Home My WebLink About07/10/1967 Meeting ~ e il69 7/10/67 ...-_0. _ I Council Chamber Eugene, Oregon July 10, 1967 Regular meeting of the Common Council of the city of Eugene, Oregon was called to order at 7:30 p.m. on July 10, 1967 in the Council Chamber by His Honor Mayor Edwin E. Cone with the following council- men present: Mrs. Lauris, Mr. Anderson, Mr. Lassen, Mrs. Hayward, Mr. McDonald, and Mr. Wingard. Councilmen Purdy and McNutt were absent. Minutes of the meeting held June 26, 1967, as mailed to Council members, were approved. NEW BUSINESS 1 Resolution 1433 - Changing governing pbdy of Urban Renewal Agency and appointing new Agency, was submitted and read in full. e Mr. Anderson moved seconded by Mrs. Lauris to adopt the resolution. Motion carried. 2 Swearing In New Agency Members - Mrs. Richard E. Miller, Roy Morse, Charles Duncan, and Frank Shearer were sworn into office as members of the newly constituted Urban Renewal Agency by the City Recorder. Member Harry Rubenstein was previously sworn in, and Members Ray Hawk and Wallace Swanson will be sworn in at a later date. I 3 Paving 43rd from West Amazon to west - Contract award on this project was held over from the June 26, 1967 Council meeting because of uncertainty of the legality of the street dedication and subdivision. The City Attorney's recommendation was not to award the con- tract, since there is now a court suit pending testing the legality of the right-of-way dedication. Mr. Anderson moved seconded by Mrs. Lauris to reject the bids submitted for paving 43rd. Motion carried. All councilmen present voting (ay~, motion carried. - COMMITTEE REPORTS e Committee meeting held July 6, 1967: "Present: Mayor Cone; Councilmen Lauris, McNutt, Anderson, Lassen, Hayward, McDonald, and Wingard; City Manager and staff; and others. 2 1. Urban Renewal Agency - A resolution was presented which would constitute a new and separate body as the Urban Renewal Agency of the city of Eugene and transfer authority which now lies with the Mayor and Council members as the Urban Renewal Agency to the newly constituted Agency. Included in the resolution were names of the new Agency's members and their terms of office - Harry Rubenstein, one year; Ruth Miller and Max Morse, two years; Charles Duncan and Ray Hawk; three years; and Wallace Swanson and Frank Shearer, four years. Reappointment or appointment of a member hereafter will be made by the Council and for a four-year term. Frank Shearer suggested that the I Agency's membership include at least one member of the City Council and that a Council members be appointed when the next vacancy occurs. Mrs. Lauris moved seconded by Mr. Anderson to adopt the resolution. Motion carried. No action was taken (see first item under New Business). 3 2. Riverbank Dedication, Valley River Shopping Center - Wayne Shields, developer of the Valley River Shopping Center north of the Wi11amette River, proposed dedication of a l500-foot strip of riverbank property at the southwesterly end of his proper~y to the e City for public use. The property is to be maintained by the City. Mr. Shields said the dedication would be made concurrently with annexation of the Valley River area to l 7/10/67 - 8 3'7 "? . 7/10/67 I the City, and asked that they retain some control over public and City access to the dedicated land to prevent any interference with Valley River's parking area. He said the dedication is for the purpose of maintaining the Green Belt concept along the River and asked that the City landscape property in its ownership on the south bank directly across from the strip to be dedicated. He also said negotiations are in progress with owners of property on both sides of the Valley River land to provide similar treatment for the riverbank. Mrs. Lauris moved seconded by Mr. Lassen to accept the dedication. Motion carried. It was understood the staff would bring back a recommendation with re- gard to landscaping the City property on the south bank of. the River. Easement Vacation, Cresta de Ruta, Mention - Council members toured the site of the requested easement vacation at 2695 Cresta de Ruta. Robert C. Mention requested the vacation to permit construction of a driveway retaining wall. Objections were pre- e sented by James Bell, owner of property to the east facing on Capital Drive, on the basis that the easement would be needed for sewer line to his property. The Public Works Department suggested a co-operative agreement between