Cone with the following councilmen present: Dr. Purdy, Mrs. Lauris, Messrs. McNutt, Anderson, Lassen; Mrs. Hayward, Messrs.-McDonald and Wingard. < ,~ , - - " .. . . " ,',." :..'\-:".t,n" The minutes of the October 23, 1% 7 meeting were approved ,as -mailed to Council members, and the minut~s~of the October 30, 1967 meeting were approved as corrected - page 2~ 5th.paragraph, changed to read: "As a result of the Manager's indication that he would meet with union representatives, the motion was withdrawn with consent of the second. I,' . . ~ - - . 1 ** Intersection 13th and Agaie ~ Councilman Purdy asked for an engineer's report on this intersection. He said the traffic is not moving from 13th onto Agate because of pedes- trian traffic across Agate. e 2 Zoning Areas Ad;acent to City - Councilwoman Hayward suggested meeting with the County"; :' ".'~, Commissioners in the near future with regard to zoning regula~ions on County areas adj a- cent to,the City . . Dr. Purdy moved seconded by Mrs. Hayward to contact the County. Commissioners and both the City and County Planning Commissions to see if they would be willing to meet with repFesentatives of the City I Council to discuss procedures and. policies on County areas adjacent to the City limits. Motion car- ried. ....,. 3 Masonic Cemetery. 25th and University - Councilwoman Hayward asked if the City can do any- thing about ~l~aning up the Masonic cemetery: at 25th and University. She said it.isover- grown with grass and weeds ~nd she has recefved complaints concerning noise caused by motorcycles in the cemetery~ Councilman Anderson remarked that situations o~ bhis nature should be handled by State legislation. The City Attorney said there'isno legal solution and it was generally agreed Ehere is no way the City can force action on improving the cemetery's condition. 4 Appointment. Urban Renewal -'Councilman George Wingard was recommended for appointment to the Urban Renewal Agency to replace Harry Rubenstein, resigned, for the balance of the term ending July 10, 1968. Dr. Purdy moved seconded by Mr.Anderson to appoint Mr. Wingard as recommended. Motion carried. 5 Bids. Abatement Demolition. Qpened November 3. 1967 1290 West 28th 1255 Hughes' 200n Eaton Jay F. COMMITTEE REPORTS I Committee meeting held November 2, 1967 : ~Present: Mayor Cone; Councilmen Purdy, Lauris, McNutt, Anderson, Lassen, Hayward, and Wingard; City Manager and staff; and others. 1 1. Street Divider, Entrance to Hendricks Park - Councilman Purdy reported that at the intersection of Fircrest and Birch Lane the street divider causes a traffic ronflict. He asked for an engineer's report. Mr. Anderocn moved seconded by Mrs. Lauris that Item 1 of the Committee report be received and filed. Motion carried. .. 2 2. Diamond Parking Lease, 7th and Olive Lot - Diamond Parking Service proposes to lease the 7th and Olive parking lot -from the City for $800 per month. Diamond would retain the parking income, maintain and clean the lot, maintain the landscaping, and issue a certificate to the City showing sufficient coverage for public liability and property damage insurance. They would reserve the right to redesign the parking facility with- out disturbing the landscaping. The City's meters are to be stored or returned to the City. The lease can be canceled by either party upon 30 days written notice, and Dia- mond agrees to replace the lot in its original condition should the lease be canceled. The purpose of the lease would be to permit participation in one downtown validation system on a City-wide basis with all of the City's parking facilities included. Dia- mond proposes to charge 10~ for 30 minutes, 25~ for two hours, 50~ for four hours, and I an all-day fee large enough to discourage all-day parking to assure considerable turn- over. It is estimated the gross return would increase about 10% so that revenue would continue to be sufficient to payoff assessments and make refunds to those who paid in cash. Payments in lieu of property tax would oontinue to be made by the City. Mr. Archie Weinstein and Mr. Brian Bronson, owners of property within the district, objected to leasing the lot on the basis that the 10~ fee for the first half hour is too high, that it should remain 5~. Mr. Weinstein also said the original iro estment e by property owners to start the lot was made on the assumption the City would continue its operation, and if a private operator assumes operation he should pay the initial investment. Maurie Jacobs, another owner of property in the district, said the lot will not be under a long-term lease, there are no costs involved, and it is an oppor- tunity to initiate a validation system in the downtown area. He said downtown merchants are very much in favor of the validation program and would like to see it start immed- iately. Tom Summers of Diamond Parking Service explained the mechanics of the valida- tion system and answered questions concerning spaces available and number of merchants now participating in the system. Mr. McNutt moved seconded by Dr. Purdy to proceed to accept bids on leasing the 7th and Olive parking lot to a private operator. Councilman Lassen asked that a comparison be made of the end effect of a 5~ fee for the first half-hour as against the lO~ charge. Mr. Summers said it would be possible but very difficult to make an adjustment on the lease cost by using the 5~ charge. I Mr. Weinstein asked if an opinion had been obtained with regard to the legality of the City's leasing the lot to a private operator, and the City Attorney said the City does have authority to lease so long as bids are called. Mr. Anderson suggested that bids be called taking into consideration both the 5~ and 10~ charge for the first half-hour's parking. A vote was taken on the motion with the understanding that bids