C. McDonald in the absence of Mayor Edwin E. Cone, Council President Glen Purdy, and Council Vice.Br;esident Lester Anderson. Othe~ councilmen absent were Mrs. Lauris, Mr. McNutt, Mr. Lassen, Mrs. Hayward, and Mr. Wingard. Cone at 7:30 p.m. in the Council Chamber on August 29, 1961 with the.fo11owing councilmen present: Hr. Purdy, Mrs. Lauris, Messrs. McNutt ,AJiderson~ Lass~en';:::Mcpo;rta1d, and Wingard. Mrs. Hayward was absent. - T ' Minutes of the meeting held August 14, 1967 were approved. as corrected, to show:Mrs. ,Hayward mentioned tennis backboard at Roosevelt instead of Mrs. Lauri s. - NEW BUSINESS' , .. 1 Mr. Anderson moved seconded by Mrs. Lauris to direct a letter to the State Sanitary Authroity to modify within their authority the steps taken to achieve implementation of smog control as it affects rye grass burners and take further steps, to: prepare legislation for ,the next session of the Legisla- ture to completely outlaw rye or other grass burning in this area if it is to continue. ' Mr. Anderson, in making the motion, expressed his opinion that a small group should not be able to in- flict the inconvenience of smoke and haze upon a community of 300,000 people in an area where everyone should have the inviolate right to an unobsyructed view of the sun and to breathe free air. Councilman McNutt objected to requesting complete outlawing of the burning. He said that not being able to burn after harvesting would put the rye grass growers out of business since some of the land is suitable only for rye grass. Mr. Anderson moved seconded' by Mrs. Lauris to delete that portion of the motion "...and take further I ,- steps to prepare legislation for the next session of the Legislature to completely outlaw rye or other grass burning in this area... II but to let the State Sanitary Authority know of complaints to see what , can be done to remedy the situation, then take more drastic action if nothing is accomplished. A vote was taken on the amended motion, and amended motion carried unanimously. 2 Councilman Purdy asked for a check of the left-turn traffic movements at Oakway Road and Coburg Road. 3 Abatement 955 East 43rd - The City Manager read a letter from E. B. Sah1strom requesting a e delay until September 1, 1967 or until the suit pending in Circuit Court is settled of the hearing on abatement of the structure at 955 East 43rd Avenue. Dr. Purdy moved seconded by Mr. Anderson to delay the hearing two weeks. Henry Baitis, 945 East 43rd, objected to the postponement. He said there is no legal reason for another delay, the structure constitutes a hazard to the neighborhood - one child has already been injured because the house is open and subject to vandalism - and action on re- I moving this house has been postponed every time it has come before the Council. I A vote was taken on the motion to delay the hearing, and motion defeated, Councilman Purdy and Ander- son voting yes, Councilmen Lauris, McNutt, Lassen, McDonald, and Wingard voting no. .It was agreed the hearing would be held at this meeting at the regular time on the agenda. COMMITTEE REPORTS Committee meeting held August 17, 1967: "Present: Mayor Cone; Councilmen Purdy, Lauris, McNutt, Anderson, Lassen, Hayward, I McDonald, and Wingard; City Manager and staff; and others. 1 l. Conditional Use for Group Foster Home. Lane County Juvenile Department - The Planning Commission approved a conditional use permit to allow the Lane County Juvenile Depart- ment to establish a group foster home at 3841 Elmira Road subject to (1) expiration of the permit on July 1, 1968 and review of the operation of the facility by the Planning Commission at that time, (2) no more than eight boys to be housed in the structure at one time, (3) none of the boys to be over 18 upon entering the home, and (4) compliance e with all requirements of R-l zone during operation of the facility. An appeal to the Council of the Planning Commission's decision was submitted by a letter from Mrs. Ed- ward J. Belknap, 671 Taney Street, and two petitions signed by property owners and residents of the area. The appeal was based on the feeling the foster care home would devaluate property in the neighborhood and cause more overcrowding of schools. Jewel Goddard of the LaneCounty Juvenile Department reviewed the history of the foster care program and said that Federal and. State funds are available for Lane County to provide this type of care. However, since the Planning Commission's decision on the request, the Department has received several offers for houses at other locations, and he re- quested a delay on the Council's decision until he has had an opportunity to see if anyone of them will meet the requirements of the program. Archie Duguid, 4320 Avalon Street, commented on the rezoning request before the Plan- ning Commission to allow a low-cost housing p~ect in the same area, and said he favored smaller units such as proposed by the Juvenile Department in their foster care program rather than concentrating a large number of units in one location. The City I Manager said because of the feeling which seems to exist in the Bethel-Danebo area that that area is being left out and not upgraded as part of the City he wanted to point out the large public investment and increased expenditures for police, fire, parks, and other services for the Bethel-Danebo area which are paid by residents of the ent ire City. Planning Commission Report - August 7, 1967 a. Judkins Point Height Restrictions - The Planning Commission submitted a revised recommendation for amendment of the zoning ordinance for height limitation and sign regulation in the Judkins Point area as an interim plan until the City's new general plan and sign ordinance are adopted. The proposed amendment would (1) restrict structures to a 40-foot height in the area generally between Franklin Boulevard and 15th from Walnut around Judkins Point and signs to a 40-foot height in the area generally between Franklin Boulevard and 15th from Walnut