Adjourned meeting of the Common Council of the city of Eugene, Oregon - adjourned from the regular
meeting held May 8, 1967 - was called to order at 7:30 p.m. on May 22, 1967 in the Council Chamber
by His Honor Mayor Edwin E. Cone with the following councilmen' present: Dr.. Purdy, Mrs. Lauris,
Messrs. McNutt, Anderson, Lassen, Mrs. Hayward, and Messrs. McDonald and Wingard~
Minutes of the meet.ing held ,May 8, 1967,. as mailed, to Council members,- were, approved.
. "NEW BUSINESS
Councilman McDonald issued an invitation to the Mayor and' Council. members to attend
groundbreaking ceremonies for the new Marist High School south of the Belt Line Road
east of ,the.WillameHe River on Tuesday, May 23,1967,11:00 p.m.

Appointment. Civil Service Commission - A letter was presented from James Pearson sub-
mitting. his resignation as :a- member of the Civil Service' Commission.

Dr. Purdy moved seconded by Mr. Anderson to appoint John Chatt as a member of the Civil Service Com-
mission for the term ending January 1, 1970, replacing James Pearson, resigned. Motion carried.

The Public Works Department recommended award of contract on the Garfield and 2nd project on the
basic bid, 5" asphaltic concrete on 13" crushed rock base, and that contracts be awarded to the low
bidder on each of the pr~jects.
William Burke, owner of West 11th Auto Wreckers at 2920 West 11th Avenue, asked several questions con-
cerning location of storm and sanitary sewer lines and width of paving on the 11th Avenue project,
which were answered by the Public Works Director.
Wyman Hammer, owner of Hammer Lumber Company at 399 Garfield Street, inquired about the type of curb
to be constructed on the Garfield Street and 2nd Avenue project, and was informed the plan for pro-
posed type of construction will be brought to the Council at a later date. He was also told that
where reinforced valley gutters are requested and installed, the cost of such irnta11ation will be
assessed to the property owner.
On the Whitbeck, McLean, and Ingalls project, Tom Hovet, McLean Boulevard, and Frank Hickenbottom,
2830 Whitbeck, inquired about sidewalks and drainage problems, and Eric G. Ostlund, owner of property
~ the southwest corner of 28th and Whitbeck, called attention to substandard size of his property as
the result of right-of-way necessary for the project.
Dr. Purdy moved seconded by Mr. Anderson to award contracts to the low bidder on each project, and to
award the contract on the low basic bid on the Garfield Street and 2nd Avenue project. Rollcall vote.
All councilmen present voting aye, motion carried.

first section of the project is expected to be open to traffic by August 15, 1968.

2. Ordinance, Amending Masonry Contractors Licensing Code - A revised draft of a pro-
posed amendmen~ to the Masonry Contractors licensing code was presented. The amend-
ment pro~ides for ~reation of a 3-member Masonry Board and sets forth its authority.
The Superintendent of Building Inspection said the Associ~t~a General Contractors
have no obje~tions to this revision. Mrs. Lauris moved seconded by Mr. Anderson to
adopt the ordinance. Motion carried.

Councilman Wingard questioned need for creati.on of toe Masonry Board. Ray Parmelee, member. of the
Zoning-Sign Board of Appeals, said the amendment would upgrade the industry in Eugene, and would

ing, and other contractors.

3. Curb Sidewalk, East" Side City View between 14th and' '15th - City View Investment, Inc.,
requested location of the sidewalk at the curb, saying it would give better access to
their propert'y because of elevation. The Public Works Department recommended denial
because (a) the paving of City View is 36 feet on a 70-foo't right-of-way, leaving an
ll-foot parking strip,; (b) setback sidewalks, have already been constructed on the
west side of the street; (c) City View could eventually Qe widened to arterial width;
and (d) the problem of elevat ion is one of the pet it ioner'~ s' own creat ion and should
be corrected now instead of at City expense when the street is widened. Mrs. Hayward
moved seconded by Mr.'Lassen to deny ~he request. Motion carried.

