Lauris also asked if 'the- streets' could- be- swept- at hight. to- avoid- having to sweep around.parked- cars. The Public Works Dire'ct'or- said sweeping at' night br-ought complaints because of the noise of the sweepers, but that it could be tried again. - - - . . . . - - , , -,- , - 2 - Side Street Closure" .;, Councilman Lassen:asked'about the closure: of Side' Street by- Oregon Electric. The City Manager explained Side Street was never a dedicated right-of-way, I that it exist'ed by- permit from: Oregon- E1ecCric -to: one property', owner. The permit was' ca'n- ce1e~ wheh use of~the street intetfered with a switching track-extendedi~t6th~ area ~nd - put into use. Delaying the project beyond that time would make it impossible to complete the work this construction season. I Paving, sanitary and storm sewers in Kingswood Terrace Addition - The Public Works Department recom- mended award to the low bidder, subject to approval of the property owner. Paving and storm sewers on 38th from Willamette to Knob Hill Lane - The Public Works Department made no recommendation on this project, but suggested it might be held until next year and then include another two blocks with the thought the cost would be decreased. Paving and storm sewer on alley between 6th and 7th, Chambers and Fillmore - The Public Works Director explained that although only one bid was received, it was thought to be a reasonable cost for the work. Dr. Purdy moved seconded by Mr. Anderson to award contracts to the low bidder on each project, except that all bids for paving and storm sewer on 38th Avenue be rejected; that the award for the. Mahala Hills Addition project be subject to School District 4's entering into an agreement to provide neces- sary rights-of-way for the City by noon, July 28, 1967; and that the award on the Kingswood Terrace Addition project be subject to approval of the property owner. COMMITTEE REPORTS Committee meeting held July 20, 1967: "Present: Mayor Cone; Councilmen Purdy, Lauris, Anderson, Lassen, McDonald, and Wingard; City Manager and staff; and others. 411 3 '1. Danebo Swimming Pool - The Parks and Recreation Director and Jon Berry, architect, pre- sented schematic drawings of the proposed Danebo swimming pool to be located adjacent to Willamette High School. The design is for a 50-meter pool which will accommodate National swim meets. One end of the pool will be covered, and a movable bulkhead will separate the enclosed and open areas when the entire length is not in use, thus providing several teaching stations, two diving areas, and ample swimming areas. A spectator I balcony is planned for the entire length. The anticipated cost. of the pool as designed will come within the budgeted amount of $460,000, and estimated operational cost is comparable to that for Sheldon pool, except for a slight increase in personnel. Members of the ad hoc committee appointed to work with the architects and the Parks Department, were present and recommended acceptance of the proposed design. . The Parks Director said that bids could probably be called before January 1968. Mrs. Lauris moved seconded by Dr. Purdy to accept the schematic plan and concept as presented for a 50-meter pool. Motion carried. Some discussion was held with regard to the depth of the shallow areas in the proposed pool. Council- man Lassen expressed concern about the safety of very small children using the pool. Jon Berry, architect, and Jerry O'Malley, member of the ad hoc committee, explained the 3~-foot shallow depth is necessary for turns in competitive swimming. The Parks and Recreation Director said very small. child- ren would use wading pools, and that a wading pool no doubt would be included in some future park in the Danebo area. It was estimated a wading pool would cost about $15,000. Dr. Purdy moved seconded by Mr. Anderson to approve Item 1 of the committee report. Motion carried. 4 2. Planning Commission Report - July 5. 1967 a. Rezone to C-3P. Willamette and Donald at 32nd.Hirons - The Planning Commission recommended denial. Betty Niven, Planning Commission member, explained the Com- mission's policy of not discussing. rezoning issues individually either with appli- cants or those opposed to specific rezoning petitions. Mrs. Lauris moved seconded by Mr. McDonald to grant a variance to allow operation of a retail garden center I on the property for which C-3P zoning is requested. John Hirons, petitioner, and Darrell Smith, architect, gave their views on general need for such an establishment at this location and or resulting traffic likely to be generated. Mr. Hirons said he would anticipate assuming the entire cost of im- provement of the alley running from Wi1lamette to Donald from which access to the proposed garden center would be taken. Signs were mentioned, and it was generally agreed any restriction could be placed on signs, as well as ensuring payment for ~ alley improveme~t, through a variance agreement. Vince Farina, Planning Commission ~ chairman, upheld the Commission's recommendation for denial based on the contention t'hat ample'G':'3P zeD.ing e:xists on Willamette north of 29th Avenue, and rezoning this particular area would infringe upon the residential area. The Planning Director read a memo from the Central Lane Planning Council recommending denial of commercial zoning. A vote was taken on the motion to grant a variance, and motion carried, Councilmen Purdy and Lassen voting no; Councilman Wingard abstaining. Dr. Purdy moved seconded by Mr. Anderson to approve Item 2a of the Committee report. Motion carried, Councilmen Purdy and Lassen voting no. Councilman Wingard explained his abstention in the Committee action. He said he would rather see the item referred back to the Planning Commission rather than granting a variance to gain referral to a joint meeting of the Planning Commission and Council, which is automatic when the Council does not I approve a Planning Commission recommendation. 