to west of Moss, with provision for conditional use permits to allow properly spaced and designed buildings and signs which exceed the 40-foot limit, and (2) require a conditional use permit from the Planning Commission for any new signs within the present 25-foot setback north of Franklin Boulevard. Those owning property along Franklin Boulevard objecting to the previously recommended restrictions were in agreement with this proposed amendment. It was suggested that a copy of the restrictions be sent to State agencies having buildings in the Judkins Point area. Mrs. Hayward moved seconded by Mrs. Lauris to approve the Planning Commission recom- mendation. Motion carried. e 2 3. Planning Commission Report - May 2, 1967 a. Annexation, Delta Highway and North Belt Line east of Willamette River, Marist- Vik-County - The Planning Commission recommended approval of the triple two-thirds consent petition for annexation of the Marist Bros., Vik Construction, and Lane County properties lying east of the Willamette River and north and south of the Belt Line Road. The area will be served by the trunk line sewer being constructed I to the Valley River Center. The annexation will form an "island" east of the Coupty property and north of Corum Street. Mrs. Lauris moved seconded by Mr.McNutt to proceed with the annexation. Motion carried. Dr. Purdy moved seconded by Mr. Anderson to approve Items 2a and 3a of the Committee report. Motion carried. 3 4. American Can Resolution - Copies of the proposed resolution supporting construction of an American Can plant near Harrisburg were distributed to Council members. A let- ter was read suggested by Councilwoman Lauris to be sent to the Sanitary Authority rather than the resolution. Considerable discussion took place with regard to the economic benefits of establishment of the plant in this area and whether the Sanitary Authority can gain strict control of probable water and air pollution resulting there- from. It was suggested that the Air Quality Control Officer be asked to express his opinion because of the technical nature of the problem. Mr. Anderso n moved 'seconded by Mr. McDonald to amend the resolution to be sent to tre Sanitary Authority to read ~'. . . approval of what can be considered adequate measures..." instead of "... approval of proposed adequate measures.... " Motion carried. It was understood the Air Quality Control officer would be present at the Sanitary Authority hearings on August 29 and report back to the Council if in his opinion strict control of water and air pollution is not stressed as a part of consideration of American Cants request for permit to construct the plant. I Councilman Anderson said he intended the change in the resolution supporting American Can to read " ...approval of what we consider to be adequate measures. .." instead of ".. . approval of what can be considered adequate measures.... " Dr. Purdy moved seconded by Mr. Anderson to approve the resolution as amended. Betty Niven, Planning Commission member, reported on the points brought out in the hearing before the Sanitary Authority earlier in the day. e The City Manager distributed copies of the Community Goals Conference statement with regard to air and water pollution, and read a resolution suggested by Mrs. Niven as a substitute for the one before the Council. He said the Air Quality Control Officer was not prepared to comment from the standpoint of technical recommendations. Councilman Wingard said he felt a decision could not be made without expert help, and Councilwoman Lauris expressed the opinion that industry must demonstrate control of air and water pollution, that it will not be done unless communities insist upon it. Councilman Anderson asked i.f the words "...hopes to be able to support..." in the suggest substitute resolution could be changed to "... will support... '! if questions raised in the hearing were answered by the State Sanitary Authority. The City Manager said that in light of some v.ery important questions raised, probably a statement of the Council's stand could be sent to the Authority, giving time for answers to be found before adoption of a resolution. Considerable discus- _ sion followed on whether standards should be set and what standards could be set , , possibility of singling out one group of people for legislation, maintaining present moral standards of the community, etc. Councilman McNutt expressed the opinion'that should the Council legislate to govern the type of attire worn by entertainers in the City, then the County and Springfield also should be encourag~d'to adopt similar legis- lation. William J. Dwyer, 5005 Nectar Way, said he did not favor disguising legislation aimed at "topless" dancers by including it in a disorderly conduct law. Mr. McDonald moved seconded by Mr. Lassen to' include a section in the disorderly conduct ordinance to regulate type of attire to be worn by female entertainers~, Motion carried, Mrs. Lauris, Mr.' Anderson, and Mrs. Hay~ard voting no. The City Attorney said he was working on suggestions for"a separate ordinance which would be brought to a committee-of-the-who1e meeting for consideration. Councilman Anderson read Section 6.14 of the Eugene City Code and said he felt this section of the tit present Code would give enforcement authority necessary. Mr. John Kirk stated that' the businessman is usually responsible for his employes' actions and said that, in this i!J-stance, any legislation should inake..the employer responsible for violation, not the performer. . Mr. Anderson moved seconded by Dr. Purdy to'table the item until the City Attorney's recommendation is 1 brought to committee. Motion carried. 1 6. Apartment. 