June 12, 1967
Regular meeting of the Common Council of the city of Eugene, Oregon was called to order by His Honor
Mayor Edwin E. Cone at 7:30 p.m. on June 12, 1967 in the Council Chamber with the following council-
men present: Mrs. Lauris, Messrs. Anderson and Lassen, Mrs. Hayward, and Messrs. McDonald and
Wingard (arrived late). Councilmen Purdy and McNutt were absent.
Minutes of the adjourned meeting held May 22, 1967, as mailed to Council members, were approved.
NEW BUSINESS
Mayor Cone recognized the presence of a group of provisional members of the Junior League of Eugene.
1 Council Initiated Pro;ects - The Public Works Department sent notices of hearing to be
e held at this meeting to owners of affected properties concerning the following Council
initiated paving projects~
Between Jackson and Madison, 24th to 28th - Estimated to cost $26,000. There were no
objections from the floor, but written protests were noted from Mr. and Mrs. Arnold
Stone, 2695 Adams, and Earl and Maggie Vaughan, 2706 Adams.
I 20th from Friendly to Washington and Jackson to Adams - Estimated to cost $25,000.
Written objections were presented from Louise Ireland, 745 West 20th; S. A. Cuddeback,
2022 Jefferson; and Stuart and Joan Rich, 2050 Madison. Also presented was a petition
opposing the paving signed by a number of owners of property in the area. Mrs. Samuel B.
Edwards, 535 West 20th, in a phone call to the Public Works Department favored the proj-
ect. Stuart U. Rich, 2050 Madison; Robert Rentchler, 1995 Monroe; John and Doris La-
Chance, 2008 Washington; and G. W. Julian, 995 West 20th all objected to the paving.
Various reasons they presented were that the street is not a through street, it 'is in
good condition as it is, paving would increase traffic and hazard for children, and a
poll taken of the area indicated about four to one were opposed to the paving. Mack
Thompson, 915 West 20th, spoke in favor of the paving. He asked where the costs would
fall and was told the entire project, except the paving of intersections, would be
assessed to owners of abutting properties.
38th from Willamette to Knob Hill Lane - Estimated to cost $4;500~. There were no
written protests on file. Thomas Marlow, 4050 Hilyard Street, said he owns property
on both sides of 38th in this area and asked postponement of the project until the
whole area is paved.
Adams from 3rd to Blair - Estimated to cost $18,500. A petition signed by property
owners in the area opposing the project was presented - also, a written protest from
Carl McDowell, owner of property at 4th and Adams. The Public Works Department reported
several phone calls to the department from owners of property in the area favoring the
paving. Willard Stradley, owner of property at 886 West 6th; W. E. Heinke, 643-645 Adams;
I and Adrian J. May, 363 Adams spoke against the project, saying they felt the cost is un-
jusitifed at this time and that the street is adequate as it is.
Hayes, 14th to 15th; 15th, Grant to Hayes - Estimated to cost $11,000. A letter was
presented from Mr. and Mrs. John Ferguson, 1424 Hayes, objecting to the project unless
location of the Amazon Parkway right-of-way is known. Written approval was received
from Clifford R. Manerud, owner of property at 15th am Hayes. George Keating, 1943 Onyx,
and J ames Boyles, 1621 Grant, owners of properties in the area, inquired concerning time
e schedule for construction of the Amazon Parkway. Mr. Keating urged paving of the streets,
and Mr. Boyles favored paving the streets if the Amazon Parkway right-of-way will not take
it out at a later date.
Ferry from 32nd to 34th - Estimated to cost $10,000. A petition opposing the paving
and representing four of the properties to be assessed was presented. James Guse,
490 East 32nd, protested the paving project. He said he had found only three people on
the street in favor of it and that he felt the street, being well graveled, is adequate.
The Public Works Director remarked about the many complaints received by his office on
the condition of the street.
Between Garfield and Chambers, Broadway to 11th - Estimated to cost $29,000. One written
protest was presented from Cora S. Thompson, 1830 West Broadway. Quinten Olson, owner of
property at 990 and 984 Chambers, said he could see no great need for a new street and
asked about the approximate cost of the project. He was told the estimated cost at this
time is $8.80 per front foot.
I Mr. Anderson moved seconded by Mrs. Hayward to approve the paving projects between Jackson and Madison
from 24th to 28th; 38th from Willamette to Knob Hill Lane; Hayes from 14th to 15th, and 15th from
Grant to Hayes; and between Garfield and Chambers from Broadway to 11th.
In answer to a question, the Public Works Director said the projects anticipated to be accomp~ished
this summer are 38th from Willamette to Knob Hill Lane and the Hayes and 15th paving.
Councilman McDonald asked that the project between Jackson and Madison, 24th to 28th, be delayed,
e since he was not familiar with the problem, and with the permission of Mr. Anderson and Mrs. Hayward
that project was deleted from the motion.

