The regular meeting of the Common Council of the city of Eugene, Oregon was called to order at 7;30~m..
PDT on August 14, 1967 in the Council Chamber by Council President Glen Purdy in the absence of His
Honor Mayor Edwin E. Cone. Other councilmen present were: Mrs. Lauris, Messrs. McNutt, Anderson, and
Lassen, Mrs. Hayward, and Messrs. McDonald and Wingard.
Minutes of the meeting held July 24, 1965, as mailed to Council members, were approved.
NEW BUSINESS
1 Commendation. Parks Department - Councilman McDonald congratulated the Parks Department upon
instsllation of a backboard for the Westmoreland tennis courts. Councilwoman Lauris men-
tioned a backboard had also be~n installed at the Roosevelt courts.
4It 2 Low-Rent Housing - Councilman Purdy announced that he and Councilmen Wingard and McDonald
have scheduled a meeting with Paul Lansdowne and Lee Anderson of the Lane County Housing
Authority. The meeting will be at noon, August 15, 1967, in the Eugene Hotel for discus-
sion of low-cost housing and rent subsidy program. Other Council members were invited as
well as staff members.

I 1 1. Film on City Government - Council members previewed a film "City Government in Action"
made by Will Trumbull of KVAL-TV, using subjects in the city of Eugene to demonstrate
the workings of municipal government. Mr. Trumbull said he will distribute the film
nationally.
Mr. Anderson moved seconded by Mrs. Lauris that Item 1 of the Committee report be received and fi led.

e 2 2. School/Park Properties - The Parks & Recreation Director showed slides of properties
in various sections of the City which have been acquired by School District 4. The'
District has' asked for the Council's desires with regard to joint use of 'these areas
so that the District may know which properties to hold for future development. No
action was taken. Written recommendation on each property is to be submitted by the
Parks Department.
Discussion turned to rates for water used for the park areas and the possibility of
obtaining from. the Eugene Water & Electric Board a reduction of the present metered
rate. Also discussed was EWEB's payment to the City in lieu of taxes. . Dr. Purdy
moved seconded by Mr. Anderson that the staff gather information with regard to City
expenditures' for water and electricity with the idea of working out lower rates or
increased EWEB payment. Motion carried.
3 3. PUC Application. Washington-Jefferson Overhead Crossings. 5th Avenue - Copt'of the
I state of Oregon's application to the Public Utilities Commissioner for overhead cross-
ing of the Oregon Electric tracks on 5th Avenue by the Washington-Jefferron bridge ex-
tensions was presented. Formal objections, if any, must be' filed with the Commis-
sioner within 30 days. Dr. Purdy moved seconded by Mr. Anderson that no objections
be filed. Motion carried.
4 4. Fire Alarm System. University of Oregon - Copy of an agreement between the City and
the University was presented covering terms under which City and University fire
alarm systems will be 'installed and operated. Dr. Purdy moved seconded by Mr.Anderson

4 2. Sewer Agreement. Valley River Center - An agreement ?etween the City, Valley River Center,
and The MaY,Dep~rtment Stores ,Company was presented covering the following points:

a. The City wili start construction no later than August 1, 1968 of a trunk.line to
provide sanitary sewer s~r~ice.to the Center, construction to be completed by
March 1, 1969. .
b. Upon completion of, th~ sewe~, ~he.Center will file a petition for a~nexation.to be
processed immediately, but annexation will not be completed until the Meier and Frank
store and the J. C. Penney store ~ave been placed on the Lane County ta~ rolis.
c. If sewer service is not 'ready by March 1, 1969, then the Center may construct its
own sewer facility and will not be required to annex to the City for five years.
d. The City will provide all other City services to the Center from the time the Center
commences use of the_City sewer, and, until annexation is completed, the Center will
pay to the City the equivalent of the ad ~alorem 'tax levied against the Center's
property.

Councilman Wingard expressed concern about the City's fire rating when buildings con-
structed under the County code are annexed to'the City, b~t it'was generally agreed no
problem would arise since: the City and County operate under ~he same building. code.
The City Manager explained the delay in annexation is because of the greater a~ount-of
valuation which would be added to the tax base if ann~~atio~ is completed after i~p~ove-- I
ments'are on the property.

1 3. Abatement, 955 East 43rd, Sahlstrom-Shaeffer - The City Manager explained the circum-
stances concerning the qouse moved to 955 East 43rd Avenue, the' subsequent knowledge
of an illegal subdivisiqn, and the dedication of only a half interest in the street
right-of-way for East ~3rd Avenue. The building permit issued on the house has expired,
and it was recommended that abatement of the structure proceed. Mr. Anderson moved
seconded by Mrs. Lauris to call a public hearing. Motion carried.
2 4. Abatement, 1255 Hughes Street, Scadding - The Public Works Department reported they
have been unable to get the owners to repair or remove the unsafe and substandard
building at 1255 Hughes Street, and recommended abatement. The property is in the
e ownership of James A. and Doris M. Scadding, Route 2, Box 211P, Hillsboro, Oregon.
Mrs. Lauris moved seconded by Mr. McDonald to call a public hearing. Motion carried.
3 5. Carport Variance, 2095 Lincoln, Parkhurst - The Zoning Board of Appeals referred to
the Council a request from John Parkhurst, 2095 Lincoln Street, for permission to
construct a carport about 10 feet into the unimproved 21st Avenue right-of-way. The
City Manager said there would be no objection to granting a revocable permit for the
I carport, since it appears 21st Avenue will not be opened at this location. Mr. Wingard
moved seconded by Mr. McDonald to grant a revocable permit to construct the carport
10 feet into the right-of-way. Motion carried.
4 6. Sanitary Sewer, Roosevelt Boulevard between Foch Street and Oregon Electric tracks -
petitioned by owners of 31% of property to be assessed. Mrs. Lauris moved seconded
by Dr. Purdy to approve the petition. Motion carried.

