I, .. _, " NEW~BUSINESS " 1 Councilwoman Lauris asked .ifthe City's aJ;1swer was filed in Elmer Sahlstrom' s suit with regard to abatement of _ a. hou$e, at Q55, Eas,t 43rd .Av.en.l}e,and was told the. answer was filed last week. ' 2 New Car Dealers - Councilman Purdy suggested initiating formation of a committee with Ie representation from the Lane.County Commissioners, the City Council, and bqth the City and County Planning Commissions to work with the New Car Dealers Association to det~rmine possible locations for this type of business. -, Dr. Purdy moved seconded by Mr. McNutt that the staff determine whether Lane County and the, two Planning Comm~$sions would be willing to participate in a committee for this I purpose. COMMITTEE REPORTS Committee meeting held October 12, 1967: "Present: Mayor Cone; Councilmen Purdy, Lauris, Anderson, Lassen, Hayward, and Wingard; Assistant City Manager and staff; and others. 1 l. Curfew - Councilwoman Hayward asked that the curfew law be reviewed with regard to high school dances at the Armory. She said students under 16 are not permitted to attend. Dr. Purdy moved seconded by Mr. Anderson that Item 1 of the Committee report be received and filed. Motion carried. 2 The City Manager announced that a Southwest Regional Town Meeting will be held November 3 e and 4 at Southwest Oregon Community College in Coos Bay. 3 2. Airport Capital Improvement - The Airport Manager gave a detailed report on a proposed five-year capital improvement program for Mahlon Sweet Field. The Airport Commission recommended a bond election to include $38,256 additional funds not budgeted for work now underway; $114,714 as the City's share with Federal participation included in the I present City budget subject to bond approval for taxiway reconstruction and lighting approved by the FAA; and $920,870 for other improvements and $1,130,000 for land ac- quisition during 1967-69 - a total requirement of $2,203,839 for the next two years. The work recommended for 1967-69 includes hangar taxiways, access roads, service and emergency roads, landscaping, runway. cleaning equipment, and overlaying runways and taxiways to accommodate heavier aircraft. The three-year period, 1969-72 , will re- quire an additional $2,150,000 for extending hangar runways, runway lighting, auto- mobile parking, security fencing, extending main runway and runway lighting, automo- bile parking, security fencing, extending main runway and lighting, ILS relocation, airport fire station, new control tower, terminal building expansion, cargo building, and additonal runway and a roadway underpass. Mayor Cone said he felt an all-out attempt should be made to persuade the County Com- missioners to create a port authority for transportation in order for the expenditures to be spread over a broader base. The Assistant City Manager said creation of a port authority may delay airport work, but that if a bond issue is approved for~critic~~ work needed to be accomplished now, the port authority probably could assume the bond. obliga- tion. The Airport Manager recommended creation of a port authority rather than Lane County's assuming operation of the airport in oider to provide better co-ordination of other airports in the County with Mahlon Sweet Field. Councilman Anderson expressed the opinion that airport improvements and expansion might create additional operating expenses. The Airport Manager said it is anticipated airport revenues will offset any additional operating expenses. It was pointed out I the Airport Commission's recommendation was to submit to the voters two separate issues - one for about $1 million for construct~on and land acquisition, the other for about $1 million for land acquisition for fu~ure expansion. It was reported metering of the airport parking lot and charging an aircraft tiedown fee are under-s.tt.i~y. No action was taken. It was understood the item would be discussed again at the time tests arecompleted to determine extent of work necessary on runways and taxiways to support heavier aircraft. e The City Manager presented details of the Airport Commission's revised recommendations made upon com- pletion of soil tests to determine construction needs for the main runway. The revised recommendation decreased the total requirement by about $500,000, and would call for one bond issue of $561,747 for immediate improvement projects and land acquisition, and another bond issue of $1,050,000 for land acquisition for future expansion. The improvement funds will allow strengthening of the main runway to 100,000 lbs to accommodate the DC9s and 737s. It will not accommodate continual landings of heavier plans like the 727, but will permit occasional emergency 727 landings. Councilwoman Lauris asked if it is felt this move is necessary in view of the possibility of construction of a new super airport south of Portland. Abe Johnson, Airport Commission member, said even with construction of a superairport south of Portland it would not detract from the need for a first-class airport here, and that these improvements are deemed absolutely necessary immediately. Councilman Anderson asked if it had been determined if a port authority could assume the City's bond obligation. The City Attorney said a port authority cannot assume any bond obligation, but it can issue bonds of its own and then payoff the City's bonds. I Dr. puray moved seconded by Mr. Anderson to accept the revised Airport Commission report and proceed to set a bond election as recommended. Mr. Anderson asked if the Airport Commission will proceed to investigate the possibility of broaden- ing the support for operation of the Field. Charles Wiper, Airport Commission chairman, said this is the Commission's primary intent after the immediate improvements are provided for. Street Closure, Christmas 1967 - The Eugene Chamber of