HomeMy WebLinkAbout06/26/1967 Meeting " ~ ~) ~)'&) e ~~V 6/26/67 I Council Chamber Eugene, Oregon June 26, 1967 The adjourned meeting of the Common Council of the city of Eugene, Oregon - adjourned from the regular meeting held June 12, 1967 - was called to order at 7:30 p.m. PDT on June 26, 1967 in the Council Chamber of Councilman McNutt in the absence of Mayor Edwin Cone, Council President Glen Purdy, Cmunci1 Vice President Lester Anderson, and Councilwoman Catherine Lauris. Other councilmen present were Mr. Lassen, Mrs. Hayward, and Messrs. McDonald and Wingard. The minutes of the meeting held June 12, 1967, as mailed to Council members, were approved. NEW BUSINESS 1 Budget 1967-68- The City Manager reviewed proposed appropriations for all funds and ~ changes recommended by the Budget Committee. The total proposed budget amounted to ,., $ necessitating a tax levy of $3,939,493.78. Mr. Lassen moved seconed by Mr. McDonald to adopt the budget as presented and levy the tax. Rollcall vote. Mr. Baitis said the building permit on the house has expired and asked that it not be renewed. He said he would file suit to.have the subdivision decl&ed null and void if the permit is renewed. 'The paving of-East 43rd is on right-of-way dedicated, in connection with property which Mr., Baitis claims to be illegally subdivided. It was recommended award of contract on this project be held over and the staff work with Mr. Baitis to resolve the matter. ., . , . . ' Paving. Sanitary and Storm Sewers. Nob Hill 9th Addition, - The Public Works Department recommended award of contract to the low bidder subject to the contractor's accepting a reduction in cost of $212.73 for: about 224 cubic, yards of excavation done by the subdi~der prior to the bid opening. , . I Sanitary Sewer. Seneca Road from 1st to 5th - The Public Works Director explained that when the assessment is made, the staff will bring to the Council a recommendation..on the amount the City will pay as, a result of the extra depth of the line. He said the 'maximum amount to be assessed to ,abutting, propert~es shoula be'7~ per square foot. Award of con- tract to the low bidder was'recoinmended. . , :I:~ Paving. Sa~itary and Storm Sewers. 18th from City View to Oak Patch' - Hal Bailey, 245'0 e West 18th,. asked it there is.8. possihifit:Y' that work on 18th Avenue would not be started until the 11th Avenue project' is completed. The Public Works Director recommended pro- ceeding with 18th, explaining a schedule is being arranged to allow start of the' sew,ers, incorporating a temporary access road to allow work to start on both projects. If the work on 18th is not started by the midc;lle of August" a~top order wtll be given and the, paving held over to next spring..' He also. explained that the $35,000 budgeted for paving includes acquisition cost of right-o.f-way west of Oak Patch Road, and the $12,000 budgeted for sanitary sewers includes cost of sewers construction west of Oak Patch next season. Award of contract to the low bidder was recommended. : . . , Paving and Storm Sewer. Garden:Way from Harlow Road to. south boundary Holiday Park - It was explained that the storm sewer will have to be. ,extended farther. than anticipated. <;: Also, that this project is a joint. effort with Lane County for completion prior to the opening of the. football stadium o,n Centenniat Boulevard because of the anticipated increase in traffic. Award of contract to the low bi.dder was recommended. Ohland S. Upton, owner of property on Sisters View, objected to the proposed ass.essment I against his property since it is outside the City limits. He ~as'informed,that there will be no assessment'levied"against his 'property until. it annexes to the City. . In answer to a question from Jack Foster, 2350 Oakway Terrace, the Public Works Dire~tor explained that ~:lOly the principal amount of the assessment is levie~ with no accumulation of interest in cases where the assessment is deferred, It was also explained, in answer to a question from Councilman Lassen, that a record of deferred assessments if now carried by the Finance Department and shows as a potential lien on the title of any property - tr~msfer,red. ~, 6/26/67 - 2 . 35~ 6/26/67 I On the balance of the pro jects, the Public Works Department recommended award of contract to the low bidder on each project. Mr. Lassen moved seconded by Mr. McDonald to award contracts to the low bidder on each project, hold- ing award of the 43rd Avenue paving for two weeks, and showing 7~ per square foot as the maximum assessment to be levied against abutting properties on the Seneca Road sewer. COMMITTEE REPORTS Committee meeting held June 22, 1967: I "Present: Councilmen Lauris, McNutt, Anderson (presiding), Lassen, Hayward, McDonald, and Wingard; Assistant City Manager and staff; and others. 