3 4. Parking Prohibition, Spring Boulevard from Fairmount to Malabar - The Public Works
Department recommended prohibition of parking in this area because (a) the street
is narrow with'many curves; (b) shrubbery and brush extend over the curbing; (c)
accident hazard; and (d) increase in traffic. Councilman Anderson suggested the
possibility of establishing a parking zone. Mr. McNutt moved seconded by Dr.Purdy
to prohibit par-king as recommended. Motion carried.
Dr. Purdy moved seconded by Mr. Anderson to approve Item 4 of the Committee report.
Some discussion took place with regard to possibility of establishing parking zones on the street.

5. Traffic Control, 26th and Agate - A petition was received from residents living in
the vicinity of 27th and Agate requesting traffic control on 26th Avenue at Agate.
The Public Works Department recommended no change, but recognized the hedge in viola-
tion at the northeast corner of the intersection. Mr. Anderson moved seconded by
Dr. Purdy to hold this item, and that steps be taken to remove the hedge violation.
Motion carried, Mrs. Lauris and Mrs. Hayward voting no.

6. Amendment, Front Yard Setback, Trailers - The Trailer Coach Association requested
repeal of the restriction which prohibits parking of trailers within the IS-foot
front yard setback and S-foot rear and side yard setbacks. Howard Holmes, speak-
ing for the Association, citied lack of back yard access in present-day residential
areas and extension of trailers into the setback if parked in driveways. Dr.Purdy
moved seconded by Mr. Anderson to refer the request to the Planning Commission for
recommendation. Motion carried.

7. Parking Prohibition, 30th between Wil1amette and Olive - Increased traffic due to
the opening of Cascade Manor prompted a request for prohibition of parking on 30th
between Willamette and Olive. The staff was asked to bring back a recommendation.

100% of the property to be assessed. The Public Works Department reported no City
costs are anticipated, and the developer is aware that sewers cannot be built to

be improved if Mr. Parmelee is willing to pay the entire cost ~nd be reimbursed if
and when the adjacent property is developed and assumes its share of the cost.

12. Paving Olive, 24.th to 24th' Place - Pet itioned by Owners of 55% of abutting property.
The Public Works Department reported a retaining wall may be required on the east side
of the street and recommended cost of its construction be included in the paving assess-
ment. Mr. Lassen moved secondeq by Mrs. Hayward to approve the petition, subject to
working out an agreement with the petitioner for payment of retaining wall cost.

13. Curb Sidewalk, Lamplite Lane - Todd Jensen requested reconsideration of the Council's
decision to require ,standard setback sidewalks on Lamplite Lane. He said curb side-
walks would conform with the location of those on Welcome Way, an adjacent street,
would give more area in the frorJ.t yards, and would prqvide a through walkway for '
pedestrians .an4 easier access to and from automobiles parked at the curb. The Public
Works Di~ector cited the many reasons for retaining the parking strip. Mr. McNutt
moved seconded by Dr. Purdy to deny ~econsiqeration. Motion car~ied.

14. Anti-Noise Enforcement - The City Manager read a letter from Martin Shedd, 1506 Lorane
Highway, with regard to enforcement of regulations governing noisy motorcycles, logging
trucks, .automobiles with "defective" muf:E:lers, etc. A report from the Municipal Court
indicated 2,035 citations were:issued for qoise violations between July 1, 1965 and
June 30, 1966, and 740 were issued during the first four months of 1967.
Councilman McDonald inquired about regulations governing excessive noise created by operation of
Hondas and by amplifiers. He reported several residents along West 21st Avenue had called him con-
cerning noise caused by Hondas on that street.

15. Oregon Electric Tracks, 5th Avenue - .The City Manager said consideration of removal of
the Oregon Electric tracks from 5th Avenue has been scheduled for the Committee meet-
ing on May 25, 1967.

The Public Works Department again recommended location of the sewer line on Stewart Road rather than
along the Amazon as requested by Attorney Winfrid Liepe, representing owners of the M. L. Martinson
property. Estimated cost for construction on the alternate route was $.0392 per square foot, and
construction of the alternate route would merely transfer cost of the sewer from one property owner
to another.
Attonney Liepe reviewed contentions he previously presented that the alternate route is more logical,
and requested the Council to reject the route proposed by the Public Works Department.
The City Manager said the sewer on Stewart Road east of Wallis Street has not been abandoned; it has
merely been postponed, probably for one year. He read a letter from John Stoner, County sanitarian,
concerning drainage in that area.
A rollcall vote was taken on the motion, and motion carried - Councilmen Purdy, McNutt, Anderson,
Lassen, and McDonald voting aye; Councilwomen Lauris and Hayward voting no; and Councilman Wingard
abstaining, asking that the record show he took no part in the discussion.