would be called on the alternates of a 5~ or 10~ fee for the first half hour, and motion carried. - Mr. Archie Weinstein objected to the Council's making a decision on the lease so quickly. Mayor Cone returned to the meeting and assumed the Chair. He said he didn't think a private operator should operate on an initial investment made by property owners in the district, and asked the Council to delay its decision to afford an opportunity for the prope'rty owners to meet and decide whether they want the lot operated on a lease basis. Council discussion revealed that if bids are invited, they will be considere~at the November 27 Council meeting at which time district property owne'rs will have an opportunity to express their opinions. Also, that information of the district, no specification was made as.to who would operate the lot nor how it would be operated, that' this is on a trial ba'sis to .try to start a' system under which free parking will be available for downtown shoppers. William Fry," attorney retained by Archie Weinstein, said he felt owners of property in the district were not given sufficient rotice of the proposed change in09peration,and that the City should expand on the present system rather than lease to a private operator to experiment on a validation system. .He pointed to the possibility of the City's eventually putting the 7th and Wi11amette lot, now being constructed, under the same system. The City Manager explained that a 1ett~r outlining the proposal was sent to each property owner in the e district on October 2, 1967. The validation system is being' considered at this time for only. the 7th and Olive lot, and is being considered at the request of downtown merchants who will pay for the va1llhtion system. Sam Burke, manager of Millers Department Store, and George Boehnke of Boehnke's Printing urged the Council to adopt the program and lease the lot as outlined. A vote was taken on the motion to call for bids on leasing the 7th and Olive parking lot, and motion -, carried, Councilmen McDonald and Wingard voting no. I Councilman Las~en s~lid his affirmative vote was to gain a t1do11ar-and1centtl breakdown so that a final decision can be made at the time bids are submitted; 1 3. Special Election, Parks Bonds - The City Manager proposed a $510,122. bond measure to pe placed' on the ballot with other issues t~ be considered at a special election in late January or early February 1968. The funds derived would pay the School District the purchase price of the Laure1wood golf course plus accumulated interest ($371.,000) , and for installation of a spri?k1er system and other improvements (improving pro shop, park- ing lot, driving range, new restrooms, fence - $139,000). The Council was asked whether it desired one bond issue for the purchase price and improvements, or a bond issue for the purchase price and a serial levy for the improvements. Mr. Anderson moved seconded by Dr.' Purdy to au~horize preparation of a Charter amendment to be submitted to the voters to include bonding arrangement for both acquisition and improvements as outlined. Motion carried; Dr. Purdy moved seco?ded by Mr. Anderson that Item 3.of the Committee report b~ approved. Councilwoman Lauris askedli revenue bonds could be sold for this purpose, and was told sufficient revenues' are not anticipated from the golf course to payoff the bonds in a period for wQich the bonds could be sold'. The golf course is only part of. the recreational area and other uses will ~ot be revenue producing. Some further discussion touched on whether to submit separate bond issues - one for the purchase, and one for the improvements. Councilman Lassen fa~ored a serial levy for the im- I provements. The City Manager said financing costs would be about equal for either a bond issue or serial levy if the present inflationary trend continues. A vote was taken on the motion to approve bonding. Fence in' Right-of-way, 25th. between Lincoln and Lawrence -'Dr. David Robathan requested permission to construct a fence in the right-of-way at this location for privacy. for his residence. The Public Works Department recommended granting a revocable permit on the premise that 25th Avenue probab~y will not be extended in this' area. Danebo Fire Station, Goodwill Industries - The Building Department reported this building can be moved to.Goodwil1 property and used if put on a proper foundation at its new loca- tion. If it is used for other than storage purposes certain modifications must be made, such as additional wiring for heavier loads if machinery is used and satisfactory dust collection for each woodworking machine. Otherwise, the use would be considered in a more hazardous occupancy and would require extensive ntidificati9ns. Mrs. Lauris mov~d seconded by Mr~ Lassen to donate the building to Goodwill Industries to be moved to their property at' 3885 Elmira Road with conditions to be met under a new permit to be issued by the Building"Department. Closing East Park - The Christmas Village Council requested closure of East Park Street north of the alley leading to Pearl Street from November 27 to December 26 to permit operation of a miniature train during the Christmas season. There was no objection to the request. Mr. Lassen moved seconded by Mr. McNutt to approve the closure as re- quested. Motion carried. 2 7. Floral Hill Drive Sewer - Rowland M. arum, 2389 Floral Hill Drive, and Gordon Lamb, 2350 Floral Hill Drive, requested deletion of the portion of the sewer now under con- tract which would serve their properties. The petitioners feel that by waiting until the system to the south of their properties is constructed, a lower assessment will result. The Public Works Department recommended deletion of this portion as requested. Mrs. Hayward moved seconded by Mr. McNutt to approve the recommendation. Motion carried. Taco Villa. 