1 1. Public Works Bid Opening, June 20, 1967 - A tabulation of bids submitted was presented with the recommendation of the Public Works Department that contracts be awarded to the low bidder on each project, except that the contract award for paving, sanitary, and storm sewers in Nob Hill 9th Addition be held temporarily. It was explained that e after engineering work onthe project was completed and before the bid opening, the sub- divider roughed out streets and made fills so that the engineering work will have to be revised. With regard to the sanitary sewer on Seneca Road, the Public Works Director said the cost to the City is more than normal because of the depth at which the line will be constructed due to soil conditions. Normal lateral depth is from six to eight feet, whereas this line will be constructed about 17 feet deep. The lateral will be a 12-inch line, and the City's cost will include the difference between the cost of a normal 8linch lateral and the 12-inch line. The City's participation is estimated at $12,500. Assessment against abutting properites is not expected to exceed 7~ per square foot. Mr. McNutt moved seconded by Mrs. Lauris to award contracts to the low bidder on each project, except that the Nob Hill 9th Addition project be held. Motion carried. No action was taken (see action taken under Bids earlier in meeting). 2 2. Planning Commission Report - May 22, 1967 I a. Naming Frontage Road along Interstate 5 at G1enwood Interchange - The Planning Com- mission recommended that this frontage road be called "G1enwood Drive." Mrs. Lauris moved seconded by Mr. McNutt to approve. Motion carried. I 3 3. Planning Commission Report - June 6, 1967 I a. Zoning Amendment. Height Restrictions, Skinners Butte and Judkins Point - The Plan- I ning Commission recommended height restrictions on buildings in the area around I Skinners Butte between,Washington Street and Co burg Road and between the Willamette e River and the Southern Pacific tracks. Buildings constructed at a ground elevation l 6/26/67 - 8 - ----- ~ 36" e 6/26/67 I of 460 feet or less would be limited to a height of, 500, feet above sea leyel, and buildings constructed at a ground elevation of more than 460 feet above sea level would be restricted to a he~ght of 40 feet. A maximum height of 40 feet was also recommended for the Judkins Point area lying generally between the Willamette River and lines south of 13th and 15th on the south and between Interstate 5 and a line between Onyx and Beech if extended north of Franklin Boulevard. The Plan~ing Director said the University of Oregon was contacted, and these recommendations will no~ hamper its immediate development plans. Mrs. Lauris moved seconded by Mrs.Hayward to amend the Zoning Code as recommended as an interim plan until the new zoning ordinance is adopted. Motion carried. Betty Niven, Planning Commission member, explained the height restrictions were recommended as an '~ interim plan until the new development plan is adopted, since the new zoning ordinance makes no pro- ~ vision for height restrictions other than those now in effect. She suggested creation of a conserva- tion committee for the study of landmarks as vista points, but said Skinners Butte and Judkins Point, because of their proximity to congested areas, should be protected by interim restrictions and asked that each be considered separately. Fred Braatz, 795 West 36th, representing several owners of property along Franklin Boulevard, asked I that a committee be appointed to study the particular problem of height restrictions 'in the area of Judkins Point. He agreed with the Planning Director's suggestion that any plans for buildings over 40 feet in height be considered on an individual basis. Jack Foster, representing Coca Cola Bottling Company on Frankl~n Bo~levard, said height restrictions on structures near Judkins Point would affect property values. Joe Romania, representing Lew Williams Chevrolet, said it would be logical to have restrictions on signs but not on buildings. Further discussion brought out that the last zoning review of the area proposed for height restrictions was about 1961, and that appeal, should the restrictions be imposed, would be handled by the Planning Commission, not the Board of Appeals. Mrs. Hayward suggested a 65-foot height restriction with individual review of anything between 40 and 65 feet before issuance of a building permit. Mr. Wingard recommended no restrictions, but a review of anything higher than 40 feet. Mrs. Niven suggested the restrictions on the Judkins Point area be referred back to the Planning Com- mission for further co nsideration. Mr. Lassen withdrew his motion to approve the committee report. Mr. Wingard moved seconded by Mr. Lassen to refer the Judkins Point matter back to the Planning Com- mission. Motion carried. 