A rollcall vote was taken on the motion as modified. Motion carried, all councilmen present voting aye. I
Mr. Anderson moved seconded by Mrs. Hayward to approve paving 20th from Friendly to Washington and ..
Jackson to Adams.
Councilman Wingard entered the meeting.
Rollcall vote. Motion defeated, all councilmen present voting no, except Winga~d abstaining.
Mr. Anderson moved seconded by Mrs. Hayward that the item of paving betwe,en Jackson and Ma,dison .from
24th to 28th be held until the June 26, 1967 Council meeting. Motion carried.
Mr. Anderson moved seconded by Mrs. Hayward to approve paving Adams from 3rd to Blair. Rollcall vote.
Motion defeated, Mr. Anderson and Mrs. Hayward voting yes; Mrs. Lauris and Messrs. Lassen and McDonald
voting no; Mr. Wingard abstaining.

"present:Mayor Cone; Councilmen Purdy, Lauris, Anderson, Lassen,Hayward, McDonald, and Wingard;
City Manager and staff; and bthers.
e 2 1. Public Hearings. Improvement Proiects - Councilman Anderson suggested a meeting of two
or three Council members with the City Manager and Public Works Director to work out
some method of informing property owners on details of Council initiated projects prior
to the public hearings. The purpose is to give answers to technical questions at some
time other than a regular Council meeting.
3 2. Zoning North of Wi1lamette River - Councilman Purdy suggested sending a letter to the
County Commissioners expressing the City's appreciation for their support in denying
the Kendall Ford rezoning request of an area just north of the River immediately adja-
cent to the City limits. Councilman Anderson said he felt there should be more dis-
cussion with the County concerning the area north of the River, especially since the
Washington-Jefferson bridge is being constructed. It was agreed a draft of a letter
which might be sent to the County Commissioners would be brought back for consideration.

Mr. Anderson moved seconded by Mrs. Lauris that Items land 2 of the Committee report be received and
filed. Motion carried.
I 4 3. Oregon Electric. Tracks. 5th Avenue - Copies of a report and recommendation from the
City Manager with regard to removal of Oregon Electric tracks from 5th Avenue were
previously distributed to CJunci1 members. Copies of the report were also sent to the
Oregon Electric people and to firms receiving shipments over the Oregon Electric tracks
east of Almaden Street. A reply from Oregon Electric was read requesting a 10-year re-.
newal of the present franchise. The City.Manager.recomp1ended renewal forone.year,with
provision for an extension of no:1onger than two years. He said he would not recommend
- a lO-year renewal since planning is progressing on redevexopment of the downtown area,
and a 10-year franchise would preclude any change in the 5th Avenue area. He said there

is no objection to the tracks west of Almaden, but franchise renewal for that portion . I
east of A1mad~nshou1dbe on an~annua1 basis until plans for the Central Business Dis-
trict are known and other arrangements are assured for service to those .firms east of
Almaden using the team track.
H. E. Hudson and H. F. Moy of Oregon Electric commented on the operating problems which
would be posed by annual renewal of the franchise. Planned realignment of the tracks
between Wi1lamet~e and.Pear1 would be delayed until it is known whether the franchise
will be renewed, and annual renewal would .prec1ude a.ny but temporary maintenance of the
right-of-wcy .
George Scharpf, owner of Scharpf's Twin Oaks at 669 High Street, said his firm depends
upon Oregon Electric for shipments and supported their request for~ontinuation of the
fr anchise.
~rs. Lauris moved to renew the franchise for two years, with provision for a two-year
extension, and review after four years. There was no second. -
Further discussion emphasized the conflict existing between plans for the downtown area
and possibility of removing the tracks from 5th Avenue and brought out that the report
from the Eugene Development Agency on downtown plans is due in about a year.
Dr. Purdy moved ~ecoQded by Mr. McDonald to renew the present franchise for one year.