the two property owners which would allow construction of the sewer line to the adjacent property at the same time the retaining wall is constructed. Mr. Mention had no objection to an agreement, but Mr. Bell said he did not want to invest further in his property at this time. Further discussion revealed that the proposed retaining wall would en- I creach three feet into the easement for a distance of about 20 feet. MrS.Lauris moved seconded by Mr. Anderson to retain the public easement but to permit construc- tion of the retaining wall in the easement with the understanding that Mr. Mention would lay a sewer line through the critical area at the same time the wall is con- structed, and with the further understanding that Mr. Mention would be reimbursed for the cost of the dry line from the connection charge for the adjacent property equivalent to an assessment if the sewer -is put into use to serve the Bell property. Motion carried. Mr. Anderson moved seconded by Mrs. Lauris to approve Item 3 of the Committee report. Motion carried. 2 4. Right-of-Way, 18th Avenue, Mayers-Williams - Permission was requested to purchase right-of-way on the north side of 18th immediately east of Oak Patch Road from Raymond and Lenetta Mayers and Clarence and Irma Williams for $1500, the cppraised price. The purchase includes a slope easement. Mr. McNutt move d seconded by Mr. McDonald to purchase the land and slope easement. Motion carried. Condemnation, Storm Drainage Easement, Elder - The Public Works Department requested authorization to condemn for drainage ditch easement across property of W. Howard and Rose Elder north of 18th Avenue between Oak Patch Road and Wilson Court. The drainage is needed in connection with the 18th Avenue paving. Negotiations have fai led to bring an agreement on price. Mr. McNutt moved seconded by Mr. Anderson to authorize I condemnat ion. Motion carried. 4 6. Sanitary Sewer, Alley between Hilyard and Alder, 260 feet north of 25th - Petitioned by the owner of 9.4% of property to be assessed. The Public Works Department recom- mended construction of the sewer to provide complete coverage of the area since it will serve six properties in the middle of the block bounded by Hilyard and Alder, 24th and 25th, which have not been assessed for sanitary sewers. The cost is estimated at 6~ per square foot. Mrs. Lauris moved seconded by Mr. Anderson to proceed. Motion carried. e 5 7. Package Store Class A, Prall's Market , 295 West 17th - Clifford W. and Anna Mae Prall requested endorsement of a license for this location, formerly Mayfield's Market, near Wilson Junior High. Planning Commission Report - June 26, 1967 , a. Vacation Utopia Street - The Planning Commission reaffirmed its recommendation to vacate Utopia Street because of ii5ts very steep grade if constructed,: and because other streets are planned to give access.to the property to the south.' Roger Chrysler, 2330 McGregor, said that his property is now landlocked because of e, the recent vacation of a portion of City View Street. He asked that Utopia Street remain a public right~of-way until other streets planned to give access to the area are actually dedicated. He also asked that City View Street be rededicated. The Planning Director said that Slocums, owners of property to the south, are having a survey made of their property and will work with Mr. Chrysler to provide access to his property. . How-ever, it is not known when right-of-way will be provided. I It was brought out in discussion that the Planning Commission has authority to re- quire dedication of streets prior to approval of subdivision plats, so right-of-way protection would be afforded the Chrysler property as the area develops. I t. was also brought out that the Chrysler property does not now have access to Utopia Street. Clifford Shields said the portion of City View vacated has been sold so that he can- not rededicate it as a public right-of-way. Motion carried. 9 Resolution No. 1435 - Calling hearing re: Amending 1967-68 budget publication, August 14, 1967, was submitted and read in full. The City Manager explained an error was made in a descriptive phrase in the 1967-68 budget pub1icatfu n- the item "taxes necessary to balance the budget" should read "total taxes to be levied." Hence, the need for a public hearing to correct the publication. In all other respects, the budget and amount of taxes to be levied are the same as previously approved by the Council.