'I In discussion of the height restrictions in the Skinners Butte area, Cliff Shirley of Universal De- velopers owning property at the foot of Skinners Butte, asked that this also be referred back to the Planning Commission. He said he felt such restrictions would devaluate the property. The City Manager suggested incorporation of a conditional use procedure for review of specific building plans in this area. Mrs. Niven said because of the difference in required criteria between the Skinners Butte area and the Judkins Point area, the 40-foot limit should be adhered to aIDund Skinners Butte. Mrs. Hayward moved seconded by Mr. McDonald to adopt the Planning Commission recommendation for ~ height restrictions in the designated area around Skinners Butte. Motion carried, Mr. McNutt voting no. There was some further discussion in which it was generally agreed that adoption of the height re- strictions is an interim plan until adoption of a new development plan for the metropolitan area. Also, that height restrictions on signs are included in the new sign ordinance now being considered. 1 b. Conditional Use, City-owned Property, east side Washington south of Willamette River, Child Care, Inc. - The Planning Commission recommended approval of use of the Raup house at 169 North Washington for operation of a day nursery by Child Care, Inc. The property was acquired by the City for future park purposes. The recommendation "is subject to (1) maintenance of site in a residential manner; (2) signs limited to one, 12 square feet; (3) maintenance of properties along the western and southern portions of the property as site screening; (4) locating and fencing the play area on the northwestern portion of the lot; (5) provision of adequate off-street parking; and (6) review of the operation may be required within two years. The Parks Department recommended rent-free use of the property 1- so that the City may apply for exemption from property taxes. Mm. Lauris moved seconded by Mrs. Hayward to approve the Planning Commission and Parks Department recommendations. Motion carried. Charter Amendment, Mapped Streets - The Planning Commission recornrnended that the Council submit,a Charte~ amendment at the next City election which would authorize enactment of "mapped streets" legislation where such legislation would protect fut~re street rights~of-way or would allow for redesign of existing obsolescent street patterns. Councilman And.erson explained that the League of Oregon Cities' legislative c~mmittee sponsor~dlegislation on .the State level but it was not I adopted at this, session :of the Legislature-: The Charter'amendment would accom- plish the same purpose. An opinion-from the City Attorney's' office said the Charter amendment would give the Council clear authority, since it is questionable if it now'has that 'authority. Supplemental Report, Crest Heights Advisory Committee - ,Three' members of the Crest Heights committee submitted a supplemental report to the report previously submitted, I with regard to sanitation problems in the Crest Heights area. The supplemental report covered what was felt by the three members of the committee to be omissions which vitally affect the area: (1) Comparative time elements involved in obtaining sewers for the:area if it depends upon creation of a:metropolitan sewer district as against that if the area annexes to the City; and (2) creation.of the metropolitan sewer dis- trict would not solve the problem of fire hazard because of antiquated water lines. EWEB could come 'into the area with water on its own:only if the area is annexed to the City. Recommendations of the report were (1) to annex the Grest Heights area'to the City without delay and to institute a crash program for sewer installation, and (2) ex- tend tentative boundaries of such annexation to include all of the College Crest Water District and that area lying south of the College Crest Water