interim Land Use Plan - The Planning Commission recommended adoption
of the January 1967 Interim Land Use Plan for the Willakenzie area, prepared by
the Central Lane Planning Council and copies previously distributed to Council
members, subject to the following conditions: (1) That the area between Coburg
Road and the Valley River Shopping Center be devoted to low-density multiple-
family housing; (2) that the area at Belt Line Road and Coburg Road remain R-l
or RA; (3) that the area west of the Delta Highway and south of Belt Line Road
is considered by the Commission to be lano for potential commercial developments
requiring large areas for operation; and (4) that the Commission would favor ap-
plications for low-density multiple-family housing for areas along arterials
which would serve as buffers for commercial and residential districts. It was
agreed a Council hearing should be held on the Land Use Plan before Lane County's
hearing on May 17 concerning a rezoning petition in conflict with the Plan.
Mr. Anderson moved seconded by Mr. Lassen to hold the hearing at the May 8, 1967
Council meeting. Motion carried.

David Pedersen, planner for Central Lane Planning Council, explained the method used in developing the
Interim Land Use Plan, requested because of the rapidly changing character of the Wil1akenzie area,
and pointed out the salient features of the Plan, explaining the planned zoning for various districts
in the area. He said the Central Lane Planning Council recommended adoption of the Interim Plan with
the policy amendments made by the City Planning Commission.

Rev. David White, member of the Willakenzie Residents Association, presented a stateme~ from the
Association favoring adoption of the Interim Plan, and recommended no change in the area until the
present study of the entire metropolitan area is completed.
Jack Gardner, attorney representing Kendall Ford~ stated his clients did not feel they had been given
an opportunity to make a presentation to the City Planning Commission in favor of commercial rezon~ng
of the area between Delta Highway and Country Club Road, in conflict with the Land Use Plan. He
asked that the matter be referred back to the Planning Commission to allow Kendall Ford to present
evidence supporting their petition.
Vince Farina, chairman of the Eugene Planning Commission, said the Planning Commission held a public
hearing on the Interim Land Use Plan, and that so far as the rezoning of the proposed Kendall Ford
property, the legal decision lies with the County since the area is outside although immediately ad-
j acent to the City limits. He ,urged adoption of the Plan as presented by the Commission.
Walter DeMartini, co-owner of Kendall Ford, said his firm was not granted the opportunity to meet in-
formally with the City Planning Commission to present evidence on the zoning of the particular parcel
in which they are interested. He asked Mr. Pedersen to point out specific changes in the Plan which
have occurred since 1959.
The City Manager read a portion of the Planning Commission minutes referring to Kendall Ford's pres-
entation.

Dr. Purdy moved seconded by Mr. Anderson to approve the Interim Lane Use Plan and place emphasis on
the conditions included by the Eugene Planning Commission. Motion'carried, Mr. McDonald voting no.

3. Trunk Sewer, Valley River Shopping Center - The Public Works Director outlined plans for
construction of a trunk sewer from the pumping station south of Belt Line Road to serve
an area between the Delta Highway and the Willamette River in the process of being an-
nexed to the City, and said this trunk could be extended along Goodpasture Island Road
to serve the Valley River Shopping Center and other areas to the east at an estimated
cost of $476,550. Or the trunk could be constructed in stages with a section being
constructed from the east at an estimated cost of $114,000 to complete the portion which
would be placed underneath this summer's road construction.' Construction of the entire
trunk rather than in sections was recommended in order to more efficiently provide for
long-range sewerage of a larger area. He said it could be constructed in conjunction
with County improvement of Goodpasture 'Island Road north of the Center. Cost of the
sewer up to 8 inches will be assessed to abutting properties, with the balance to come
from sewer bond ,funds, and Valley River paying about $35,000.

Wayne Shields, developer of the Shopping Center, said they were willing to sign an an-
nexation petition but would want to be a~sured no action would be taken on it until
the Center's completion, since they have negotiated with the County on paving Good-
pasture Island Road and want to stay under County jurisdiction until Valley River is
ready for occupancy.

The City Attorney said it would be necessary to petition annexation simultaneously
with the award of contract for construction of the sewer. Mayor Cone suggested posting
a performance bond. H. A. Anderson, co-developer of the Shopping Center, cited advantages
he felt would accrue to the City from the Center's construction. Councilman Lassen in-
quired about keeping track of the progress of the Center's construction, drawing several
comments concerning similarity between County and City inspection and the fact that both
operate under the Uniform BuildingCode.

Mrs. Lauris moved seconded by Dr. Purdy that, since it would be advantageous to construct
the sewer before Goodpasture Island Road is paved by the County, the staff work with the
Valley River people and bring back a proposal, and that the matter of annexation of the
area be referred to the Planning Commission. Motion carried.