5 7. Bids, Airport Improvements, Opened August 3, 1967 - A tabulation of bids was presented
for runway extension and lighting at Mahlon Sweet Field. C. J. Montag & Sons was low
bidder on the runway extension at $184;375.61. Steeck Electric Company was low bidder
on the l~ghting at $53,632.20. No action was taken. A special meeting of the Council
will be he~d August 8, 1967 at 5:00 p.m. to award contracts.
6 8. Traffic,' 18th and, Oak - A l2-hour count of. the traffic entering the intersection at
18th and Oak'was presented in response to an inquiry from a.councilman concerning es-
tablishment of a three-p~ase signal to allow eastbound 'traffic on 18th to turn north
onto Oak. The count, expanded to 24 hours, indicated only 1704 eastbound vehicles out
of 6420 entering the intersection on 18th turned north. onto Oak. The traffic engineer-
ing department reported that changing the phasing on the $ignal at this intersection
would disr~pt the p~ogre~sion on. 18th. . However, an updated report on 18th Avenue si
I being prepared for the Council's review, and the 18th and Oak intersection will. be in-
cluded~ No action was taken.

8 10. 10th and Oak Parking Structure - The Council was informed that the Supreme Court may
not hear the appeal in the 10th and Oak parking assessment.district suit until the
first of the year. Time limits are set by statute for presentation of paper work to
the Court, and in this case November 28 is the deadline. The City Attorney said he
would file with"the Supreme Court a request for. early heating on the basis that the
case is of public interest.
9 11. Variance, 27th and Jeffersoq Suess Letter - A letter was read from Robert Suess with
regar4 to. granting a variance at a previous Council meeting to allow his construct ton
of a duplex at 27th and Jefferson."

to recommend a program of jail administration; (5) inclusion in the program of rehabilita-
tion of prisoners and implementation of work release; (6) co-operation of the three juris-

and federal agencies; (7) centralization of administration. and responsibility-fur the
jail, preferably Lane County. The general consensus was ~hat the type 'of physical:
facili~y needed: and its location would depend upon the type of institution needed .by I
the .community; that metropolitan co-operation is the best way of-implementing the type
of study necessary to determine the faGility needed and.its adminlli tration; that any
study should be guided by professional people inlaw enforcement, including police ad-
ministrators and judges, and in. medicine and psychiatric. services, '::;as well as ..the..

sentatives of Lane County, Springfield, and Eugene be created to set up the procedure
for implementing a study to determine the type of correctional institution needed in the

be - rezoning property at 19th and Agate to R-3G. He asked that the agreement. between the City and
Mr. Weaver be brought back for discussion because it did not state the number of units to be con-
structed, it did not designate a time limit, and it provides for R-3G zoning when he understood the
rezoning was intended to be' R-2. with a variance.. It was understood discussion of the agreement would
be scheduled for a committee-of-the-whole meeting.

Considerable discussion took place, with disagreement as to whe.ther adoption of this resoluti?n would
abet the State Sani-tary Authority's position in gaining greater con,trols over water and air pollution
by industries constructing plants in this area. Coupcilman A~derson pointed out thatconstruction of
the American Can plant near Harrisburg will hinge on the State Sanftary Authority's decision after a
. hearing set for August 29:, 1967, and at that :time ,objections should be registered: He said nonsupport
of American Can by not adopting this resolution would place the City in. a biased position with respect
to location of future industry in this area, and that the Sanitary Authority should know that the e
forest resources will have to be utilized but at the same time air and water pollution contrtHled.

I Councilman Wingard said he felt the Sanitary Authority's rules are outdated and do not protect com-
munities, and that support could also be registered at the hearing rather than by adoption of this
resolution. He recommended not adopting the resolution.
Councilman McNutt said he felt industries allied to forest products are necessary in this area and
that instead of ruling out the industry, importance of air and water :pollution controls should be
stressed.
Councilwoman Hayward said steps should probably be taken to encourage the Sanitary Authority to change
its standards. She mentioned that strict control of air and water pollution was of greatest importance
to the Community Goals Conference.
Councilwoman Lauris commented that not adopting this resolution would definitely help to prevent air
and water pollution.
Mr. Anderson suggested copies of the resolution be distributed to each Council member with the idea
e that the wording might be changed to achieve support of American Can and at the same time stress the
importance of strict controls to prevent pollution.
Mrs. Hayward moved seconded by Mr. Anderson to table the resolution, distribute copies to Council
members, and bring it back for discussion at a committee-of-the-whole meeting and the August 28, 1967
Council meeting. Motion carried.