Commerce requested closure of streets on November 28, 1967 between 6:00 and 8:00 p.m. to effect a "mall" in the area generally between 7th and 11th, Charnelton and Pearl. A description of the activities planned during that time was given by Dave Whitbbead, chairman of the Chamber committee in charge of the Christmas season opening. The Public Works Department called attention to the parking which would be closed off, difficulty in moving traffic, expense incurred in placing and removing barricades, etc. Mr. Anderson moved seconded by Mrs. Lauris to go ahead with the plan for the mall, providing clearance is made with the Police De- partment and the City Manager's office. Motion carried. Dr. Purdy moved seconded by Mr. Anderson to approve Item 3 of the Committee report. Motion carried. r'l 2 4. Jefferson Street Extension, Federal Fund Freeze ~ The Assistant City Manager reported there was some concern that the current Federa~ freeze of public works money would jeopardize contract award for the Jefferson Street extension, due for bid opening in November. The Council agreed a letter should be directed to the State Highway Depart- ment urging completion of the project at this time. e The City Manager said a letter was sent to' the State Highway Department with regard to the Federal fund freeze. 3 5. Abatement, 955 East 43rd, Sahlstrom - The Assistant City Manager. reported that although the City was requi~ed to file an answer in the law suit filed by Mr. Sahlstrom with re- gard to this abatement, the City Attorney asked for an extension of time and will file I the City's answer next week. Dr. Purdy moved seconded by Mr. Anderson that Items 4 and 5 of the Committee report be received and filed. Motion carried. 4 6. Retaining Wall, 2905 University - Marvin D. Hammarback requested permission to construct a four-foot retaining wall of four-inch cedare adjacent to the sidewalk at 2905 University Street. The Public Works Department recommended granting a revocable permit for the wall. Mrs. Hayward moved seconded by Mrs. Lauris to grant the revocable permit. Motion carried." Committee meeting held October 19, 1967 : "Present:Mayor Cone; Councilmen Purdy, Lauris, Anderson, Lassen, Hayward, McDonald, and Wingard; City Manager and staff; Representatives of AFSCME Local 1724 and Fire Fighters Local 851; and others. 5 1. County Air Pollution District - Councilman Anderson asked for staff review and Council discussion of creation of an air pollution district on a County boundary basis. The City Manager said the City Attorney has been asked to meet with the Springfield City Attorney and with Lane County Deputy District Attorney to explore the type of agreement and action I necessary to cre~te a County-wide district and to report back as soon as possible. The Manager explained there is a January 1 deadline for County boundary districts to apply for 50% matching funds from the State. Some State appropriations are available to in- dividual cities on a 30% matching-fund basis. 6 2. Westmoreland Community Center - The Parks Department reported 12,658 persons used the Westmoreland Community Center during its first month of operation. e 7 3. Leased-Housing Program - A letter from Senator Wayne Morse indicated he has asked the Department of Housing and Urban Development for prompt and thorough consideration of Lane County Housing Authority's leased-housing program application. 8 4. Commendation, Safety Director - A letter from the State Compensation Department ex- pressed appreciation for services and courtesies extended by Benjamin A. Masengil and Lawrence L. Jack in furtherance of the Department's advanced first aid classes. 9 5. Governor's Tax Message - The League of Oregon Cities forwarded a copy of Governor Tom McCall's message outlining his proposal for state budget reductions and property tax relief for consideration of the Legislative special session October 30, 1967. Dr. Purdy moved seconded by Mr. Anderson that Items 1, 2, 3, 4, and 5 of the Committee report be re- ceived and filed. Motion carried. 10 6. Agreement. First National Bank.. Paying Agent - The Finance Department recommended enter- I ing into an agreement with First National Bank of Oregon whereby the Bank will pay the City's coupons and bonds when due from money 'previously deposited by the City. The Bank's cj arge is 4c; per coupon and '50c; per bond for items paid in Eugene, :and no :charge for itens paid in New York, at an estimated cost of $525 for current outstanding issues. Eugene. The overlength vehicles will consist. of semitruck and tr~lers with an overall length not to exceed 105 feet. City streets involved are 7th .P1ace, Garfield, 6th,- 7 th to Belt Line, Delta, and Interstate 5. Mccracken Bros. made a test run, and the Traffic Engineering Department reports no problems. The City Manager asked the Council to consider giving ttIe staff permission to transmit approval, after investigation and test runs, to other companies expected to be requesting thB same type of permits. He said the State_permit is for one week for a specified number of trips during that period. Council- man Purdy suggested a review in three months. so that if any difficulties arise the Council may havem opportunity to withhold its permission. e . . . Dr. Purdy moved seconded by Mr. Anderson to amend the motion to provide for review in three-months and to give the staff authority to approve permits for other companies after the necessary investigation and test runs. Motion carried. 