2. Public Affairs Conference - Mayor Cone announced a Public Affairs Conference to be held
at the University of Oregon on June 15-17, 1967.
No action was taken.

3. Staff Appeal. Electrical Board Decision. Fire Walls - A memo was read from the Superin-
tendent of Building Inspection appealing the decision of the Electrical Board with re-
gard to a building under construction at 2365 Cal Young Road. The National Electrical
Contractors contend, and were upheld by the Electrical Board, that the proposed walls
separating units in the building do not constitute fire walls as defined by State
rules, and that the building should be wired as one multi-family unit, requiring metal
conduit, rather than as separate units in which case portions of the wiring can be in-
stalled in non-metal conduit. A permit was issued by the Building Department for the
building in question in line with the Building Code adopted by the. City which allows
multiple units in one building to be separated by fire walls as defined in the Code.
The Building Department maintains the Code sets higher standards for fire walls than
required by the State rules.
Allen Hamilton and Don Robinson, members of the Electrical Board, stated the Board's
reasons for upholding the Electrical Contractors in their appeal to abide by the
State's definition of fire walls. Jack Shiller and Del Randall, speaking for the
National Electrical Contractors Association, and Les Lynch, acting chief electrical
inspector for the state of Oregon, cited the State regulations and reviewed their
objections to the method of wiring permitted in the building under construction.
Mr. Wingard moved to overrule the Electrical Board. There was no second.
Dave Hoffman, local electrical contractor and member of the Planning Commission, re-
marked that approval of the type of wiring used in the Cal Young building would con-
stitute a major change in enforcement, and said he felt it would create confusion in
the industry in making decision with regard to wiring multiple-family buildings.
The City Attorney said the matter appears to be one of disagreement between the State
and the City on the definition of fire walls. The Superintendent of Building In-
spection said his department is now drafting suggested amendments to the State's
rules where conflict appears between the State and City, and that these amendments
will be brought to the Council for submission to the State Electrical Board.
Dr. Purdy moved seconded by Mr. Wingard to uphold the staff on the wiring method
used in the building under construction at 2365 Cal Young Road, and to withhold
issuance of permits for construction of any other buildings of this type using the
challenged wiring method until the conflicts between the State administrative rules
and the City Code are resolved. Motion carried.'

4. Danebo Fire Station - Bill Wilson, architect, showed sketches and described the
design of the proposed new fire station to be located on the west side of Berntzen
Road between Elmira Road and Bell Avenue. The station is estimated to cost $70,920,
exclusive of landscaping, for about 4700 square feet, or approximately $12.85 per
square foot. Fire Chief Smith recommended approval. Mr. McNutt moved seconded by
Mr. Anderson to approve the design. Motion carried.

5. Landscaping. Herzog Mobile Homes. 1700 Highway 99N - An agreement was entered into
by Clinton Hedrick, manager of Herzog Mobile Homes, and the City setting forth condi-
tions to be met by Mr. Hedrick in connection with rezoning his property. Landscaping
called for in the agreement has not been started, and the City notified Mr. Hedrick
that unless he installs the landscaping within six months, the City will proceed with
the planting and assess the cost to the property, as provided in the agreement.
Mr. Hedrick stated several reasons for not having completed the terms of the agree-
ment. Mrs. Gordon Barron, 1540 Hughes Street, requested action on the planting.
Mr. McNutt moved seconded by Dr. Purdy to enforce the terms of the agreement.
Motion carried."

4. Rural Fire Protection District Contract Rates - Copies of a report comparing cost.
of fi,re 'protection insid~ the City with that for rural fire. districtswer~ previously
distribu~ed to Council members, and to the rural fire .districts. The City Manager .re-
ported that one district said they felt they should serioesly consider ,providing their
own fire protection. He suggested the possibility of a four-year program of adjusting
the charget,o districts to more :nearly compare with the cost ~or protection inside the
City. The program would raise the charge to 6~ mills in 1968-69, 7 mills in 1969-70,
7~ mills in 1970-71, and 8 mills in 1971-72.

extend an existing retaining wall about, six feet into the street right-of-way at

quested retaining wall.