2750 Roosevelt Boulevard - The City Manager informed the Council a new liquor license application was submitted by Edward and Beverly A. Johnson for a Retail Malt Beverage Class B license at this location, and that it will be presented for consideration at the November 6 Council meeting." Out-of-City Swim Fees - The Parks Department recommended out-of-City season (three months) pool fees of $7.00 for children, teens, and adults, and $21.00 for families. The recommended annual fees for out-of-City children, teens, and adults was $14.00, and for families, $40.00. Dr. Purdy moved seconded by Mr. Anderson to approve out-of-City fees as presented. All councilmen present voting aye, motion carried. 5 2. 9th and Almaden Property - A 9'x94' strip of land was left in City ownership from right-of-way purchased for extension of Broadway between Almaden and Chambers. The strip lies at the southwest corner of Almaden and Broadway between the right-of-way and property in the ownership of Joe Nouben. The City offered the property to Mr. Houben for $477.79 plus $964.40 street pavin& asse.ssment. Mr. Houben made a counteroffer of $477.79: It was agreed the Council would look at the property be- fore making a decision. No action was taken. 6 3. Side Street - Petitions were presented for reopening Side Street between Wilkie Street and Highway 99N. The City Manager suggested investigation of the history of the street with regard to dedications with a report to be returned on whether to go to I the Public Utilieis Commissioner for reopening. Mr. Anderro n moved seconded by Mr. Lassen to proceed as suggested. Motion carried. 7 4.Planning Commission Report - October 10, 1967 a. Variance to allow storage building in R-l zone, 22nd between Hilyardand Alder - The Planning Commission recommended denial of William J. Baker's and Wayne H. Oldaker's petition on the basis that the lot on which the building is located was created by an illegal subdivision. The lot is 40'x85', has no street front- e age, and legally can be used only as an accessory lot. John Jaqua explained the history of the lot, said it would be used for the same purpose it has been used for, and that it is not suitable for residential purposes. Mayor Cone left the meeting. Council President Purdy assumed the Chair. The City Attorney said the Council may maintain the status quo of the property through enactment of an ordinance forgiving the illegal subdivision. Mr. Jaqua said his clients would have no objection to placing a covenant to run with the property restricting its use for storage and to prevent its being used for resi- dential or commercial purposes. Mr. Anderson moved seconded by Mrs. Lauris to request the City Attorney to consult with Mr. Jaqua or use any other procedures he cares to take in order to legalize or correct the situation. Motion carried. I Mayor Cone returned to the meeting and assumed the Chair. 8 5. Planning Commission Report - October 30. 1967 a. Contract Amendment. Interstate 5 and Glenwood Interchange - The Planning Commission recommended modifications to an agreement with James H. Weaver to allow construc- tion of a motel at this location. The modifications will allow (1) retaining walls at least six feet on the Freeway side of the major trees, and (2) a l2'x12' sign not more than 24' feet, to be non-revolving, non-animated, and non-blinking, and e covered with plastic or similar diffusing material if neon or fluorescent lighting is used. Dr.Purdy moved seconded by Mr.Anderson to approve the agreement modifications. Commendation, Police Department - Letters were presented from Selective Service Head- quarters and from the Lane County Chapter of .'theAmer:Lcan Civil Liberties Union commend- e ing the Police Department in ,their handling of the rece~t draft protest in downtown Eugene. 5 8. Human Rights Report - The Human Rights Commission expect.s to return a report and recom-. mendation to the Council about January 1, 1968 on the CORE demands -referred to the Commission by the Council. 6 9. Washington-Jefferson Extension - The State Highway Department wrote that since .schedu1l.ng 1- construction of the southerly extension of the Washington-Jefferson bridge will.depend upon Federal funds, a freeze would have some effect upon it. The.remainder of 1-105 is to be contracted ihe latter p~rt of 1968 and that schedule wi[l be followed if there is no cutb~ck in funds. 7 10. Alley Assessment Procedure -The .City Attorney issued an opinion as to whether an a~artment house owner can be charged the entire.assessment for 'alley improvement or the assessment pro rated according to potential occupancy when the alley is used primarily for the apartment's access. He said such would be contrary to tie Charter and to Oregon case l~w, that assessments must be divided equally on a square~footage basis alnong abutting properties,. unless the apartment owner would agree otherwise. 8 11. Portland Airport Study - A letter from the Port.of Portland indicated it is in the process of determining what its program will be, that at this time. .it does not en-' vision a'nything' which will detract from the need for contemplated .improvements at Mahlon Sweet Field. All cougctlmen present voting aye, the bill was declared passed and numbered 15022. 11 The City Manager informed the Council he will be attending a symposium in Philadelphia during .the week of November 13, 1967 having to do with systems analysis of. urban_problems. The symposium will re- sult in the selection of three to f{ve demonstration cities which will be provided consulting services by data processing to set up systems analysis. The program i? conducted through a grant. from the In- ternational City Managers' Association,' Fels Institute, and .the National Bureau of Standards.