4. Day Nursery, Raup Property, 169 North Washington - Jerry Hendricks, chairman of the
Board'of Directors of Child Care, Inc., requested use of the,City-owned house acquired
with the Raup property for the Riverfront Park, for a day nursery. He said the house
would be used to provide a place for low-cost care of children of working mothers or
mothers ,who need to become self-supporting, and would be staffed by professionally ,
trained" people. The proposed day nursery is a pilot program fo~ this type of care; ,
no funds are available, but application'will be made for Federal funds. Mr. Hendricks
'said the City's granting use of this property for Child Care~ Inc., would constitute
part of the community's commitment 'required for Federal grants.

Aubrey C. Trimble, member of Child Care Board ofDirectors~ said necessary remodeling
of the Raup house to meet requirements for a day nursery would,cost'them about $2000.
The City Manager explained that rental money from the house 'is now used to maintain'
it and to pay taxes on it, and that eventually it is intended to be used for living
quarters for a Riverfront Park' caretaker. He said-the house can be remod~led, and

5. Sewer Location, BD-67-l7, Martinson Properties - _A 'report from the Public Works De-
partmen~ on alternate locatio~ of the se~er to serve Silica Park suggested by Winfrid
Liepe, attorney representing the Martinson properties, indicated'it.would add about
$600 to the cost. It also would require acquisition of easements across private prop-
~rty, whereas the original design was ,developed for construction of the sewer on public
right-of-way. Construction on the alternate route, although relieving the Martinson
property of assessment, would add about $4000 to the cost for another property owner'
because his development has proceeded on the premise that the sewer would be constructed
on Stewart Road and on Wallis Street. The Public.Works Department recommended award of
the contract on the basis of the original design.
Mr. Liepe restated his, preyious arguments and again pointed out the assessment~ for
which theMartinson' property is already obligated.' He outlin~d what he felt would be
the logical location of sewer lines to allow industrial ~evelopment of the'Martinson

Attorney said his investigation revealed that (a) the Planning staff did not require
posting of bond for streets as required in the subdivision ordinance; (b) payment of
outstanding taxes on the property prior to the minor subdivision was not required; and
(c) the requirement of granting the subdivision only if there is an existing street or
road was not followed. He said with regard to the third point' that streets were dedicated'
simultaneously with approval of the subdivision. It is his opinion that the subdivision
could be revoked but is not required; that Mr. Baitis could attack the legality of the
Commission's action in court; and that the Planning Commission has the entire authority
in the matter of revoki"ng or not revoking the subdivis ion, the Council having no juris-
diction in the matter. The Council was informed that court action is now pending be-
tween the property owner and the contract buyers. Mr. Baitis again called the Council's
attention to the legal points he raised as a result of being told previously that the
Council could take action only if error was found in issuance of the house moving permit.

1. Washburne Park - The Parks Department reported that the 1963 appraised value of five
lots immediately north of Washburne Park was $63,250. At that time, the Council de-
cided not to purchase them. Some Council members said they felt, because of the
changing character of the neighborhood, there would be more use for a playground-
type park. The Parks Department plans to eventually close a street running through
the park, adding about 3/4-acre for use, but to maintain the character of the park
essentially as it is now.
Mr. Lassen moved seconded by Dr. Purdy that the item be received and filed. Motion carried.

2. Park Property Purchase. Bethel-Danebo. Petersen - The Parks Department reported that
Paul, Richard, and George Petersen are willing to sell to the City about 12 acres
lying north of Royal Avenue and east of Ellsworth Street for $40,989. Payment is to
be made over a 3-year period with the first payment being due after July 1, 1967,
and 4% interest charged on the balance. The Petersens stipulate also that the park
is to be named "Philip Petersen Park" in memory of the son of George and Marjorie
Petersen.
Dr. Purdy moved seconded by Mr. Lassen to proceed with the purchase of the property. Rollcall vote.

3. Ordinance. Weed Control - Amendment to the weed control regulations was presented
which would delete the second mowing date of the year now in effect, and instead
require mowing by June 1 and then keeping the growth at a height of no more than
10 inches for the balance of the summer. The amendment also adds a $2.50 penalty
for late payment of a mowing charge.
Dr. Purdy moved seconded by Mr. Anderson to approve the amendment. Motion carried. (See Ordinance

4. Contract Extensions - A list of projects was presented which because of bad weather
or conflicts with other construction have exceeded the time limit set for completion.
Liquidated damages of $350 were assessed on one project, contracted to Boles Builders,
The Public Works Department recommended time extmsion on each of the projects and,
instead of collecting liquidated damages, that Boles Builders be removed from the
eligible list of bidders for one year.
Dr. Purdy moved seconded by Mr. McNutt to approve the recommendation. Motion carried.

5. Parking Prohibition. Highway 99N - The Council previously considered parking prohibi-
tion on Highway 99N from Roosevelt Boulevard to the north City limits. However, com-
plaints from motel owners in the vicinity resulted in the recommendation that parking
be prohibited only between the hours of 6:00 a.m. and 9:00 p.m.
Dr. Purdy moved seconded by Mr. Anderson to approve the recommendation. Motion carried.

6. Curb Sidewalk. south side 28th. Taylor to Almaden - The Public Works Department, as
the result of a request from Floyd Hodges, 2810 Taylor Street, recommended location