Mr. Moy of Oregon Electric said that the one-year renewal has the effect 'of'pcrstponing I
8;ny substantial improvement of the tracks. He said if actual work is not started on the

central business project for at least four years, then major improvements on the tracks I
could proceed. j

The Assistant City Manager said a draft df a proposed one-year renewal franchise was sent to the
Oregon Electric people for review and would be brought back to the Council for action. No action ~was
taken.
1 ' ~. Garbage Rate Increase - The Administrative Assistant explained that a ,request from gar-
, ~ag~ haulers for a 30~ per can per month increase for residential g~rbage service and.a
comparable increase for commercial service was considered by the Garbage Board. Results
of a questionnaire sent to garbage haulers by the Board indicated an increase is war- .
ranted, and the Board recommended a15~ per. can per. month increase for ):"eside.ntia1 serv-
ice but no increase in commercial service. The Board also recommended that commercial
rates be established for contatners of one yard and less, and that intermediate containers
be charged at the same rate as the next smaller container. Mrs. Lauris moved seconded by
D.r. Purdy to approve the Board's recommendation. Motion carried.
2 5. McLean Boulevard Paving - Furtick Construction Company requ,est change in width of paving
on McLean Bpu1evqrd ~o 28 feet instead of 36 feet. Furtick maintains steep slopes created
by the 36-foot paving will make driveways unusable on both ,sides of the street. Mrs. Lauris

3 6. Code Amendment, Parking Strips - The Public Works Department recommended amendment of the
City Code with regard to fill required between sidewalk and curb to define "earth" as
soil of all kinds including gravel;. clay, loam, cinders, mulching material, or ground
cover. If ground cover is. used instead of grass, it must be approved by the Parks De-
p artment . Permanent surfacing is also allowed"so 'Long as' it is cement concrete and not
asphaltic concrete. It was also recommended that the Code be amended to allow p1antings
in the area between. the property line and the curb so long as a five-foot wide continuous -

3 12. Paving Norwood Street - Lowell D. Smit h, owner of Marlow Park Subdivision, requested
paving of half of a portion of Norwood Street between Sally Way and Carmel Avenue during

mitted well beyond the deadline of January 15, and recommended denial. Public Works
also recommended that other owners of property on Norwood Street from Sally Way to
Carmel Avenue be polled to determine whether the entire street should be paved during
the 1968-69 season. Mrs. Lauris moved seconded by Mr. Lassen to deny the request.

within the street right-of-way. The Public Works Department recommended approval
of the requested curb cuts, and that a revocable permit be granted Williams to al-
low the steps in the right-of-way. Mr. McNutt moved seconded by Mr. Anderson to

5 18. Willamette River Dam - A letter was read from the Corps of Army Engineers in response
to an inquiry regarding a low-level dam on the Wil1amette River to provide a quiet-
water area adjacent to Skinners Butte Park and North Bank Park. The letter stated the
Corps proposes to evaluate the possibilities of such a development in connection with
the Wil1amette Basin review study. The letter also commented on the work being con-
tinued on Amazon Creek studies as a part of the Wil1amette Basin review study. No
I action was taken.
6 19. Legislation - The City Manager called attention to the League of Ore~n Cities legisla-
tive bulletin which reviewed status of tax legislation before the Legislature as of
June 6, 1967. Cities were requested to immediately notify the League if any operating
programs are jeopardized under tax plans being considered.
Councilwoman Hayward inquired about H.B.1338 (annexation when health hazards exist)
e and was informed only technical problems are involved which can be resolved.
The City Manager reported that legislation with regard to the 10th and Oak off-street
parking structure passed both houses and is before the Governor for signature. He
said the deadline for appeal in the court case is June 16, 1967, and the architect
selection committee is ready to make a decision on an architect for the s'tructure and
work will proceed immediately if no appeal is made by that date.
7 20. Commendation - A letter from Patricia R.Schneider, instructor at Lane Community
College, was presented commending members of the Fire Department who have taken
English courses under her instruction. She commented with regard to the employes'
enthusiasm, co-operation, high quality of work, spirit, good attendance, and ambition."