5 b. Rezone to R-3PD. west side of Oak Patch Road between 15th and 18th. Chowning,- The Planning Commission recommended denial of the rezoning which would allow a planned unit development of 134 units. Noble Chowning presented a sketch of the proposed' development and explained the general concept. The Public Works Director said the sewer design for this area was based on 12 people per acre, whereas this planped development anticipates 57 people per acre. Vacation portion of Cross Street at Railroad Boulevard, Mannings, Inc. - Because of difference in surveys discovered in connection with paving Cross Street, Mannings, Inc. requested vacation ofa segment on the south side of Cross Street at Railroad Boulevard on which their building encroaches. Mannings will dedicate additional right-of-way to the City at this intersection to compensate for the vacation. The Planning Commission recommended approval. Mrs. Lauris moved seconded by Dr. Purdy to set a date for public hearing on the vacation. Motion carried. 2. Planning Commission Report - July 10, 1967 5 a. Closing Off Old Country Road Running Diagonally from Country Club Road to Coburg Road- The Planning Commission recommended approval of the street closure, referred from the June 26, 1967 Council meeting, The Public Works Department recommended immediate closure, and initiation by the Council of paving that section closed off from Coburg I Road, as well as paving Country Club Road between Co burg Road and the Delta Highway, both to be scheduled for 1968-69 construction. Mayor Cone commented on use of the one lane of Country Club Road onto Coburg Road if the old County road is closed, ex- pecially when Autzen Stadium is in use. Mrs. Lauris moved seconded by Mr, Anderson to approve the recommendation, Motion carried. 6 b. Closing Off Turnoff From Coburg Road to Ferry Street south of Ferry Street Bridge - The Planning Commission recommended approval of this closure, also referred from e the June 26, 1967 Council meeting. Designating 23rd from Willamette to Friendly as Collector - The Planning Commission recommended approval of designating 23rd as a collector street by installation of yield signs at all intersecting streets not now controlled. Some discussion ensued concerning use of stop signs instead of yield signs. It was explained that 23rd is a minor collector and yield signs have been found effective for controlling streets entering a minor collector. Mayor Cone called attention to the intersection at 23rd and Lincoln and said probably a four-way stop would be better than the present control.. Dr. Purdy moved seconded by Mr. Anderson to approve installation of yield signs at intersecting streets on 23rd not now controlled. Motion carried. I It was understood a report would be brought back in six to seven months on the effectiveness of the yield signs, and that the intersection of 23rd and Lincoln would be viewed on a future Council tour. 8 3. Traffic Control, 28th and Friendly - A petition was presented requesting stop signs at the southwest and northeast corners of 28th and Friendly. The Publi'c Works Department recommended denial on the basis that the present stop signs are in conformance with an overall plan for the completion of 28th Avenue to Chambers Street. e Dr. Purdy moved seconded by Mr. Anderson to deny the petition. Sidewalk Compensation. 888 West 28th - The property owner, James Walker, has indicated he would rather be paid for the sidewalk destroyed in connection with street construc- tion at 888 West 28th Avenue than have it reconstructed. Reconstruction would require acquisition of additional right-of-way. The Public Works Department recommended payment. Dr. Purdy moved seconded by Mr. Anderson to approve payment instead of reconstruction, the amount to be determined by the staff. Rollcall vote. Motion carried, all councilmen present voting aye. 2 15. Street Overlays - The Public Works Department asked permission to include several street overlay projects in this year's construction program. Funds would be derived from addi- tional revenues of about $54,000 received because of the 1~ added to and reapportionment of gas tax funds by the State Legislature. Protests were registered by residents of the area against the arterial type street constructed because they felt it would decrease the value of their property. The Public Works Director explained that the type of street construction was determined by soil tests, and said that this project is the first stage of an arterial between 29th and Chambers, the balance to be built this year. She had asked the City for $19,000. The City Manager said the City would be willing to proceed with further negotiation for purchase of the property for the right-of-way.