District which has natural drainage into 'it to prevent pollution from above. The Public Works Director said sewer can be extended to the area within a reasonable length of -time, but it must be under~tood it might be two years or more after annexation before s~rvice would be I available l?ecause of necessity for acquiring easements. Mrs. Lauris moved seconded by Mrs. Hayward to inform'the memb,ers submitting the supplemental report that the City 'would consider annexation upon petition initi~ted by people in the area, the boundaries to be worked out with the staff to restrict the annexation to an area which can be served 'by sewers. Paving 27th, Jackson to Friendly; 26th, Adams to Madison; and Madison, 26th to 25th :Place - Council, initiated 'projects heLd, over from the June 12, 1967 Council meeting. The Pub'lic Works Director explained this paving is in a neighborhood improvement area and, with a major storm drain project, will complete basic City improvements:in the- area. It was brought out that the 20th Avenue project which was denied by the Council is expected, to be completed in the next. year or two,. The. puol.ic Works Director said, and the C~uncil generally agreed, that'owners of abutting properties will not'petition street improvement so long as the City maintains unimproved streets. Sprinkler Bid; Hendricks Park -:The Parks 'D~partment reported the low bidder, Lees Backhoe Service:, was unabl~ to. procure a performance, bond: for the irrigation ins talla- tion in Hendricks 'Parks. It was:therefore' r.ecommended the bid be awarded to the second low bidder, Ramsey-Waite Company, in the amount of $7,240.00. The second low bid was $245.00 more than the low'bid. Collector Street. 23rd from Willamette to Friendly - The Public Works Department, because of accidents occurring at the intersections of 23rd with Olive and Charnelton, recommended that 23rd be designated a collector street with yield signs installed at those intersections not now controlled. Mrs. Lauris moved seconded by Mr. Lassen to refer this item to the Planning Commission for review. Motion carried. 3 10. Street Closure. south of Country Club Road and turn off north of 3rd Avenue at Coburg Road - The Public Works Department recommended immediate closure of the street running diagonally behind the service station at the southwest corner of Coburg Road and Country Club Road, and of the turn off lane from Coburg Road to Ferry Street immedi- ately south of the bridge. Both closures were requested as a result of accident incidence e at these locations. The Public Works Department also requested initiation of street. im- provement on that section of Country Club Road between Coburg Road and the Delta Highway for construction in the 1968-69 season. A letter was noted from Charles L. Potterf, " 420 East 3rd Avenue, calling attention to the accidents caused by the right-angle turn from Coburg Road to Ferry Street. Mrs. Lauris moved seconded by Mr. McNutt to refer the item to the Planning Commission. Motion carried. I 4 11. Crossing Gates. SP at Garfield. Pearl. and High - The Public Works Department recom- mended installation of crossing gates at the Southern Pacific tracks on Garfield, Pearl, and High. The cost of the installations would be shared 50/50 by Southern Pacific and the City, with the City's share estimated at $10,000 per crossing to be budgeted for 1968-69. Mr. McNutt moved seconded by Mr. McDonald to approve the City's entering into a contract with Southern Pacific as recommended. Motion carried. Metropolitan Planning Review - A letter was read from the Mayor of Stockton, California requesting support for Federal legislation which would repeal the provision in the 1966 Demonstration Cities and Metropolitan Development Act making mandatory a review by a metropolitan or regional planning agency as a prerequisite for Federal loans for public works projects and local facilities. Mr. Leonard originally requested permission to charge a $35.50 starting rate instead of the' present $26.00. .He later amended his request. to a $30.00 starting fee with a $.75 portal to portal metered rate and various 'incre'as'es in' miscellaneous servicec.:charges. The committee recommended a $28.00 starting fee, and a: fee of $.75 per mi'ie portal to portal (Le.; from Ambula'nce Service to hospital and back to Ambulance Service) instead of the present $l. 00 per mile fr'om point of pat ient pickup to patient destination. Also, a change from $.25 per mile on wheelchair coach rates to $.25 per mile portal to portal.
