Regular meeting of the Common Council of the city of Eugene, Oregon was called to order at 7:30 p.m.
PDT on September 11, 1967 in the Council Chamber by His Honor Mayor Edwin E. Cone with the following
councilmen present: Dr. Purdy, Mrs. Lauris, Mr. McNutt, Mr. Anderson, Mrs. Hayward, Messrs. Lassen
and McDonald. Councilman Wingard was absent.
NEW BUSINESS
1 Councilman McDonald said he has received many complaints concerning 18th between City Vmew and
-' Oak Patch Road, and asked about the status of the sewer and paving project. The Public Works Director
said problems have arisen because of extensive sewer construction, but with the traffic detour put into
today it is hoped work can be expedited. He said the project is about six weeks from completion and
the weather will determine its progress.
e 2 The City Manager said Councilmen Anderson, Purdy, and Lassen, selection committee, will meet
this week to choose the architect for the parking structure at 10th and Oak.
3 The Council was notified a joint Council/Planning Commission meeting is scheduled for Monday noon
September 18, 1967, to (1) review some of the more controversial points of the new zoning ordinance,
and (2) review of those portions of the Community Goals report underlined as needing implementation.

The City Manager explained $75,000 was budgeted for this building; the original cost estimated
was $71,000 before details of the hose tower were known. He recommended award of contract to
A&G Construction on their base bid of $76,300 plus Alternate 3, making a total cost for the
building of $80,900. With inclusion of architect's fees, construction insurance, and soil tests,
e the overall cost will be $87,314. He said in order to be able to proceed, $10,000 will have to
be transferred from the fire department automotive equipment fund and equipment now being used
in the old station could be used for another budget year releasing $2500 in the present budget.
Mayor Cone questioned the need for the hose tower requiring the additional $4600. It was ex-
plained the tower provides better air circulation than an inclined ramp and generally does a
better job than the electric cabinets so far as amount of hose which can be dried at a time
and in extending the life expectancy of the hose. William Wilson, architect, explained also
that the $4600 figure mainly represents appurtenances in the tower such as hose brackets,
ladder, framing, hoist, and catwalk. He said it would be very difficult for firemen on off
'hours to construct a separate hose tower, as suggested by the Mayor. Mr. Wilson answered
several other questions concerning other alternates, and explained the per-square-foot cost
of $13.80 would be reduced to $12.30 if the site work amounting to $8520 is taken into con-
sideration. He said duct work will be installed in the entire building for air conditioning,
but at present the coil unit and controls would be provided for only the living side, with the
sleeping and study quarters to be air conditioned at some future time. Completion of the proj-
I ect would be expected in 90 to 120 days from the date of award of contract. Some discussion
took place with regard to possibility of reducing the size of the apparatus room, but Mr. Wilson
said the designed size is the minimum. The City Manager explained the building's potential
is to house four pieces of equipment.
Dr. Purdy moved seconded by Mr. Anderson to award the contract to A&G Construction on their base bid
of $76,300 plus Alternate 3 for the hose tower at $4600; to transfer $10,000 from the Fire Equipment
Fund and use $2500 budgeted this year for equipment; and ask Councilman Lassen to review the plans
and specifications before the contract is signed. Rollcall vote. All councilmen present voting aye,

was submitted by Paul and Phyllis DeWitt (formerly Ray Bostwtck), with Police Department approval.

"Present: Councilman Purdy (presiding), Lauris, McNutt, Anderson, Lassen, Hayward, McDonald,
and Wingard; City Manager and staff; and others.
e 2 l. Traffic . 17th and Mill - Councilman Anderson said he received a call from Mr. Daugherty
requesting a stop sign at 17th and Mill for control of traffic at that intersection in
view of several recent accidents. He asked for a report from the Traffic Engineer on
that intersection.
Dr. Purdy moved seconded by Mr. Anderson that Item 1 of the Committee report be received and filed.
Motion carried.
I 3 2. Leave of Absence, Wingard - Councilman Wingard requested a five-week leave of absence
to part icipate in an "Urban Land Institute" study tour of 11 European countries.
Mr. McNutt moved seconded by Mrs. Lauris to grant the leave. . Motion carried.
4 3. Abatement, Eaton Drive, Fischer - The Building Department recommended abatement of a
structure at the end of Eaton Drive in the ownership of Dale Fischer. The building is
vacant, partially demolished, no longer structurally sound, and constitutes a safety
hazard and a fire hazard. Mr. Anderson moved seconded by Mr. Lassen to call a public
hearing on abatement of the building. Motion carried.