563 Jefferson. Moved to 2nd and High - The Building Department withheld'a permit pending Council approval to move this building to 212 High Street. Council members looked at the apartment at 563 Jefferson Street and at the site to which it is ' proposed to be moved~ William A.' Davenport explained the project and'said he is willing to post a'$5000 bond to a~su~e completion of the apartment's remodeling after it is moved. A~' i~ediate decision was needed since the house is one,on'which the State High- way Department will'be accepting b~ds on August 22, and the"developer does not~ant to enter a bid without knowing if the'City'wi1l permit moving the'structure. Sewer Assessment Policy:-- The Public Works Director pres,ented a report describing the computer p'rogram which will be: used the 'first time in September- to compute the Bethe1- Danebo assessments. It was also reported that the' City is now installing all 'stub lines to the property lines, which is considered a more equitable policy than the 1- method previously used, and the mthoed now being used for calculation of individual assessments was explained. Also discussed was' the: question of'whether the City should participate in the cost of over-depth sewer lines in the same way it does in over-size construction. It wa's report:ed that difficult terrain and soil conditions in p:art of the Bethel-Danebo area resulted in excessive cost to the property owners. It was recom- mended that sewer systems in which more than 28% is deeper than lO-foot average and in which the assessment r,ate wo'uld: be more than 7(;. should be a.ssessed' a maximum rate of 7<:,: 'per s-quare foot(trunk sewer cost of ~(;. per squar-e foot not included). Setback Variance, Swimming Pool, 255 East 28th - Jack Gardner,- attorney representing Ken Paul, appealed the decision of the Zoning Board of Appeals denying permission to co'nstruct a swimming pool within the setback areas. He said that his secretary called the City's Building Department before construction started and was told no building permit was necessary. He also stated that all neighbors who had previously objected to construction of the pool withdrew their objections with the exception of Mr. and Mrs. James M. Berkey, 190 East 37th. The Superintendent of Building Inspection re- e ported that both a utility easement across the back of the property and setback regula- tions were being violated by the construction of the pool. Possibility of vacating the utility easement was discussed because it was felt it would not be used for underground utilities, and the pool would not interfere with any over- head lines. Mr. Gardner said the pool could be moved in about four hours if the need arose, and said his client would lose a considerable sum of money already invested in I the pro ject if the variance is not granted. Dr. Purdy moved seconded by Mr. Anderson to table the request. Motion carried. The City Manager said the petitioner was to investigate the possibility of any advantage he may derive from vacation of the easement at the back of the property but had not contacted the staff in that re- gard. The Manager explained the petitioner's original request for information on a building permit was with regard to a collapsible pool, for which no building permit is required. Rezone to C-3P, Willamette and Donald at 32nd, Hirons - The Planning Commission re- atfirmed its recommendation to deny this rezoning request. Mrs. Ruth Gustafson asked the Council to consider granting a variance to allow a garden center on the property. She stated the property owner expressed the intention of building an 80-unit apartment house on the site if the garden center is not constructed. It was pointed out that if the garden center is unsuccessful, the zone change would then permit any type of commercial use of the property and that this type of re- zoning would be "spot zoning." After further discussion, Mr. Anderson moved seeonded by Mrs. Lauris to postpone action in order tpat further investigation could be made. Motion carried. City/County Jail - The City Manager reported that SUA, a management consulting firm of Beverly Hills, California, now making a study of library requirements in Eugene, submitted a proposal to conduct a study of jail facilities and forecast needs for the next 25 years at a cost of $11,000. This cost is $3000 less than it otherwise would be because of the firm's already being engaged for the library &udy. He also reported e that it is believed such a study should be conducted on an area basis, including Lane County and Springfield, and that the Lane County Board of Commissioners are in favor of the study and would pay at ieast half the cost, but that Springfield has not yet indicated any interest in participating. Eugene has no money budgeted for this item, but it could possibly be transferred from another fund. It was also mentioned that such a study had been recommended by the Metropolitan Civic Club. A motio n to participate in the study was approved." The City Manager said the city of Springfield voted not to participate in the cost of the jail study undertaken by SUA, and that the city of Eugene's share will be about $5000. The City Attorney advised the Council that all legal steps with regard to holding the hearing at this meeting were met, and it was e the Council's decision whether to postpone act ion. It was explained that this contract will enable the City to provide about $2500 in engineering work so that the project can proceed. The completed project will provide the City a facility into which Bethel-Danebo storm waters can drain. Dr. Purdy moved seconded by Mr. Anderson to adopt the resolution. Rollcall vote. The Building Department requested abatement of the building because it is vacant and open, subject to extensive vandalism, and constitutes hazardous fire conditio ns. Council members viewed the property e on a recent tour. Dr. Purdy moved seconded by Mr. Anderson to adopt the resolution. Motion carried. 3 Resolution No. 1454 - Transmitting to Planning Commission for September 5, 1967 hearing amendment to Zoning Ordinance re: Group Home Care, was submitted and read in full. Councilman Anderson reported on the trip the selection committee made to interview architects for the parking structure at 10th and Oak.