2 8. Collective Bargaining - Robert Ferrar and Fred Mohr; on: behalf and with the consent of AFSCME Local 1724, read an introduction to a report which they asked to preseht at the I October 23, 1967 Council meeting. The presentation is in reply to a report and recom- mendation given the Council by the City'Manager with regard to the Union's request, with the support of Fire Fighters Local 851, for formal recognition and. the right of col- lective bargaining. Mr. Mohr said a resolution and statement of policy would be pre- sented for the City Council to establish a system of collective bargaining and designa- tion of representation. The City Manager suggested scheduling'a meeting on October 30, 1967 with the Union!s report the only item on the agenda in order to provide ample time for full discussion. There.was some concern expressed relative to time element because of budget preparation in the near future. Mr. Anderson moved seconded by Mr. Lassen to adjourn the~October 23 meeting to October 30, with collective bargaining the only item on the agenda. John Jensen, president of Fire Fighters Local 851, and Harry E. Williams, vice president of International Association of Fire Fighters, did not favorpostpon~ng discussion and asked a final decision at the October 23 meeting. Councilman Lassen; noting he wouLd not be able to be present at an October 30 'meeting~ withdre~ his second. Councilman Purdy.seconded th eMotion, and said he preferred full disc~ssion of.the report at a.Thursday committee meeting. It w~ss~ggested the item be placed at the end of the October 23 agenda and postponed a I week if,that meeting is too lengthy. Olive and 24th Place - In connection with a petition previously approved by the Council for paving Olive between 24th Avenue and 24th Place, the Pub~ic Works De- I par:tment requested a' decision on method' of ass,essment for cost of a retaining walf neces- sary at tpe northeast corner of 24th Place and Olive. A slope easement has been r~fused by the property owner., Estimated cost for paving is $5000, and for the wall, $8000, result- _ ing in a $20 per front foot cost if 'the entire project is assessed against all abutting . properties. . An alternative is for the property adjacent. to the wall to bear the full cost of the wall. Another suggestion was to change the street alignment. The Public Works Director said this was investigated but would only transfer constructionof the retaining wall to the other side of the street. He said a cul-de-sac could be constructed from the north, not taking Olive entirely through, but this would require replatting which would e have to be approved by the Planning Commission. Community Goals - The Planning Commission recommended implementation of those portion s of the report from the Community Goals Committee on which emphasis was designated: (1) Request Central Lane Planning Council to consider creation of a Scenic Conservation Committee at the metropolitan level. (2) Create an Architectural Review Board. (3) Obtain information from the University concerning its policies and 'p1ans which have a bearing on the City's long-range physical development plans. e (4) Continue investigation of payment in lieu of taxes to the City for fire and police protection and to the school district for University-owned property occupied by married students. (5) Ask the Lane Coupty Assessor to publish and distribute a list of basic improvements which can be made on a structure without affecting its taxable value. I Some concern was expressed about creation of the Architectural Review Board and possible conflict with renewal projects. It was explained action on the recom- mendation is to indicate the Council's thinking, and actual ~reation of a Board would be by resolution with specific function s of the Board set out. I,t was also explained, with regard to Items 3 and 5, that the University Campus Development Committee and the City Planning Commission are exchanging representation at their, meetings, and that the Lane County Assessor has been contacted with regard to structural improvements as they wu1d affect taxable value. With regard to Item 4, the Manager said agreements have been made with the University on police protection and fire marshal service, but not on fire suppression. The Planning Di- rector said the Commission's denial was based primarily on its concern with not being able to provide services for the increased density the requested rezoning would create. Two petitions signed by residents of the area were presented opposing the rezoning. Carl Peterson said he did not have concrete development plans but that he felt the rezoning would not decrease values in the area. Councilman Lassen asked if the Planning Commission had given any consideration to a lesser density, and the Planning Director said the Commission would look e favorably upon a lesser density to buffer adjacent commercial property. Nick Schnell, 3841 Souza Drive. said he felt schools in the area could not absorb the density the rezoning would allow, and asked several questions with regard to the type of building planned and whether adequate sewer service is available. He said the site is not suitable for a single-family residence. Copies of their presentation were distributed to Council members prior to the meeting. Mr. Ferrar asked the Council to adopt the statement of policy included in the presentation with re- gard to recognizing that employes have ,a right t~ organize and have unions of their choice, and the right to collective bargaining. ',', John Jensen, president and business agent; Frank Jackson, vice president; and Leonard Jensen, secretary-treasurer; all of Fire Fighters Local 851, cited various publications in support of their request for a collective bargaining contract. John Jensen asked the Council to appoint a subcommittee with authority to act for the Council and people of Eugene to discuss and implement a.bargaining contrac~ with Fire Fighters Loca~ 851. He urged that a decision be made at the October 30, 1967 Council meeting. Councilwoman Lauris asked if his proposal included. the Public Works employes, and Mr. Ferrar answered that Local_1724 is requesting only a statement of policy. No action was taken.