carried. The City Manager suggested the record show Mr. Wingard's trip is not at City expense.
5 4. Deferred Sewer Assessment, Waite Street,..Berntzen - H. D. Berntzen, 3791 R<DyalAvenue,
requested deferral of sewer assessment of $1,456.82 against his property at the end of
Waite Street between Berntzen Road and Louis Lane. The Public Works Department recom-
mended deferral until. the property is platted and the,existing:l-foot freeze strip .deny-
ing access to Waite Street is removed. Mr. Anderso n moved seconded by Mrs. Lauris to

I 6 5. Resignation, Rubenstein, Urban Renewal Agency - A letter was read from the Urban Renewal
Agency forwarding the resignation of Harry Rubenstein as a member of the Urban Renewal
Agency because of possible conflict due to his property ownership in the Central Eugene
Project area. The City Manager explained that Agency members expressed a desire that
the replacement be someone with knowledge and experience in land transactions and invest~
ment. He suggested that if the Council recognized the need both for representation of
the Council on the Agency and someone with the qualifications expressed as desirable by
the Agency, then someone not on the Council: could' be appointed, and a Council members
e could be named as an ex officio member. Some discussion followed, and it was agreed the
matter would be brought back for consideration at the next committee-of-the-whole meeting.

7 6. Joint School/City Use, Parks - Copies of written recommendations were distributed to
Council members with r~gard to several sites in School District 4 ownership on which
the District requested an indication of the City's desire as to future development.
The Parks and Recreation Director gave further information and answered questions re-
garding acreages and locations. Mr. McNutt moved seconded by Mrs. Lauris to approve
the recommendations. Motion carried.

8 7. Sewer Assessment Calculations - Council members received copies of a chart depicting
two previously used methods of calculating sewer assessments and the method adopted by
I the Council at its August 29 meeting. The Public Works Director explained the method
of calculation in each instance and the differences in amounts levied under varying
circumstances.

Elmer Sahlstrom, reviewed the history of the house which he and Harvey Schaffer had moved to 955 East
43td Avenue -and. events leading to his filing suit in Circuit Court requiring Mrs. Marvin Lee to per-.
form her, contra'ct ,.calling for the s'ale: of her property to them or purchase of the house. He said the
case has been advanced for trial on November 7, 1967 or sooner if an opening appears on the docket,
and requested the Council's reconsideration of its abatement order until the suit is tried. Mr.Sahl-
strom said he_ wou1dfile for Court review of the matte'r.
Councilmen Las.sen and McDonald. mentioned the: hazardous condition of the property as it now is, and
Mr. Sahlstrom said he could have the debris cleaned up and the house locked.

Thelma Fowler, attorney for Mrs. Lee, said that since the first contract between the Lees and Sahlstrom-
Schaffer w.as entered. into irr November 1966 her client feels there has been ample time to complete re:-
modeling of the house and could see no justification for the Council's changing its decision on the
abatement order.
A vote was taken on the motion to approve the committee action. Motion carr.ied, Councilmen Anderson I

I of the properties useless. Mr. Hyer said the bond funds should enable "at least a $100 reduction for
each of the 20 lots on Hawthorne Street on which the BPA easement lies.
Council membe~Lauris and Lassen pointed out the Council already has voted to forego the ~~ per
square foot assessment on that area beyond 160 feet, and that these lots receive the same benefit
from the sewer as any other single-family lot in the City. The City Manager explained the bond funds
are used for trunks and lines in excess of 8", pumping stations, and treatment facilities, and that
laterals and house connections are assessed to abutting properties. Any change in this financing
method would constitute a major police reversal. The City Attorney said the law requires assessment
on a fair and equitable basis. It was pointed out that reducing the assessment on the 20 properties
would result in unequal distribution of the sewer cost over the entire area.
